National Action Financial Services Stay away from these crooks

I am receiving calls regarding an Express card I opened in 1999 and was in collections at one point; however I settled the debt with Express in 2003. I haven’t heard anything regarding this account in over 6 years since I paid it. Now NACF is calling me several times a day demanding money and yelling at me. This morning the man who called, Scott, literally started yelling at me calling me a “drain on the country, a deadbeat, and telling me there is “no excuse for me.” I advised him that I had paid the debt but do not have a record of it since I only keep my canceled checks for 6 years. He went on to tell me that it wasn’t his problem and since I couldn’t prove that I paid it I still owe it.

I asked him how I could verify that the debt was valid and he said to check my credit report which I did and nothing was there. I kept a lot of my old credit reports from the time period when I paid the debt off because I was working on improving my credit. The last credit report this appears on is from October 2003. I have a credit report from May 2004 where it no longer appears. It still doesn’t appear on credit reports from any of the three bureaus.

I brought this to his attention and he told me that the fact that it isn’t on my credit report means nothing and told me that if I didn’t trust that I owed the money and pay him that I would be in “big trouble.” I told him I felt like this was some kind of scam and that I didn’t feel comfortable paying him money that I don’t believe I owe and that there is no evidence that I owe. He told me that I’m a real piece of work and a piece of trash. I asked him to stop calling me and he replied no and continued to yell at me.

We have done shredding service with this company and they have yet to pay past due invoices. They closed one of their offices and did not contact our office and we still have containers at the location to be removed. There is no valid phone number or email for this company to schedule removing the container or to discuss the unpaid invoices owed to us.

I continue to receive calls everyday from this company re: a Virginia Madsen? someone I never heard of; I press the button that says if you are not Virginia Madsen, calls will be discontinued...not happening...called the company and they say I
have to call blockbuster to get my number off...this is ridiculous...

I had a Verizon bill around 150 due to my sons father would not pay his half. At the time I was unaware of small claims court. I did not pay the bill. Today is Monday and nearly 10 years ago, I get a letter saying i owe $1672.09. What the h— is incorrect with this place?

I continuously get automated calls from National Action Financial Services for a Jennifer Mazenga. I don't who this person is, never heard of this person, but continues to get phone calls for her and I want it to stop.

Go to the "Do Not Call Registry" and file a complaint. Because they used a recording to contact you this falls under unlawful practices. Even if you have not registered, you can still file a complaint. Do this until the telephone calls stop. Also, call them one last time and tell them if they call you one more time you are going to file a complaint with the Registry which carries a $10, 000 fine. This will work.

Go to the "Do Not Call Registry" and file a complaint. Even if you have not signed up with them, you can still file a complaint if the telephone call was a recording. This is what I have done to get them to stop calling our place of business.

National Action Financial Services Constant harassing phone calls

I am constantly receiving phone calls regarding a debt of a friend. He lived in my home temporarily. National Action Financial Services will not inform us of what the supposed debt even is. Chris has checked his own credit report, which is totally free of any debt and has been for 2 years. This company and its representatives are rude, and very harassing. I am also reporting them to the better business bureau. The call I received this morning was from a Bruce Clough. I am sick and tired of these idiots calling for a debt that does not exist, and the person they are trying to reach doesn't even reside here anymore.

This company should check public records, and use the U.S. Postal Services Registered mail system. That would be proof that they are actually a legitimate company. Of course, since what they are doing is FRAUDULENT, that would mean mail fraud... Pretty high penalty to pay for harassing innocent people.

National Action Financial Services Rude service

This company has been calling me for 2 months with an automated system that will not let me talk to any one. I have to waste my minutes calling them back and when i do they are rude. The most recent time 06/08/2010 at 2:55pm I was called by them and immediatly called back to talk to someone. I told the person who answered the phone and then was transfered to a person that said he was a manager and did not give his name. I told him they had been calling me for 3 months and the calls needed to stop or I would sue. Then he said you need to shut up and listen because the adults are talking. I told him I was more of an adult than he would ever be. I did not see him in Iraq fighting a war, he was the scared little *** harrassing innocent soldiers like my self.

Go to the "Do Not Call Registry" and register. If he calls again tell them you will file a complaint if they do not stop calling, then follow through. Remind them there is a $10, 000fine. Yes, they are soliciting for something, your money.

