Mr. Cooper - unlawful foreclosure

Nationstar has not only reneged on the terms of the acquired mortgage in terms of insurance, they have imposed extensive fees and repeated inspection charges; falsified information about my account; neglected to credit $14, 800 in payments, they claim I am in arrears for $9, 399.00, and are now foreclosing on my house that my daughter lives in. Nationstar Mortgage Company claims to have paid my insurance through the escrow account I have. The insurance company confirmed today that Nationstar never made one payment for my homeowners insurance. Yet Nationstar took almost $3000 of my money for insurance in 2013, 2014, 2015. Nationstar is currently filing for foreclosure on my house because they claim I am in arrears. They have provided no evidence of this. I have documented extensively my payments. I have proof that: 1. Nationstar claims to have paid hazard insurance from the escrow account with 2013, 2014, 2015 1098 forms. 2. correspondence regarding the complete lack of insurance paid with money from the escrow account 3. all mortgage payments were made, and all payments were made by wire transfer directly into their account after April 2014. In 2013 they took $832 for insurance from my escrow account. In 2014 they took $2, 156.00 for insurance from my escrow account. In 2015 they took $1, 113.00 for insurance from my escrow account. Because I live abroad I was not informed of this at all. Nationstar has not only reneged on the terms of the acquired mortgage in terms of insurance, they have imposed extensive fees and repeated inspection charges; falsified information about my account; neglected to credit $14, 800 in payments they claim are in arrears, and are now foreclosing on my house that my daughter lives in. I have tried to correspond with Nationstar since April of 2014. None of my inquiries have ever been acknowledged or responded to. My requests for their legal counsel's contact information were ignored 3 times since May of 2015. I have tried to communicate with the law firm representing Nationstar. I have provided the law firm and Nationstar with documentation of every payment that has been received, proving that I don't owe any money. Nothing has been accomplished. I have no lawyer because they all want a $25, 000 retainer. The foreclosure date is on or around May 3rd, 2016. How is it possible that a company, who has numerous class action suits involving hideous levels of corruption, is allowed to take a person's house away, when they are not in arrears? Time is running out.

Mr. Cooper - foreclosure while in loan mod process

I applied for a Loan Modification with Nationstar Mortgage. Each time that Nationstar sent me a "Helping You Stay In Your Home" packet with the "Making Home Affordable" documents I would fill them out and sent them back to Nationstar Mtg. 12/19/2014 I received another packet, I returned the completed Loan Modification Documents. 2/15/2015 I was assigned a Dedicated Loan Specialist. I called the number I was given to contact the Dedicated Loan Specialist Sandra Cline [protected] ext 4670521 numerous times. I have never spoken to her because Nationstar's policy is not to transfer calls. The agents were not able to assist me either. I received a Notice of Trustee"s Sale dated 2/17/2015. I called and no one at Nationstar could assist me. The bank bought my home at auction on March 18, 2015. I did not received a Denial Letter from Nationstar Mtg. I read it was illegal to foreclosure on homes while in the loan modification process.

Is it legal that nationstar keeps charging me for home inspections? I was late before but have been caught up and I receive a Statement to yet another home Inspection! What's wrong with this company seems like they want me to fall more behind! Is this legal I live In colorado

I am a victim of identity theft I sent the police report an i. D. Of who I am to nationstar I did everything they ask me to do now nationstar is ignoring my call scott roberts is not aswering me customer service cant help me becase I dont own a home we do I go from here I need help.

Mr. Cooper - negligence, fraud, breach of contract and unlawful debt collection

BOA sold my mortgage loan to Nationstar and in August 2013 I received a letter stating that they are increasing my monthly payment by $200+ to help pay off my loan within the next 30 years. I called the company and explained to them that legally they cannot do that and that I'm not staying in this house another 30 years due to me being in a lawsuit with the builder (my house has severe structural damage). I was told that if I didn't make the full payment then they would not accept the regular payment of $1050. Nationstar set up an automatic payment from my account and set the date to 16 Dec. On 18 December we found out that we are incurring late fees because it is past the 15 day grace period. My husband asked the representative why they set it up to take money out on the 16th if they knew the grace period was 15 days why would they set up the payment for 16 Dec; she stated she didn't know and if we want to change it then we need to log in online and change it.

Mr. Cooper - non applied payment missing funds

As a background, I fell behind on my mortgage last year and in January worked out a payment plan with Nationstar wherein a portion of my monthly payment was put into an unapplied funds account until it equaled a full month payment which was then applied to my account. In that regard, I priority mailed a certified check to Nationstar Mortgage on 9/21/2013 which pursuant to the tracking number was received by Nationstar on 9/23/2013 but, to date, has not been applied to my account. I sent an additional certified payment to my loan specialist at Nationstar on 10/10/2013 which should have been applied to my account as two payments since the payment was for one full month and the additional funds would have made my unapplied funds account equal to an additional monthly payment. However, since the 9/21/2013 payment was not applied to my account, on October 1st my account went into default triggering arrearage letters and notices sent by attorneys representing Nationstar which I received on 10/11/2013. Pursuant to said letter, I then sent another certified check with cover letter to my foreclosure loan specialist on 10/30/2013 for the remaining amount ($497.31) shown in the attorney’s letter as my arrearage which should have brought my account current to date. On 11/4/013 I received my second certified check ($1, 890.00) back from Nationstar indicating that it was an unacceptable payment amount since it did not equal the total arrearage amount and showing a different arrearage amount ($5, 570.32) then the attorney’s letter of 10/10/2013 showing $4, 817.71 as arrearage.

I have tried contacting Nationstar Mortgage on numerous occasions and their attorney’s office with no results.
Their attorney, Natalie Burris, of Codilis & Associates indicated that I ... “can bring copies of the certified checks to the Judge as defense when my house is foreclosed on...”, she was of no help to me whatsoever when I asked for assistance in her client’s negligence in misapplying my mortgage payment. This unapplied 9/21/2013 certified check has created undue stress on me and my family and my relationship with Nationstar Mortgage. I have done my due diligence in sending my payments and tracking receipt of same with Nationstar, I have left several messages for my foreclosure loan specialist, Rickey Wiley, to contact me to discuss my account but he has never returned any of my calls. I have sent him two letters with checks and he has not applied the checks accordingly and never responded to my letters requesting assistance. If my 9/21/2013 payment was applied accordingly my account would not have been 4 months late as of 10/1/2013 and would not have triggered my account to be sent to the foreclosure attorneys.
I sent certified funds totaling the arrearage amount shown in Nationstar’s attorney’s letter and now I am being told by a letter from Nationstar of a new arrearage amount to satisfy my loan. I am being harassed by Nationstar and their attorneys with letters but no one has the courtesy to return any of my calls when I have reached out to them for assistance. They have mis-applyied my funds and returned payments that I mailed to them, I can only assume that they are doing this to other Nationstar Mortgage customers causing unnecessary penalties/late charges, attorneys fees, etc. not to mention undue hardship and mental anguish on me and my family. This is completely unethical.
I have the tracking number and confirmation of the receipt by Nationstar as well as copies of the certified checks. Since the check is certified funds, my bank advised that it would be difficult to issue a stop payment on the check and therefore is making this more difficult to resolve the unapplied funds.

