Capital One scam and cheating

I had decided to make use of my time overseas to improve my credit and started this credit card account. As I am in a country notorious for postal corruption I thought it would be better to use my sister's address. I have explained to them over and over that I work for the Government overseas and for security reasons I have my mail going to my sisters. The whole issue started when I logged into my account from home where I use a local ISP, at work because it is a government office we are on U.S. I.P Addresses. After this logon they blocked my access to my account. This caused me to incur a late fee because I couldn't see how much I owed from the initial annual charges. I had to incur the additional expenses of calling my sister to have her look at the physical statement. Then I paid the whole thing off. To remove this security hold they wanted a notarized letter from my sister, a letter from my office, copies of my identification and hers. She has mailed this three times to the address they provided:

The have repeatedly told me they have not received it. So, here I am stuck with a valueless piece of plastic because I wanted to improve my credit. Their customer service people that I get to speak to are useless and offer no customer service at all. I have requested repeated that due to the fact that I am in time zone that is 11 hours ahead of theirs, if they would communicate with their security department and email me. No they can't do that. I am beyond frustrated, but don't see another option to fix my credit or get this to work for me.

It has been weeks and I have not recieved, my master credit card.It has a limit of $300.00.They took out $39.95, From my bank of america account.Also the limit of $300.00 went down to $2oo.00, I have not used it yet, In fact I have not recieved it at all.Thats a big problem there.Thank you in advance if you could help me.Mr.Anibal Ferrer.E-mail=ajandakferrer@yahoo.com

I am inundated with emails all day every day from this bank. Most go to spam but the overflow to my inbox is unbelievable. I have unsubscribed numerous times to not avail. I also made a complaint to the federal website. It's like Capitol One all over again. I cn't believe with all the complaints against this Bank that their practices continue.

HSBC Orchard bank, your calls to their 800 customer service number. When you asked for dispute, call will be redirected to dispute department in their off shore Indian call center. The agent Joseph who'd refused to give last name told me they can only dispute a damage claim $112 of a total purchase of $1, 326.2 which the Chinese supplier only submitted an invoice of $911. They cited Master Card agreement that they cannot help you with partial refund for no shipment? ($1, 326.2 - $911 = $415) And shipment was damaged by DHL China from China to LA, but the supplier said DHL China won't pay claim. So I'd asked them to submit invoice from DHL China for that $462 charge and a concession letter, so I can file the claim in US. See if DHL USA will handle the claim and refund the $462 freight charge on shipment they had ruined? But China supplier refused to submit the papers because the real amount from DHL was probably not $462. So I'd asked the dispute department to help me with shipping/handling under this circumstance that the seller was dishonest. Again they had cited Master card as they won't deal with shipping/handling. You can see the mentality is different, Orchard credit card should be my banker. Help me to file dispute of the total amount, if the other party should refund the no-shipment amount of $415 then they should pay back or submit their proof that they had already shipped. And also if they insisted to keep the $462 freight? They should submit the real invoice that DHL China really did charge them that amount and a statement DHL China refused to pay for claim on damaged shipment. Because no couriers in US can still charge freight after they smashed the goods. The whole problem was the math of the Indian staff was not that great, they could not subtract the only invoice received was $911(including the $462) and there was a $415 amount never being shipped. The factory sold something they didn't have and conned me to pay them for full amount then sent me some junks that I could not return because China is too far away. I'd spent over 20 hours in communication over the phone, they always put you on hold to read the invoices. But nobody can help them if their math was too bad and acted not as on your side but on the other party's side. Once the dispute is submitted, the other side which is the vendor can submit their proof to say otherwise. It is not their right to be a judge and not to help me to file dispute? Who dare to use their cards?

There should be a way to adjust your spam filters to totally block out anything from thier email addresses.

You might check with the FBI and see what can be done also.

You might find out the emails of the bank managers and start forwarding all of these spammails to them.

fix your credit by getting a pre paid master or visa card from your local bank and stay away from these people

Capital One fraudulent activity

This company is terrible when it comes to customer service. You'd think that you could get someone on the phone in the fraud department after all fraud is a serious thing.

I mean they send me a theft affidavit and they don't even give me enough time to send the form in before they decide they are going to close the investigation.

I just want the two charges taken off of my account.

Capital One scam and cheating!

On monday October 1st 2007 I checked my checking account online normally as I do i see a balance of five dollars and some cents it was good. And again I checked it again on Wednesday October the 3rd 2007. I was paid on Oct 2nd about $574.00 and I saw 7 overdrafts charges of $32 each totaling $ 224.00 dated on the October 1st. I immediately called a local branch in Dallas, Texas I was told they were not responsible but the branch where I opened it at in New Orleans, LA. I did call and talked to the assistant branch manager to get the charges waived but she said if it was not their error they would not refund the money. I looked over my account and saw that the most of the charged were debits why did they go through if there was no money(insufficient funds) because if that was so they should have been declined and there was a charge $ 99.00 that I didn't expect which a company refunded in 2 days. The bank claimed that didn't cause the overdrafts.

I just want these overdraft fees waived because if these not were not charged I would have been in good standing. They should have been declined if supposedly I didn't have the funds. My debit card was also canceled on October 1st and nobody seems to be able to tell me why all I was told there was an 'alert' on my card. I still waiting for a replacement I do not know if this related or not.

All I want is my $224 back I don't think this is fair I know for a fact if an account does not have sufficient funds it will automatically be declined.

Capital One Credit Cards is a big scam.. They cheat on everything, even on rewards, limits everything.. DONT GO FOR CAPITAL ONE CREDIT CARDS EVER... Wait for some time.. you ll get great deals from CITI, CHASE etc...

I sincerely feel for you, I'm presently fighting ''Capital auto finance'' for some made up charges from extension of one monthly payment, this was in 2008, Capital one will WILL FOLD UP, just a matter of time. This are very bad evil people. during the weekends i'll be going to different car dealerships to tell customers on the car lot to beware and avoid using ""capital one for their financing.

My name is Adam Berlin; I own and operate Sports and Imports. We are an independent auto dealership located in Asbury Park, New Jersey (Neptune TWSP).

In light of the recent “bail out’ appropriation to Capital One, I felt obligated to share the details of my situation to help prevent Capital One Bank from similarly mistreating other qualified borrowers and to ensure Capital One Bank is held accountable for their actions.

Capital One Bank has wrongfully refused to honor a floor plan financing agreement that was renewed and signed on July 1, 2008 for a term of 1 year. Specifically, the Credit and Security Agreement (CSA) entered into in this matter provides for a (1) one year term, which was not scheduled to expire until July 1, 2009, “unless sooner terminated pursuant to a default”. Their termination was expressly based on a “business decision” without relevance to any of the terms and conditions of the CSA. This is the type of corrupt, deceitful and greedy corporate behavior that I thought the government was trying to prevent.

On August 14, 2008 Capital One announced they would end financing of auto dealers' inventories (floor planning) in New Jersey and New York. They gave dealers a very unrealistic time frame, 45 days to find another bank. Oddly they said they would continue to finance dealers in Texas and Louisiana.

