This company has been withdrawing money out of my account even though I have canceled the account over a year ago. I noticed that I was being billed and notified them immediately. Their "records" never indicated that I canceled. The cancellation was done over the phone and in person with the agency that asf was with holding for. I have tried multiple times to correct this situation over the phone and each time I have been told that it was never canceled because it wasnt in writing. After reviewing my copy of the contract it was found that technically they were never authorized to with hold any money. I have no problem paying for what was used but I dont feel it fair or just for them to continually bill me. I have put a stop payment with my bank because they would not stop and now they are continually billing me and adding on other charges. Please help me with this annoying situation. Thank you

actually i have sent in a letter to asf, it was faxed along with all the documentation of being "payed in full" which was actually over paid by two years. it was addressed to cody he wouldnt give me his last name, gloria she also wouldnt give a last name and to chris peterson. now that it has been two weeks later i got another bill with late charges added on to it, as well as it stateing that i was past due on the month previous. i would be more than happy to fax anyone a copy to review along with my confrermation from asf of the account, the contract, the letter that they recieved, the activity of the account ect. ASF IS A HUGE RIPOFF AND I HAVE YET FOUND A WAY OF GETTING THEM TO STOP BILLING ME!

Mr. Erdmann never sent any request to cancel. He state she cancelled with the club, but the club does not handle that process and would have referred him to us. We cannot hel Mr. Erdmann with his cancellation unless he submits it in wrting to us.

This Company is terrible! I have been trying for a month to cancel my membership at a Gym that uses them, because I have moved away. I have mailed and faxed them on numerous occasions everything they requested, and they keep coming up with excuses why they cannot cancel the contract! The Customer Service Reps will not allow you to speak with anyone else nor will they give you names to contact anyone that has any authority! This company is a HUGE SCAM! BEWARE! Very unprofessional and completely uncooperative!

I have had similar issues with this unethical company. I faxed a medical letter from a well respected Orthopedic MD here in Birmingham, AL stating that a tear in my tendon would not allow me to work out. There is a medical consideration in my contract with allows me out of it and they would not honor that. This came after my bill for the first two years of the contract went from $19 per month to $45 after they auto renewed (that was my fault for not reading the contract). I have been paying $45 per month to not attend the gym. They also would not allow me to speak to a supervisor after sending me a letter stating that the letter I faxed was not enough to cancel and that I had to be "permanently disabled" to be relieved from my contractual obligations to them.

THEY ARE UNSCRUPULOUS and CORRUPT. I am filing a Better Business Bureau complaint, notifying the gym. Due to the fact that I lost my debit card they no longer have me on file so they have been sending late fees and membership fees to me by mail. They also indicated that should I provide a letter stating that I am permanently disabled I would still need to pay the full years worth of "gym enhancement fees". That seems ridiculous considering I was trying to cancel only 2 months after my contract was renewed.

I am certain they will try and attack my credit report but I will dispute it considering I have tried to cancel, received a ridiculous denial letter, waiting over 20mins for someone to answer on 3 occasions, have been denied access to a supervisor AND THE KICKER, when I asked for a copy of my contract after receiving a denial letter stating my contract notes that I have to be permanently disabled... the rep told me that they DON'T HAVE THE CONTRACT on file at the office.

HOW DOES A COMPANY SEND A LETTER STATING THAT MY MEDICAL LETTER DOES NOT COMPLY WITH THE GUIDELINES FOR THE CONTRACT WHEN THEY DON'T HAVE THE CONTRACT IN FRONT OF THEM?

SAME problem-

Keep Faxing, mailing - THEY NEVER SEEM TO RECEIVE my correspondence! Hmm... well since they get to bill me for thirty days after they receive my cancellation AND you cannot contact them to find out if they got your letter for ten business days, or fax for 24 hours. I am out of my contract period and have been on a month-to-month plan. These people are scamming $35/month from me since the beginning of March. I really loved my gym but cannot attend due to family reasons. Unfortunately, I will not be joining again if they are still working with this company.

