Hello,

Pacesetter built us a beautiful home that we closed with them on Oct 2021. We were satisfied with practically everything and our warranty claims were fairly minimal. However, on January 2022, we upgraded our side yard with decomposed granite and draining on the far end of the side yard away from our home structure so the rain water will properly drain. It was draining perfectly until Pacesetter began construction on our next door neighbor's lot (same side as the upgraded decomposed granite drain side yard). The workers piled up a whole bunch of material and mud on along the neighbor's fence that separates our lot to theirs. When the thunderstorm came in, the rainwater gushed all the material into our yard since our home is a lower elevation than our neighbor's yard. We sent in the claim through Prohome and sent a text to Pacesestter's PM to keep a record that we communicated this to them. However, after 1 year of dodging our issue, Pacesetter sent Prohome to us instead of facing this themselves, claiming that they are not responsible for this damage and now they will report to Maverick the structure warranty company that our 10 year warranty is no longer valid since our renovation expires our warranty since we altered the foundation (which we did not). Pacesetter didn't even try to look at our side yard and threatens us now through Prohome that we will lose our warranty by lying to Maverick. We called Maverick and they said our side yard upgrade WILL NOT expire our warranty especially since we put in the draininage to better protect our structure. However, since Pacesetter's workers CLOGGED those drains, now Pacesetter is put our structure at risk while we did everything by the rules. No one answers my emails or calls me back from Pacesetter so all we can do is talk to Prohome but since Prohome is not responsible nor in charge of outside damages, they can't do anything about this to solve it. I have been professional, extremely patient and nice throughout this process but now I am fully enraged and I am fully going LEGAL for the entire damage. Hope this allows them to learn their lesson to professional as a legit business. I feel scammed, betrayed, disrespected, and full out slapped in the face!