If they are breaking month old contracts to existing creditworthy customers with a proven track record of servicing debt for 6.5 years, you can bet they certainly aren’t making new loans to qualified borrowers. The government’s plan to inject money to encourage lending is not achieving the desired results, quite the opposite.

My company has been in business for 6.5 years. In the last 3 years alone my company has collected $1, 500, 000 from consumers in sales tax for our government and community. We have sold over 5, 000 vehicles totaling $60, 000, 000 in that time frame (some deals we sold out of state and we paid other states sales tax).

Five month ago we employed 32 people, now we are down to just 10. Eighteen months ago we consolidated 2 locations in Tinton Falls relocated to a larger better equipped facility on Asbury Avenue. After massive renovations and $400, 000 later we resurrected the former Cadillac building into a new landmark in Monmouth County (once owned by the Rockefellers’ from the 1950’s).

We have enjoyed a 6.5 year relationship with Capital One Bank (through 3 bank mergers without interruption). Throughout our entire 6.5 years we had a very successful relationship together with a flawless track record of responsibility and on time payments. We have (and still maintain) perfect credit, both personally and professionally.
As an owner and creator, with tremendous pride and ethics, I have also been faced with many difficult “business decisions” over our 6.5 year history. That being said, I can respect and appreciate any “business decision” that a company makes if they feel it’s in their best interest.

The irresponsibility of Capital One, however, is not just unfair and unethical…..but their actions are severely damaging consumers and small business’ ability to borrow with complete disregard for the governments ‘bail out” plan.

If they wanted to end our relationship and get out of the “floor plan business” that’s their decision...I could accept it and move on. Conversely, I’d expect Capital One Bank, as a “hugely successful business” to honor their decision to renew my 1 year CSA (Credit and Security Agreement) that was signed on July 1, 2008.

When I was told by Capital One’s representative Rich Antanacii only a month after resigning a 1 year agreement I was “shocked” to say the least. At the time I didn’t fully appreciate the magnitude of his wrong doing. The CSA was not terminable at will. It can only be terminated upon the expiration of its term (i.e. on July 1, 2009) or upon the event of a default. Incredibly, Rich Antanacii unilaterally terminated the CSA by his letter dated August 14, 2008. This letter was not based upon a default; none existed for this to happen.

Stated bluntly, IT’S ABSURD AND ACTIONABLE!

In addition to Capital One’s wrongfully inducing me into signing the CSA on July 1, 2008, Capital One also forced me to close a floor plan line maintained separately with Manheim Financial Services. In doing so, only 13 months earlier reflects Capital One’s complete disregard for my company’s business interest. Manheim has since informed me that re-opening my account with them is no longer an option.

Needless to say finding another lender in the current environment is also impossible. The inability to secure another floor plan lender has had a devastating mental and financial impact on our company and if someone doesn’t step in immediately it will most likely result in Sports and Imports closing its doors with even more job loss.
To add injury to insult, I learned that on December 4, 2008 Capital One definitively announced that will acquire Chevy Chase Bank in MD. Under the agreement, Capital One will purchase Chevy Chase for $445 million in cash and 2.56 million Capital One shares.

So, Capital One gets $3.56 billion in bailout money and buys a bank for $520 million. Without looking at a financial statement or being an analyst I think it’s pretty clear one of two things are going on: either Capital One used our hard earned tax dollars to fund this acquisition or they used their own money in which case why would the government give them our money?
I don’t see any benefit to our economy; consolidation usually doesn’t create jobs it ends them.

After reading about the acquisition and being faced with an imminent collapse of my own company it became clear…it seems to be a pattern for Capital One. They intentionally are mis-leading the government (or at least the public) by borrowing money to fund an acquisition much like they mislead me in signing a 1 year agreement on July 1, 2008. By the admissions of Capital Ones own employees..past and present….I recently learned…contrary to what they had been telling, they had no intentions of staying in the floor plan business and haven’t for a very long time. Yet they signed a 1 year contract in July and canceled it a month later for no other reason other than a “business decision”.

One can’t help but wonder if it’s just coincidence that Capital One is Virginia based company and also able to get away with “company” murder?

I don’t understand how lending a hugely profitable and cash rich company $3.56 billion help our financial crisis when they turn around less than a month later and spend a huge chunk of it to buy another company that will most likely result in more job loss and certainly no job creation. The $3.56 billion cash infusion did not encourage them to start lending again what so ever. In fact, it accomplished just the opposite by giving them even more power to abuse.

Additionally, on December 17, 2008 NJ, Governor Jon S. Corzine signed legislation creating the New Jersey Main Street Business Assistance Program, the latest in a series of initiatives established under his Economic Assistance and Recovery Plan to help the citizens and businesses of the Garden State weather the national economic downturn. The program was designed to enable qualified small and mid-size firms and nonprofit organizations in New Jersey to access capital by providing State support for bank lending through loan participations and credit enhancements.

Developed in partnership with the departments of Banking and Insurance and Treasury and the state’s banking community, the Main Street Business Assistance Program will be funded by a $50-million State appropriation and administered by the New Jersey Economic Development Authority (EDA).

As soon as I read the news I called my representative at NJEDA to reiterate my need for help. As I learned from my conversations with them 3 months ago, loans still need to originate and be approved at one of the EDA’s 13 preferred lending institutions. Wouldn’t you know Capital One is a preferred lender? When I attempted to reach out to some of the preferred lenders, including Capital One, I was told the same thing I heard three months ago, “right now they aren’t doing anything”.

Capital One’s wrongful termination of our CSA should be enforced and they should be held liable for the damages they have caused. At the very least, someone should stop them from wrongfully and arbitrarily ending other creditworthy borrower relationships, while allowing Capital One’s CEO, Richard Fairbanks and his crew to walk away with hundreds of millions.
According to Fortune 500’s annual ranking for 2008, Capital One Financial is the seventh largest commercial bank in the U.S. and the 130th largest overall U.S. Corporation. (that was before their latest acquisition) A bank of that size, with the help of a $3.56 billion dollar infusion from the government, could do a lot of good. Unfortunately, no good has come of it.

One can’t help but wonder, what’s in Richard Fairbanks Wallet? Your family’s money? It seems Richard Fairbanks and his “army” thinks they can take what they want, when they want, from whomever they want without consequence. Maybe that’s why Fairbanks has been in the top 5 the highest compensated CEO’s for the last 5 years earning over half of a BILLION DOLLARS!
I believe in “free markets” too which is why I went in business for myself. However, unlike Capital One, I honor my commitments and obligations. Does earning a multi-million dollar a year paycheck require taking advantage of the very people that helped get you there just because you can?

Having said that, I am smart enough to know I don’t stand a chance against them in court, and I sincerely hope someone else’s intervention might. In the mean time, I stand defenseless against Capital One’s soldiers as their lies and games force me to default and ruin my reputation and credit (780 fico).

