i have a personal loan through citifinancial. when i got this loan in august 2008, i added on the 'unemployment benefit', meaning if i were to lose my job, my loan would be paid for me after 31 days of unemployment. i made my loan payments on time in full up until october of 2009.
my husband and i had been through rolling lay offs at our jobs, and both of us had lost several hours every week at work. my loan office in york, pa offered a diffurment for five months, which i accepted as my household income had fallen drastically.
in march 2010, my husband was permanently laid off from his job, and with his unemployment benefits through the state of pa, he was making less than half of what he had been making per month. in addition, i received a 5% pay decrease which was company wide at my job, and with health care cost increases, i am bringing home nearly 200 less a month than i was a year ago.
in march 2010, i was under the impression that i was still covered in the five month payment diffurment. i was wrong. at the beginning of april 2010, i was contacted by my local loan office saying that i still owed 135 for my march payment. with my husband being unemployed, and barely making enough to pay our electric bill, i did not have the money.
in may 2010, i had been unable to make a payment for april or may. i talked to the citi agent i had always dealt with. i told her of my problems and why i was 2 months behind on my payments. she seemed sympathetic enough and again offered me a five month payment diffurment. that day, i told her that i had moved onto third shift, and that it was not okay to call me before 4pm. she actually stated 'so things have just gone from bad to worse?' she was fully aware that i am having a horrible time and cannot do more than i have tried. she made me do an over the phone post-dated check payment to be taken on may 21st. she then told me that she would contact me to let me know if the diffurment was approved by her home office, and that she would let me know after the payment on the 21st of may went through.
i never received anything after that. no phone calls to let me know what was going on, no monthly statements, nothing! until two days ago. i know a normal person would have went to the branch and inquired, but as i stated already, i work third shift. anybody who was ever made to do this without a choice can tell you that life is harder. you spend many hours in bed trying to sleep, and when you finally do, your day is gone. i explained this to my citi agent, as i said before.
two days ago, the constable showed up with a civil complaint from citifinancial. there is a court date set for july 19. they are demanding a judgement against me for 8, 000 plus 178.50 for legal fees. citifinancial filed this suite against me on june 14th, 2010. all because i am past due 3 months (april, may, and june).
i don't know what to do. i am afraid to call. my husband tried to call yesterday while i was alseep, and they were completely rude to him, refused to talk, and yelled at him. if anybody has any advice, please e-mail me!

Find yourself an attorney! we are in a similar situation with them. I am paying my accounts within 2-3 weeks of the due date but every month I get a cost to cure letter. It's BS. We have paid $15, 000 on a car loan that has paid off less than $100.00 in principle over 5 years. If you look at the laws in your area- they practice harassment. There are attorneys that will handle your case and collect from the settlement. Keep all of your records too. The corporate office doesn't even know what the branches are doing. One of my cost to cure letters came from the branch while corporate already had my payment.
