I just read through all the complaints that are listed on this site about ASC. I totally agree with everything that was said, and at this point everything has happen to me as well.
After five months of trying, sending my paperwork at least seven time, cutting expenses I was finally told, "They would be better off if I did foreclose" WHAT! REALLY? And that I did not show "Affordability". No kidding. I have now got us with in a couple hundred dollars of breaking even every month, but still don't qualify. I will now have to increase my income. Well in California, that is easier said than done. I finally took the step of getting a roommate to increase the income and get to a place where they might work with me. Guess what...
Now I have a surplus so don't qualify.
This has been the most frustrating experience I have ever had to deal with.
On a positive side, I got my second done in a matter of weeks... Hat's off to HSBC.

misleading customers
I was approved by well's fargo for a loan modification if I paid the payments set forth in a forbearance agreement (please note I bypassed asc and contacted well's fargo). According to the young lady I spoke with my first payment would be due nov 21, 2009 next one dec and the next jan after this the modification would be set in motion as long as I made these on time with full payment.
We were so happy, I ask the next step, she said we would get a letter in the mail from asc we would however have to deal with them (asc), we got our letter in the mail today nov 2, 2009 first payment is due oct 26, 2009.
Well guess what i'm late.
According to the envelope it is dated oct 27, 2009 that's when it left the post office in califorina to come to me from wells fargo.
So it is now null and void, figure that.
So do they really want to work with me to maintain and keep my home?

Hello my name is Larell Bryant and I'm experiencing the same thing with Wells Fargo, as Brenda, here in NJ. They took me in and out of court from November of 2013 til February of 2014, which I was granted, at least so I thought a new monthly loan modification and was pleased with my $300.00 dollar difference, now just recently August of 2014, Wells is telling me that I'm behind in my payments, which are back to $1508.99 and I never received this in writing, which also means it was a fake loan modification which took me out of work every month for court dates, so who can I turn to for help in this matter, this company has no right to toy with innocent peoples lives!
No they do not want to work with you at all.
Handling of mortgage
We have been in the process of TRYING to modify our mortgage with America's Servicing Company for ELEVEN MONTHS! Our home has been scheduled for auction no less than five times. We submitted all information requested no less than five times, yet we were denied a modification. I was advised the last time our home was scheduled for auction that the beginning bid was over $100, 000 LESS than what we owe on it to ASC. We have a bank willing to take over the mortgage, but ASC refused to discuss and/or negotiate with them. It's hard to believe they are willing to lose $100, 000, or more. Anyway, for those who are interested we located a company that has been representing our interests in negotiating a modification of our loan agreement with ASC. The company has had the auction(s) put on hold pending an agreement with ASC. There are no up front fees, which caught our interest to begin with. Poor customer service
America's servicing company (Asc) is servicing our first mortgage loan for wells fargo. They are by far the worst organization I have ever had the displeasure of working with. They are incompetent, disorganized and out of touch with reality. They have no ability to work with customers. They could not help us with a modification to our loan, even after 7 attempts. They made mistake after mistake and there is no consistency within the organization. They have several different departments within the company which no one at asc seems to understand. Customers have almost zero chance of speaking with someone who could help with the first phone call and each time I have called, I have been directed and redirected to different departments, personnel and phone numbers. I cannot count the number of times I was given wrong phone numbers, hung up on, told incorrect company policy or incorrect information. It is almost as if this is done purposely to keep from having to make decisions about modifying loans. I agree with others who have suggested that this company should be investigated as deliberately and fraudulenty keeping consumers from working out loan solutions. The worst part of this is that I had no choice as the loan was sold to wells fargo and serviced by asc without my even knowing it, let alone playing a part in the decision. Where is our choice for opting out with these transactions? Now we are stuck, days away from foreclosure and no place to turn but attorneys. We will fight, spending money better spent on house payments, simply because of the incompetence of companies like these. Many people across the country are of the opinion that people who invested in loans they could not afford should just be allowed to fail. What they misunderstand is that there are many more of us in a group that can afford the price of the home's we have purchased, but cannot afford the adjustable rate mortgage's that we were pushed into and never intended on keeping had the housing bubble not burst. We can keep our home if the banks would offer a solution - pretty simple... Fix the rate for good at a low, affordable level. Not hard. Not rocket science. However, we cannot get to a decision maker! Things across the country would be so much better if these companies simply understood this basic principle. Fix the arm's and fix the economy. Wake up, banks and work with your customer's who can afford a modification. Please offer workable modifications and everyone benefits. Continue to provide poor or no service, and you will lose more and more money from unnecessary foreclosure properites and slow the economic recovery.