I agree with the comment that this company is fraudulent and unethical! I moved away and fortunately had a copy of my contract that stated the cancellation requirements. I met the requirements with documentation and was met with the comment that the contract I signed wasn't even valid in the state I live!
I will NEVER USE ANY COMPANY THAT ASSOCIATES WITH ASF INTERNATIONAL.
I HAVE SOUGHT LEGAL COUNSEL REGARDING THIS AND AM ALSO FILING A BETTER BUSINESS BUREAU COMPLAINT IF THEY DON'T REMEDY THE SITUATION ASAP!

THEY TOLD ME BACK AND FORTH, OH U HAVE TO GET A LETTER FROM THE POTHER COMPANY OR FAX THIS OR THAT, FINALLY THEY SAID I HAD TO GO ONLINE TO CANCEL, WHEN I DID IT TOOK A MONTH TO HEAR BACK THAT I WASNT APPROVED FOR THE CANCELLATION. NOW IM STUCK! WE ARENT BEING CHARGED FROM OUR ACCOUNT, JUST BILLED BUT I DONT WANT MY CREDIT RUINED. THEY HAVE TACKED ON MAJOR FEES! CONTRACT ENDED IN FEB. I am another getting the run around with this unscrupulous company, anyone for combining resources and erasing this stain for good? Please e-mail me if you are, as I am past irritated and feel like going straight for the throat. I have experienced the exact same thing as the rest here: Denial of receipt of cancellation, they state that their records show that I owe, regardless of the proof I have, long delays (20 minutes or more) on hold, Managers that do not contact you as promised, oh..If they send bills to you in the mail for money you do not owe, isnt that mail fraud?

We have a contract through our martial arts studio to pay through ASF International. We tried to set up an automatic draft but my bank has a block on this company which would not allow the payment to go through. (After seeing these complaints, I can see why.) So I set up my bank account to automatically mail the payment to ASF the first of each month. ASF is now sending me a bill charging me an extra $10 each month for "manual billing". I called them and explained that my bank wouldn't allow the automatic debit to take place but that I am having the payment automatically sent and that they don't need to bill me. They say they can't stop sending the bill, and can't stop charging me the $10 per month.

After seeing the other comments posted here, I'm guessing they are trying to force me into giving them access to my account.

Who charges $10 to mail a bill anyway? I know of no other company that does that!

I am so unimpressed with ASF... First of all I live in Canada and have had no luck with Sign in. Doesn't recognize my SIN # or Phone #. Actually the funny thing is that it did when I first got my Gold's Gym account... then when I first called about my Payments and possibly cancelling my account, suddenly I couldn't sign on anymore.
I had been advised that if I paid Gold's Gym three months of Gym Membership fees, I could cancel my membership ( as I no Longer use it) I called ASF to check into my options as to paying this and have the membership cancelled. They told me I was past due on my account which I was not aware of... it shows it coming directly off my visa every 2 weeks. Then informed me that they were charging me $5 every time it was completed... because it had to be done "manually" ?
Now it appears that my account is three months behind and they are also charging a $9 late fee.
When I asked about getting out of the contract they said they had nothing to do with that... Now I see it's ASF you are supposed to send the Cancellation request form to. It's right online!
I am in the midst of trying to contact them again... as they have been harrassing me ( Calling up to three times a day) to get payment from me...
Bunch of Idiots and completely useless...

ASF is a third party billing. In terms of assigning billing, the companies that use them supposedly get the money from them up front and then ASF turns around and bills you for the 'credit.' What I find interesting is there is no 'truth in lending' with regard to this line of credit or 'cash advance' to the business or to the consumer.

That alone would be reason to wipe them off the planet. We do have a lawyer that we have access to, but ASF is difficult to reason with. I think they took their Customer Service training from credit card companies who shall remain nameless but whose initials are BofA.

Marnie, in the US we have Fair Debt Collection laws and I am sure that once you send them a drop dead letter they will stop the harrasment. I am sure Canada has something similar in terms of them not being able to contact you once you have notified them you have contacted a lawyer/counselor/solicitor.
Check it out, and go to Clark Howard's website. He is a consumer advocate out of the south and has sample copies of drop dead letters on his site.

I'm in the same boat with everyone else.

