How does Bidrack Work?
Register for a free account. Get a free spin on the bidwheel to earn bonus bids. Purchase a bid

pack for more bids which never expire! Each bid costs on average $0.50, depending on which bid

pack option you choose. Once purchased bids are placed into your account every time you place a

bid your bid credit will go down by 1 and the price of the product will go up by just 1 cent. The time

of the auction will increase by 15 seconds every time a bid is placed. If no one else places a bid,

when the clock hits 0 you win!

Once you win its time to pay for the auction. You pay the ending auction price plus a $1.99 to

$19.99 shipping fee depending on the product (Gift Cards are only $1.99 while items delivered

instantly, such as bid vouchers, incur no shipping charge). If you do not win you still have a chance

to buy the product at a discounted rate! Simply use our Buy It Now feature. The Buy It Now

feature allows you to apply any money you spend during the auction placing bids to the Buy It Now

price. So for example lets say you spend 25 bids trying to win a $100 product and you did not win.

Your 25 bids are worth $7.50 (25 x $0.30), simply click buy it now and the $100 price will have the

$7.50 you spent on bids deducted from the price! Please note that we calculate the average bid

value here to be $0.30 due to the free bids given out on the bid wheel

I won an auction. Item was supposed to ship in 72 hours. I never received the item yet my credit card was charged for shipping! I demanded my money back, and never received a reply. Fortunately my credit card company will refund my $ and then take $ back from from Bidrack.

Call your credit card company and request they charge the merchant back, or do whats called a chargeback, dont even bother dealing with bidrack they will only refund if you complain 20 or more times, just call your bank, tell them you were charged $99 and never agreed to it, and you want them to initiate a chargeback for you so you can get your money back, if the bank says no or tells you to call bidrack tell them your next call is to your local attorney general and BBB office if they dont do the chargeback or ask for a manager. They are required by law to open an investigation in to the charge they tell you no so they dont have to deal with the work

Maybe BidRack has quit charging credit cards without authorization as they were doing early in their scam and maybe they have quit cancelling winning bids as they have done frequently. Those are not as important to the business model as they now are using bidbots and they're not just driving the price up as some scams have used them, they make it impossible to win an item that has any real value. Oh, they'll let you win a cheap video game or a low-end watch but try to win a TV or iPhone or such and you will be outbid by one of the following bots :

lkagioos345
paulmccabe19
xjpride
firoj
eelcity
k8431
joseph270710
tcolema3

Just go there and watch any big item and see who the bidders are. You'll see lots of folks like yourself, but watch for the bots. They win every time. Spend all you want. You lose. If you look at any big ticket auction that is currently active, there will be a place to the right that says this item last sold for $xxx. Follow the link and I guarantee it will be one of the bots that won.

So now you don't have to worry about them shipping your iPhone 'cause you're not going to win one.

If you believe you have had Unauthorized Credit Card Charges, been a victim of Deceptive Marketing, or otherwise unfairly treated by the online penny auction - BidRack.com you must deal with these matters immediately with your credit card company or bank in case of debit card use. You MUST notify these financial institutions in writing and state the reason for your request to "Charge Back" any of these transactions. Also continue with your reporting of your experiences with that company as you have done here and by all means file a report with the Better Business Bureau and Federal and State consumer protection agencies. As stated below from BBB business reviews of Bidrack.com it is in fact a Canadian company and is under the control of Nomorerack Retail Group Inc.

I contacted customer service and complained that the bid package I was charged for was not the bid package I selected when signing up. The representative kept telling me that I chose the $99 / 175 bids + 2 spins. I kept insisting that I chose the $27 / 40 bid pack. Interestingly, she said I would have had to manually pick the $27 bid package on this signup page and I told her that I did. Why would she make the comment that I would have had to do that manually in order to get that option, unless she already knew that most people would NOT sign up for any package if they had the understanding that it was a free trial. And why would anyone intentionally chose the 2nd highest bid package not knowing how this auction site worked? Even more interesting is that fact that everyone on this complaint board has stated that they were charged $99. So, I went back into the site registering as a new signup (see attached pdf file) to see if it would default to the $99 bid package. I did this 3-4 different times and each time on the credit card input page it defaulted to the $60 bid package. Therefore, this leads me to believe that once an unsuspecting consumer enters their credit card information, they must have a program that automatically switches the bid pack and charges the $99 bid pack rate instead of the $60.

My credit card company told me if the credit card information is given freely, there is no recourse as far as reversing the charge. Therefore, I insisted to this company’s customer service that I chose the lowest bid package, which I did, and demanded and received a refund for the difference between the $99 bid pack & the $27 bid pack. I told them that I had pdf files screen prints of the registration and would fax it to them as proof. For those of you that were duped in freely entering your credit card info, I suggest requesting a refund stating that you only sign up for the $27 bid pack; at least you could get back $72 of the charge.