National Action Financial Services Scam

I owe NO money but they are trying to collect debt and are harrassing me! I am tired of the endless calls and needless harrassment. I will find a way to get their license, if they have one, revoked. They are clearly a scamming company trying to take advantage of people by getting them to give personal information and then stealing money and identities. Since I have to go to 100 words to satisfy this pissed off customer site, though there is nothing more to be said, I will continue to say that this company, National Action Financial Services is a SCAM!

National Action Financial Services Still contacting me even though I filed bankruptcy

I have filed for bankruptcy and listed them as a creditor. They are still calling me even though they are not supposed to. This is a direct violation of the bankruptcy laws.

You send them a cease and desist letter, a copy of the bankruptcy filing page, and the discharge letter from the Court.

Then you file a motion for contempt with the Federal Court that heard your case (Through your attorney) and ask for attorney's fees and damages for each individual violation.

Keep a log book by your telephone :)

I was in the same situation several years ago and consulted an attorney. She told me they are in contempt of court, violating the bankruptcy laws. Type a letter stating the current situation, copy your bankruptcy filing forms (not the entire packet of forms) for your state and discharge papers if you have them and send them to these deadheads. Be sure you let them know you will be filing a complaint with your state justice department if the phone calls do not desist immediately. Also, go the the "Do No Call Registry" and register. IF they continue to call, file a complaint with them also. Good Luck

National Action Financial Services Fraud and cheating

This company is in blatant violation of the Federal Fair Debt Collections Practices Act. The first time I received a call from this company was on April 8, 2009 from a gentleman named Len Seiner, who left a voicemail with his phone number but no company name. He failed to state that he was from a collections agency, which is a violation of Federal regulation.

In his second call on April 10, 2009, he finally admitted he was from a collections agency, but his credibility was already shot. I called him back on the same day, stating that all further correspondence will be via mail and that we will never speak again. Today, April 13, 2009, I got a call from a Robert Farence from the same company, which is in blatant violation against my wishes and against Federal Regulations. They have been reported to the NYC Department of Consumer Affairs for harassment. And I want this incident to be known so that others may be prepared.

I owe them $800...for Chase! They say that if I don't pay them right now, they will take me to court and pin the lawyer’s fees on me, making my bill go from $800 to $3, 000. I only had $400 on the card, the rest is from Credit collector fees! :( I don't have $800 right now because I need to get my car fixed before inspection and it could be $1, 000! What should I do? I'm so confused and stressed out. They leave rude messages on my phone, cell and home, and I can't take it anymore.