My husband and I are going through the same issue. Nationstar says there has been no activity on our account since March 19, 2014. The payment that was applied March 19, was February's payment, as we fell behind due to the propane prices this past winter. I emailed Nationstar to let them know about our situation, and when our account would be current again. They did not respond back. I sent a "half" payment (which they always put in a suspense account until the other half was received), in the amount of $250. (Our house payment is $453...in April, I sent out 3 "half" payments in the amount of $250 each. These half payments should have made us current through April. In May, I sent 2 half payments, in the amount of $250 each, and June the same thing. I received numerous letters stating that we were behind and there was a certain amount past due that I had to sent, all at once, to bring our account current. I just thought these letters crossed with our payment, and I failed to contact them, other than by email. On July 15, we received a letter from their attorney, Gray and Associates, (which came in a plain white envelope...no return address; just my husband's name and address typed on it), stating that we were referred to them for foreclosure. The letter was dated July 1, and we didn't receive it until 2 weeks later. I called Nationstar, at this time, and I talked to "Vickie Lewellan", who I guess is our "account manager". She would not work with me at all. She said that they are "putting us through this" because we didn't contact her sooner. She then pushed "mortgage release" and said there is NO way we could save our home, unless we could come up with $4233.66 and rising, by July 31. She said there was a "sale date" of August 28, 2014. I didn't get anywhere with her at all. I called again the next day, as I went to our mortgage account online, and saw the "Brandon Allen" was our "foreclosure specialist". I figured I would speak to him. I was told he was out of the office, but anyone in his department would tell me the same as he would, and I was put on hold so many times, with a different rep coming on the phone after about 5 minutes each time. Finally, I was given the number for "customer relations". I called them, and was hee-hawed around to about 4 more reps. I finally got one lady that seemed to want to help. She said "we can fix this", and she asked me to type up a letter to the "research department" and send it out, asking for a "payment search". She also said to put money away, so that we have it for when they ask for payment. I have been doing that. She also told me that there is NO "sale date" so we "have time"...so Vickie lied about it. 3 days later, I received one of my money orders back, which I cannot use because it is issued to "Nationstar Mortgage", one check, issued to my husband, in the amount of $74.90, and another check, in the amount of $200, issued to "Nationstar Mortgage", so we cannot use it. I sent out copies of these to multiple departments at Nationstar, hoping that it would get out, and they would realize that I had been sending money. I didn't have any problems with our payments until I began sending them to the overnight payment processing address, which is located in Dallas, TX. I have made multiple phone calls and no one wants to work with us. We received a letter in the mail that the "research department" has NOT come up with any more of our money, and it had Brandon Allen down as our single point of contact. It said that if we wanted to work out "payment assistance" options, contact him directly. By this time, my husband and I are ready to take the loss, as long as we can save our home that we have lived in for 13 years. I finally got a hold of Brandon, after multiple voice messages I left him, after about a week. He also said there was no "sale" date as of yet, and that we were not in "full active foreclosure" at that time. He was going to look for the money. In the meantime, I had emails from Vickie, to contact her. Finally, I did, even though I did not want to listen to her. She again told me that there was no way to save our home. I asked her why she "lied" about the sale date, and she just changed the subject. I told her that Brandon was not handling our account, as he was our foreclosure specialist. I mentioned the letter and told her about the payment assistance options, and she said there are none. She said that she was going to talk to Brandon about that. A few days later, on August 9, we received a letter stating that we are required to pay the past due and the attorney fees, which total almost $5000. The letter was dated August 5, which is the same exact day I spoke with Vickie. Since this time, Brandon has not contacted us once. I emailed a couple of the departments to see what we are supposed to do with the check we have, issued to them, for $200. I have received no responses whatsoever.

I WOULD NOT RECOMMEND THIS MORTGAGE COMPANY TO MY WORST ENEMY EVEN. STAY CLEAR FROM THEM! THEY ARE CROOKS AND SCAM ARTISTS.

I read a review that stated they were an "F" rating with BBB, and that as of May of 2014, their mindset is to foreclose on 20, 000 homes in 2014. This company seems eager for our property. They do not care about anyone. I have read so many reviews, and very few of them are good ones. One person filed bankruptcy in order to save their home.

I trying to get my mortgage down lower. First it was Bank of America then they sold it toi Nationstqr.Mortgage Co. I'm going on two year trying to get modification today they denied me to lower the house payment. I send all the paper to them and they said that I was missing some paper. I, m send them all the papers and then they deline me . I try to call them but never answer the to call me([protected]. They are Bad company.

Mr. Cooper - inept payment posting

Approximately 1 year ago, nationstar took over the mortgage from boa. At the time, I was glad. I wanted nothing to do with boa any longer. A year later, I actually miss them. At least they never misapplied my payments.

For 1 solid year, I have had to contact their customer service people and have the payment applied out of principal and back to monthly payment. I like to pay one month in advance. And in even amounts. But I always send a very clearly written payment stub with exact numbers. Each and every month for the last year, they have taken and applied the full check directly to principle. I've asked who does their posting - is it india? Mexico? China? No one will give me an honest answer.

The last supervisor level 1 - floyd - before he hung up on me - told me it was my fault for not paying the exact and correct amount. I have to ask if he's ever actually seen their payment stubs with the extra words and lines allowing for addition monies to be posted to escrow and principle. But he hung up in frustration.

So one year later, i'm still trying to get someone who knows their system and can give me an honest answer to why they can't get it right.

I'm so sorry that you had a bad experience with Nation star. Whenever you make an over payment it does go towards either principle or escrow or deferred late fees or suspense.. (For most MTG companies) once they have put the money into suspense after 90 days if not applied towards a full contractual payment they will send it back to you. Most MTG companies don't hold on to funds like a savings. Hope everything is going better for you.

I have the same issue with them. I have to call every month to have them correct payments. If I send a payment coupon and check showing what month the payment is for and it arrives before the payment date they apply it to the principal and I have to call and have it reversed. Now that I've tried to send the payment on the first of the month, the payment appears to be lost in the mail so I have to make a phone payment to avoid penalties and stop payment on my missing check or let it go through and watch them post it to my principal not next month's payment. This is the absolute worst company we have ever dealt with and we're ready to sell our home just to get away from this incompetent company.

Mr. Cooper - not willing to help

In 2009 I was in a Major car accident that after about a year put me onto disability. I call the mortgage company in 2010 and they put me onto a two year modified mortgage payment program that would bring my account current when completed it was to include $220 a month for escrow.Then last May I applied for the HAMP program and they stopped my Modified program and put me onto a Unemployed program that would end in July and then they would put me back onto the Modified program until December to give them time to finish the HAMP packet. Everything in November of 2012 was going fine, their Bankruptcy Department even stated that I have made all the payments and only need to pay around $500-600 more by December and my account would be brought current, but when I received my December statement I found that what they wanted as a payment increased by the amount I paid in November ($2000). Every month since then I have watched the payment amount increase by the amount I pay and the people I was dealing with can not explain what was happening because it was being done by the Foreclosure Department. I then called their Foreclosure Department and they tell me that I have NO payment applied to my account since May of 2012 then changed their story three times and sent a completely different story to the Making Homes Affordable when I tell them that I have records showing that I have been paying and their Foreclosure Department even stated that I have. So, since November I have paid the following amounts: Nov $2000 and $900 at the end of month, Dec $1100, Jan $1000, Feb $1000, March $1000, Apr $1000 and watched my payment amount increase as follows: Nov $2988, Dec $4988, Jan $5888, Feb $6988, March $7988, Apr $8988 and May to around $10300. I have talked to two different persons and after speaking to them they would not call me back. The last person I spoke to was Carol Morrison who told me to hold of sending any more payments until she got back to me, NOT to worry about the foreclosure she would postpone it and she was going to research what was going on because my account should have been brought current as of Jan of 2013. I waited for 3-4 weeks and received no call from her, so I call her and left a message but still received no call. I have been calling every two weeks but no one will answer the phone nor call me back.
As of right now they want a payment of $13, 316 which is what I have already paid plus another $7, 316. Plus there is money missing from escrow because my yearly amount to go out would be around $2200 and the amount the mortgage received was around $2600-$2700, But the mortgage company keeps telling me that my Escrow Account is short and can not explain where the excess Escrow money went.
Please help I would like to have my account adjusted to reflect they payments paid, my account brought current like their Loss Mitigation and their Foreclosure Department stated that it was suppose to have been back in Jan 2013 and to have the Foreclosure Sale STOPPED. I would also like to have someone who will call me back get in contact with me so we can get my Mortgage modified to a fixed rate.
The amount that needs to be adjusted is the $[protected] already paid and the amount that was added to what needed to be paid which is about $[protected].

Mr. Cooper - refinance under harp program

I am a totally blind individual and work for the VA here in Reno NV.
I have been a customer with Nationstar Mortgage for over two years, and I have never missed a payment or have been late. My previous loan was with Bank of America before my note was obtained by Nationstar Mortgage.
I started the refiance process in the first week of August 2012. My loan officer, Andrew Graham, contacted me about one week later to inform me that all necessary documents to proceed with the refi were present and he mentioned that it could take 60 to 90 days for the completion of the refinancing of my loan.
It has been over 5 months now since the refinancing process started.
During the past 5 months, I contacted Nationstar'sloan processing center multiple times to inquire how long it would take to complete the refinance process.
I have also contacted Mrs. Tracy Darnell, of Nationstar Mortgage concerning my refi. She told me that the loan could not be moved forward because it is allegedly in a subordinate department. According to Mrs. Darnell, she send emails to the department and was told as of 1/8/13, that they are still working on trying to complete the subordinate process.
I also left a message for Mrs. Darnell's supervisor who never returned my call
I am extrely disappointed with my mortgage company and the way they handle my loan.
I am looking fotward in getting some help in closing this loan. This inconvenience is causing me and my family financial hardship. I would appreciate any help in resolving this matter.

Started my HARP process in Dec, 2011. Two years and counting.
Now, Nationstar is wanting more points for the same interest rate promised, more origination fees and on top of it, you can't choose your own title company (for title insurance/settlement) which is easily $600 lower than their option, Solutionstar, a subsidiary of Nationstar.
I'm get legal counselling and will report what I find out.
For people waiting for subordination, contact the bank with the 2nd loan, and bring them on the same email chain. It took me a year to figure this out. In my case, Bank of America has my 2nd loan and they basically were waiting for Nationstar to respond during the subordination process. Good luck to you all!