I have spent the last 6.5 years building….working day and night and day….sacrificing valuable time that could have been spent with my wife and son. I will not rollover and let them hurt others without, at least, attempting to seek justice.

Capital One they are corrupt

I was VERY dissatisfied with the way I was treated by the Capital One representatives with regard to some fraudulent charges on my credit card statement and I am very suspicious about the way they handle business. By the way, I am an excellent customer.

In November/December 2007, I received a call from Capital One stating that someone was attempting to make charges to my credit card from Hong Kong. My card was cancelled and a new card was issued. This was the first time anything like this ever happened to me. There were no suspicious charges on my current bill and I never really made it a habit to scrutinize my bills on a monthly basis since I have never had fraudulent charges appear before. So when I received my end of year SUMMARY from Capital One in January/February 2008, I noticed that there were three charges made to my credit card that I know nothing about. One was on May 1, 2007 for the amount of $21.40, one was on July 4, 2007 for the amount of $123.90, and one was on August 6, 2007 for the amount of $123.90, for a total amount of $269.20. I immediately made copies of the charges and sent a letter explaining the suspicious charges. On Friday, April 11, 2007 I was transferred and put on hold numerous times. More often than not you could not understand the people you are talking to. I spoke with Florine, Charine (ID XNZJ966), Elizabeth, John, and finally Rudy (ID FQK130) who told me that a credit would be issued, my credit card would be cancelled, and a new one sent out. On Saturday April 12, I called Capital One again, and discovered what Rudy told me was a lie. My credit card was not cancelled and the charges were not removed. Again, I was transferred numerous times, to Sergio (WWE444), Alan (OPG134) and Mohammed (LAE734). I have reason to believe the names and ID numbers are all fictitious b-c you could never track anyone down again once you hung up from them. Since nobody would help me and since this was the worst customer experience I have ever had, I told the last person I spoke with to cancel my credit card once and for all. But I am not done. I demanded credit for $269.20 for charges I did not make, and I wanted a letter of apology for the way I was treated from every person that transferred me and threw me back in Q. I intend on exposing Capital One and telling my story to as many people as possible and to shed light on the corrupt behavior of Capital One in an effort that it lessens the number of victims in the future.

A letter to the Comptroller of the Currency Administrator of National Banks at 1301 McKinney St Suite 3450 Houston, Texas 77010 quickly helped resolve my issue. I was issued a credit from Capital One.

Capital One scam and cheating!

I have finally paid off my full balance with my orchard bank account, i am in the process of paying off all my debt and I am almost done! I was told by the women that i spoke with that she can wave the late fee since i was paying off my balance in full... she told me to wait 4-6 days and the 30 dollar credit would be on there... well i checked my statement and it was never credited ...i know it is only 30 dollars... but no i keep getting emails saying they cannot do that... it is on my account agreement... i mean seriously why would i pay off the whole balance and not the 30 dollars if this is what i was told... i will be also contacting the BBB and all troubleshooters in colorado... this is the worst company ever and customer service sucks!

I had a balance of 372.72 as of the 7th of April. On that date I paid the full amount and I saw no other transactions listed, and I have not used the card for months. I just received a wonderful statement that I owe 68.00 which included a 30.00 transaction fee/debits and a 30.00 late and finance fee. The 68.00 fee had a date of 4-03-08 and I paid the entire bill on 4-7-08. How could I have paid the balance after the 68.00 was supposed to have posted first and not have had that 68.00 reflected in the 372.72 balance. Will this ever end.

Capital One they call me several times a day

It's either Capital One Auto or Chase Auto. Out of about 100 calls one person told me and I'm not to sure which they said.

They call me several times a day, treat me with no respect. Don't answer my questions. They ask for someone I've never heard of before. They say they will remove me, it's been 2 months. A minimum of 4 calls a day. I ask for there supervisor and they don't connect me, they DISCONNECT me. I went along with them once just to find out who they are, cause they don't give any information. I am tired of being lied to, I am tired of hearing my phone ring at all hours of the day. I am tired of getting wakeup calls at 8am on a Sunday when it's my only day off! Sunday is a holy day and it should not be used for these *** people to call. Why don't they do there research to find out who they are calling and be polite rather then get angry. I am reporting them to the BBB and will file for harassment very soon. I would love to file a class-action lawsuit against them just for not having there facts straight.

Capital One is out of control! i have had a loan with Capital One for 16 months and have never been 30 days late. I have a grace period of 8 days, they start calling me three days into my grace period. Day and night starting 8am to 9pm! this is harrassment! especially on Sunday on my cell at Church. i have spoken to them saying it is set up on my on line banking for a certain day and an hour later i get another call, now im so mad im yelling at them then an hour later i get a call with someone on the other end just breathing, and my response is put your supervisor on and i get hung up on! 8:30 pm just as im putting my children to bed how frustrating. Any helpful tips would be appreciated on how to legally stop these BEASTS who get paid and with a ton of interest.

I agree with your comments about capitol one I have been laid off, and they won't let me have a couple months to catch up the payment, which is less than 700.00 total a repo man has came 2 times to the house I told him nicely, you are not going to take my car we are job hunting and going to school. I have wrote them letters stateing my case.They are not user friendly at all. I had to change my number and get it unlisted so they will stop calling.
change your number its worth the cost. we plan on paying the loan off as soon as we can.

I feel the exact same way about capital one They even called me on Mothers Day. These people have no rules. I am online now trying to find out what are my rights as a consumer. If anyone file a class action suit I am on board.

It is unfortunate that you had medical issues within your life. The truth is, although times are hard, the clock keeps ticking. If you're not making your regular payments and just doing partial payments the loan will advance in days. Even if your informing them of what's going on, you have a financial obligation. Upon signing the contract, you agreed to making your payments on a certain date. Ideally companies do not owe you any type of extensions, you're the one who owes them (their money.) It is in the best intrest of the company to come retreive the vehicle from you. After all, they do own it.

I will join in ANYONE who wants to do a class action suit against this company! They are the worst. We got behind due to some major medical issues, tried to keep them in the loop and paid what we could. They call and call and call..never leaving a message. Never any correspondence in writing. Next thing ya know they are coming to take the car by wat of repossession. They NEVER contavted me that this was the case, just came for the car in the middle of the night. This comapny needs to be stopped..Anyone have any similar problems?

my tele-phone, rang every hour day and night, from capital one, even after i spoke to there rep. telling them my intents. The phone did not stop, even in church on sunday.. i asked that they please stop the frequent calling it continued.. I FELT LIKE TAKING A GUN AND SHOOT MYSELF, FROM THE HARASSING CALLS. tHEY MAKE ME FEEL HELPLESS. I AM VERY IUNCOMFORTABE WITH THIS SITUATION, I AM A STRUGGLING WORKING WOMEN, AND HAVING VERY BAD FINANACIAL PROBLEMS, AND ADDED THESE CONSTANT THREATS, IIS CAUSING ILLNESS.mY PRAYERS IS TO BE DONE WITH THIS COMPANY. I HIGHLY SUGGEST NO ONE EVER CONSIDER DURING BUSINESS WITH CAPITAL ONE AUTO LOAN, EVER THEY ARE LIKE LONG-SHARK . THANKS

Capital One terrible customer service!