I just filed a report with the FTC concerning this same company after receiving a call from a Desoray from this company. While the message was not necessarily considered a violation of federal law, she stated "you're very well aware of what we're calling in regards too". I actually had no clue what they were calling about and no clue who they were. Upon returning the phone call, got a representative and a supervisor on the line who not only did not REQUIRE me to give to them my date of birth and last 4 digits of SSN, but VOLUNTEERED them to me. Then we got into a huge argument over how their "confirmation" process works (or more importantly doesn't). I was told it was their "company policy" to do this this way. Desoray eventually got on the phone in an apparent and vain attempt to intimidate me with "Mr. Clark, this is Desoray" and I immediately conveyed to her respectfully that her message was completely unnecessary. She asked what she could do about it and KNOWING it wasn't going to happen but to humor myself, I said "I want an apology". The reply was "That's just not gonna happen" at which point I replied that I wasn't surprised. A lot of these companies deal with people daily who blow them off for whatever reason and these companies use this as an excuse to stereotype and treat the REST of their consumers like crap. Today I called NFAS back to inform them that I had filed a complaint against their company (cause I'm just that kind of guy) and spoke with a Ms. Maloy, who ironically enough I spoke with the previous day and we actually joked and she admitted in the call (yesterday) that their representative and supervisor was wrong for volunteering my info over the phone instead of requiring it as she had done. The funny thing about this is during today's conversation she could remember EVERY detail about our phone call EXCEPT me telling her what her representative and supervisor had done and then pawned it off with a very vain disclaimer of how she speaks to oh sooo many people each day and can't possibly remember every phone call and YET she remembered and told ME every detail of the previous days phone call. When cornered about it, she became very evasive while trying to maintain professionalism. If you want to try to alleviate this problem, go on line and there are a list of states listed that are 1 party states (12 of them to be exact and NY is one of them). The rest are 2 party states. What this means is (for 1 party states) that to record a phone call with a 1 party state is that ONLY one party has to consent to the recording. Look it up on line if you have any questions. You can ALSO request a small yellow book that I have in my possession. It's the Fair Debt Collection Practices Act and you can even download it online which is where I got the one on my hard drive. Collection agencies HATE it when you start quoting from these books. The book is NOT very big and can save headaches down the road, know what your rights are! Document everything and I encourage you to record phone calls legally so they may be used against these companies. If the company refuses to "authorize" the call to be recorded, I simply ask, "Then what are you hiding. If you're doing your job right, then you've got nothing to worry about especially considering the call is recorded on your end too." The only thing is they can get rid of the records on their end, they can't get rid of yours. I've told these companies about the FDCPA and Ms. Maloy went as far as to inform me they have it plastered everywhere. I asked her then if they're so informed about the FDCPA, why aren't they obeying it? Logical question to me. I'm not an attorney, but like some of you, have dealt with companies like this before and there are resources available out there on the internet as well as federal agencies you can use to file appropriate complaints. Hope this helped someone out. I'm not a disgruntled consumer, I'm a consumer that knows their rights better than these collection agencies think I do and I'm one of MANY consumers this agency does NOT want to cross the wrong way again as there are numerous legal consequences that can and will follow. NFAS wants to play, I've got all day to play, but they better bring a heavy bat!

have they ever just appeared at anyone's family's house searching for information on you?! they went to my mother in laws house looking for me under my maiden name last night! i was in utter disbelief when my mom told me this morning that the guy came around 10-1030 pm looking for me. and they didn't even use the full collection agencies name, they merely stated action services...they have never contacted me before this, let alone show up at my prior addresses!

oh and as for where to report this harrassment to : Report it to the State ATtorney General for the state that the collection agency is located in and also the Better business bureau.

First mistake: answering the call. Do not speak with these people again. Send them a letter stating they are to cease all contact with you and and if they don't you will file a lawsuit. Problem solved. That was easy wasn't it?
If you do owe anything you should pay it but contact the orginal creditor and arrange to pay either directly to them or through them. Trust me there are many horror stories on here about people who paid to the collection agencies and have nothing to show for it because the agencies records of payments mysteriously disapeared or was wiped out or whatever B.S stories they feed people.
For that reason and many other personal reasons I will never deal with a collection agency. My credit is squeaky clean although it hasn't always been. but I have not and will not ever deal with any collection agency. If and when I have ever owed any money to any creditor in the past. I have always gone directly to the original creditor and paid through them.

ok so your wondering how your # is attached... well there are skip tracing agencies all around the country that are outsourced to with the sole purpose of finding #s on accounts .. they use paid databases like detectives and police use.. these agencies pay min wage... so you do the math... someone just quick looked at the last address of the debtor and saw whatever # was attached and threw it in there.. collectors had nothing to do with it... we call relatives ... what good would it do to intentionally call people with no knowledge of the person were looking for?

I too have gotten several calls from this company (Division of Robert Farence) that were recorded on my answering machine. On the messages they do divulge that they are a collections agency but they do not state who they are trying to contact. When I called them back, I discovered that they were attempting to contact a person that I bought a house from 3 years ago. What is even more disturbing about all of this is that I do not live in that property and the number where they were calling me is my personal residence in another state! When I tried to explain to their agent how I was connected to their intended recipient, they tried to blow me off by insisting it was just a wrong number and they hung up on me!

Naturally I called back immediately and went through the same process of trying to explain my circumstances to another collector with this firm. They, too, continued to insist that it was just a wrong number. So, I asked to speak to a supervisor. The so called supervisor named "Robert" tried to tell me again that it was just a wrong number and that their firm had done nothing wrong. He refused to let me speak to his superior and hung up on me even after I had told him repeatedly that there was no way that this was just a wrong number as the only way they could have gotten my phone number was through my name being associated with the address of the property I purchased from their "mark".