I joined a gym in September of 2006, and my contract was for 3 years. I moved from Savannah to Washington Dc and wrote a letter asking them to cease payment on my account. So to this date--i'm still being billed $29.00/month. I have 15 installments left at a toll of $435.00.

I called today to be told that I have to fax in some cancelation form, a proof of utility bill in my name, and $75.00 cancelation fee- $75! I'm furious- they already have $551.00 of gym membership money that I HAVE NEVER EVEN USED, and they want me to pay an additional $75 to CANCEL.

This company is corrupt and a scam. I will NEVER EVER use or sign any contract that deals with ASF- they are terrible.

Now I have to wait to find an extra $75 to stop this terrible company.

If anyone has any solutions on how to make this stop without having to pay the money- please let me know.

I too am having issues with ASF. I called to cancel my membership at the salon I was using. Months later, I receive a letter from ASF saying that I owe money. I called and was informed that I had to give them 30 days notice, by fax, to cancel. Convenient how the bill they sent me gave me just less than the 30 days to cancel to avoid paying the bill.

I called and was told to just fax in the cancellation paper anyway, so I did. Later, I am sent a letter stating that the cancellation could not go through until I paid the dues in full. Why would I pay for something that I cancelled?!?! I called again and the girl on the phone was VERY rude and when I asked to speak with her supervisor, she was conveniently "off" for the day. I was told to leave a message for her and she would contact me within 24 hours. Days later...nothing. I call back and can't get through.

Today I just received another bill...

Same sad story. Twenty minutes on hold, they just a biller then they control the cancellation, your cancellation isn't valid (for whatever reason), they ignore the consumer protection laws for your state. They are the worst - in my case the martial arts studio sent in an "automatic renewal" a month early for two years at $4500 dollars instead of the one year "automatic renewal" on the contract. ASF says, "Sorry, the gym isn't responding so we can't correct this."

Automoatic renewals are illegal in several states but in California they are "questionable" so I have to sue the gym and find a way to fight ASF.

Has anyone had any luck with the Colorado Attorney General? Anybody know how to pursue as a group?

I'm a law student in the process of terminating my contract with ASF. We'll see how it goes, but so far the service has not been as horrible as some of the other posts above make it out to be. I think it just takes some searching and a little creativity to get through to a customer service rep. [And no, I will not reveal how I did it until the process of cancellation is over.]
However, because the posts above and on various other message boards online paint ASF as an unethical company, my ears are open to being part of a class action suit. Again, we'll see how well my cancellation process goes. Gym memberships are designed to be hard to get out of, and I think that needs to change. A lawsuit would be one way to jumpstart that change. Just give me a few months to find out what happens... if it gets to a ridiculous point, you can count me in!

ASF International is a total rip-off. I had a 2 year contract with AFS for a local gym and they kept billing my credit card even when my contract expired. Even more they kept billing my card after my credit card also expired. I closed my card account and they kept billing me. I complained about it and the person I talked to at AFS was very rude and gave me the run-around to call the local gym for refund and to cancel my account. I told him that my contract was effectively cancelled when my contract expired months ago. He said he would credit back the charge and close my account, but he never did.

This BATTLE with ASF is over a year old. See all above for the same challenges EXCEPT, I did get a signed cancellation notice from the mgmt of our Martial Arts studio (as stated on contract), notice was sent to ASF by not only myself BUT also the club manager...and of course, see above for how it was treated. I did cancel credit card and they started billing anyway. Did notify bank and bank did refund fees on two sepreate occasions. It is a pain agreed but as AmeriCANS we must not lay down and roll over. Keep calling, keep writting, keep faxing, take notes, keep a paper trail, be diligent and we will prevail! Yes, it sucks, yes, they make life tough but at least we have the opportunity to fight. ASF is not a very ethical company in my professional opinion and I think they have also duped the clubs that they do business with-especially the small gyms/studios. So, study before you sign. Follow up. Don't let them get to you. Do file complaints with BBB, Colorado's AG and with your state's AG if you want to really get under their skin...other wise you are fa_ting in the wind...oh, any smart as_'s at ASF, please respond so that I will have the fun of posting the details of our dealings:)

I received a bill from ASF today. I have had a gym membership for about 18 months. The bill stated that I was past due and had $100 in late fees and mailing fees. This is the first comunication I have received from this company. I had my memebership set up on auto pay. I also went back and noticed that there were other charges (other than my memebership) on my credit card from ASF several months back that I missed. I am in the process of contacting ASF and finding out what they are trying to do. I am very nervous after reading these posts.

