Ask them what they mean by a 'motion'. In most cases, the worst thing that can happen is your credit score is lowered and you get some threatening letters. First from the bank. Then from their lawyers. After they get absolutely no response only then can they file a legal action.

Received a phone call with the exact information. Frank Turner [protected]. American Legal Processing. It is bad enough when the email you but the fact that they call with all your personal information makes it scary. Next thing they will be showing up at our homes and taking us to make-shift prisons. It is indeed a shame the FBI cannot catch these groups of scam artists.

AMERICAN LEGAL PROCESSING Thteatening Phone Calls

Yesterday I received a phone call from an American Legal Processing stating that i owe $600 to a payday loan that i received in October of 2009. The man had an Indian accent and was very rude to me. He stated that i would have to pay $400 by the next day or the police would be at my house to pick me up. I would then have to pay a additional $2, 000 in court coust. I was scared at first because he had all of my information including my SS#. I dont know what this is but i wish they would leave me alone

I was contacted by this compant for the first time in Feb 2010. The Indian genetleman first told me his name was Alex Christopher and that he was calling from American Legal Processing. He stated that I owed $1245 dollars for a payday loan from 2007 (that i have no idea about). He said the loan was for $300, and that if i did not pay $415 by the end of the day, he would file a claim at the court house in CA. I was like ok, until he stated he wanted me to fax my SSN# and my credit/debit card # to someone named Mark Brown. I never was premitted to speak with Mark Brown or a supervisor. When I asked to speak to someone in charge, he became irate and even hung up on me. Then he bega to call my cell phone every other minute for an hour straight. I started avoided the calls, so he started calling my job again.

Now here it is April and he's back! Yesterday he called stating that i could send the money through MoneyGram to a Company named Options CCS (this was 11 am), and then he called back and stated he needed me to send it to a different company Crown Gate INC. This made me pause, and think what collection agency is this disorganized. This is a scam, please call your States Attorney General and repot this!

Once I told him I was calling, he did not call back!

These people are also calling me, stating that i owe $1245 dollars for a pay day loan as well. I too was told they would send the police to my jib, and in addition have to pay 15, 000 in court cost. I asked for this in writing, and the very same indian man named Alex Christopher aka Bob walker aka David John, became irate and hung up the phone. I am way over this mess, and i will not pay.

AMERICAN LEGAL PROCESSING Threating actions that are not true nor legal

I have received voice mails and conversations with the same man that other consumers have. I have had collection experience for at least 10 years involving first party debt and third party debt. He falls into 3rd party debt collector, and by no means can he threaten anything that he is claiming he can do.

He is so breaking every collection law in the book. When a collector is trying to collect bad debt, he is suppose to say the miranda rights first thing. This is a statement that includes this is an attempt to collect a debt and anything you say can and may be recored. Any collection agency worth anything would keep their business in mind and would have every collection call recorded.

Not just to record the consumer, but to also monitor their collectors. A 3rd party collector cannot tell a consumer (threat) unless they are willing to back it up. You cannot be arrested for bad debt concerning a payday loan, or any unsecured loan, including medical bills. You can be arrested for writing bad checks doing this on a regular basis or in some states if the checks are over a certain amount.

And of course if you owe the debt and it is not current it will be on your credit report, but tha can be cleared up if your having a hard time with money and you for instance get employment where you may have been unemployed which is probably the reason the debt is owed in the first place. You will still have the collection accounts on your credit, but it does look better when it is reported paid in full.

A car loan will never turn over debt to a 3rd party collection agency, they would simply come and repo your automobile. Same thing with a mortgage, the mortgage lender would start foreclosure procedures.

Student loans or any money owed to the goverment they could garnish your wages at your place of employment or they could put a lien on any real property you may have. They are going to get their money one way or the other. But, they would not use a collection agency.

This American Legal processing is going above and beyond the collection laws, and should be investigated. Then have all business revoked.

I have received a call from a Mr Max Cliton who was looking for my 28 year old daughter. He spoken with a very bad accent i had a hard time understanding him. I told him he called me a work and not to call me here again and i hung up on him. But he kept calling me at work after i ask him not to. He made threats that if my daughter who is 28 don't call him back or make some type of arrangements with him he would then take me to court for it. Since she was supposely used me for a reference and i sign something. Now i have a good memory but i never got a call from anyone about a reference for her or nor would i have signed anythingl. The think that worries me is he called and asked for me using my midden name which i have not used for 30 years. Now it worried me if he knows that what else is he able to get hold of. I have spoken to my daughter she has not threaten messages from him also she said she has no idea what he is talking about and won't tell her what she owes and who she owes it to. We both have asked him for his address so i can send him a letter to tell him to not to call or harrass us again and to put in writing not to call me at work . But he has refused to tell us.