I could probably write a book about this RIP OFF Company! My loan was also sold by Option One Jan 06. I became ill, contacted them in May 06. Stated organ has failed, going in for transplant in July. Please advise process if payment missed. By July 19, 2006, I had received no response. Each time I sent a letter (to have proof) and also faxed, it took 45 or more days for them to respond. By the time I return from the hospital, they are now calling me twice a day (or more) about the missed payment. They sent a letter stating options were to add the missed payments at the end of the loan or receive a deferment / moratorium. It took so long for a response, I wrote the chairmans office. I now know why the company sucks! It took that office so long to respond, I had forgotten I had written them (over 60 days). And, then the lady said she had to go back to the customer service office. (Completely unable to assist.) Just to cut this short, let me warn you, if you are late on a payment you are not eligible for a deferment. If you are late, you are unable to add a payment to the end of your mortgage, so I ask--why send a letter offering the options? They finally sent a letter to foreclose, I went to an attorney.
If your loan is sold, I strongly recommend you re-finance elsewhere!
I have America's Servicing Company as my mortgage company, and I too am extremely upset with the service. I agree with one of the writers that ASC will call me if I am a few days late, but I can never find anyone to help me when I have a concern. I am in the process of trying to refinance my loan, and when I pulled my credit report, I discovered that ASC had erroneously reported to the credit bureau that it had started foreclosure proceedings twice, but I timely make my payments every month. To make matters worse, when I requested a letter providing that it was in error in reporting these comments, it would not state that "it was in error;" the mortgage company I am seeking to go with requested this information. Rather, it wants this mortgage company to interpret my payment history and deduce whether it was in error. And, as to any letter I was to receive, it told me it would take two (2) weeks to process. Okay, the letter went out on April 25, but it is now May 9, and I still have not received a letter. ASC says it can take up to 7 to 10 business days for the mail to reach me. Okay, fine, can I get a fax? I have requested a fax of the letter twice, but sill have not received anything. ASC rips off homeowners with the expensive fees it charges. It abuses its power by reporting erroneous information to the credit bureau. And it hurts those homeowners who are trying to do the right thing!
I was laid off on 12/30/08. I called ASC to let them know that I would be receiving regular paychecks through the end of Feb. and apply for a loan modification, knowing money was about to get very tight. I was told that I was ineligible to apply because I was not behind on my mortgage. When I asked "Isn't that the point - to NOT get behind?" I was told that there was no reason to lower my mortgage if I could currently make the payments and to call back when I couldn't. I called back in Feb. and was told that even though my money was running out, I would have to be 2 months behind to apply. In April (now 2 months behind) I called and was told that again I was ineligible because I didn't have a job. I told the csa that it would be a lot easier to get caught up and be able to make my payment if it was lowered, that although I was actively job hunting, nothing had come together yet but I had applied for unemployment. I was told to call back when unemployment came in and they would discuss applying at that time. I was in "adjudication" for 4 months. I have finally received a lump sum in back payment, but now that lawyers fees etc. are involved in my foreclosure, I am unable to save my house. It upsets me because I've been trying from the beginning to keep them notified and have them work with me. They still call me several times a day, even though they've sent me into foreclosure. My only hope now is to apply for hardship and try to short-sale my home. They contradicted themselves every time I called. I think this is intentional and they don't really care about their customers - as one of their reps so eloquently stated in their slam of all customers.
I agree...my cousin in Hawaii, is fighting this company because of fraudulent activities and it has been 5 years since she started the process, with an attorney. These Mortgage companies keep changing names, selling to other mortgage companies so often, it's difficult for the home owner to know to whom they must pay their mortgage. It's OUTRAGEOUS! This country is going to the Trash Can, with Mortgage Companies, Banks and Wall Street, and our Congress leading the garbage trucks.
HORRIBLE EXPERIENCE! They are raking up fees and milking this "supposed" modification review process for all it's worth! This has been going on for 3 months now with "never received documents" "you need to talk to ____ department" "the date on that document is now over 30 days old and we need a new one" "I will make sure this is expedited right now" call back in a week" "call back in a week "call back in a week" "oh, sorry it has been over 30 days! we need you to reapply, resend everything again with updated information so we can open you a NEW CASE"