I signed up my 17 year old daughter in Feburary with Red Dragon Larate and had to cancel in June due to her permanent lower back injury. I've tried contacting ASF International dispite how difficult it is to get someone to answer my phone call. Finally, I got thier address from a billing statements I recieved, and I sent my doctor's letter explaining that due to a permanent back injury he ordered her to stop attending karate. However, dispite this letter, ASF said she had to be permanently disabled. Today, I got a final bill for late payments and charges that excede the terms of the contract. I am now preparing a criminal/civil lawsuit in the Superior Court of Los Angeles charging the organization with a multitude of wrongdoings. Count me in on the class action suit. I have been trying to cancel a membership for 2 months now. I moved more than 25 miles away (890 to be exact) provided the proper proof of move as stated by several of ASF reps in the form of a certified utility bill. And what do I get? A letter from ASF stating that they require additional proof, as if the utilitly bill wasn't enough. Now they want a "newly issued drivers license" or a "post office confirmation letter" all they while prolonging the cancellation and forcing me to pay additional membership fees. THIS COMPANY IS ABSOLUTE B.S.!
I like the idea posted on another website of reporting any future charges as fraudulant. Has this worked?

I belonged to the Fitness Club until February of 2007. In August of 2008, I received a bill for dues from June, July, and Aug of 2008 ! I had never even heard of ASF Int'l. The fitness center had changed owners twice since my contract was signed - and it wasn't with ASF.
How can they dust off a dead file and start billing an account where they don't even have the contract. I'm currently in a battle of dispute letters with them. Unbelievable.

I will be ending my contract with golds gym in burlington, nc in two months and would like to start mailing letters of cancellations for renewel to ASF. I just had my october payment taken out and before it always said Golds Gym on my bank statement but now it says ASF International which makes me nervous after reading everyones experiences. I would appreciate any advice anyone could give on what to write in the letter to them to prevent them from taking out anymore money after the contract ends. I plan to write a letter to the gym and to ASF fax to them and then mail it to them along with a copy of the original contract I signed. I also plan to close my bank account and get a new number after my final payment next month just in case they try they will not get any extra money from me. If any one else has any extra suggestions on what to do I would appreciate it. I also think a lawsuit should be put against them for their to be so many people not just on this site but mutiple sites being billed for money when they should not be how are they able to get away with this kind of behavior. Every person on every site should sign-up in the lawsuit against them. Anyone know any good attorneys or firms willing to take up the fight?