I'm going through the same BS with Nationstar. I call them EVERYDAY and every call I back up with e-mails so I have documentation of my horrible experience.
I get the name of every person I speak to and put them on my e-mail list along with the ever-changing Single Point of Contact persons and the customer service reps who do nothing. I send out an e-mail daily to dozens of their employees. I forward every bad article I find as well.
I started this a week ago after getting the run around for 8 months. Today when I called I was told that my application is "in review" and they are just waiting for my credit report. So we'll see what happens!

I unwittingly signed up for the “trial period” for a loan modification with Nationstar. As I did not hear back from the agent named on the “offer” letter I began to research their program to see if I could find any information on their process. Low and behold….volumes of complaints on any type of related forum and complaint board. So I immediately just went back and made my regular payments. I denied their offer after finding out their tricks. (Remember…their “collectors” are not that bright). That made them hunt for anything they could to intimidate me. I have three fax numbers for them – bankruptcy [protected]), foreclosure specialist [protected]) and research [protected]). When I fax, I fax all of them. I reiterate everything that was discussed in conversation as well as any response to any letters they send. I went to pay and the rep would not take my payment, said that there was a demand letter – I have not received it (of course), but found out how much is due and when. I faxed the rep asking to fax me a copy asap – to all 3 fax numbers! After what I’ve read I will submit complaints to FTC in Texas, State Attorney General (for CA & TX) to Consumer Financial Protection Bureau (I downloaded their listing so I can provide complain counts with my faxes), Texas Dept of Savings and Mortgage Lending, as well as a good number of the 488 state representatives. Like the rest of you I am going through a HARP re-fi with Nationstar and getting the same run-around regarding my new loan. I was originally quoted 60 t0 90 days in August of 2012, it is now mid-April and I am still "in the process" due to a subordination. On occasion they will send me an email, or give me a call about my loan status - BUT IT'S ALWAYS THE SAME BS. I am very tempted to let them know I am not interested in continuing the re-fi process with them.

In the back of my mind they are milking it because they are still getting my normal $2200 a month mortgage ($1900 of which is pure interest /profit for them)...so why would they be in a rush? I am open filing a formal complaint, or to a class action suit, if one is brought forth.

My husband and I also have a first mortgage with Nationstar and are trying to refi with them under the new program HARP. We started our refi in November 2012 and still have not closed. Every time you call you get the run around and when you check your status of your loan you get a different answer every time you call. As far as getting someone to call you back, you can forget that. We are waiting for a subordination as well and that is even a bigger mess. I would also like to know what federal agency we can file a complaint with and if there was a class action suit to join, me and my husband would gladly join in.

Nationstar has my first mtg due to being sold from another, they solicited me to refi under HARP. I have been trying for 8 months now getting the same run around as jules1317 and am ready to throw in the towel. I would like to know what federal agency to file a formal complaint with and is there a class action lawsuit I could join or how do I start one?

Mr. Cooper - fees & rates

Had a great loan company originally through a great bank, then surprise - got hit that it was sold to this horror fest of vermin. No customer service skills, unreal fees for unknown reasons, cannot get anyone to give a consistent answer and 'because that is the way we always do it" is not a logical answer to a "why" question. This company exercises unethical lending practices, will not release my documents, will not allow me to refinance with a reputable lending institution, refuse to remove fees that are not legitimate. Why can these people still exist? They are servicing $92 billion in loans, but are worthless people and stealing from customers.

I had a Bank of America home mortgage that was bought by Nationstar and they are forcing the $9.95 'transaction fee' on me too! I contacted them online in January and demanded refund, they said no! and I told them it was illegal to force a new fee on me that wasn't part of my old mortgage company's terms and conditions, they apologized and didn't give a refund. Today, the 13th, I am trying to pay my bill online again and the $9.95 is automatically added to my payment, forced on me. I called in and demanded a supervisor speak to me - they will not refund it and claim they can charge anything they want because I can mail the payment in after the 9th of the month. I said I am going to pursue a class actions suit for them illegally charging me for terms I NEVER agreed to when they bought my mortgage. Would you like continuing information of how I may be able to get a legal suit started, if I can? I am disgusted they are forcing a $9.95 fee when my original terms and conditions state a late fee will only be charged after the 14th of the month. feel free to email martinipup at gmail com I am not ok with this company ripping me off when I pay every month! for years and years! and I did not sign up for their terms and conditions, they were forced on me!

This place is horrible. IF I do not pay my house payment on the 1st they will call me every day sometimes up to 10 times a day. They even call is at 9 pm at night. I hate this place. Then they charge us fees for calling us. Everyone needs to stay away from this place

This company recently purchased our mortgage. In mid-January of 2012, they sent us notice that our adjustable mortgage was to increase in March of 2012. The problem lies in that they had used the wrong index to calculate this increase. On Jan 31st, 2012, I contacted them and spoke with Arlene who said that a research request would be sent and that I'd have a resolution within a week. Nearly 10 days later, on 2/8/12, I called again to check status and was told by a man named Chase that thee was no record of any request being sent for research on this matter. Then, he just repeated the steps that were taken in my 1st call to them. I pressed Chase on the matter, saying that everytime I hang up the phone with them, I risk losing 10 days with nothing being done. I was hopeful that I could get deeper than the Customer service rep to try and get some resolution, as the date of mortgage adjustment was rapidly approaching and there was no time to waste. I was refused and it was made clear to me that there was no other course of action for me to take except for waiting for the request to take it's course. Subsequent to this issue, I have discovered that Nationstar has made an error in my mortgage interest reporting to the IRS, causing me to expend as of yet unknown effort in making corrections onn that issue, as well. The mortgage adjustment error is over $100 monthly, and the IRS error appears to be in the $5, 000 range.

Mr. Cooper - load mod scam

My husband was unemployed most of 2010. We contacted Nationstar before we fell behind on the mortgage for any helpful options. We either made too much or too little depending on the offered programs (while on unemployment which was quite a paycut). We managed to make it thru 2010 with no help from them. By September 2011 we were 60 days behind on the loan. We received a trial payment offer in the mail that same month stating that if we made all 3 new payment amounts on time our loan would be modified. We did make the payments and in December 2011 we received the offer package that said our loan would be permanently modified. We sent the package back and made our new payment amount in January and February 2012. Now we have received forclosure notice. When we contacted Nationstar, we were told differenct stories, depending on who you talked to. Simone Browne said the new loan was not approved and could not give me a reason why. Mr. Crowe told us it was just a system error on Fannie Mae's side and would be corrected. He also stated that they have several hundred accounts right now with this problem. He told my husband he would check on this and call back the next day. We did not hear from him as promised. My husband finally reached him 2 days later and now he says Simone was correct and the loan mod was not approved. We are disgusted with this company. I think they are scamming people. I googled complaints about them online and there are hundreds of stories out there about this pitiful company. We will be researching what our options are.

Verified complaint for wrongful foreclosure
And jury demand

Introduction: this complaint alleges inter alia that nationstar mortgage wrongfully foreclosed on real property commonly known as 81 greystone trial, black hawk, colorado, 80422. Specifically, nationstar repeatedly and falsely told plaintiff that his loan modification was either in-process or had been approved, failed to inform plaintiff that his loan-modification application had been denied, and that this failure prevents plaintiff from exercising legal rights, including but not limited to, chapter 13 bankruptcy, that would have allowed him to retain title to his home, which he largely built with his own hands.

Plaintiff, keith cabaniss, pro se, for his complaint against nationstar mortgage, swears and affirms that:

1. Defendant, nationstar mortgage, is a national mortgage lender that has transacted business in the state of colorado.

2. Plaintiff, keith cabaniss, is an individual who resides in, and previously owned and occupied real property located in gilpin county, colorado.

3. The real property that cabaniss previously owned has a common street address of 81 greystone trail, black hawk, colorado, 80422 (The & ldquo;home”).

4. The home is known as parcel no. [protected], in the public records of gilpin county, colorado.

5. The legal description of the home is:

S: 3 t: 2s r: 72w subd: la chula vista ranch block: 002 lot: 013a & imps a tract of land created by ble 04-09 recpt #122305 & corrected by ble 04-09a recpt #124137 formerly known as blk 2 lot 13 & east 1/2 of lot 18.

6. Cabaniss was the first owner of the home.

7. The home is located in the mountains of gilpin county, colorado.

8. The home has a unique and spectacular view of the continental divide and longs peak.

9. Cabaniss designed the home, and largely built and finished it with his own hands.

10. Cabaniss purchased the land on which the home resides in november, 2003; built the home from july 2004 through january 2007; and completed its interior and first occupied the home in january 2007.

