Church's Chicken - racial discrimination

My name is Nicholas Brager, I was on unofficially let go from Churchs Chicken on 5/31/11 (about 4 weeks ago). My boss Luis Martenaz is saying I gave away a cup of mashed potatoes, but I'm only doing what I was trained to do from the first day I started (12/10). Luis expressed to me that you never give food away but sometimes elderly people get a little confused with their order, and if this happens give them the item as long as its something small. So 7 months later on the day in question, an elderly man and his granddaughter come into the store and he ordered a 3 piece meal w/corn. So I fixed him a 3 piece w/corn as his side, and he asked where his mashed potatoes were. So I explained to the gentleman that he said he wanted his meal w/corn, and he said "no I wanted that extra" so I said ok and I explained to him I would have to charge him for the extra side. The man started to get loud and visibly irratated, it just so happens all of my bosses were in the store that day, the regional manager, the store manager, and the assistant manager. I looked over my shoulder to see if anyone saw what was happening, but they were all huddled around the computer in the back. So what I did was explained to the elderly man that when he orders his meal if he wants to order something extra he has to tell me its "extra" other wise I'm going to switch the side normally comes with this meal for what he asking for. The gentleman said he understood, so I told him I would give him the mashed potatoes this time, but to remember next time. The elderly man thanked me and left the store quietly. In my opinion I stopped a potential problem from happening in front of the customers, my bosses, and most important, his granddaughter who was about 5, and never had any idea things were starting to heat up. My boss walked up behind me and asked what I was doing and started getting loud with me in front of the customers and before I could tell him what happend, he tells me to clock out. I didn't say anything I just did it, because the customers in the store were my regulars and I didn't want to create any more of a scene. Five minutes before this happend my boss Luis, the store manager had got a call from a customer who was upset about a mistake that Luis had made with her order, and when he refused to correct the order, the customer said she was coming to the store. So Luis tells me that this lady was coming and gives me her name and order complaint and tells me to say I am the manager and to handle it however I felt. Now this woman is mad she will probably be loud and possible vulgar, but he trust to deal with that, but he doesn't trust me to make a disicion about mashed potatoes! This was just an excuse to get rid of me. He had already taken me off the schedule five days prior to this occurance. The only reason I was there in the first place is because I called and complained about being off for so long, so he told me to come in the next day for four hrs. He sent me back home within a hr. and said it was because of the mash potatoes but this is just to price of doing good business sometime. The customer is always right. This is the fourth time he has taken me off the schedule with no warning or explanation! I have bills to pay and we agreed upon 30 hrs a week. He should not be able to take me off schedule for two weeks at a time with no explanation. I can not pay my rent or bills and I have nothing for my child. I feel like this is a violation of my civil rights and plan on taking legal action. This establishment is completely ran by Hispanics and I am the only non-Hispanic, and he takes my hrs. and gives them to the other hispanic workers. Everyone is suppose to get 30 hrs. and when he takes me off schedule I notice that the other two hispanic workers hrs. increase from 30 to 40 hrs so I know for a fact he taking my hrs and giving to them and lets me sit at home not even knowing if I still have a job or not. And its been a month and he still hasn't called me and said rather i'm fired or not.
My bills or due and I have no way to pay and this puts everything on my fiancee and were probably going to be evicted because of this mans actions. I have tried a number of times to talk to him and he won't say anything except " I have to talk to my boss" but his boss doesn't know me. And also they all speak english but they refuse to speak english in front of me. They look and laugh and constanly make me feel unwanted, but I can deal with that, but also he's taking my wadges unjustly.
One time he had me clean the metal plates on the wall and I cut my thumb wide open and afterwards he says " oh i'm sorry I meant to tell you about that people have cut theirselves there before" and then advised me not to see a doctor. Please someone contact me on this matter, all I really want is my two weeks pay he took away from me, and i'll go away try to put all this behind me, but I am perfectly willing to seek legal counsel and if I wasn't so tired of writting i'd have a lot more to say!
PLEASE CONTACT ME [protected] Thank You,

Nicholas Brager

I think you should have a job already since is already more than a month u dont work there, because having a kid and no job that means your not responsible at all if ur just sitting there waiting for something to happen. money does not grow on trees u have to work hard to get it! Another thing u said that all the managers were there, why dont you just call one of them to solve the problem thats why they're there to take care of situations like that, u are not the manager to decide who to give free food or something, and not because they tell u to give them something doesnt mean you have to do it, first they have to pay for it, coustomers always want free stuff or pay less for more.