Listen, my story is different than the ones I have read above, but I do believe it would have been the same end result. My husband and I paid for a year in advance for us both at a local gym (Xtreme Fitness in Cabot, AR). We didn't use the gym for different reasons. We received a bill from ASF in July for a yearly "enhancement fee." I didn't know what this was, so I called ASF. They informed me that it was part of our contract that my husband had signed and would send me a copy of the contract-since I couldn't find mine. What I received in the mail was a forged contract. My husband's name was mispelled and was not signed "Jr." as he always signs. I filled out a cancellation notice providing that I should receive my money back since they cannot hold me to a contract that we didn't sign. Weeks goes by, I'm calling every week for an update, finally I get a denial of cancellation letter in the mail. Why? I call again...nobody knows, nobody gives me any good answers. A couple days later I receive a different contract altogether in the mail that DID in fact have my husband's signature on it, which does prove my point that the first one had been forged. There is a "term and condition" in the contract that states "Entire Agreement- Changes: You agree that this Membership agreement is the entire agreement between you and club. You also agree that it is the ONLY agreement." Well, I look at that statement and say, but it is not the ONLY agreement. There was a document created with our info. on it and my husband's signature was forged by someone, so this to me looks like a breach of contract on their end. The forged contract at this point has mysteriously disappeared from ASF's possesion(imagine that). Here's where I believe that this coincides with what all you are going through. The majority of the complaints here have said that after your billing cycle had ended, ASF keeps billing you. On the contract that ASF sent me that was the "fake" the "renewal terms" were marked "non-renewable". On the contract with my husband's signature on it, the "renewable terms" did not have ANYTHING marked. My theory- After your yearly contract has ended, someone can go back and just check the box that says "renewable terms" and if you have not kept a copy of your contract or if you maybe didn't notice that section was not checked then ASF can just go back and say "You, the consumer, didn't read what you were signing" and they can squeeze a bit more money out of you at the end of your contract. This Chris Peterson person (customer service manager-what a joke, he wouldn't know what customer service was if it jumped up and slapped him in the face) that I talked to would not admit that anything was wrong with what they are doing and when I referred him to all the complaints on this site and others he stated that most people on these sites are just overdramatizing the situation and are just trying to get out of their obligations. He also said that I was trying to get out of my obligation. Actually, Chris, no I am not trying to get out of my obligation. In fact send my refund to the Ronald McDonald house for children in Little Rock, AR in me and my husband's name if you think that is what this is about. I don't care about the money at this point. This is about a company whom is doing something unfair to the American people in a failing economy where people are losing their jobs and their homes, because the corporate fat cats all chase the almighty dollar and don't give a rat's behind about what is fair and just. This ASF is just a whole different breed of people and those of us with a heart, in my humble opinion, will never be able to understand where they are coming from. The only thing you can do...PLEASE report them to the State's Attorney General's office and the Better Business Bureau.

Can we get together and sue these people. I found 7 months of charges that I did not about in my credit card, It is in the contract about that separate charge but when my contract expired I assumed the whole thing expired. Now they want 3 months ahead to cancel, this is simply dishonest from a company like MILE HI KARATE in PARKER, COLORADO, 80134 that was supposed to be teaching my kid some values and leadership. Maybe this is the kind of leadership that our current leaders have learned, and the reason for all the scams in this country at all business levels. I'm really pissed off about this.

read your contracts. the problem you are having is with your gym, not with asf. they are the billing company inforcing the rules of the contract that you folks signed.

I have cancelled my account three times with this company, and somehow it always seems to reappear. I have never signed a new contract, and the account reopens. I have spoken with several representitives on the phone who assure me that they have cancelled the account, and that there is no balance due. After the second cancellation I spoke with the president of the company and he assured me that it was cancelled and would not return. After this, my bank account was hit five times at $109 and then charged fees from my bank. This racked up to $700, that I will never see again. I am fighting with B of A, because of this and I just hope that if anyone can be saved from working with this company from reading these comments. I wish I had. I spoke with a representitive today, and they show the account open and with a $1884.00 balance. Funny, I thought I had cancelled three times now. Suprise! These crooks should not be in business!

Last comment BS, I was at my gym when he faxed info over, ASF told me unless I send the notice to them with THEIR cancel form and supporting documents, MY contract most be keeped up until they Approve cancelation..

Lets see I gave 45 days notice in a letter signed by gym owner, copy of new lease agreement and AFS still denied ?after they stated they did not recieve info, I refaxed (denied because I owed after I had my bank not pay after cancel date)

ASF is a great company for small business owners that do not have time to handle billing in-house. The only people that I have ever heard complain are the ones that signed a contract and do not have a valid reason to cancel. This is not the billing company or the gym's fault, it is your fault for not paying attention to the agreement you signed. I'm sure that there are business' that are not honest in how they explain their agreements and that is why you have to be your own advocate and study the agreement fully BEFORE signing. Rather than focusing on finding loop-holes and ways out of contracts maybe you should consider not signing in the first place and save the gym and the billing company some time too. Everyone wants to blame someone else for their poor choices instead of taking responsibility for their actions.

Okay, guys, the gloves are off. I threatened AFS with litigation in July of 2008 and they backed off totally. Then beginning in January of 2009 they began drafting my AMEX account again multiple times in a 30-day period.

I had backed off on my class action. Guess what. I am going forward full steam ahead. All individuals wishing to join this suit please send me an email to dennis@azlimited.com.

