I was sold a Wave-Tech Pool (32K) + financing for $4K in a retaining wall to support the pool. I paid $2K cash down, for a total expenditure of $34K. I have since found blogs and internet postings of over 43 complaints with the Attorney General's office, 84 unresolved complaints with the BBB. When I first looked into the company, the standing with the BBB was good, unless you yahoo-search "disaster" and "law suit" and Wave Tec Pools you are unable to discover the hundreds and hundreds of people who have been destroyed from Wave Tec business practices. I don't understand why they are still allowed to be in business.

Here is my story - these are only the highlights, the rest of the "pain" and frustration over the last 4 months is too lengthily to compile.

The first contractor did the following:

A. Disregarded city approved permit specs, refused to dig in area that was permitted then Dug the pool in the wrong area, placed walls up unleveled which created an "above ground" pool. This placement was not permitted and the entire pool bracing had to be dismounted, leaving a 12' x 20' hole in the center of my yard with a mountain of dirt behind it, over 16' tall.

B. Erroneous and Unnecessary Trench: The 12ft long, 4 ft deep trench along the side of my home -- beginning at the main juncture of my sprinkler system pipes in the back yard, when only six inches was necessary. They plowed through the red flag markers that indicated where the electrical system and sprinkler system was.

I have to attend an "Architectural Board Committee Review" from my homeowners association and face fines up to $50+ monthly until this is resolved.

C. Next Contractor came, WaveTec agreed to have this new contractor extract the dirt from the yard from first dig and haul away, I agreed to the comprise to dig then deeper and put more money into a retaining wall.

D. Contractors took the dirt to be hauled away and instead, put the dirt back into the first dig, leaving now a large mound in the original hole.

E. Contractors dug the second hole, but not deep enough and very very very unleveled, but still placed pool wall bracing. contractors requested the second "check" from Superior funding, turned into WaveTech. The contractors then abandoned work and the site.

F. Contractors cannot return phone calls because they say they have a "problem" with WaveTec, compensation for work that is due to them, etc. etc. etc.. They have walked off the job and will not return.

G. WaveTec refuses all phone calls and will no longer reply to emails.

H. Superior Funding, of which i found out is owned by the same person that owns WaveTec, Curtis Batts, calls frequently for monthly payments of which I have sent, but they cannot seem to find.

I. I am writing to determine if there is a class-action law suit, to get my own attorney to pursue in full or to have some kind of intervention into this situation.

I have a new number to get past BRAD, her name is joyce [protected].she handles payments issuses. I told her about my problems and she said she was new there. Maybe you can get some help from her, ext# 108.also does anybody know anything about superior funding status? They tell me my payments are going to compass bank, but i called that bank and they dont have no knowledge of my account. I was told my payments are going to a lockbox in houston c/o compass bank.does that make any since?

the escrow sounds good, however, like others, when I try to contact the bank who is handling the acct., I get no where.
I, like many, want these people out of business, so that they may not hurt others.

I have tried and tried to find the laws regarding this billing issue.
So far, all I can find is that superior funding is not following the laws set forth in the TRUTH IN LENDING laws set forth by the Federal gov.

This is a rather large acct. (on our part), and the only acct handled sooooooo poorly. And the only one that we have absolutly no access to. Is there a law being broken there?

Brad asked me to mail him our statements with payments records showing the late fees, the overpayments, and the unapplied amounts. I did as he asked, (even though all of that information should be right there at their fingertips!), certified, then called him to let him know it was coming certified, to please sign for it.
According to the tracking code on the certified receipt, it was signed for.
My cover letter asked for them to resolve, or at least contact me within 2 weeks of receiving my letter. Legally they have 30 or something like that days to respond. The end of this month will be 2 weeks, so we will see. However, a payment we mailed on the 4th of may of this year, has yet to be deposited, yet another law being broken.

We did contact a lawyer, but are having trouble finding one who wants to take this case. I need a good lawyer uncle!

Like I said earlier, our contractor was excellent, it is this mishandling of my money, lack of communication on statements, untimely billing and deposting, and getting nowhere when asking questions that has me thinking that my money is being stolen.

Here is a hint on how to handle Brad, or Joyce, or anyone.
Be as nice as you can. YOU CAN CATCH MORE BEES WITH HONEY THAT WITH VINEGAR.