Back in September, 2007, a charge appeared on my Capital One credit card statement dated 9/19/07 which I felt it necessary to dispute. I immediately sent off my dispute letter dated 9/29/07 (yes, it takes ten days to receive my statements in the mail). They then wrote requesting further information, which I provided to them in a letter dated 11/1/07. I then received yet another letter and a form to fill out dated 12/17/07 (which I received on 12/24/07), and in the letter, they indicated that the form, sales or purchase agreement, etc., had to be returned by 12/24/07! I stayed home from my family's Christmas Eve festivities in order to gather my information together to get to them on 12/26/07, as obviously they would be closed on Christmas Day.

Some time passed and I never heard from them so I called their customer service department to inquire as to the status of the disputed charge. They informed me that they never received the information I sent them on 12/26/07. I immediately sent in the information once again on 1/30/08. I again contacted them regarding the status and they indicated that nothing further had been done as there were answers to some questions marked N/A. I proceeded to explain that they did not apply to my situation to which they responded that there needs to be an answer in order to present it to the merchant. I responded that if thats the case, they need to so indicate on their form. So, they sent me new forms to fill out, which I did on 3/12/08, and I answered every question whether it applied to my disputed charge or not. On April 10, I received yet another letter from Capital One stating the following:

Thanks for contacting us about a disputed charge on your Capital One account. Unfortunately, at this time, we consider your cased closed. Heres what happened: Due to current operating regulations, we have a limited amount of time to reverse a charge back to a merchants bank. Unfortunately, that time frame has expired. In the future to preserve your dispute rights, please notify our office in writing within 60 days of the statement closing date reflecting the disputed charge. Youll need to contact the merchant and work directly with them on this matter. We apologize for any inconvenience this may have caused you. I then telephoned their customer service department immediately upon receipt of this letter and got nothing but an argument despite the fact that I pointed out to him in no uncertain terms that I complied completely with all of their requests and there was absolutely nothing more that I could have done on my part and that the fault lies with them that the time expired. I told the man I spoke to that if this is the way they choose to handle customer disputes, then they certainly deserve to be exposed to the fullest extent and that I would be posting my experience on the Internet.

Capital One how to handle the phone calls!

If you are reading this, it is probably because you don't want to be called by these people again. You may be late in payment and that is why they call you. They act like they know you and say (for example) "John? John Smith? Hello?" on an answering machine or if you actually pick it up, they sometimes do not speak and they hang up or they will get rude with you. And this can, and most of the times will, happen SEVERAL times within just one day!

Well one thing some fear would be to get a machine that you can hook up to your phone to record the phone calls and simply tell them at the beginning of the phone call "I will be recording this conversation" because by law you MUST tell them you are recording it if you are. But, who's to say you aren't really recording it but tell them you are? *hint hint* Most of the time it freaks them out and they won't want to talk so they hang up!

If that doesn't budge them, simply state that under the FDCPA (Fair Debt Collection Practices Act) it is illegal to be calling several times a day and you will be reporting them if it continues to go on. And under Section 5:7 it states "A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:... Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number."

Just thought to help, I was able to get them to stop calling and keep us off of any "list" they have.

Capital One deceptive practices!

On January 8, 2008 I got a new credit card from Capital One, taking advantage of advertised offer of 5.99% for life. I promptly transferred $7,500.00 worth of other debt to this card. I set up payment via the web. I paid $250.00 on January 22nd, in advance of the first billing, which I HAVE NEVER received). I have attempted to make a second payment (still having received no statements) but the account is locked on line and I am unable to make a payment.

After reading literally hundreds of complaints against this credit card and bank, I now realize they are VIPERS and certainly up to no good. If I had adequate funds I would promptly pay off this card and take out ads stating my opinion of their obviously underhanded activity.

I would LOVE to join any class action suit against Capital One and their credit card practices. I suspect they are going to be giving me a lot of grief over the next few months. I would also love to sue individually, but at this time I don’t think I can afford such a lawsuit.

IF YOUR TIME IS IMPORTANT TO YOU, NEVER USE CAPITAL ONE CREDIT CARD. They are the worst in the industry! For the 4th or 5th time in a few months, they have put a hold on my credit card for no reason. It is so embarrasing! I am waiting in line to pay the cashier at a supermarket and the card gets declined. I know that there is plenty of money on the card, so I called the customer service number. Guess what? I am transferred to India, where I could barely understand the customer rep's thick Indian accent. I had to repeat my card number several times, then she argues that the number I gave is not a legitimate number. I said, "What?!" I am reading the card that you, guys issued me and I have been using this same card for years. Then, she puts me on hold for several minutes. Upon her return, I remind her that I am still holding up the line at the supermarket and people are starting to glare at me like it's my fault that my credit card is having problems. The service rep asks me to repeat the credit card number 2 more times, puts me on hold for 3 more minutes and then says that there is no hold on the card and for the cashier to try to run it again. For the 4th time, the store cashier runs the card and again, the computer screen says that the card is declined. I tell the service rep this, and she still insists that it is not on their end, but on the store's end. The cashier runs the card 2 more times. Same thing. I ask the service rep to be transferred to a supervisor and she says in "an-i-don't-give-a-crap" voice, "I can't transfer you until I exhaust all the troubleshooting possibilities. What are the last 3 digits on the back of your card?" I give her the number and she says, "That is an invalid code". Again, I shriek, '"What?! I am simply reading the back of my card and I have used this code and this card for years? What is going on?" She says (amused), "Hold the line..." Again, I was on hold for several minutes, then she comes back on the line and said, "I don't see any problem on the card. Run the card again... Maybe this time it will work." I ask the cashier (who at this time, is now glaring at ME), to run the card one last time. Guess what? Card is still declined and the phone goes dead!

This company is awful, they got a lawyer and are garnishing my wages now because i couldnt pay them what they wanted and never even gave me any notice of garnishment and i had to call the courts myself to see who it was and what it was about. I always thought that you had to go to court to get a judgment filed against you, i was wrong i guess? This company is horrible and downright dirty and i would never suggest anyone getting a card from them.

Capital One refusing to goto arbitration!

Capital One Auto Finance stated 12/07/2007 via UPS they will refuse any arbitration of any kind this is a direct violation of the FAA act of 1921 I filed arbitration claims against them 4 times 3 times with the National Arbitration Forum file# MX0711002018527 The reasons are the following

1). I have been mailing my Car Payments Certified Return Receipt and they are claiming this is in Debt Collections I have made over 2 years of Car Payments 205.35 at 19.99 percent even though my credit score the past three years is over 650 meaning the rate should have been 10.178 percent

2). I bought the car through Tacoma Auto center and they had this listed under WFS and or Onyx I was not aware that this was a subdivision of Capital One Auto finance if I knew this I would have walked out.