11. On may 25, 2007, cabainss signed a promissory note to nationstar for the amount of $230, 431.01 (The & ldquo;note”).

12. The note was secured by a deed of trust on the home.

13. Nationstar filed an action on january 17, 2008, to recover title to the home by having the gilpin county public trustee conduct a public sale of the home (The & ldquo;foreclosure”).

14. On information and belief, nationstar did not own the note or hold the corresponding deed of trust when it filed the foreclosure.

15. On information and belief, nationstar sold the note and had previously assigned the note and/or the corresponding deed of trust at the time when it filed the foreclosure and thereafter.

16. On information and belief, nationstar acted only as the servicer of the note, i. E. Nationstar did not own the note, but contracted with the note’s owner to administer the note, including to collect payments made on the note.

17. From january 2008, when nationstar filed the foreclosure, through mid-february 2010, nationstar consistently and repeatedly postponed the sale date in the foreclosure action.

18. Cabaniss entered the streamlined modification program loan workout plan (“smp”) february 19, 2009.

19. Nationstar’s agent, vessia, told cabaniss on february 27, 2009, that his smp modification had been approved.

20. Cabaniss made one payment under the smp.

21. Thereafter, nationstar called cabaniss and informed him that smp had been cancelled, and cabaniss would instead enter a trial period plan under the home affordable modification program (“hamp”).

22. Cabaniss entered hamp in august 2009.

23. Hamp requires that applicants complete a three month trial period by making the payments that would be required under a proposed modified loan terms. If a hamp participant makes these required trial-period payments, the participant’s loan may be modified to reflect the trial-period’s payment terms.

24. Cabaniss timely made his august and september payments under hamp.

25. Cabaniss pre-paid his october hamp payment with his september payment.

26. In september of 2009, cabaniss called nationstar to ensure that it had received his august, september, and october hamp payments.

27. By timely making his august, september, and october payments to nationstar, cabaniss successfully completed the hamp trial period.

28. Assuming that cabaniss met other hamp program requirements, cabaniss’ successful completion of the hamp trial period entitled him to have his loan modified in accordance with the trial-period payment terms.

29. Nationstar confirmed to cabainss that (A) it had received his august, september, and october hamp payments; and (B) it was sending his plan to another nationstar department to draft new loan documents for cabaniss’ new and modified hamp loan.

30. Cabaniss’ hamp loan-modification application was denied on or about septmber 28, 2009.

31. On or shortly after cabaniss’ hamp application was denied, nationstar knew that cabaniss’ hamp application had been denied.

32. Nationstar did not notify cabaniss that his hamp application had been denied.

33. Nationstar was required to notify cabaniss that his hamp application had been denied.

34. Cabaniss did not receive new hamp loan documents from nationstar.

35. Cabaniss did not make further payments to nationstar while he was waiting to receive his new hamp loan documents.

36. Nationstar consistently told cabaniss that his new, modified, hamp loan documents were in progress. The communications between cabaniss and nationstar, include, but are not limited to the following communications:

A. Cabaniss called nationstar on december 10, 2009, and informed it that he had not yet received any new, modified, hamp loan documents. Nationstar informed cabaniss that it was "still working to prepare new loan documents, could take another month. "

B. Cabaniss called nationstar again on january 26, 2010. He informed nationstar that he still had not received the new, new, modified hamp loan documents. Nationstar told cabaniss that & ldquo;everything is ok. & rdquo;

C. At the time nationstar made the statements in the immediately preceding paragraphs (A) and (B) to cabaniss, nationstar knew that these statements were false.

37. On or about four days after the january, 26, 2010, telephone conversation in which nationstar told cabaniss that & ldquo;everything is ok, & rdquo; nationstar set a sale date for the foreclosure.

38. The gilpin county public trustee held a public trustee’s sale of the home on february 25, 2010 (The & ldquo;foreclosure sale”).

39. February 26, 2010, was the last date on which nationstar could schedule the foreclose sale without having to file a new action to request a public trustee sale of the home.

40. At the time of the foreclosure sale, cabaniss had no notice that nationstar intended to continue with the foreclosure.

41. Prior to the foreclosure sale, nationstar provided no notice to cabaniss that nationstar had set the foreclosure sale, or that nationstar otherwise intended to proceed with the foreclosure.

42. Cabaniss learned of the foreclosure sale on march 3, 2010, when he discovered a notice that phil heter, a denver-based repossession/eviction processor and reo broker, that fannie mae now owned the home.

43. If cabaniss had had notice of the foreclosure sale, he would have been able to exercise legal rights, filing a chapter 13 bankruptcy petition, which would have allowed cabaniss to prevent the foreclosure sale and keep the home by restructuring his debts and becoming current on the restructured note over time.

44. After cabaniss learned of the foreclosure sale, he again called nationstar. On march 9, 2010, cabaniss spoke with thomas brown of nationstar. Cabaniss asked mr. Brown to have nationstar rescind the foreclosure sale because nationstar had (A) failed to provide cabaniss with any notice that it was proceeding with the foreclosure sale and (B) had made multiple misrepresentations to cabaniss regarding the status of his hamp modification and of his note to nationstar.

45. Brown and cabaniss went through nationstar’s records of the communications between cabaniss and nationstar.

46. Brown stated that nationstar’s records of its communications with cabaniss comported with cabaniss’ own records of these communications, which are reflected in the preceding paragraphs of this complaint. Brown also confirmed that nationstar had not notified cabaniss of the foreclosure sale or of that cabaniss’ hamp application had been denied.

47. Despite his concurrence with the facts as cabaniss presented them, brown and nationstar refused to rescind the foreclosure sale. More specifically:

A. Cabaniss asked brown, & ldquo;what happened?”

B. Brown responded, "something transpired. "

C. In response to further questions from cabaniss, brown would not reveal what transpired, refused to rescind the foreclosure sale, stated that he was going to terminate the telephone call, and then hung up.

48. On may 17th, cabaniss held a conference call with geraldo hernandez of nationstar and jeff plaine of money management (A hud-certified loan counselor).

49. During this may 17th conference call, hernandez again affirmed that:

A. Nationstar’s records of its communications comported with cabaniss’ own records of these communications, which are reflected in the preceding paragraphs of this complaint;

B. Nationstar did not notify cabaniss that his hamp loan-modification application had been denied.

C. Nationstar did not notify cabaniss of the foreclosure sale date or that nationstar was proceeding with the foreclosure sale.

50. On may 20, 2010, cabaniss spoke via telephone with chelsea of nationstar mortgage’s legal compliance department in dallas, tx. He asked why nationstar proceeded with the foreclosure sale despite having informed cabaniss that & ldquo;everything is ok. & rdquo;

A. Chelsea responded that there had been a "miscommunication between [nationstar’s] loss mitigation and hamp department [s] . "

B. Thereafter, cabaniss asked chelsea "why am I being held accountable for miscommunication within nationstar?"

C. Chelsea responded, & ldquo;there is no explanation. "

First claim for relief
Wrongful foreclosure

51. Cabaniss repeats and realleges all preceding paragraphs.

52. Nationstar’s foreclosure sale was wrongful.

53. Cabaniss has been damaged by the wrongful foreclosure sale.

54. As a result of the wrongful nature of the foreclosure sale, the foreclosure sale should be rescinded.

Second claim for relief
Breach of contract (Covenant of good faith and fair dealing)

55. Cabaniss repeats and realleges all preceding paragraphs.

56. As part of the note, nationstar had an obligation to deal fairly and in good faith with cabaniss in its efforts to enforce the note.

57. Nationstar did not deal fairly and in good faith with cabaniss in its efforts to enforce the note.

58. Cabaniss has been damaged by nationstar’s lack of fairness and good faith in an amount to be determined at trial.

Third claim for relief
Fraudulent non-disclosure

59. Cabaniss repeats and realleges all preceding paragraphs.

60. Nationstar represented to cabaniss that (A) his hamp loan application was in process; (B) he would receive new loan documents from nationstar that complied with the term of the hamp trial period that cabaniss had successfully completed; and (C) cabaniss’ loan from nationstar and the processing of his hamp application was & ldquo;ok. & rdquo;

61. Nationstar’s misrepresentations detailed in paragraph 60 above are false.

62. At the time that nationstar made the representations details in paragraph 60 above, nationstar knew or should have known that these representations were false.

63. Nationstar made the representations detailed in paragraph 60 above with intent that cabaniss rely on these representations.

64. Cabaniss relied on nationstar’s misrepresentations to his detriment.

65. Cabaniss has been damaged by nationstar’s misrepresentations and his detrimental reliance on these misrepresentations in an amount to be determined at trial.

Fourth claim for relief
Fraudulent non-disclosure

66. Cabaniss repeats and realleges all preceding paragraphs.

67. Nationstar had a duty to disclose to cabaniss all material facts that were relevant to the foreclosure sale before the foreclosure sale proceeded, including, but not limited to, the fact that the foreclosure sale was proceeding and that cabaniss’ hamp loan-modification application had been denied.