I have made several attempts to reach ASC on July 31, 2007. I have been trying to call them since 8 am to 11 pm. Every time I have called them, its an automated response and I'm kept on hold for 70 minutes, 43 minutes, or told by the automated machine that I can be transferred to another automated response If I choose not to wait for a representative. When the prompt directs you to press 9 if you don't want to wait for a representative, your placed on hold indefinitely and your unable to make your payment over the phone. I feel that they have set up their phone system in a way to identify homeowners who are paying at the last minute, so that their calls are never really answered and payments end up being late, because they - ASC is unreachable. This is ridiculous. The more you're late, the more they collect - its wrong, it's not right, They have set up their system to screw you. Something needs to be done. A class action suit needs to be brought against them by all who have been affected by their fraudulent business practices.

First of all i am a collections rep for asc out bound collections... and first let me tell everyone do you know what asc is... its a NON-PRIME Loan servicer for everyone who doesn't know what that means it services bad credit loans, wait let me rephrase that horrible credit loans, and it makes me laugh when im talking to you and your there talking about how perfect your credit is and i see when im calling you and i see your true double digit credit scores... also your payments are due on the 1st not the 16th people who have bad credit seem to find this confusing thinking the 16th is your due date because thats when you get your late fee... also have you ever wondered why you get stuff from wells fargo with your mort. payment stuff , because asc is affiliated with wells fargo but wells fargo just doesnt want to be labeled the company with all the bad credit loans... how does asc end up with your loans... companies suck as freemont, countrywide, emc... etc companies originate loans the, prime loans (excellent credit) sub-prime (mediocre credit) and non-prime(bad credit)... the originating company keep your loan for 2 months if your lucky ,then thats where the fun starts the prime loans get sold to a company the non prime loans get sold to a company and then asc get all the non-prime loans get sold to asc... so i hope all this info answers your questions to why you have this horrible company servicing your loan... all because you all have horrible credit no one to blame but yourself!
Oh yeah i know asc is a screwed up company but i also find it funny when i hear people talking about sueing asc... and winning... yeah right when you walk in the court room with your bootleg lawyer and then asc/wells fargo comes in with its all-star team of lawyers who get paid more in 1 day then your lawyer will make in a year... do you really think your going to win your lawsuit.

This is by far the most ignorant and pathetic group of individuals I've ever dealt with in my entire life. I don't even know where to begin with how frustrated I am in dealing with these ###s. You start every call with the lowest ### on the totem pole. When that ### begins repeating back information to you plug your ears because the only thing that is coming out of their mouth is a display of how ignorant they are. Your told one thing and then you call back a couple of deays later to find out that was incorrect and it'll be 3-5 business days to process your paperwork. 3-5 days later you can then find out that after voicing your frustrations that ### A didn't handle things appropriately that you'll then get to talk to ### B who has the same system access rights and responisbilities as ### B. Now ### B proceeds to tell you that they can access your information that you submitted ### A but when they are done running you around they will still proceed to tell you that they need different information and once you've provided that information it will of course be 3-5 business days. If your mortgage is currently with this group then you more than likely know exactly what I'm talking about. If your not currently involved with this company then save yourslef the hassle! AVOID THESE PEOPLE LIKE THE PLAGUE! Stupidity runs deep at this company!