Right on ellen67, I have no problem with bidrack.com actually I kind of love it. But! I don't think it is very fair that 80% of these complaints are about people making mistakes and blaming it on companies. This complaint is under bidrack.com. It should be under, bad kids, or something stupid like that.

Yes Robert there was a class action suit launched against BidRack announced on June 24th or 25th 2011. The case can be followed by anyone by use of the Justia website at:Parino v. BidRack Inc.

http://dockets.justia.com/docket/california/candce/4:2011cv03149/242288/

Plaintiff: Verna Parino
Defendant: BidRack Inc.
Case Number: 4:2011cv03149
Filed: June 24, 2011
Court: California Northern District Court
Office: Oakland Office
County: Marin
Presiding Judge: Donna M. Ryu
Nature of Suit: Contract - Other Contract
Cause: 28:1332 Diversity-Other Contract
Jurisdiction: Diversity
Jury Demanded By: Plaintiff

Be sure to check back on its progress every six month's or so to see if it survives all the pretrial procedures of discovery and scheduling of the hearings of Motions to extend and dismiss the case by the defendants.

DO NOT expect any kind of swift Justice! with any sort of class action lawsuit.
DO take care of this threat to your credit and identity by taking action yourself, as soon as it occurs, and with the people that gave BidRack your money, by way of a request to "charge back".

Oh Goody! So you wanna play, dooyah? You feel you haven’t met your quota yet, LoveFist, or did you just want to help your friends to reach their goals? I would love to continue this battle of wits with you all, but I am somewhat apprehensive of getting into a fight against unarmed wo/men. These idiotic comments you all place everywhere to defend the many penny auction rip-off discussions is only your narrow minded and perhaps, monetized, viewpoint to so many requests of refunds for something the people feel they were tricked into and clearly DON”T want. Everyone has the right to deal with any merchant they choose and have the equal right to not deal with any merchant that they decide NOT TO. Everyone has the right to cancel any contract and withhold payment from any merchant. Once the contract is disputed by a third independent party, such as a court of law, that is a decision that is binding on both parties, NOT a decision reached by some banker to protect their interests and to boost profits.

What makes you think any merchant has the right to force a consumer to deal with them or keep the money after they have discovered they have been duped? Can you spell S C A M ?

This is my last reply to you all that came to defend one of your own kind, who’s goal seems to be to disrupt any resemblance of an intelligent productive discussion. It is a free forum, as you state, so feel free to jabber amongst yourselves.

Any class action takes much time, can never guarantee that you will get any of your money back, and the scam will be packed up and moved on to a new one long before it gets to trial, if it survives the first year of pretrial BS to be actually heard by a judge and jury.

The details of the penny auction site that allegedly acted in similar fashion as BidRack, can be found in charges that the Federal Trade Commission just laid in May of this year, a full year and a half after that penny auction began its pioneering actions of charging huge membership fees without proper notification or authorization. This penny auction mentioned in this FTC complaint folded on its own account and before the end of 2010.
http://www.ftc.gov/opa/2011/05/jessewillms.shtm

Release: 05/17/2011
FTC Charges Online Marketers with Scamming Consumers out of Hundreds of Millions of Dollars with 'Free' Trial Offers
“The defendants allegedly contracted with affiliate marketers whose banner ads, pop-ups, sponsored search terms, and unsolicited e-mail led consumers to the defendants’ websites, and the defendants paid the affiliates for each consumer whose credit or debit card was charged. The defendants allegedly made false claims about the total cost of products, recurring charges, and the availability of refunds. They also buried important terms and conditions in fine print, the FTC alleged.
The complaint charges that the defendants’ penny auction offers falsely indicated consumers would receive free “bonus” bids, but those who provided credit or debit card numbers to facilitate future auction buying were hit with charges they did not know about, including $150 for introductory “bonus” bids and $11.95 per month for ongoing “bonus” bids. The FTC also charged that Willms and his companies made false weight loss and cancer cure claims for their products, and touted bogus endorsements by Oprah Winfrey and Rachael Ray.
The FTC further alleged that the defendants provided merchant banks with false or misleading information, in order to acquire and maintain credit and debit card processing services from the banks in the face of mounting chargeback rates and consumer complaints. Willms and his companies also allegedly violated the Electronic Fund Transfer Act and Regulation E (issued by the Federal Reserve System’s Board of Governors) by debiting consumers’ bank accounts without their signed written consent and without providing consumers with a copy of the written authorization.”