3). The Contract is Notarized and Apostilled.

4). The affidavit is Notarized and Apostilled arbitration.

Capital One claims there is no arbitration clause so when I have any more Financial deals please exclude any offers from Capital One divisions subdivisions. If I buy a New or Used Car Please exclude Capital One they are unfair in their dealings.

Capital One terrible service!

In 8/2006 I bought a statue for $4,000. The comp. Elliot in new jersey, delivered damaged. I refused it. They promised me new one I never got it. I called capital one on 9/15/2006 to get my money back. Well this went back and forth for 3 months with me and elliots inc. Elliots won. They have money and statue. Capital one wants me to pay for it. I told them no way. I don't have statue. Tsys called me from 3/2007 to 8/2007 when I sent mt lawyer after them. Capital one hired them. Tsys claimed they where legal serves for

Capital one. They said they would sue me and called me every day. At least I have every ones names times and recordings and documented calls.

CAPITAL ONE IN NY IS THE WORST...I BELONG TO THE NJ BRANCE BUT I WENT TO THE BRANCH I NY BECAUSE ITS CLOSE TO MY OFFICE...I REQUESTED A NEW CHECKING ACCOUNT NUMBER BECAUSE OF 2 AMOUNTS I DID NOT RECOGNIZE...THEY ISSUED ME A NEW NUMBER.. DID NOT CLOSE THE OLD NUMBER...FIRST PROBLEM.

THEY TELL ME AND GET SNOTTY WITH ME THAT THE AMOUNT I HAVE IN THE ACCOUNT IS $1, 853..I SAID TO THE MANAGER AT LEAST 16 TIMES ARE YOU SURE BECAUSE IT DOESN''T SOUND RIGHT...THEY SO NO NO THAT'S THE RIGHT BALANCE...

I PAY 2 BILLS...6 DAYS LATER THEY CALL AND SAY YOU MUST COME TO THE BRANCE ASAP!
I RUN TO THE BRANCH AND THEY SAY YET SNOTTY AGAIN...THAT WAS NOT THE RIGHT AMOUNT
IN THE CHECKING ACCOUNT YOUR NOW OVERDRAWN BECAUSE YOU SPENT THE MONEY..I SAID WHATTTTT I ASKED YOU 16 TIMES WHAT THE AMOUNT WAS AND YOU SAID $1853...OF COURSE THEY DID NOT ACCEPT RESPONSIBILITY FOR THE ERROR...PROBLEM IS THEY ARE IN A RUSH ALL THE TIME, THEY DO NOT FOLLOW THROUGH AND DO NOT TAKE RESPONSIBLILITY... I KEPT SAYING THAT'S NOT THE RIGHT AMOUNT..AND THE BRANCH MANAGER, CUSTOMER SERVICE ALL SAID IT WAS THE RIGHT AMOUNT...

TD BANK IS THE BEST..NO DRAMA AND ALL IS ACCURATE...

To Micky, from reading your post, that was an issue with you and your merchant. That's like borrowing money from your mom to buy something from a store but then when you don't want what you bought you ask your mom for money? makes no sense I'm sorry. Think about it. With credit you actually borrow money from the bank when you purchase something, so if you don't like the purchase do you go back to the person who lent you the money... I don't think so!

I don't recommend getting a Capital One credit card. Capital One Bank’s has structured their credit card business to extract excessive finance charges and late fees from their customers. This strategy should be exposed, to protect customers. Here is my experience:

1. Capital One restricted me to an unbelievably low credit limit of $2,000 even though my credit history has always been flawless. I realize that this is their prerogative, but no other credit company I have ever dealt with discounts prior credit history. This strategy makes it easy for customers to exceed the credit limit.

2. Capital One’s website does not accept early payments. At Capital One, early payments can only be made over the phone, for which a $10 fee is assessed. When I made an early payment over the phone to avoid exceeding my credit limit, their computer system flagged my early payment as "suspicious activity” even though my payment was immediately and successfully drafted from my bank. Even worse: my credit account was not credited with this payment until one week later after I called and complained to four people in Customer Service. Holding my money because I paid early is a strategy that should be against the law.

3. Capital One’s notified me that electronic funds transfer from my checking account would begin on December 4th . On my statement that was due on December 4th was printed the following information:

“Capital One’s automatic payment service is in effect for your account…. As requested, the New Balance shown on this statement will be debited directly from your designated bank account on your Payment Due Date. You do not need to send a separate payment….”

My bank account was NOT automatically debited on December 4th, and finance charges of $11.88 as well as a late payment fee of $39 were imposed. I was $70 away from reaching my credit limit. I had to call a customer service representative to have the problem corrected.

4. After just the ONE late payment above (which was THEIR fault), Capital One’s website threatened me (in bold, red text) that the national credit bureaus would be notified of my delinquent activity if it continued. I can only imagine how much trouble it would be to have to correct my credit report if it had been wrongfully tarnished.

5. Capital One inquires against your credit report every month, looking for any delinquent activity on any account you have. They have the option of raising your interest rates if they find anything they deem unacceptable to them.

Capital One rip off!

My husband purchased a 2005 Chevy Silverado in the fall of 2004 with an auto loan from out then bank Hibernia National Bank. In December of the following year Hibernia sent out 'skip a payment' coupons to all customers who were in good standing. Basically it was a break from your car payment at Christmas with only interest to accrue for that month. Capital One purchased Hibernia National Bank sometime in 2006 (?) and transferred the auto loans to Capital One Auto Finance in 2007. In August I began to receive letters about a 'skipped' payment. I went to the branch to try to clear it up-I had all payment coupon recipes where the payments had been made at the bank branch. After sitting for nearly 2 hours with a personal banker-I was told that the best thing they could figure out is that my Christmas offer to skip a payment from several years ago was being considered a skipped payment and penalties were applying. The branch was unable to do anything to help. Capital One began calling my house daily. Each day I would explain what happened. Each day my account was being turned over to 'Special Ops.' Or that the Hibernia accounts were not completely transferred over yet,etc.etc. After 3 months,more phone calls than I can count with special ops, unanswered e-mails to Capital One and Capital One calling my home as many as 13 times daily I finally received a call from a human in Special Ops. The call came to my cell phone while I was at work. The person left his name and number with extension. Not surprisingly the number does not work, the extensions is non existent and not one person who answers at the 1-877 line can connect me to this person. I was finally forced to take a loan on my home equity line of credit and pay the extra payment to avoid the harassment of the phone calls. Also, now the penalty and late fees for every single month after my complimentary skipped Hibernia payment are added to the remainder of the loan. I was told in no uncertain terms by the personnel at COAF that it was not Capital Ones policy to let anyone skip a payment and even though they purchased Hibernia and their contracts it does not appear that they must abide by guidelines of the contracts they purchased.

I am having a horrible experience with Capitol One! On my auto loan, they were accessing late fees and it was not showing up in my online account, so I never knew the correct ammount to pay. Long story short, it appears as if I underpaid by $38.46. So I just got a BILL from them with a PAST DUE Ammt of $38.46 AND a LATE FEE of (no kidding) $265.91!