I coudn't agree more. ASC is staffed by people whom I would not hire to flip burgers at McDonald's. It has taken 2 weeks and 10+ calls to post a simple authorization letter, so they can discuss the loan with me. Despite faxing the same information to them FOUR times (including twice to supposed escalations unit), I just was told that the authorization is invalid. Reason? The authorization is not notarized! Hmm, it certainly is! Even their rep admitted they see the notarization on the document. But, no matter. The rep can't do anything (and this is a supervisor) until the guy that said the authorization wasn't notarized actually admits it was notarized. Sounds like a circus? You bet.
And this is just getting in the door to speak with these people! I can't even imagine what's on the other side of it, judging from the incompetence thus far.
Non-Performance
America's Servicing Company and US Bank Assoc. are the selle(s) of a property we are trying to purchaase in Victorville, CA. The escrow was supposed to close on the 3rd of September 2009. It is now the 10th of September and it still hasn't closed due the seller not performing their obligation. We've done everything we were supposed to do prior to the closing date and the seller keeps stalling with one excuse after another - the last one (as of September 9. 2009) being they have to re-draw the deed. When we began this contract, we were told that if we went over the closing date, we would be liable to pay $50/per day. We were ready to close the 27th of August, but the Escrow officer didn't bave the documents ready and didn't get them to us until September 2nd, we signed them on September 2nd and they were overnighted and were delivered to the Escrow Office at 9:56 AM, September 3rd. Our locked in loan rate expired on September 6. At this point, the seller has breached our contract and we are now looking into suing the seller and their representatives for non-performance.

Withhold information
Call ASC June 2009 to find out how I could use the stimulas package with my house loan. I then faxed everything they told me to send them on June 10, 2009, called and confirmed they received it and was told it would be 60-90 days processing.
Called to make my house payment September 4, 2009 and asked about the progress. I was then told it was on hold and they needed more information. I was never sent a letter or received a call to let me know this. I then asked why they didn't tell me the other things I needed when I faxed the first 20 something pages of information or why they didn't inform me I needed to send them more information. I got the run around and now it will be another 60-90 days.
I have had my loan with ASC for a few years and with all the bad reviews and complaints have always stood up for them. Well, it finally got around to me.

FHA and others need to change some of the qualifying parameters (31% of gross to be net) and make the process much simpler for homeowners that are in distress. My mortgage payment is 31% of my gross but 55% of my net. I can only spend my net. What are they thinking?
I am collecting these letters to present to Obama to make a change to this ridiculous and failed program. He loves grassroots efforts and I am sure he will listen if have strength in numbers.
Your stories kept me from making grave mistakes with ASC (my mortgage company). One loan modification company told me to stop making my payments and give them $4500 instead. If I had done that I think I would have been on the street already. I don't think they can foreclose legally if I keep making my payments on time, right?

Since January 2009, I have tried to get a loan modifacation and have been unsuccessful after sending my information at least 6 times and each time I call to check on my progess I get a lame excuse about all documenation need to be no older than 30 days but yet no one contact me to continue the process. Also, as I go over my monthly bill I notice when my mortage is mailed 10 days prior to it's due date it is always created to my account on the 16th of the month and they charge me a late fee when the statement clearly says a late fee will be charged after the 16th apparently the company does not know the difference of the words on and after. I am also appaulled at how they what to charge you a $15 fee to pay a bill on line, how in the hell are they allowed to charge a fee to pay a bill. I have stage 4 Colon Cancer and i just found out they increased my payment by 400.00
a month plus have not been appling my payments and the increase will just hurt us .
This Company has to be stopped and looked into by the federal government and i do
agree that a class action lawsuit by all of us should be started. This Company is ruining
peoples lives and without a care because they can and no one has tried to stop them .

A email address is required, and remember your email address and passwork it is hard to change it PLEASE PLEASE that help everybody I had applied for a modification and they over rode that, they sent all of my stuff to asc and they had to act on it. let me konw how you come out. I sent in all of my paperwork on June 1, 2009 for a loan modification, was told it would take 30-45 days. I call every week and get a different answer. I called on 8/18/09 and was told that the appraisal was recieved and a negotiater should be assigned in the next couple of weeks. I called back today and was told that my file has not been set up yet! I HATE this company. They do whatever they want! I continue to get letters stating they are setting up insurance for me for 500.00 - I have homeowners insurance and my insurance company continues to send proof of insurance, but ASC continues to send these letters!

