I thought I'd warn other landlords that this property management broker is unethical and dishonest. For those of you (with M&M) please note that this years 1099 has been inflated by the amount of advance rent used for the tenant's last months rent. Florida law requires that these funds be escrowed meaning out of the reach of Landlords until such funds are released. M&M has determined, without sufficient legal reason that this untouchable money must be declared as income for 2020. I have cited chapter and verse of IRS laws that this escrowed money isn't "constructively" received per the statute which is their claim. They will not engage in a conversation explaining their defiance of the statute. For the most part they've been uncommunicative. Even if they were somehow correct, they should only be counting the advance rent actually collected in 2020 since they have no idea if the money collected in 2019 and previous had already been declared. By their thinking, it should only be the advance rent M&M collected in 2020 but they won't respond.
Also beware of them performing unnecessary maintenance without your knowledge and refusing to hand over vendor invoices. They will almost never give you the invoice, they simply write up their "own" invoice and deduct it from your account. This is totally dishonest.
Desired outcome: Follow the law and send me a corrected 1099 MISC.