68. Nationstar failed to disclose the material facts detailed in paragraph 67 above to cabaniss.

69. Nationstar’s failure to disclose the material facts detailed in paragraph 67 above to cabaniss was willful and intentional.

70. Cabaniss has been damaged by nationstar’s willful and intention non-disclosures in an amount to be determined at trial.

Jury demand

Cabaniss demands a trial by jury.

For these reasons, the court should vacate the foreclosure sale, restore title to the home to cabaniss as title existed prior to the foreclosure sale, award cabaniss economic and punitive damages, award cabaniss all costs and attorney fees incurred in this action, and award cabaniss all such further relief that the court deems as is just, proper or appropriate.

Mr. Cooper - grievously delinquent/erroneous/extortionate business practices

Grievously Delinquent/Erroneous/Extortionate Business Practices
Nationstar is failing to provide final documents for the qualifying mortgage modification. This failure continues to add to the “delinquency of the account.” The latest story from Nationstar which has been ongoing since November 2010 [and prior to that with CitiMortgage] is that they now state that they are waiting for the escrow documents from our county to complete the ‘final documents’ of the mortgage modification. I will follow up with our county to verify. I will follow up with Nationstar regarding this communication with a letter that I will fax to them verifying this information. This will be submitted under “Section 6 of RESPA.” The continued delay(s) are just one of the many delays experienced with the servicing of our account towards a final modification. Once the account is ‘brought current’ Nationstar can no longer assess late fees, interest accrual, etc. And as such, the continued unnecessary ongoing delay by Nationstar is viewed by this home owner as extortionate practices. If you are experiencing harassment, contrary/conflicting information, erroneous activities, delay tactics, improper credit reporting, escrow issues, and any others service issues not mentioned; please contact the Federal Trade Commission and report Nationstar as a violator of “Fannie Mae/Freddie Mac Modification Policies and Procedures as a Service Provider Contract” and/or a delinquent/erroneous service provider. Go to: Http://ftc.gov for more information. Filing a claim with the Federal Trade Commission will trigger an investigation into Nationstar’s business practices. Mr. Cooper - inaccurate monthly statements

My HELOC was transferred from Principal Bank to Nationstar Mortgage LLC in July 2011. The very first monthly statement was a joke: inaccurate number of days in cycle, inaccurate listing of APR, inaccurate mathematics to compute interest, inaccurate mathematics to compute principal balance. In addition, the online Account Summary initially indicated a fictitious amount past due and that changed daily. When I intially contacted Customer Service I saw that I was not getting anywhere and I requested a Supervisor which never came to the phone. My former loan servicer, Principal Bank, set up a conference call with Nationstar Rep, Kal, who admitted there were problems with the statement. Kal said the he would request a research into the problems. For this statement I had paid the indicated interest and a substantial amount toward the principal. The problems with this 1st statement were never resolved. I received a second monthly statement which still indicated an inaccurate APR and principal balance after payment. I e-mailed Mr. Keenan Cain and Eliot Robinson and today talked with Nationstar Rep, Ryan. Ryan admitted that these two statements were not entirely correct, but said that my next statement will be. Should I believe him? If it is not, my next complaint will be with the appropriate regulating agencies. It appears Nationstar is not willing to correct the inaccurate statements and provide them to me.

Mr. Cooper - nonpayment of taxes from escrow

My mortgage was sold to nationstar mortgage last year and I have had nothing but issues since. Since initial correspondence in october, 2010, forwarding tax property bills to be paid out of my escrow; additional letters and many months of correspondence, phone calls, etc. , I received an email from nationstar in january 2011 that the taxes had been paid. I received a letter in may 2011 from the county attorney indicating a lien was filed on my property for nonpayment of taxes. I ended up paying city and county taxes myself (County taxes were doubled because of delinquent fees). I was told by the mortgage company that they will not reimburse me. We will see about that. It is funny that this company just went public with the sec in may. I would join a class action suit against the company should someone file it.

The one way to guarantee that you get fast efficient service that addresses your problems and corrects them quickly is to inform the N* representatives that you are recording the phone call to ensure customer satisfaction. Put your phone on speaker or simply video record the calls. You only need to say it once at the beginning of the call, as they do to all of us, then after you start getting the run around (and you known you will) tell them " I'm recording this call to ensure customer satisfaction."
Then listen for a dial tone because I guarantee they will hang up on you faster then you can Jackie Robinson.

Nationstar is terrible! I can't believe they are getting away with treating us like this! I have the same problem. Our loan was originally with MoreEquity but, when Nationstar bought the loan our payments went from $3, 600.00 to &4, 300 with no explaination or warning! When I asked, they stated that they paid our insurance, taxes and escrow account. I never had a problem with MoreEquity! Now we are trying to modify through Nationstar and they are offering us a payment of $4, 100.00! We are barely making ends meet now.

They did the same thing to me and it was the final straw. We're trying to do a Deed in Lieu to get rid of our house. The anxiety over the last couple years since our mortgage was sold just isn't worth it any more. Had to jump through hoops in March when my car died and I couldn't get a car loan because Nationstar was reporting us as delinquent. We finally (after 2 weeks of constantly calling & e-mailing them) go paperwork stating we were in fact current.

Since then, they've been applying payments incorrectly and not crediting our account. Calling them gets a million different answers, none of them correct, and e-mails get ignored or a standard "We can't fix this problem through e-mail. Please call." It's past frustrating! Now we found that they didn't pay our taxes, either.

Mr. Cooper - terms of loan

Just purchased a house and wanted a loan that was assumable, without pre-payment penalities and no origination charges. I was told by Wells Fargo that they would do that, but calling around, I talked with Leasha Johnson and she said she would match that. All along there were problems with her story changing, rates changing (which they do) but it usually included a change in cost, adding in origination cost, or discount fee if I wanted a certian %. Well a long story short, I stressed my frustration and continued on as I was on a deadline to close. Final papers came and guess what...
there was an origination fee, a discount fee and the kicker... its not assumable!
As an investor looking into other property, I assure you I will not use them again and I hope this helps someone before they use them!

Mr. Cooper - deed

My complaint is pretty much the same as everyone else's .. about the incompetency of the employees to resolve problems. I went through the trial payment program for a loss mitigation option. Like the others, I was told at first that it was to be a 6 months trial payment. I kept calling in after the 6 months and was told they didn't have any records of my paperwork or some reason like that. Oh, they had my income and expenses info incorrectly too and insisted that I had given it to them but when I asked them for a detailed of what they had, noone could provide it. At any rate, I started the trial payment program again and it must gone on for more than a year or so until someone was willing to escalate it for final processing. My loan was modified but in the process, Nationstar Mortgage had apparently recorded a SPECIAL WARRANTY DEED before they finalized my loan mod, conveying the title to the investor, FNMA. This was done without me knowing anything about it until I started inquiring in Dec 2010 about my property taxes and why I had to pay more from my escrow acct, yet, the property value went down. Come to find out, because of the Special Warranty Deed recording a couple of years ago, the county no longer can give me my homestead exemption as a homeowner/occupied principal residence. I have been going back and forth with Nationstar.. with the supervisor of the Escrow/Insurance Dept and they kept insisting they had never done a deed change. I asked FNMA for assistance but was sent back to Nationstar. Finally, on my last call (last month, I think), they told me to have my attorney contact them and they were no longer going to talk to me. I sent them an email, requesting some docs and it hasn't been responded too.. it's been a month now. Oh, I forgot to mention, I had to obtain a copy of the Special Warranty Deed from the county's website and sent to Nationstar to prove they did sign and recorded the change with the County.

I'm needing some help as to how I can go about taking them to court myself as I don't have the money to hire an attorny and/or I'm willing to cooperate in a class action lawsuit.

Hello Michelle and Lisa,

While I am sorry for the abuse that you both have suffered at the hands of Nationstar, it is not surprising as we have the unfortunate pleasure of dealing with Nationstar on a daily, if not hourly, basis for our clients that have experienced the same or similar mortgage servicing issues that you have stated in your valid complaints to include CFPB violations for payments not being promptly and properly credited, restricted dual-tracking, fair review process, no runarounds, notification of foreclosure alternatives and most importantly; unfair, deceptive and abusive acts and practices (UDAAP). Can I say that there are multiple consumer rights violations under Federal law that I found in your complaints and I am on a mission to educate consumers on their consumer rights.

I routinely look for posts to answer in hopes that it will not only bring optimism to those homeowners and borrowers in distress but also some basic information to assist in fighting the banks like Bank of America, Chase, Citi and Wells Fargo that are "too big to fail" but yet don't appreciate the bailout that we provided in their time of need. The debt collectors like ASC, SPS, SLS, Green Tree, Bayview, Caliber, Ocwen and Nationstar are simply just piranhas but they can be beat at their own game too just like the big banks can be defeated.