Thank you for your comments. I appreciate your information posted and I agree with all of you. Changes to need to be made now and not in the future. Life happens and if they cannot assist a family in their time of crisis why purchase a home. What happened to the American Dream?
I was in an accident in 2007 and was in the hospital for two months. Three surgeries later, I lost my job while hooked up to IV drips. Ugh! As you stated Mark, no mortgage company or HUD qualifies one to have their current loan modified, % rate decreased, etc. Unless you have some sort of income stream, one will not qualify for any considerations in regards to your loan. Which is odd, because if we are collecting the maximum unemployment benefit per week, as you know, still does not provide you with the income needed to pay your monthly mortgage here in Ca. COBRA benefits cost me nearly $700.00 per month. Unemployment benefits do not cover COBRA nor the rest on your monthly expenses.
Here in CA as you probably know, our home values decreased exponentially. Many of these lenders are not willing to make the necessary adjustments to the principal at today's housing market values. I learned that a lender is compensated on the approval of your original loan. However, when your loan is then sold in the future to a "Servicing Company'", the incentive for a loan modification is not part of their compensation plan. There is no commission plan in place for these companies to service our loans. They don’t care about your job loss or anything else going on in one’s life. If they don’t get paid they don’t want their time wasted. I was shocked and appalled when I learned this information. I couldn’t believe that there is no incentive for these professionals to take into consideration the financial hardships, unemployment, death and dying, stepping out of one's career to take care of an elderly parent, sick child, etc.
The Congresswoman from Orange County, brought this to the CA consumers attention in 2008. She started contacting these company's on behalf of homeowner’s. There were several times she said that she couldn’t reach a company representative and went through the telephone automation maze.
Evidently, as I understand it, our representatives are now attempting to change the laws so the Servicing Companies are held responsible for their unwillingness to help consumers. Finally, they need to be compensated for modifying loans, to date they are not, so this has to change. I was shocked when I learned this fact. These financial institutes are truly playing - "Chess" with our lives. They can choose to help you or not. This should not be negotiable. Let’s change the laws to protect homeowners and the American Dream.

Sharon encourages everyone to contact the FTC [protected] and file a complaint. She also encourages everyone to call your congressman or woman, the better business bureau, state dept., consumer protection agency, state attorney general and not to delay.
I found this encouraging, she also shared that the FTC last year settled a class action case against EMC for the same predatory servicing of loans. There is hope! Together we can make a difference.

3. I thought that is why the program was to help the people who lost their jobs due to the construction industry, which I was employed.

fraud company and a rip off
Americas Servicing Comany came in and bought the loan from New Century Mortgage and started increasing the rate of interest without letting us know what was the rate increase base on or what the next rate increse will be.It went from $1039.00 to $ 1759.00 and I ended up paying this company over $ 8000.00 over and above the original mortgage amount of $1039.00. .I asked for a modification since May 2009 and they will not respond to me later after a month they want me to send them a financial worksheet.I send them all copies of my paystubs, Insurance of house, tax returns two years, copy of all my utility bills as supporting documents along with the hardship letter showing a deficit in my balance sheet -on June 18th via certified registered mail receipt .I have the sighned copy of the letter of receipt sighned by their rep. I received a call from another rep on the 13th of Aug 2009 andthey say they have lost my papers and then I was asked to resend the papers via fax on 07/15/09 .THEY TRASHED THE PAPERS NEXT DAY. I sent it again on 07/19/09 they called me last friday saying we cannot modify your loan because that too much money for them to give up so if I cut down some expenses they will bring down the loan rate to modify. Today I received a letter from ASC where they want to do forbeareance and want me to pay $ $671.87 three times in for August September and october and in November 2009 they want $3579.96 totaling to $ 5595 for three months @ 1865 / month.( please note that I am presently current in my payments to ASC and never missed a payment and am suppose to pay $ 1359.00 with their new reduced rates at 7.25% for the month of August) your interference has made them so mad that they wrote to me that I should not have complained to you and tnow they want to go for the kill and get me so under that I - being current, mailing regular payments, with excellent credit will have to loose my home, credit, my business, and my sleep because of no fault of mine...they ar threatening of foreclosure.