Well, I will have you know that my personal privacy has been violated. Someone has done enough research to locate my personal phone number under my personal name at a totally different address in an entirely different state from the previous address belonging to the person whom they were trying to get in touch with.

My whole intention in calling this firm the second time was not just to have my phone number removed from their data bank - which they say they have done - it was also to try to find out how this could happen so I could prevent it from happening again in the future. I even explained this to "Supervisor Robert" who refused to understand or even help me! He told me that there was no way that I could prevent it and that I was going to have to deal with each occurrence on a case by case basis. That is atotally unacceptable answer to someone who has had their privacy violated by their firm!

At the moment I'm searching the internet trying to find out who I can report this to and what I can do to stop this sort of privacy violation from happening again. If anyone has any helpful information, please post a response. I will be contacting my phone company but I feel that there should be a government agency where this type of intrusion can be reported to.

Any help would be greatly appreciated!

National Action Financial Services They are constantly harassing me and I owe nothing

They are constantly harassing me about a debt from 1996 on a vehicle that had been wreck but nalc had put there own insurance on my vehicle that I paid for every month and they vehicle was paid off after the accident now they say I owe like 20, 000 for a 9000 vehicle and when I asked her to send me any a copy of any paperwork she had she didn't have any. They were very rude and literally threatened me on the phone then hung up on me I am changing my phone number and I am contacting an attorney and suing them for harassment.

This company is a BUG...they are trying to collect on debts that either no longer exist or are outdated...they keep living messages and messages...call mr. Lynch. I refuse to answer calls that are left by non-humans, or recordings... This is pure harrassment. When you get them on the phone, then they think they not only have permission to call you, but to record you...take me to court, that is what I say...you can't collect on something that is none existant or out dated.

National Action Financial Services Cons

This company called my house looking for my mother/father in law who have never lived here. He played dumb as to how/why they called our number. When I asked what this was in relation to, he said "they saw something that could cause a potential problem and wanted to speak to them about it". So I said "oh I see they haven't done anything wrong you just want to make money off them". He said no you've got it wrong and you need to learn to be more polite and hung up on me! These companies should not be allowed to call people and con them if they have no true issues!

National Action Financial Services Took on the wrong debt

The company sent me a notice of an old old credit card debt that I had settled outside of court.

Has called me the last 26 days regarding Hillco Receivables account and I sent a certified return receipt letter that I disputed the debt and requested an entire accounting of the debt. I have yet to receive it.

I went through a debt resolution program in [protected] to pay off my credit cards. The company, Hillco Receivables keeps turning over the account to agency after agency. This last agency, NAFS, has been calling day after day and it's getting old. I have paid my debt according to the settlement agreement, and have told them that.

I hate this company. They are liars and extremely rude people.

I tried to settle an account with them over the phone, which went okay, until I told them that I would not pay until I see the settlement letter.

First they said the letter was sent back to them, even though they sent me things in the mail before. Then I told the supervisor to fax the letter and they never faxed it.

Those idiots hung up on me when I got mad at them for not sending me the letter. NEVER DO BUSINESS WITH THESE ***! THEY WILL SAY OR DO WHATEVER IT TAKES TO MAKE A BUCK AND THEY DON'T CARE ABOUT THE CUSTOMER AT ALL.

Hi... they told me that I owe them because of a motorcycle debt that I had with HSBC... so I paid them $4400 which was more than how much I should've owed but I did pay them.. This was about 8 months ago and they still haven’t sent me a letter or title or anything... I called them numerous times and they keep hanging up on me... what should I do? They are so *** up... I’m so pissed I don’t know where my money went... and I’m actually trying to sell the bike and I can’t even do that cuz I don’t have the title.

That is the biggest reason why you should never deal with Collection Agencies. You run the risk of something like what you experienced happening. Its always best to deal with the original creditor if you can. Even if it means sending all payments through the original creditor and letting them sort it out with the Collection Agency.