That's a Total of $304.37. The past due ammount was only $38.46.

Is this even legal?!?!?! I am so angry!

Capital One is horrible. My previous loan company Onyx sold my loan to Capital One Auto Finance and everything changed. My other company allowed me a 10 day grace period but when I signed the loan but with Capital One Auto I was told they don't have a grace period because they don't charge late fees and instead the amound acrues interest or some bull... it was while back so I'm not exact on wording sorry. Now I notice that even though my loan is due on the 28th and Im sending it between the 1st and the 5th of the month that they are now charging me $30 late fees and $15 administrative fees. Sometimes even when I send it out on time I am still seeing these fees.

Capital One Auto Finance is a total rip off. I'm paying off my car in total at mid December... because I am so close to my last payment (June) and just want to stop dealing with them... Never again. They are crap.

Daniel,

Capital One rep is lying to you about not allowing skipped payments. They just offered that very same thing to me this past Christmas. I did it. It cost me a $35 fee to deferr the payment, but my point is they do have a policy allowing them to do just that.
They are lying to you plain and simple.

Capital One not paying creditor

I opened an account with Capital One in order to transfer my high interest rate line of credit balance to their Master Card. I went through the process on November 22 and the transfer was approved. Six days later I checked my line of credit account online and it was still showing the same balance. I contacted them and they told that they had not received the money. I contacted Capital One and was told that they just approved the payment. This is 6 days after original approval! I continued to check daily and nothing changed. I kept getting canned messages from Capital One, in response to my enquiries, saying that he payment was approvd on Nov. 22 and to please contact them if I have more questions! Today, December 10, twenty days after the original approval, the line of credit account is still unpaid. So I called Capital One again, only to be told that they experienced problems sending the money electronically and had to mail it, and with the holidays and state of USPS, it could be a while. They mailed the check! What if they don't get it, or if it gets lost? The customer service rep was like a tape recorder. Nothing to say outside of the script that she had.
Now, my Capital One statement says I owe them $4,006, with the first payment due in two weeks, my line of credit provider shows $4065 ($4006 + $59 in iterest becuase the money was not paid).
I cannot wait until the $4006 is paid to my line of credit account, I pay off Capital One and throw their card away. One thing I can tell you is that a Capital One card will never be in my wallet. Their service and the way they practice their business (of ripping customers off) is deplorable. For God sake, do NOT apply for Capital One card, they suck.

Capital One fraud on billing statements!

If you look at all the major banks giving out mortgages and credit cards you will see on the bill the problem facing the American consumer. The banks are the problem and they need to stop extorting people off of fraudulent billing, financing, and late fees like Capital One Bank.

Capital Ones stock price lacks the real finical stability to hold the weight of water; this company’s stock should be dumped back too the company for a profit. Capital One has various consumer management problems, vary bad PR and costumer service. These factors are some of the main problem with the mortgage and banking crisis, this company finds unrealistic ways to make money off of the basic consumer, with fraudulent charges, unrealistic fixed rates on mortgages, and the financing of late fees or a charge that is financed by a credit card that is made by the company of the credit card issuer. ** ##

It is in the low $50’s and it really should be in the low $10’s for the practicing of credit defamation on the American consumer and helping the credit/mortgage crisis in America

Consumer Protection needs to be implemented into place over these types of banks like Capital One, and major Banks need to pay the same price as the basic consumer does with a rating system like the Credit bureaus give when he or she applies for credit, mortgages, or for banking needs. And to have harassing companies like Midland Credit Management, Allied Interstate, and The Westmoreland Agency calling them 5 times a day while harassing them at work, at home, on the holidays, and the weekends just like how Capital Ones Collations agencies do.

Capital Ones price is to high for a company that is next in line on the credit melt down and mortgage crisis

Subpart A_General

Sec. 226.4 Finance charge.

(a) Definition. The finance charge is the cost of consumer credit as a dollar amount. It includes any charge payable directly or indirectly by the consumer and imposed directly or indirectly by the creditor as an incident to or a condition of the extension of credit. It does not include any charge of a type payable in a comparable cash transaction.

(1) Charges by third parties. The finance charge includes fees and amounts charged by someone other than the creditor, unless otherwise excluded under this section, if the creditor:

(i) Requires the use of a third party as a condition of or an incident to the extension of credit, even if the consumer can choose the third party; or

(ii) Retains a portion of the third-party charge, to the extent of the portion retained.

(2) Special rule; closing agent charges. Fees charged by a third party that conducts the loan closing (such as a settlement agent, attorney, or escrow or title company) are finance charges only if the creditor:

(i) Requires the particular services for which the consumer is charged;

(ii) Requires the imposition of the charge; or

(iii) Retains a portion of the third-party charge, to the extent of the portion retained.

(3) Special rule; mortgage broker fees. Fees charged by a mortgage broker (including fees paid by the consumer directly to the broker or to the creditor for delivery to the broker) are finance charges even if the creditor does not require the consumer to use a mortgage broker and even if the creditor does not retain any portion of the charge.

(b) Example of finance charge. The finance charge includes the following types of charges, except for charges specifically excluded by paragraphs (c) through (e) of this section:

(1) Interest, time price differential, and any amount payable under an add-on or discount system of additional charges.

(2) Service, transaction, activity, and carrying charges, including any charge imposed on a checking or other transaction account to the extent that the charge exceeds the charge for a similar account without a credit feature.

(3) Points, loan fees, assumption fees, finder's fees, and similar charges.

(4) Appraisal, investigation, and credit reportfees.

(5) Premiums or other charges for any guarantee or insurance protecting the creditor against the consumer's default or other credit loss.

(6) Charges imposed on a creditor by another person for purchasing or accepting a consumer's obligation, if the consumer is required to pay the charges in cash, as an addition to the obligation, or as a deduction from the proceeds of the obligation.

(7) Premiums or other charges for credit life, accident, health, or loss-of-income insurance, written in connection with a credit transaction.

(8) Premiums or other charges for insurance against loss of or damage to property, or against liability arising out of the ownership or use of property, written in connection with a credit transaction.

(9) Discounts for the purpose of inducing payment by a means other than the use of credit.

(10) Debt cancellation fees. Charges or premiums paid for debt cancellation coverage written in connection with a credit transaction, whether or not the debt cancellation coverage is insurance under applicable law.

(c) Charges excluded from the finance charge. The following charges are not finance charges:

(1) Application fees charged to all applicants for credit, whether or not credit is actually extended.

(2) Charges for actual unanticipated late payment, for exceeding a credit limit, or for delinquency, default, or a similar occurrence.

(3) Charges imposed by a financial institution for paying items that overdraw an account, unless the payment of such items and the imposition
of the charge were previously agreed upon in writing.