After a messy divorce, I refinanced my 3.9% mortgage to a 6% mortgage with Integrity Mortgage Co. After less than 30 days my loan was sold to these jokers. If I am to believe the ASC employee's blog on this site, it is because I am a 'deadbeat' and ASC only gets the worst of the worst. (this is a prime example of the business ethic embodied by their employees as he makes fun of their customers in a public form like this). After 4 misposted payments in 8 months (they eventually found 3, and I had to stop payment on the 4th) they proceeded with foreclosure and told me I'd have to come up with $11, 000 in cash to bring myself out of this situation. I borrowed 401k money to do what they demanded, and they returned $8k back to me for 'overpayment'. Are you kidding me? A ridiculous collections agent wouldn't accept my payment by phone until I gave him a 'good enough reason' why my payment was past due during the misposted payment fiasco as well. Really? A collections rep who won't accept a payment? Isn't that what they do? I get a statement about every 3rd month, and I can't access the website because it doesn't play well with my ISP. So...the dance continues with these idiots.

I file a complaint to Federal Commisions because this company have not grant me a modification after 7 months now. I took my other mortgage company 1 month. Its been in the review status for almost a year now. We need to stand up to this company as consumer and have them closed down.
Non-Modification & Foreclosure Initiation
LOSS OF RENTAL & PROMOTIONAL INCOME:
Regarding payment status, I contacted my creditors, including ASC, in July of 2008 before I missed any payments because my tenants at both the primary and investment properties were withholding rent and moved owing money. Because I was not behind yet in my payments, both ASC and SPS advised they could not help me. Then when the winter set in, oil, transportation, operations and maintenance expenses, and continued loss of income made it impossible for me to satisfy my mortgage obligations. My salary has also been ###ed for the past decade due to reasons that I shall not discuss herein.
COMPLAINT AGAINST LOAN MODIFICATION COMPANIES, PARTICULARLY FIRST UNIVERSAL LENDING:
Despite being behind in my payments, ASC never sent my paperwork to an attorney to initiate foreclosure proceedings until March 2009. I believe this is attributed to the fact that First Universal Lending -- the second company I signed an agreement with in order to assist me in obtaining a loan mod from ASC -- effectively cancelled their negotiations with ASC after I cancelled a fourth payment of $499.95 since our agreement was only for three such payments for a total of approximately $1, 500.
ASC INITIATING FORECLOSURE PROCESS DESPITE FIFTH ATTEMPT AT MODIFICATION:
Shortly thereafter, I received a Demand Notice and then a Summons Server named Mike hand-delivered a Summons & Complaint to me on Thursday night (June 18, 2009). Said document had been filed on June 10th, 2009. Now, I and/or my attorney have to file an Answer with the Court and ASC's attorneyby or before July 6, 2009 to ensure that ASC does not regain the property via default judgment.
Needless to say, I am very much alarmed at the way ASC has moved to advance foreclosure proceedings despite the fact we have been working to negotiate a modification for approximately a year now! Each time I submitted information, they issued a denial letter that contained expenses that were grossly above any information I provided.
I also submitted information showing how affordable the mortgage would be if the interest rate were dropped from 10% to 2%; my monthly payment would be approximately $1, 500 per month; I also advised I would be willing to pay the mortgage for 40 years to compensate for the adjustment!
I am not trying to discharge my fiduciary responsibilities. I do, however, need help and have learned a great lesson -- never enter into deals when you have to depend on gross and/or rental income to make the deal. Both are bogus assumptions. Net income is the only reliable indicator of a person's ability to pay, as long as that income continues.
I am a victim of the sub-prime predatory lending crisis and have been paying loans that average 10%. When the tenants were paying their rent, I could afford the payments, which I made from April 2006 to July or August 2008. When they stopped, my financials changed accordingly.
HOPE NOW: FAITH WITHOUT WORKS IS DEAD...
I do not want to lose my home and believe I qualify for President Obama's Home Affordable Program. I received counseling from HOPE NOW already. I am Client #106. What I, indeed WE ALL, need now is an affordable modification so we can move on.
Respectfully speaking, homeowners need more than Hope; we need modifications, NOW.
HAMP MODIFICATION GUIDELINES:
According to the HAMP Calculator, with a monthly mortgage of $3, 248 and a gross income of 6, 324, I am paying 51% of my gross income for the first mortgage. More realistically, however, is that I only bring home $4, 200 as my net income, the debt to income is a whopping 77%! when you add one rent totaling 900 or $650 (75% allowance), the debt to income is about 60%.
SUMMATION:
Despite the denials, I have submitted a fifth modification request to ASC, and respectfully request that all Foreclosure actions be ceased. I called the company on 6/17/09 and they advised that they received my fifth hardship letter and that they were effectively canceling the short sale. Nevertheless, on the very next day, Mike served me a Summons & Complaint. Failure to provide an Answer within 20 days (before July 6, 2009) could be problematic!
I would appreciate any assistance you can provide.