It pains me that you have fallen victim to the illegal, unfair, deceptive and abusive acts and practices of Nationstar but I commend you for seeking help; too often homeowners do not fight for their consumer and constitutional rights! With that said, you have overlooked a key aspect to your fight, which is putting it in writing in the form of a proper QWR and submitting a formal complaint to the FTC or CFPB for immediate response; it’s sad that it takes regulatory muscle to affect change but it is true. I'm willing to join a class action lawsuit myself and my sister in law is willing to go to court too .We both are now in foreclosure do to nationstars incompetents .It's sad to see so many people hurt by this company which I also called fortress out of new York it's net worth is 63.8 billion dollars as of June 2014 let's get together people and get are money's worth ..

Mr. Cooper - predatory

My mortgage was recently sold to Nationstar 11/1/2010 and I am already having problems. Since it has been sold to Nationstar I have receive 3 separate documents stating how much I am currently 'past due'... each document states a different amount. And when I call I get yet another amount. Document printed on 11/11 states $4062.40. Document printen 11/12 states $2458.12. Document printed on 11/13 $2559.76. Really? so which one is it... NONE! I signed onto a forbearance plan with Citimortgage in July. In July I would pay $648 and in August I would pay $648, then Sept- Oct-Nov I would pay $1036 and finally in December I am to pay $2974 to bring my loan current. When I call Nationstar and explain they say yeah we see you are in a forebearance plan but you havent made a payment since August and "if you pay 'such and such' right now then you'll only owe blah blah blah. They are just trying to get money from me that I DON'T OWE! So I what am I to do now?

I was with Washington Mutual years back when it was bought out by another mortgage company then it when to Nationstar so I have been dealing with them for awhile. I recently refinanced for a lower rate which really helped my situation through Loan Deport who was evidently handling the refinance for Nationstar . Now Nationstart is handling my loan at the present. My major complaint is the monthly payment is due on the first of every month with a grace period until the 17th. I keep getting letters that indicate I am pass due because I usually pay around the 12th or 13th because my retirement check does not arrive until the 10th or 11th of the month and when it arrives I promptly pay the mortgage. I have never been late in all the years I have dealt with this company and never been charged a late fee. These letter is probably automatically populate if the payment is not received on the first of every month. I have tried calling and there is NO voice prompt to reach a service assistant, so that is why I am writing this complaint . Nationstar save the paper and me the aggravation every month of you telling me I am past due and when I call the payment has been received and next months is due. NOT PAST DUE!

Wow! I am going threw the exact same thing. I was never ever late threw citimortgage and just got my first letter Nov 18 2010. saying my loan needed paid for November in the ammount of 2500.00 really I have never been late ever. I was like has to be a mistake so called they were very rude and said it was late as of the 17th.. wth .. I never even knew where to send the payment till I got the address.. Now I have the 51.00 onto the 2500.00 to pay? my loan is only 991.00 a month.So where the heck is the 2500 coming from?
She said if Igave her my bank info I could pay right now and they would wave the late fee.. Ha Ha I said yeah well I'll pay on your site i'm not giving u my account info over the phone! She then said well u can't pay This month online just Dec.. She said u will still be a month behind either way..
I said u guys Ihave never heard of I never signed a paper or anything and now your changing my loan ammount. This isn't right! She then said well anything else I can help with? I said yeah why do I owe that much? She said go to our website and hung up on me...
There has to be something we can do? I am going to try and refinance threw another company but I am not going to send another payment to them! Whats the point they will just keep it and say u owe more..I am going all the way with this! I am not going to let them force me out of my home.. Its the Holidays! They have not heard the last of me..

Mr. Cooper - liars/cheats/crooks hamp not!

So glad to not be alone, yet I feel for others like us, having to work, deal with these people.
This first complaint is like many others.

Bought our home in march of 1999, we as lot of other americans do, we refinanced. After a few more years we refinanced again, and the last time was approx. 4 years ago, right before this economy took a crap.

Our loan is through fannie mae, yet the servicer at that time was flagstar. We had okay dealings with flagstar, which we had to. Like a lot of us, we had to file for the hardship program. We got accepted. Our monthly mortgage was before the hardship was $2, 048.30 (Ouch) we had sent in all of our letters, our check stubs, all that was needed. We got accepted, for this hardship.

We had spoke to a lady by the name of patricia l. Very friendly, and really wanted to work with us. She got our payment down to $683.00 per month for three months, then we had to do this all over again yet we had gotten approved for another modification with flagstar, basically another trial modification. We then filled out the paperwork and sent in all required papers to flagstar for the hamp program.

Okay, now, on the sixth payment, third payment of the second modification, flagstar sold our loan to what we call """"""""""""""""""""""""""""""""""""""""""""""""""""""the nightmare from hell mortgage company"""""""""""""""""""""""""""""""""""""""""""'""""""""""""""""""""""". """""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""nationstar""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""""".

Here now its time to pay our third installment of our second time around modification, and we receive a letter two days before its due saying they ""sold"" our loan to nationstar... Having nothing but this paper saying we sold your loan to this company..

No account number, no address, not even a phone number. We look them up on the internet, find this nationstar, and they have no information on us and no information to give to us. We call flagstar, they tell us; we have sold your loan, and you no longer have the account with us, and to contact nationstar to find out where to send payment... (Oops) payment is now late and we are now in default... Finally, after a few months, yes a few months, we finally know where to send the money to, but its not the $683.00 its the full amount along with the months, we are now behind...

At this time, the economy, is really in the crapper, and im not working, my husbands business has slowed down to a minimum and we are barely making ends meet. We cut back on everything, food, lights, clothes, gas, electricity, etc. We're living sometimes off the means of our friends and family. (Thank you to dave and karen wiley, mr. Steven hallsted and the others we were able to pay back)

At this point, ive given up, thrown my arms up and said f*** it all... So my poor husband now is in charge of everything, bills, dealing with nationstar, working and trying to provide for his family...

One day I over heard him talking to nationstar (Chad) omg-ness this boy/man/rude person on the other end couldn't be from our mortgage company. Well, it was. He was yelling and cursing at my husband putting him on speaker, then cracking jokes, like are you on drugs mr. B. Finally after chad hung up on my husband, thats when I decided I would take over the mortgage company. Not to say I was going to find someone nicer, or I would even be nicer, yet I needed to give my husband a break from the insanity of nationstar.

On july 1st of this year, I took over. I have recordings of all I have spoke to, I have recordings of them after they ask me all the pertinent information, I ask for their name, they hang up on me. I have all the dates, times, and how long these conversations or lack of conversations lasted. Either ive recorded them or ive written it down, down to the seconds on the phone with them...

Its now august 24, 2010 and now our dealing are with a lady/girl named chizo (chizbo) ~ loss mitigation rep~. Some of their names I felt as though I was going into a cartoon. One I talked to was named: pinkie, oo'kay whatever...
Three days ago she wanted us to send her $2, 048.30 and keep the money they had gotten from flagstar $1, 376.70

No modification, chizo and I had gotten into a bit of a tado and I said I was going to call back. I called back around 2pm central, so about 5 minutes into a conversation I was put on hold by justin, and chizo got on the line. This was not looking good. She proceeded to tell me to hang up and call back, as she wasnt going to discuss my file due to she didnt have it on the screen. My replay " this is me calling back, I didnt ask to speak to you, just put me on hold and I will wait. Brian the manager of these reps. Supposedly got on and looked at my file and said our hamp had been denied. Really? And what time did this happen, I asked, brian replied, at 2:17pm central. The next thing out of my mouth was, uhmmm what a conundrum I just got put on hold with chizo at 2:14pm and mow my hamp had been denied? Chizo, whatever she did, she did wonders, he replied... Yes, she sure did, my response to him...

So now, our home is going up for auction on the 16th of september, 2010 at 9:30am

Chizo called today and told my husband we had to pay by the 26th of august $4, 098.60 and we have no idea if we will get qualified, if not we just gambled our money away...

These people here at this company, have lied to us.

1st lie made by chad: we never received any type of paperwork, yet we have the fax sheet that says he received it all 31 pages

2nd lie made by chad: telling us to send him $683.00 for what, we're still unsure. Maybe he wanted us to pay his back child support, naw, now we know.

3rd lie made by chizo: I really want to work with you to safe your home

4th lie made by chizo: we need a contractual payment of $2, 048.30 by the 26th of august, (Which) this lie runs into the lie that was today.

5th lie made by chizo: we need $4, 098.60 by the 26th of august, 2010

So my friends, this has been our story dealing with ==============nationstar mortgage===========

The long and short of it, they don't want to work with you. They will take your money and the free government money and deny, deny and deny! Just waiting for housing prices to go up. We are the tenants, and caretakers of our homes, yet their not paying us to take care of them...