At this point you can gather any proof of payments such as bank statements, checks, correspondence etc... and get a lawyer. There are some great Consumer lawyers out there who will represent you based on a contigency fee. If you can't afford an attorney or don't want to be bothered with that, you could file in small claims where you don't need a lawyer. Also file a complaint with the State Attorney General's office where the Collection Agency is located in. Good luck

that is absurd and untrue... if they said they delivered the letter it was done...maybe someone should have their head checked out.. you wait years to pay a bill then you want clients to do things your way... no... sorry ... no one should be disrespected but dont expect praise for doing something you should have done in the first place...

once you pay a bill we update with the client ; your orig. creditor... then they are obligated to produce your title.. not the collection agy. we are however to provide you with a letter showing settlement was paid.. 30 days after your ck clears ( for agy protection naturally)

I received a letter from National Action Financial Services. They were trying to attempt to collect a debt that was not valid. In California if a debt is older than 4 years old, the debt is no longer valid and any attempt to collect the debt is considered fraud.

I wrote them disputing the debt. Also, I wrote the California Attorney General about them. Asking them why they are allowing this fraudulent company from continuing to attempt to collect old debts.

They also checked my credit with my written authorization. They are only allowed to check my credit with my authorization or with a valid reason to do so. Since this fraudulent company knows that the debt is not valid, and since they did not obtain my written authorization, they can go to jail up to 5 years in prison for illegally checking my credit.

I am suing them in small claims court.

I hope they go to jail for illegally checking my credit.

There's really nothing more to say. If you owe it then yes you should pay it. On the other hand, Hell no you don't have to deal with these shady collection agencies and be subjected to abuse. But if you do decide to pay the collection agency any money be careful. You are opening yourself up to be defrauded and taken for a ride. Your best bet is to go back to whoever the original creditor was and make arrangements to pay the money directly to them. Make it a goal to try to stay on top of your current bills. If you get behind always communicate with your creditors and let them know what is going on.

Source of advice: I have done been there and done that, survived bad credit, and am doing fine..

although i do not think National Action Financial Services deserves one red cent for a junk debt that they bought for pennies on the dollar, I do like how these deadbeats who thought they could just walk away from a bill and get away scot-free, years later get harrassed mercilessly by their collectors. That part is great.

listen... if people would live within their means none of this would happen... there are too many spoiled brats out there that get mommy and daddy even grandma ( pathetic right) to cosign for them on vehicles, creditcards, even mortgages without any stable financial future...then they lose their job, go to jail .. or as most debtors form a substance or gambling addiction...leaving a mess for everyone.. hope you enjoy knowing that your kids will continue the cycle on top of dealing with your massive damages... and please if its taken you years to even attempt paying back a collection account dont expect us to hold the drool cup and pat your a__ ok... please ... swallow the truth grin and bear it...

umm thats not true. that stats are for legal pursuit. They cant take you to court but they can collect. It will always be a "valid debt" until you pay it you deadbeat. pay your bills obama wont save you

The company called me today asking for a measly $133.56.

I told them I would pay it off one month from the day.

THEY REFUSED
and started yelling like trained monkys like dept collectors do.

I hung up and called them back and said I will pay half now hand half later.

after a series of transfers and then getting this woman on the phone who sounded like she was just poised to yell at people.

She offered me a $100.00 settlement and I told her I can only do 66.78 now and 66.78 a month later.

After she started yelling I hung up the phone .

These people are totally irrational and refuse to listen to common sense.

**notice**, I pay my bills on time, but this was a situation of me not knowing that I had an overdrawn closed account.

When I reopened my account I was told that they would use that money to pay off the debt. ( they told me it was not in collections)

SO NOW, I have a situation of being able to pay but having IDIOTS not taking the money.

I told them I only had a bank card.

Why dont people take a stand and make laws to

SAY NO TO
- unlimited overdraft fees
- unlimited debt collection fees
PAY WHAT YOU OWE, not THEIR cost of doing business.
- Employers REFUSING to cash YOUR check at THEIR OWN BANK

National Action Financial Services Deceit

This company has a message that you automatically give consent to have your call recorded. Based on my state law, it is illegal if you request before-hand that the call NOT be. I requested that the call not be recorded and was told "no...It will not be". After some banter, which included the agent "fishing" for info for which I did not embellish, including info that I was a student (which I am not!) I was told at the end of the conversation that the phone call HAD been recorded. I am so glad I got her name, direct phone number, both long distance and toll-free. Suffice to say, the FTC and my state Attorney General will be told about the incident.