These charges were laid in May, and it is now July without any public notification that this Motion has been heard by a judge or granted. At this time all charges are simply allegations of wrong doing and therefore the named defendants should be considered to be innocent of all charges until such time as they are proven in a court of law.

ellen67, I really enjoy your manner and your fireside chat approach to do your business but I find it really hard to reason why any sane person would be here defending a company that they do not even have a membership or use as you state by this comment "I stopped short of putting my credit card info because I realized they were going to charge it" and further you add "So I have no love for this company". So why, ellen67, do you spend so much of your time commenting so often on companies that you do not have a love for? I especially like this good cop - bad cop thing you got going on today. Nice touch, but spouting four letter obscenities from the same mouth that throws around terms like "ad hominem attacks" is a bit of a stretch of that old routine.

Thank-you ellen67 for giving me an inside glimpse of your reasoning to comment so frequently, most kind of you. If you read my comment again, you will see that I never referred to you as speaking with obscenities nor would I ever. You have a class act going here and I know you wouldn't spoil it. If you were not aware of this before now, it takes at least two people to pull off a good cop – bad cop routine.

I am glad though, that you made references to "if you agree to a contract, you are responsible for it. If information is provided and you don't read it, that is the consumer's problem. Hmm, you already sound like a consumer service representative. So, okay let’s talk about the "contract" that you deem a personal responsibility. I always thought a contract was a written agreement of a "meeting of the minds" where two or more parties agree to specific terms and conditions for a transfer or exchange of products or services. This contract should be mutually beneficial to all the parties involved. What has your “own share of mistakes in life” taught you in real terms that govern your daily actions? Did you learn that a one sided contract that doesn’t represent a “meeting of the minds” is binding simply by someone signing it. Tell me further, ellen67, if you learned anything about the legality of any contract that is obtained through fraudulent means, omissions of pertinent information to the contract, or if any of the parties to a contract fraudulently misrepresent material terms or conditions.

If that is too vague for you, perhaps you can look through any of your old contacts for employment to see if perhaps there are places for both parties to identify themselves legally, truthfully and that information is sworn to and signed in the presence of a lawyer or notary. What do you think of that contract standing up in court if it contained any false information or if one of the parties did not sign it?

Very good reply to that ellen67, very calculated and professional. I have enjoyed meeting you ellen67, and I am almost sorry that this Bidrack smash and grab is winding down so fast. Sorry that we will not chat more, but glad that fewer people will be exposed to this abuse. All but few affiant offers are removed from the engines and most all the banner ads, pop-ups, sponsored search terms, and unsolicited e-mail are gone as well, so this one has runs its course. Maybe we will meet again when the next penny auction makes star status and is in need of your talents. It won't be hard for me to tell which auction site is next to come to life, I just need to open my gmail daily and watch for information as to where I can find 1000 Amazon Kindles Selling Today Only for $21.67 each. I just read recently under newest posts area of Penny Auction Watch: The State of Georgia Shuts Down Wavee

http://www.pennyauctionwatch.com/2011/07/the-state-of-georgia-shuts-down-wavee-com-governors-office-of-consumer-protection/

“Wavee.com has been shut down by Georgia Governors Office of Consumer Protection because they were operating illegally by not being registered with the Georgia Auctioneers Commission.”

Also I read in another recent post at Penny Auction Watch Not Licensed? You May Need to Think Twice Before Starting a Penny Auction

http://www.pennyauctionwatch.com/2011/07/not-licensed-may-need-to-think-twice-before-starting-a-penny-auction/

“Here is an alphabetical list of the 21 LICENSE FREE states: Alaska, Arizona, California, Colorado, Connecticut, Hawaii, Idaho, Iowa, Maryland, Michigan, Missouri, Montana, Nebraska, Nevada, New Jersey, New Mexico, New York, Oklahoma, Oregon, Utah and Wyoming.”

I couldn’t help but note that Delaware is not on the current list of states that DO NOT require licensing. Do you believe like I do that ANYONE who has been adversely affected could make an inquiry with the Delaware Governors Office of Consumer Protection for specific information of the licensing requirements of that state that BidRack.com has a registration?

dee is ###, I am sorry to have overlooked that information about BidRack.com is now called DealDay.com. I just checked out that link you left here and did end up on what looks like a BidRack.com landing page that those clowns just did a word seach, and replace on.LOL You know you can still win that same BRAND NEW 2010 Boxter? Industry Tips
"This company offers an online auction site selling overstock and manufacturer liquidation items to the general public. The company claims to differ from other penny auction sites based on the "no bid purchase required” marketing strategy.
In this company's case, users must purchase a "Deal Time Membership" in order to use the company's services and features. Deal Time Memberships can be purchased during the registration process when advancing to the checkout page, where the registrant is asked for a credit card number for billing purposes. The cost of the service is $99.99 for 30 says of unlimited use of the site and features. The service is offered with a negative option cancellation clause. This means that unless you cancel your membership, your credit card will be billed $99 every 30 days until cancellation requirements have been met or your membership is terminated by the company. You must cancel your membership before it renews each month in order to avoid billing of the next month's membership fee. The company claims that membership fees are fully earned upon payment and are therefore non-refundable. "

That's right, DealDay.com is a membership only shopping site that:

The cost of the service is $99.99 for 30 says of unlimited use of the site and features. The service is offered with a negative option cancellation clause. This means that unless you cancel your membership, your credit card will be billed $99 every 30 days until cancellation requirements have been met or your membership is terminated by the company.