Capital One late night phone call

On more than one occasion, I have had Capital One call my house as late as 11pm. Upon contacting the company to file a complaint, I was told that they can call my house whenever they feel! What they do not realize is that I have two young children (6 & 3) who wake up when the phone rings at this time of night. I have requested that they stop calling my house and have even cancelled my credit card with them ( my husband still has one) but they continue to call late at night and REFUSE to stop! It is ridiculous! John, the "Account Manager" even told me that I could not speak to his supervisor. Now, we all know that that is a bunch of bull. Unless you want to wake up in the middle of the night, DO NOT do business with Capital One!

I too have been receiving harrassing phone calls from Captial one despite many many attempts to get my number off their calling this. They call 3 and 4 times a day. I have never had a capital one card, done every want a captial one card and want to get this calls stopped. Any ideas what can be done.

Capital One failure to close credit card account

My account was paid off as requested by a Capital One supervisor who stated the pay off amount be more than due to cover any additional charges that might be presented over the 30 day account inactivity time required to close the account. The over pay ammount was to be refunded after the account was inactive for 30 days. After about fifty days I called Capital One to ask why the refund was not processed after the required 30 day account inactivity. They promply moved on sending the overage back to me and it was received within seven working days.
Guess what, the account remained open after I received the refund and a PC software bill that was not approved hit the account (around five days after receiving the refund). I was made aware of this when I recieved a billing statement from Capital One for the charges.
I called Capital One again and was routed to five different agents. The fourth agent advised me that
even after the refund the account had to be at a zero balance for another 30 days before it could be closed.
The fifth agent that I spoke with had to deal with transactions disputes against Capital One accounts. The agent stated that she had notice these transactions on other accounts and were being submitted by DRI PC Tool.Com [protected] MIN. This will take the dispute department 45 days to resolve.
Back at the ranch, Capital One failed to refund my over pay on the account after the inital 30 days the account was inactive, after the refund was shipped out the account was not closed and a transaction that was not approved was allowed to hit the account. This will require I start account close process all over again.
This company is evil and uses any excuse to keep the accounts open, potentially allowing unapproved transactions to hit accounts requested closed even when the consumer has gone above and beyond to pay account balances.
My credit card was cut up and discarded four months ago and the closing process started that long ago. I am not in the mood to continue to bang heads with this out of control financial institution of which the Federal Government has not gotten involved to audit. Where is the Attorney General of the United States that needs to weigh in on these lending institutios.
I bailed out of this card as their charges for services were to much and penalties came in from unknown areas including holding payement received until the following billing cycles in order to penalize the account holder. My interest rates increased without notification and when I closed the account an agent quickly asked if I would keep the account open she would authorize dropping account interest rate from 21.9% to 14.9%. I said no, I just want the account closed and asked if my account was good for them (regarding timely payments) why wasn't I automatically given the lower interest rate. This same agent was the one who worked with me on sending the overage on my last payment and never stated that the account had to be zero not over in order to close the account.
What a circus and at this point they can eat this account as I will not respond to any billing from them as I don't get paid to take time out of my day to be routed through the Capital One staff in order to be frustrated by their seemingly creative and negligent account management practices.

Contact Capital One throught [protected], you'll be transferred to India, as soon as they pick up a phone ask for a u.s representative or an account manager, and you'll be transferred to either an account manager in Richmond Virginia, New Brunswick Canada or Nova Scotia Canada. Half the people in customer relations in India don't even know what's going on half the time

capital one has done the same thing to us saying pay this amount and the account will be closed went throught our bank so that our bank would get the information direct the bank paid the settlement to capital one which then in return did not contact the bank to let them know that the settlement was not paid completely we were short apparently by 53 and some odd cents that was in july 07 now in july 08 we have been harrased by total ccredit recovery saying that they were going to take our home explained to kyle that this was paid he laughed to bad so sad and he is the manger and was ignorant to the bank also paid another settlement to capital one now account should be closed right NOT now we have been receiving harrasing calls from nco financial the principal here how many times can we allow the so called capitol one to say on the advertse in saying we are here for the customer i have been trying to get answers from the the account supervisory team at capitol one for answers to no avail this now has been going on since july 08 if anyone else in the world has been stung spit on and chomped down please do share we are greater in numbers the bull ### has to stop we are just the liitle guys here harrsement i do beleive is ellegal right please to forgive the spelling errors i am a little pissy right now looking forward in hearing from you

Capital One shifting due dates reulting in fees!

You know those Capital One commercials that end with a barbaric looking character asking “what’s in your wallet?” Well apparently pirates. Capital One is just like the rest of the credit card companies, and just like pirates they pillage. What’s worse is that they take from their good customers for no reason other then to line their own pockets.

Case and point, on the 29th of July, 2007 I reviewed my then current statement from Capital One. It said that for the prior month I had been charged a late fee of $29, and an over the limit fee of $29. To my amazement I realized that my due date had been moved up from the 10th, to the 7th for the month of May, and to the 1st for the current month June. I was technically late on the 7th for the May payment even though my payment to them posted before the 10th. Capital One charged the late fee, which put me over the limit. I was now liable for the over the limit fee, and charged as well. Like millions of people I make my payments about the same time every month especially now that I use on-line banking. During this period I realized that I would be late for that current month payment because the new due date was now the 1st (hmm). This meant that I would be charged a total of $89 in fees in two months.

To my surprise a Capital One representative called me on the 2nd to inform me that I was once again late (now by less than 24 hours). When I questioned him about the due dates moving he informed me that the company has the right to do so. I then asked him if I could request the due date to be changed back to the 10th. He said that this would require two billing periods, WHAT? It is important to note that in subsequent phone calls to Capital One two other representatives told me that Capital One does not move due dates. I said, “I have the statements indicating that your company did move the dates.” They offered to remove one late fee and the overdraft fee. I wanted no part of doing business with a company that behaves this way. I promptly paid-off the credit card and requested that the account be closed. Then things became even more disturbing.

About a month later I received a statement not confirming that my account was closed, but informing me that I owed yet again another fee of $29 plus finance charges that they could not clearly explain. By the time I finished dealing with Capital One on this matter they had tried to charge approximately $130 fees within three months. They reduced this amount by two late fees, but that is not the point.

We all know when we are truly late, but charging us fees by using deliberate tactics to make it difficult to pay on time is STEELING. Making it nearly impossible to close the account, and charging even more fees should be illegal. Auto lenders must give payoffs good for a few days at a guaranteed amount, and so should these credit card thieves.

I have been a Capitol One client for several years, I recently paid off a $4400 balance on a card with a $4900 limit so that I could use the card for everyday purchases and earn some points. I started using the card and recieved a call telling me that my credit limit had been reduced to $600. I have never missed a payment on any card and have a good credit score. I have utilized the card and paid it off at least two times. I am a high income user with a long record of responsible credit usage. I told them to cancel the card as a $600 limit is not of any value. I will not do business with thbis company in the future and advise others to do the same,

I have also, been ripped off by capital one.
I had been paying my card online. I also have insurance on the cards. I have been in the hospital and now I need the balances paid off. I have to do more then just prove I been in the hospital.