Americas servicing company has kept me at bay after THREE files have been submitted for modification. I filed a request in August, again in November, and again in Februauy. They ignored all requests, no one would contact us. They denied receiveing faxes, that they later "found". They started the foreclosure processon us. We were served forclosurer papers. They insist they did not set a sherrifs sale date, and would not forclose while we were in modification, and then their attorneys state their clients granted them permission to forclose. The attorneys office at Phelan and Schmieg strong armed us into signing an agreement with them to pay, and we were misled by them.
They say they will forclose, and ASC says they will not. We are now stuck with double payments and now ASC won't modify due to the agreement. Cathc 22, and NO HELP from ASC...
I am going thru the same exact thing! my story is i got behind due to a house fire two years ago! Then lost my job and stillnot in it due to a contractor ripping us off! and ASC paid them! they are holding the rest of my funds in an escrow acct. and wont release them until i find another contractor who wont touch it cause so much of the work has to be re-done and that cost money! and where do i get the money from?

We have a 80/20 and America's Servicing Company has our 80 loan. Our 20 loan interate went down and we get notified that our 80 with ASC went up 7 points to 15%. We did a modification with them and it took over a year with all those payments and interest of coarse being tagged onto the loan and all the they did was go down to 14%. Bless there hearts!Whatever! We called again after my husband lost his job and then found one but at a $10, 000 pay cut and to see if we could modify again because there was no way that we would be able to pay at that rate still and they said we had to be 2 to 3 month behind before they would consider. Oh please. Let me just start off by saying that if you got stuck with a first and a second ARM that you should be pissed at the closing agent. Second even the most crooked of the crooked is not going to put a 7% cap per ir change on your loan. Thirdly you would have to have like a 13% margin and that means u either have the worst credit on the planet when u took out the loan or u look as stupid as u sound on here and just got straight taken advantage of. Anyway you look at it you didn't bother to read your docs at closing and that is nobodys fault but your own and certainly not asc's fault
I agree we have been trying to work with ASC for almost a year now to get our mortgage modified to a fixed rate. I talk to them at least every other week and they always need me to send updated letters and statements and paystubs.. I don't know how this can be legal I am loosing sleep and am so stressed over this we do not want to lose our home. We have two small children and live in our dream home and wish that there was something that we could do. We have called several different people (Hope for Now, Ect.) we have even tried with a lawyer, but we just cannot afford any extra right now. We are willing and doing everything that they ask of us and still we get the run around. Is there anything that we can do...We are running very short on time and are looking for anything. America's servicing company is a fraud. The government needs to investigate this company and shut it down. I hope they are not paying the governement off so they can keep on killing people. I beleive that Wells Fargo is affiliated with them and they too needs to be shut down. There have been over 366 complaints to BBB for this company and yet they haven't shut down this company. What they are doing to people is allegal. Every one that has complain against ASC needs to come together so we can have these people lock up for life. They are murderers, theives, fraud, scam, and needs to be in jail. They need to give the home owners the money that they took from them. Please join me in taking our lives back from these theives. You guys ain't seen nothin yet. America's Servicing Company aka Wells fargo aka US Bank is one company that you want to stay on the good side of! Further - it has NOTHING to do with being subprime. I was carrying a score over 800 before I tangled with ASC.
First, they nearly doubled my payment days before the index went down. Then, they've raised it even more every three months - even with the index at almost nothing! It's now triple my initial rate!
Those good folks reported me as in default while I was in their special forebearance program and making elevated payments!
They filed foreclore with over $6000.00 of my money in an escrow account - the funds that I sent them while in forebearance that they refuse to apply to the loan!
Then, they topped it all off by filing for a summary judgement the day after my first court hearing. Their reason - they say I failed to answer their complaint! (I kinda thought showing up with my attorney at the hearing may have covered that.)
Luckily, the judge denied the motion. But, they still call me 6 - 7 times a day - even though I filed a cease and desist and we are in current litigation!
This company is simply unbelieveable.