I contracted Wave Tec to build my pool in April 2006. The pool was actually finished in November 06. The following is a list of all my problems. I tried to get a hold of Wave Tec for months after the pool was built. I am willing to join any and all in a law suit against this company. This has caused me much problems and money!
• The liner has many wrinkles.
• The pump is not energy efficient as they stated it would be.
• The pool leaks about 30 gallons of water a day.
• The timer never worked.
• The liner has holes.
• The walls of the pool are collapsing.
• I have problems with my neighbors because the pool is leaking and it’s rotting our common fence.
• I have called them about all these problems and they never answer or they transfer the phone call and no one ever answers.
• I had problems with the homeowners association because the contractors left all the material in the front of the house for months before they started construction.
I also cannot find a lawyer that is willing to take up this case. If anyone knows of such a lawyer, please let me know. Thank you

As much as I hate to hear others are experiencing the same nightmare I am, it does make me think that WE, all thousands of us, need to contact the attorney general. We had our pool installed in January 2005, construction started in September 2004. Prior to that, 3 weeks after we initially contacted them, we decided not to continue with them. They threatened to sue us for $8500. We should have taken the hit there because now we have a cracked and rusted frame that we used as a pool for one summer, and owe $30, 000 which we are still paying or our home will be foreclosed on. We hired an attorney 2 years ago, this summer we went to arbitration and was awarded an amount to cover the cost and demolition of the pool. We have not seen a dime, and never will. They have closed the doors after moving whatever monies were left to their other company--SYNERGY. At this point, I feel that the only justice would be for Mr. Jason Herring to serve some prison time.
If anyone has any information on the attorney general being aware of this, please send it on. I have a judgement and still suffering with this nightmare. I refuse to stop until this company pays me what we were awarded, this mess they call a pool is out of my yard, and this man is behind bars.

I own my own pool company and have been building pools for 25 years in North Carolina and Virginia. I have seen some of the awful shapes pools have been left in done by Wave Tec. If anyone in the surrounding area needs pool reapirs, please contact me and I will do them just above cost. I am just glad I didn't take a job offer from this company when I was about to and feel bad for anyone who has been scammed by them. I am so sorry I every ran accross this company (wavetech). The contractor did a lousy job with the concrete boarder. The cement is cracking badly in corners of the pool. The liner is tearing badly and I lose water every day. I have to put water into the pool every 5th day to keep it above the skimmer. I have filed complaints with the BBB and the attorney general's office. But it seems as if I am stuck with an ugly pool. What can I do?

This company is a joke. I have experienced the same problem as many of you. The concrete boarder that they laid out is severly cracking. The "Massage" chair that came with the pool is separating from the pool. I have made several complaints to the BBB and the attorney general's office. I cannot seem to get help to fight this company.

Wave Tech is not a good company to deal with...it is a terrible pool company period! I think they should be sued BIG TIME for all the damage and suffering alot of people have gone though. I should know, I am one of them. I just had the liner replaced because it had torn in three different places within a four year period. Not only that I had to have the pump and filter replaced ( took about two years to figure out this one, and hundreds of dollars on chemicals.) because they used a smaller one that was not meant for a large pool. The diving board also cracked in the first year of use! I would love to hear from some Wave Tech customers in this area!

Hi My name is Marcus, please contact me at WaveTecComplaints@gmail.com. We have a 2006 Wave Tec pool thats still no where near being paid off after yrs of on time payments. I want to start up at a contact list of everyone with a Wave Tec pool who has had financing issues or maintenance issues. It may take a while or even a couple years to get a bunch of people on board but at least we can start archiving complaints by area, year, and type. After I have gotten a contact list built up, I would definitely like to take this to a lawyer here in Houston and let them contact everyone and see what can be done. Its clear Wave Tec/Synergy Pools has ruined thousands of families lives and possible even lost some their home using their shady lien contract practices. So whether its horrible pool lining issues, leaks, wrinkles, pumps, or contract disputes. Please send me your email describing your story and we can all band together and perhaps at some point in the future get some justice moving forward... So email me and put in the subject "WAVETEC"... Any emails I receive I will add you to my emailing list and I will also forward others emails and complaints to you. Doesn't matter who gets this going, long as we all try to get a simple contact list going and move forward.