Also, I have been telling them to stop send my bills to my PO Box for a year and gave them my new address.
The last time I spoke with a customer service rep she said that capital one didn't have to send me a bill at all. They actually want your bills to come late and even when you pay early they will report that it came late and charge late fees.

CapitalOne is late posting my payments. I make electronic payments each month for all credit cards. Most credit card companies post payments on the same day that the money leaves my bank. CapitalOne takes 4 days to post. I am making payments twice a month and tracking this.

Once I have a diary of the late postings, I'll probably stop using the card.

This practice is most likely a VIOLATION of usury laws. However, most people cannot afford to fight these credit card companies for these kinds of violations and it is NOT in the best interest of any body of government to shut these critters down.

Enough people banding together with a savvy lawyer could probably generate a big enough "attention" to them and shut them down... brick by brick.

Capital One continuous "finance" charges after 8 months canceled card!

I have been getting bills after I cleared out my capital one credit card. Then, some strange $1.83 charge showed up and another bill was sent. Then, the next month, a $15 charge was on for finance. After I tried and tried to get a real human on the phone for days and days, to no avail, I finally pay the $16.83 bill only now to get my mail and get yet another $15 charge! I have not used this card in months. It is cut up. Will this ever end? What do I have to do to get rid of this horrible company? They are committing a crime by stealing from me. I don't want their services and will tell anyone I can that they are not the credit card that anyone should use. I am writing the Better Business Bureau and any other organization that will take my complaint.

FINALLY! Others have problems with capital one. I found out through there automated service that I had a multiple account, and someone in Canada opened an account using my SSN. When I called them they gave me numbers after numbers to call they got rudder and rudder then they started to hang up on me and play it off like it was nothing. I was told by one person that Canada and the US have similar SIN and SSN numbers...I don't know if this is true or how to find out but there not going to get anymore money from me...ever!

I am going thru the same problem in Ohio with Capital One. I had a low interest rate credit card for my business, and due to some unforeseen events I had to close the business. Capital One cancel the car without notification, then apparently starting charging late fees and over limit. I received no contact from them for about six months in 2009, suddenly the acct. that was 569.97 was blossomed into 996.14 by april 2010. Now they are taking me to court for $1, 2223 and change. Is there anyone out there who can help? Are there any class actions against them. The interest rate also went up to 29% without any notifications. I need help in resolving this issue immediately.

I have a 200.00 Capital One Mastercard. Got behind on all my bills due to unforseen crisis. Tried to work with all creditors. Only one would not do this. The little 200.00 Capital One Mastercard. Their very rude and unbeleivably arrogant telestaff sets the rules for resolution, with no room for barter When they do not prevail in their layed out plan, the repercussions come in the form of 1.telephone terrorism. By their own admission they are permitted by law to call 3x per day. They are caling me in excess of 10 times per day, often 3x in the space of as little as 10 minutes, anywhere from 7 AM to 10 PM, 7 days a week. Many of these calls come from numbers that show up as "unknown" on call display. I beleive they are breaking several laws right there.
2. sudden rapid escalation of total bill. My 241.00 bill mushrommed to over 600.00 in under 6 months. They are terrorizing me, and when I suggested that I was going to speak to a lawyer about this, the guy on the phone laughed, and said if I cannot pay a 200.00 credit card bill, then how am I planning on paying a lawyer! What an arrogant mouthpiece!
Also, invoices are not showing payments received. One payment in the past 6 months was 100.00, and has never shown up on any of their invoices as having been paid. They are blaming my bank. My bank says different. My bank gave me a receipt for the payment.
Are there any class actions against this company yet? It seems to me there should be. I know a lot of others with their own horror stories regarding this company.
I would advise anyone and everyone to steer clear of this company.

Don't stop until someone hears you. Negative publicity will eventually get you help. OF course, it will become someone else's problem, but they will finally leave you alone. Fight back!

Yes I know how you feel. We hat Capital One for 3 years. Suddenly they started to charge us overdraft. They claim we paid 1 Dollar less on the bill in August. I say B.S.
Now it is November and we are overdraft 198 Dollars, even though I tried to straighten this mess out ( know that they are lying) and they charge now late charges and overdraft charges every month 39 Dollars each charge, and still w/out results. I told them, that I wanted a detailed report about the charges stemming back to July.

So far nothing, matter of fact, that so called supervisor hung up on us.

Unfortunate, those are the big power full cooperations, that pay politicians, so they pass laws in their own favor at the expense of the customers. As long as this corrupted payoff to the politicians go on, the less chances we have, to get fair laws passed, that would protect us from those, conniving, bloodsucking thieves.

Capital One major rip off!

This company is a major ripoff. I just closed out two accounts with them and they were the only credit card company I paid off that I had to send extra money to pay off completely. I also paid off two Capital Ones and a Juniper card at the same time and they accepted the amount they had posted online, no phone calls needed to zero out my accounts.

Now, Orchard has credited my accounts and owes me money. One card they seem to have handled ok. The other card... well, they are trying to make me pay a month's interest and I called them today and Dave (real name of the guy I talked to there, no last name given even though I asked repeatedly) said they would refund my $19.32 interest payment. Thieves...

And it would take them 10 days to get me a check. Dave said they were not set up to put money back into my bank account only take money out of it. I did tell him I wanted 20% interest for the 10 days it would take them to get my money back to me. After all, my bank account earns interest although it's only chomp-change and that money could be earning interest instead of costing me money.

Orchard Bank is also the only one that delayed posting my payments for a couple days but not if you pay on a Friday and the payment is due on a Sunday. You will be late as they can only charge you a late fee on Sundays, not post any payments. I have personally called them each month for the last 6 months and had them remove the late fee. Which they did after I ranted at them.

Also, the payment must be paid online before 12pm est to be posted in 2 days or it will take 3 days to post. And as that wasn't true a few months ago, it must be a new rule to steal your money from you. And they also charge you to make a phone payment or a same day payment. Do not even try to mail in a payment, you are just asking for them to charge you a late fee and an interest rate increase.

They also are the only cards I had that were 25% and 30% which is double my capital one cards and triple my juniper interest rates. This rate change came about only after my cards were about maxed out. Gave me a BS story on it and told me they would lower it after a month with no activity, which turned out to be a major LIE!

Orchard bank cards are one big con job on the unsuspecting person as they change their rules to suit Orchard Bank and no one else. Grifters...

BANNKER CT.. Sounds like your Christmas bonus is coming from Orchard Bank! You get over yourself! Unless your one of the thieves (which is apparent) then you would be bothered by such actions. Working class is always targeted by crooks like you! Thanks Joanna for the info I had recently applied with Orchard thank god I hadn't mailed that paperwork in!

All companies have policies that you should familiarize yourself with. As for employees not giving a last name, get over yourself. There are way too many sick people out there..if you have someones last name you can find out where there live with a map and directions.

Orchard, I think you will find is owned by HSBC, they are true con artist, if your problem goes as usual, it has only just begun. Get a lawyer before it's too late. (Read the other posts about HSBC 21 pages).