It is simple folks. Most complaints that I've read are a SIMPLE matter of reading (or not reading) what you are signing. Ask for a copy and read it again. Sounds like a bunch of people upset about not getting the questions answered the way that they wanted. The contracts say exactly what is required to cancel and how to do it. If you send it in writing like requested (thirty days in advance as required) you will probably get your membership handled in a proper manner. The complaint that payment continues to come out even after the year or two year term..Well, most contracts will roll over to open ended (they still draft, but you can cancel). Think about it..if a club has [protected] members all expiring at different times how could they possibly keep track of every persons daily expirations even after the term. So for those that say "They keep drafting 5-6 months after you expired, I say you must have a checking statement or on-line banking, did you not notice it was still coming out 5 or 6 months ago..did you tell them to stop? Probably not and you probably kept using the facility until you wanted to quit. They probably asked you to notify in writing, but your busy or forgot. Then all of a sudden it becomes that you've forgotten about the 5 or 6 months you have been using it and because your now overdrafted it becomes ASFs fault or the clubs.. "They kept on taking money after my term". If they cancelled you on the day it expired you would probably complain the club was rude and closed your account and locked you out. It's a no win for the club either way.

ASF is doing a job of collecting memberships dues...does your cell phone require something in writing to cancel or make changes..most would answer, Yes!.Most every contract requires some sort of written action on the consumers behalf.

If you try to cancel by just closing the account, changing accounts or the "As one complainant suggested...use a relatives address that qualifies as (Moved far enough away to quailfy for the move clause)". Grow up folks..be responsible..pay your bill and meet the terms of the contract.. You signed it, had time to read it..and most of all used it when you wanted it.
ASF deals with thousands and thousands of accounts and hears excuses on a regular basis.

Health clubs are required to send a copy of the contract they use to the Dept of Commerce & Insurance within it's respective state. The contracts are reviewed and approved. They must meet certain criteria...(and for those who need simple terms...that means checked to make sure the consumer's rights are not violated and are protected..that your not getting screwed over). The club is then issued a certificate...that means the consumer's right's are MET and the contracts that the club is using are fair to both parties.

Bottom Line..read what you sign..Understand it.. if you have questions ask..You can't hardly dispute a paper trail..If you send mail, send it certified..make a copies etc..

Enough with the crying about lawsuits..the courts are bogged down with enough useless complaints..

And yes..I am a multi-chain health club owner. I am expressing a concern because the bottom line is that too many people have lost values and what a contract actually means..spend more time enjoying your membership and not so much trying to figure a way out of it.. I've used many different EFT Companies over the last 15-20 years..ASF for the last 5 years. Not everyone is going to be happy. I've had people in my club claiming they are moving to try to meet the "Moving Cancel" clause. Then only a month later I see them filling up a grocery cart at the local grocery store. They see me and say .."Well I thought I was moving". I guess it was the old "I'll use a relative's address". So much for integrity.

ASF manages thousands and thousands of accounts, both paying and non-paying, they have heard most all the excuses as have I as a club owner..ASF is thumbs up. For those that will disagree and have a poor opinion of me and ASF, well it's like a belly button (being polite).

I came across site by accident. This is a non-sense page and I don't plan on returning to read more of the he said, she said complaints, save the white collar lawsuits for real offenses..No need to shoot the messenger, it just needed to be said..

Seems like it's all about the quality of the person and not the quality of the company. Just my .02..

Of course the actual club owners would be in love this company...they are collecting lots and lots of MONEY for them (see love sick business owner above)! It's easy to say "read your contract" when in fact if you have actually read these complaints you would see that is not the issue. As of March 10, 2009, the Better Business Bureau has taken them OFF their accredited business list because there are over 600 complaints that have been filed with them reguarding many of the same issues listed here. Power to the people! In the future we are going to see more and more gyms stepping away from these rediculous contracts and instead just doing month to month memberships. I have worked for several gyms in the past and people attend gyms for a fun thing, not to have to deal with unethical business strategies and greedy corporations. It just makes everyone shy away from entering into any type of gym contracts in the future. Good luck with the lawsuit and it is absolutely necessary for the people to have a voice and not be bullied by these negative nancys like business owner above.