Did you know this: the hamp program has only qualified 31% of the people.

The government set aside 50 billion dollars, yet has only used 1.5 billion in a year and a half

For one, the banks don't want to do the paperwork, they take the money and collect interest on it, you know the free money the government has given them

Second: people are paying off their mortgages that aren't worth the value of their home. Ex: they are depleting their 401k's (If they have one) , borrowing money (If someone has the money to loan them. )

Americans need to take a stand, call your congressman, write them letters, do whatever it takes to make them listen. Don't make any deals unless you know exactly what your getting. Take that last stand, don't do upgrades to your home, thinking your going to get approved, cause the looongg and short, the chance of you being that 31% who get approved, is slim to none. Good luck!

As for nationstar, you can take our home, and make it yours... We survived without you for years, and we will survive without you again. Karma, is a bit** so to all those folks that we spoke to at nationstar, remember us in your dreams, because when its your time, you will be judged by the one and only!

I am another victim of this pack of liars. We have filed a complaint with our attorney general here in Oregon against this company. It won't save our home, but I sure want other potential victims to know who these groups of sewer dwellers are. We are now dealing with the lawyer from the eviction side of this tragedy. Mr. Cooper - payment administration not in order

Nationstar took over our mortgage from Flagstar Bank. Apparently, they did not receive full records from Flagstar and concluded that I did not have homeowners insurance. They automatically instated a ridiculously expensive insurance and established an escrow account on my behalf to pay for it. Even though I submitted proof of insurance (with the excellent help of my insurance company, Liberty Mutual), they kept the escrow account and the insurance active. After many calls, when they finally canceled that insurance (for which I even had to sign a release form), they kept my escrow account balance and started charging late fees. After numerous more calls, they finally canceled the escrow account too, and sent me a check for the balance...! I immediately paid that amount back to them (as they did not owe me anything, and I want to be current at all times).
Yet, my account still shows a balance (the old escrow account balance plus late fees), even though I have always made all my payments in full, on time. And for months now they keep calling me daily about my balance. And I call them back every other day or so! And every day they assure me that they will correct the problem. But it never happens!
Either they have a serious issue with their administration, or this is a scam. In any case, I consider this harassment.

I have an escrow account that was carried over when NationStar bought my Flagstar loan. However, NationStar didn't pay my homeowner's insurance. It was due on the 15th and is now 11 days overdue. My insurance company called them to ask why the payment was late, and NationStar said that they weren't responsible for paying it. My insurance company called and told me to pay up or they would cancel my homeowner's insurance. I called NationStar and they told me that my condo association pays my homeowner's insurance. What?! I told them this was nonsense as I'm in a stand-alone house. They are responsible. I had to wait on hold a lot and talk to several people, but I remained insistent that they were responsible for my homeowner's insurance. At first, they tried to say that there wasn't an escrow account, but I pointed out that they'd recently increased my mortgage payments to cover the escrow "shortage." They are saying they will "do research" tomorrow and then "overnight" a check, which "may" arrive by next Tuesday. They are also promising to write me a letter stating that they made a mistake and that they will pay my mortgage in a timely manner in the future. We shall see.

Mr. Cooper - fraud!

After reading all of the other complaints, I can assure you that you are not alone! The more complaints that I read posted by other people, the higher my blood pressure went! My loan was was also bought out by Nationstar which is the only reason I am a customer. I have lender paid insurance and they forgot to update my insurance company that they are the new owners so my home owner's insurance lapsed. I constantly called and I was told it was my responsibility to let my insurance know! After a month of back and forth and demanding a conference call between companies, it was resolved.

The most recent problem I have had is remitting appropriate payment on time but yet Nationstar claims they don't have my payment. Well, according to my bank...they cashed my check! I continue to receive calls from them even at 9pm and it is simply a recording to call them back, not even a live person. I have called in just about every day and I continue to receive RUDE employees who do not know what the hell is going on. I have requested to speak to supervisors (which is an act of congress) and when a supervisor got on the phone, he called me by the wrong last name. I corrected him and he told me that we needed to make this change on my loan but I was very quick to correct him again that I never had the last name he was referring to, not even my maiden name. This just goes to show you that they are reckless. Every time I call, they ask the same stupid question of where I mailed it to. Uh, hello! It must have been right because someone cashed it! I took time off work to go to my bank and obtain a copy of the cashed check and fax to them to prove that they already have it. I am sick and tired of doing their job...what the hell do I pay them for! They are useless and tampering with my credit!

I filed a complaint with the Better Business Bureau who has them at an A+ rating which I have no idea how. This discredits the BBB rating system.

I am at a loss for words as I feel helpless!

Mr. Cooper - liars

I have been in a loan mod since July 2009. Here it is Jan 2010. We have paid our trail period payment on time every month and they say were are approved but they are behind on the docs to modify our loan permently. Today we received a note on our door saying that we are going to sheriff sale in 2 weeks. When I call they say they cant foreclose while I am paying the modification on time. Well then how can they? They keep promising to call the foreclosure attorney and cancel the sheriff sale, but they ARENT! The program is a scam. They still are doing bpos on our house. They want it back. I have followed the program to a T and how can they lie and steal our house with no reprocousions?

I have been working on my MHA plan since Aug. 2010.
Nationstar morgage lost my documents. Never even
told me til I called to see how it was going. Well it is March
2011 now. After sending numerous documents, bank statement, etc.
I called. DENIGNed! Our income is half what
it was when we first bought the place. I was told the denignal
was because I was not behind on my payments. Yet I do not
make enough to refinance. Already tried. Now I am on food stamps
and credit cards. Nationstar bought out GMAC. And they are
a debt collection agencie. So even though I have never been late. I
basically feel like I am in debt collections. The first paper work I recieived from nationstar said if I was more than two month behind on payments they would start forclosure. Not only that. They send late payment notices when the payment has never been late. So much for OBAMA's PLAN. Just the
same ole run around... Has anyone ever gotten a MHA modification
that worked? I have only heard horror studys...

Mr. Cooper - where to begin???

I have already filed a complaint with these people and I have written to my Attorney General. If each of you that have a complaint against this company will file with your Attorney General and we band together we MIGHT actually get some answers to what our problems are. My parents have paid thier last mortgage payment to Nationstar Mortgage and some how the company has lsot the cashiers check, they have asked that we go to the bank and stop payment on this. We were asked to over night this check, did that. Was told 3 days later the check was not there. After 6 days of lying to me, telling me the check would be posted at this time and then at another time. Today, the 7th day they recieved the check I was told they can not find it. They want me to pay for a stop payment and they will reimburse me. Sure... just like they have been telling that the check would be posted at this time and it never was. To make my complaint, just that, a complaint instead of letter. I am going to sign off of here and call my lawyer, ENOUGH is ENOUGH

Mr. Cooper - harassment&posting payment

My parents have been with this company for many years. Their last payment was due Nov..They have had automatic draft since day 1 with this company. The day the Nov. payment was due they recieved a phone call stating that since the last payment was not the full amount that has been drafted the were not able to take it from their account and they needed to pay by check over the phone. Which was done at the time. 2 days later they recieve another phone call stating that the check was not for the amount owed, they done yet another check over the phone for $1.48. ANother 2 days go by and yes another call from this company stating they can not take payment over the phone for last payment it needed to be a cashier check or money order. Which by now they are trying to tack on $22.00 in late charges. But the company did cash the check for the $1.48. I refused to let my parents pay the late charges since the problem was the companys. Another 2 days go by and they recieve a letter in the mail stating that they owe for Nov. and Dec. payment. They don't have a Dec. payment since Nov. was their last payment. We call and they can't explain that problem. I refused to let my parents send in a Dec. payment. We finally talked with someone that waved the late fees and I told them that we were overnighting them a check for the last payment.The checked was signed for at 10:09 a.m. Tuesday morning. My parents continued to get harassing calls from this company. It was so bad on Tuesday my mothers health was at risk. Her blood pressure was sky high. At 9:00 p.m. on Tuesday my parents recieved yet another call from this company and at this point my mother asked that they contact me over any more problems, they refused. Now mind you this 9:00 call was after I had already talked with 3 people and they stated they had recieved the check it just had not posted yet. So these calls were not necessary. I finally called myself and talked with ( they only person that treated us like we were real people) Aaron Henderson. He did remove my parents phone number from the calling list and added mine. I have not recieved a single call since. BUT...the check is still not posted. It is setting there in the office, and has been there since Tuesday at 10:09 a.m.. Why all the harassing calls for a payment that they are doing nothing with, why were we told to give a check over the phone if this is not allowed and why cash the cash for $1.48 and not the one that would have brought the payment current? and WHEN are they going to post the payment that was so important that they had to call at least 4 to 6 times a day? I have contacted my lawyer we are now working on a case of harassment. This is crap what they have done to my parents and there is no telling what they have done with others. This company has to be stopped!