I feel as if I was misled to believe that I was joining a penny auction(the offer said Free Registration), now I am aware it is not, it is the same auction style as Ebay with none of the Ebay reputation, services or nearly as broad a range of products with completive pricing. For this EBay wanna be, to want to trick me, or anyone else into just a one time purchase of membership should be looked into by the authorities. Do you think DealDay.com is interested in anything but serving up a healthy dose of this policy? –> “. The company claims that membership fees are fully earned upon payment and are therefore non-refundable”

I had the same bad experience as others note. A charge to my card of $75. I also closed out my account almost immediately after opening it. Bidrack tells me that somewhere in their website they told me 3 times no less to expect such a charge. It is a scam and I wish I could find the web info that told me initially about such a "positive" experience the writer had with Bidrack--well, that was probably written by Bidrack! How dumb can I be? I have filed a complaint with the Better Business Bureau and did email the DE Attorney General.

When I signed on with bid rack .com they offered numerous electronic items for auction. Now they only offer c*#p that can be bought at any local flea market. I'm not interested in cheap sunglasses and watches. I have over a hundred bids left with these guys. Don't waste your time or money on bid rack .com.

Sure wish I'd have done some research before registering on Bidrack.com. What a mistake! I too was lured in to shop based on their advertising. I thought it would be like eBay, however my credit card was charged instantly for $99.00.
I thought I would pay after I won something. WRONG! I immediately emailed them, since the phone line rang busy, asking for a refund. They refused saying it is against their terms and conditions. I did not see anything up front that said terms and conditions or I would have read it and ran. Now Capital One is arguing with me about a refund. Bidrack lied to Capital One and said that I hadn't contacted them at all. I have copies of the Case ID that Bidrack opened on their website. This whole thing is a giant headache. Whatever you do ~ do not use Bidrack unless you want to loose.

I spent over 72.00 back in June of 2011 on the website bidrack.com. I was told several times by customer service reps, and by email from them they were working on the problem and would be sending me either a refund or the item, to just be patient with them. it is now November of 2011 and I have yet to receive either the money back into my account or my items which ironically they were still auctioning off on their website up until they finally closed the site.

I have spend countless time, money, attorney calls and hours on the phone with either their customer service, or emailing. Please whatever you do, do not use this site, or their sister site NOMORERACK.com as they are too responsible and won't help any of the customers to their sister site which they created.

No option to purchase. It was an automatic charge when the credit card info was entered. This is just not right. Will not refund the money.

I went online to bid-put in my credit card info and was unknowingly billed $99.00.This is apparently happening to a lot of people as I see researching the internet. Apparently it was on the left side of where you put in your cc info? And there is a no refund policy that is in the faq section!

Bidrack operates auction sites in Delaware and Vancouver, CA. The offer Free registration with a CC so you can purchase Bids and use them to buy items(usually cheap quality at inflated prices since the bids are expensive). They then charge everyone a $99 fee in a Bid package which is only explained in fine print. So many complaints are online against this company for hidden charges, using Beta testing on the customers and not delivering goods, stealing bids from user accounts, etc. My CC company has their hands tied and cannot help. Avoid them like the plague!

I went to there web site and was looking at things they sell and the next thing I knew I had 100 dollars taken out of my checking. I have called several times and emailed them. The response I got was that a representative would be getting back to me. I got many emails from them telling me they were following up on it. I have not heard from them now for a long time. This has been going on since [protected]. I hope that you can help me.

I registered for bidrack, bid on something, and was charged $99. The google search for bidrack states "No Gimmicks. No Hidden Fees. Ever." Also, if you watch the "how it works" video, you have to select which bid package you want before you are charged. However, that didn't happen. Apparently, if you just try to bid on something, that will pull a trigger whereby you will get zapped $99. That strikes me as both a gimmick and a hidden fee. Avoide them like the pague. Stupid me, I gave them my credit card number. They are cheats, and ripped me off. I suspect I wll need to contact my credit card to have the fees reversed.

Hey! Some of us Love bidrack.com. I got a ipad for $243. Beat that. I assume if you continued and you were the one who got it you wouldn't be complaining. The video says "step one, sign up, ...step two purchase a bid package..."