This is the worst company i have ever been with. They bought out another lender and call at least 5 times a week asking me to make a payment. Their rates went up within a couple of months without letting me know about it. Never deal with this company.
We have been going back and forth for over 18 months with ASC - aka Wells Fargo. My husband is a disbabled vet. We were blindsided when he was laid off his job and what with the length of time it takes to get disability benefits from the VA and social security...that was the only reason we even fell behind. They have repeatedly tried to foreclose, we have completed 2 forebearances. We just got out loan modification papers on the first. We are still working out terms on the 2nd. Word of advice...buyers beware...don't let anyone talk you into the first and 2nd mortgage or interest only mortgage to get into a house. It's a virtual nightmare. Anyway, as I said we just got our loan modification. We are working with the local housing authority who is helping us deal with these scam artists. We just executed the modification and wouldn't you know it. The day, the very day they received the loan modification papers back about 4 hours later our house is showing up on the trustees website with an active sale date of 7/24/09. It's a real wonder a lot of us homeowners don't band together and go gunning for these ###s. Anyway, I'm sure it's to the point now with the new laws passed they are going to wind up removing the listing or it'll be their turn to take the heat. These banks don't deserve these bailouts Obama has been handing them. They deserve to be out of business.
My mortgage was sold to ASC and every 3 months they are raising my payments. 1 time Iwas 2 weeks late and they threatened to foreclose they are a disgrace to financial institutes.

Not only changed our initial company without giving us another option before doing that but also they RIP US OFF every month with the fee they charge when we pay over the phone $15 or $10 over the phone!

This company suck so bad. I got laid off Nov of 2006 and I feel behind in may of 07. I called them so many times to make payments when my unemployment checks would come in and they would not take them. They wanted the hole mortgage at once. I just wanted the money out of my account so I knew it was going to my mortgage. I ended up having to borrow money from my grandparents and I got them paid all but 1000$ and I told them if they could wait 3 days I would have my paycheck and I would be able to pay that to. They said no pay the 6000 and we will just add the 1000 to your monthly payments. I said so will that mean I am out of foreclosure. The lady said yes it will bring you out of foreclosure and it will stop bad reporting on your credit. So I said fine. Well tonight I spoke to ASC and the guy told me "O NO it will still report bad on your credit until I pay that off.Plus I get charged fee on top of it. I am so pissed off right now. I think they need to be shut down fast.

I have reported them to my US Senator and plan to report them to our Attorney General. They have done so many things that are illegal and they are so corrupt that our HUD counselor is stupified. We have had 3 forebearance agreements and they broke two of them through sheer incompetence. We are considering filing bankruptcy but are waiting to hear the Obama plan.

ASC just sent us a letter saying "their guideline" require us to carry hazard insurance equal to the amount of our loan amount.. This doesnt make any sense to us because our home is worth twice our mortgage and our mortgage covers both land and dwelling value. Our original contract before our mortgage was sold to ASC doesn't say anything about this. help.