Good morning russell,
I am not happy with the service that i have received from you or your company at all. I have left repeated messages on your voice mail, and have talked with your company several times regarding this matter of being charged your property insurance rate. Your company states that you record every conversation. Why don't you have your company do a little work here (Yes, it's called research) and go back to january conversations that i had with your loan modification department. You will then learn that i did exactly what your loan department said to do. Make my monthly payment, and everything would be taken out of this payment for the house payment, homeowners insurance, and taxes (Escrow costs). Again for your informatin- i followed through on my end by what your representative said, "get homeowners insurance, i did, verify was sent, i did, then verify it was received by the nation star insurance department, i did". It just amazes me that if your company representative tells a customer something that your company does not stand behind what your company represenative say to its customers. Then you pull some crap off some line somewhere in the loan modification or your insurance contract in the fine print that contradicts what your company represenative says to it's customer. I'm not a lawyer, nor want to be. Nor do i think i should have to be to have to read every line of every sentence in a loan modification or your company homeowners insurance policies & requirements. As a customer, i ask the questions, get the answers, and i did what i was told by your company represenative!

When i have called you, i don't get a response back. When i talk to your company, they have been rude and not helpful at all. Every time i call, i get a different answer or response to this issue, depending who happens to pick up the phone at your company and talks with me. So where is a customer to go if every time a customer calls your company and gets a different answer? It's definitely not you, as you don't return calls. It's not about the $1, 200.00 you are charging me for not having the homeowners insurance (As your company states). I did what your representative said. It's about the integrity of your company (That's you-nationstar mortgage) having your representatives making false statements to customer, and we are stuck paying for your misrepresentation of information.

So where does the money go if i'm making my monthly payments and you're not paying for my homeowners insurance? I sure have not gotten an answer from your company on this. I have asked them many times.

I am forwarding this information onto the better business bureau as a black mark against nation star. You leave me no choice in this matter. I am also filing a formal complaint with your company. I am sure nation star doesn't really care, and i won't get a response, as you have proven this to me. Also, i will let all my business friends know about the shady service that nation star represents.

I'm just a small guy in the big picture. But i do know business. I was a district manager and vice president in the sporting goods retail world for 22 years. Now i'm just a commercial electricity manager working in 16 states. So yes, i do know about business integrity, and doing the right thing for my customers. This is something that nation star mortgage has no idea about, and does not care.

My home insurance company asked me for Mr. Cooper's fax number and, if it is on your website, I couldn't find it. Why the big mystery? Other companies include easy-to-find fax numbers with their contact information. All I get is a customer service phone number and it does not show up in google searches. If there's a reason you deliberately exclude that information from your website and email notes, I'd like to know what it is. Yours truly, Lena Fried

Oh where to start. My home owners policy was bought by Nation star Oct 2016. My home owners insurance policy was due for payment Nov 16, 2016. They NEVER paid it, and my insurance was cancelled. I was not notified of this matter until Feb 2017 when I received a letter from Nation star that I had no hazard insurance. I called and spoke to Aaron, he stated that they did not pay the bill because there was not a receipt to send in with the payment. Just that they received that it was due. They are to LAZY to pick up the phone and do there job and request what information that they needed, so instead just said "Hey we just wont pay it". So now I was instructed to find new insurance, which was not cheap because I had went past 6 weeks with out it. My originally policy was $1039 my new policy is $1749. I was told by Arron that they would pay the difference and all that would come out of my escrow is $1039. Well guess what, that was false the full amount came out of my escrow. So I called Arron back he said he would escalate to get this resolved and get me a refund issued. June 2017 my mortgage was sold again to Round Rock, because of the screw up on Nation star end my mortgage went up. I have called Nation star every week for months now and the incompetent employees just keep telling me they will get it escalated to the Research Dept. They state that there is no phone number for the Research Dept and that all they can do is email. Total crap! Every dept will have someone that you can contact. I have reported them to the BBB and about to send them to small claims court. This has been going on since Nov 2016 and it is now July 2017. I just want the refund that is owed me from Nation Star! NEVER USE NATION STAR, IF YOUR MORTGAGE IS BOUGHT OUT BY THEM CHANGE IT IMMEDIATELY!

Our mortgage was sold to Nationstar by GMAC mortgage and that is the worst thing that ever happened. Times are hard for everyone right now and those idiots make it worse. I paid our mortgage payment online or over the phone evr since they got our loan. They charge so much to do that and now since they don't credit it when they automatically take it out of our account, they are slapping $50 late charges on us. They are doing the same thing to my mom and dad that got stuck with them too after GMAC sold out. They say the "grace period" is at their decrection and that if the payment is 1 day late they can nail you with those charges for each day which is ###. My husband lost his job and I got hurt at work and have some workman's comp coming in but they won't work with me and keeps sending dum ### notices about that bail out ### that would make us lose our house anyway. This is crazy and we don't know what to do now since it seems like we can't get a new loan by someone else to get the hell away from Nation SUCKS!

Frustrating, my mother has applied for the loan modification program since Feb, 2012. All the information has been provided but the first time they denied and said they never received the full package with the info! We have confirmation of Fax, that were sent.

1.Second time around send all the info, and received denial on August 8, that she did not meet the HAMP Guidelines.
What do you need?
2.Apartment worth less than Mortgage
3.current 6.25% mortgage
4.We have to provided money for food and medicines and clothing and part of the mortgage and maintenance. Because Medicare and pension are not enough to survive. My father died 6 years ago and that income is not there!
5.The maintenance on the condo has doubled $ since they purchase the unit!

Is there some kind of help, maybe reducing the rate to current rate 2.0- 3.0%? with no closing costs for seniors!

Our load was sold be SunTrust to Nationstar, although SunTrust wasnt that great Nationstar is worse. We got one payment behind a few years ago when we were with SunTrust, they basically told us to not pay on our account for 3 months and they would put us on a loan modifacation, what a nightmare it has been. They tacked on so many fees the loan went back to the orginal loan amount. They lost paper work, added ungodly fees to our loan for inspections that were no more then them coming by and taking pictures of the house which we phoned in to complain about because our kids are running around in the yard. Lost records of payments and such. We are damn neer ready to walk away and they can shove this house up there A$$...

I' ve been trying to get my mortgage modify through the HAMP program since Decemeber 2010 with nationstar mortgage. I had to send the same application about 9 times. Everytime i sent it they aid they haven't recieved it now since june everything seems to come togather i started making my three trail payments. Successfully i sent two with no problem. I sent the 3rd month with my paper work to ensure that the loan has been modify. Now they claim they haven't recieved it, and trying to get me to do it within the company inhouse finance with them but they still haven't found my payment which was with my final documents. Some one please investigate these people because ain't no if, ands, nor uts this company poses a red flag

About a year ago my mortage was sold to Nationstar. This has got to be the worst, most unprofessional company I have ever delt with. Our payment is due on the first, if they do not have a day or two prior they are calling my home phone, my cell phone, my wifes cell phone, all hours of the day and night. Sometimes 9 and 10 at night wanting there money. Its like dealing with the Mafia. They will not work with you on anything. I have, or should I say had an 800 plus credit score and never had any issues with any other loan carrier, I fell behind about 2 weeks and was told that my credit history does not matter with them, I have no credit because I am a new client. I did not ask to be sold to Nationstar. As much as I dont like Citibank I would love to be back with them. Do not deal with these people. You would be better off doing without.

We had a fire at our home over two years ago. State farm is our insurance carrier. They absolutely have treated us in such a way that you would think is criminal. They set us up with rip off cleaning crews that have stolen and lied to us. They are all in 'bed' together, from the adjuster to the general contractor they 'suggested' we hire. After one year, the contractor finally got started on rebuilding our house! Then after two years, state farm was cutting us off from our rent supplement and telling us our deadline was up to be repaid for replacing lost personal items. . . Yet: they had not paid us back for the items we had submitted to them on their claim forms a year prior!... We had to pay over $350, 000 out of our own pockets to get the construction going. Now, the house is almost done, my savings are drained, our adjuster is non responsive and down right abusive when he does finally return a call or letter. Someone needs to know how state farm treats people. We have been abused so badly, I could write a novel. But, the main thing is that everyone needs to know that state farm is horrible... They should be punished. It is so unfair. If a judge could hear our story, I know he would side with us. The public needs to know our story.

I could not agree with you more! You definitely summarized NationStar very well when you said they DON'T CARE. I have yet to have a manager/supervisor call me back. I have never dealt with a company as unprofessional as NationStar. And the general attitude of most of the representitives is the same: CONDESCENDING! I feel for you and I really hope you got refinanced with someone who will at the very least act like they care. Good luck!
