2011 I went to rand easter show where I was told about the holiday plan. The guy told me that I could sing a contract which will cost me around r4700.00 for a hear and I will qualify for a seven days holiday with about eight people in that year. I sighned the contract ut I was supprised when the document came they binded me for fiv e years. I refused to pay and discussed this with the consultant but they refused to listern to me saying that I only had 5 days to cansel the contract and then is was about 7 days. I did not want to be tied to that long commitment and now they are treathening me with legal action because I refuse to pay. I do not want this contract because I signed under false prretence. What can I do.

Wont cancel my membership
I bought into this in January 2013, never used any points they have given me. I realized that they have lot of hidden costs, wants to cancel because i cant afford, but they still wouldnt let me. Is there a law that allows them to treat consuners like that. What i want is for them to leave me alone, even if it means not refunding my money back, i want nothing to do with them anymore. Please help

contract declined - no refund yet..
I phoned in on 04 march 2013 to make a booking and i got feedback that my contract was declined . Since 5 DEC 2012 till now no one phone us to let us know that it was declined. When i asked them what about all the money we paid them on the 5 DEC 2012 they said they will get back to me. I am trying now for 2 weeks to get a answer about my money and still no one can help me. This is not acceptable i am taking this to SA Carte Blanch if no one can help me before 19 march 2013.

contract cancellation declined
I have been trying to cancel my membership with this Club for over 2 years now. I get to be told about conditions on which they can cancel my membership which are just impossible to meet. I do not think it is fair that any company is allowed to force consumers into buying a product even if they are no longer interested. Checking on the internet I got to realise that there have been people trying to cancel their contrats from 2006. If you dont pay, you get listed on the Credit Bureau whcih everyone wants to avoid. How can a company be allowed to operate like that? This is unfair consumer practice. I started paying R500 in 2007 and now I pay almost R1500. My priorities have changed, I need to cancel my membership, let alone the pathetic service I get from the Club. Please goiogle complaints about this Club and stop it. Even with a house bond, tehre are options to cancel the contract how much more for a holiday club? Please help. Membership number 110765

I had a contract at flexi club which I realy did not want, I was actualy being forced in this thing. But my stupidness I signed up and I know that I cant afford this. I was retrenched almost 4yrs ago, and I paid flexi club r11000, in january 2009 and I told them that I dont want to go any further and they must cancelled it. Up till now the balance r8000. Again. I received an email this morning from attorneys that if I dont pay the money, they will send me a summons. I phoned them and ask them what I must do. Cause I dont work, and sickly with heart and diabetic problems. At the moment my water is also been cut. What can I do, cause the lady that I spoke to said I have to pay the money in 48 hours then they can cancel it. Please help.

Am a member of flexiclub since 1999; wanted out in 2008 & failed since then. Was paid up member but now in arrears of r40000 + judgement against me! Have offered to give them back their shares for free & pay them whatever I owe... Terrible that an unemployed man is treated this way. Ruining my chances by blacklisting me is the last straw for me in this game.

i was called to come and collect my free prize...i asked them do i need to sign up for anything they assured me no.i got there a lady named joy told me and my wife we just have to sit in a seminar with her real quick.she told us about the holiday access and we never have to pay any money cause we will receive points.she told us if we wanted to cancel we could do so within 5 days.on the 2nd day of signing the contract we contacted her.she told us she would get back to us regarding the papers and the address and number we can email or phone.she never got back to us.she ignored all my calls and sms and now im sitting with debt that i dont need and i was surely in my right of cancelling period.this woman lied to us and ignored us after the 1st call.they calling me all the time wanting there moneys but no one can do anything about this woman who conned me.i have emailed all the addresses and no one replies the only time i hear from them is when they want there money.everybody is just ignoring the fact that i tried to cancel within 5 days.

Cancellation - a frustrating struggle
My husband signed up with flexi club in 2001. during our neeting with the flexi club broker, we were told that we could cancel our membership at any time. we signed a cheque for R11, 000 as we were told that it was the purchase amount and each year we would be charged a once off renewal fee. in 2002 I phoned flexi club and told them that we wish to cancel our contract. i was told to fax them a letter requesting cancellation - which i did. i phoned again a week later. the consultant said that the letter would be presented at the board of trustees meeting to confirm ou cancellation which we would receive in writting. after a month with no response i called again, only to be told that we have to belong as a member for 3 years before cancellation. in 2007 we drove up to Durban from east london to flexi club offices. my husband got extremely worked up, the manager then brought us a cancellation form to sign. we asked for a copy, they said that their photocopier was not working and assured us that the contract was cancelled and a copy of the cancellation form would be mailed to us. in the interim they gave us free entry tickets to ushaka marine world. after 2 weeks we contacted them again to enquire about the copy of our cancellation form. The consultant said there was no record of any cancellation and the only way to cancel would be to sell ourshares or upon the death of a member. we have handed the matter over to our attorney who now says that the only way to cancel the contract/membership is to pay R23, 530 by the end of October 2012 and if we don't they will be adding next years fees on and we will continue as members. i am sick to death of flexi club. there has to be a way to fight these 'THIEVES". You have to feel sorry for people like that - they simply have no feelings and their world revolves around bitterness and money - SHAME On THEm!

Cancellation of contract

I signed up with flexiclub in January 2012. I had so much hardship making a booking the first time that I decided to cancel. I haven't to date utilise any of their services and they refuse to cancel. Firstly, we were not made mention of a 5 day cooling period, niether does our agreement mention it, so that should be taken as null and void, and secondly, you are only allowed to utilise there service after you receive a membership number, which takes 4 to 6 weeks, so how can they expect people to cancel in 5 days, when they haven't used the service yet and seen how crappy it is. If I had used the service the very next day of signing up, I would've cancelled same day, however they do not make it possible to do that, Please guys DO NOT be fooled by these people, I am going to get our local newspaper to do an article about this, because there are alot of people in my community who have signed with them and I would like to warn them. Nobody bothers to call you back, I am stil waiting for cancellation and I will make sure these people do not take anymore money from me!

I have been a member for a number of years, but do not reside in south Africa anymore and therefore have no need for the product anymore. My family have left the country with me and I can therefore not transfer the product to them either. I have requested that the product be cancelled. My product has been fully paid for 2009 - I didn't even use my last benefits because we had left. They have refused my cancellation and relied on this clause: We draw your attention to the Certificate of Purchase, Point 16 which states:
"I understand that this application is subject to approval by the Club and Vacation Properties and that should I wish to alter or withdraw this application, I should do so by giving written notice to the Club and Vacation Properties within 5 (FIVE) working days..."
and "we refer you to point 12 on the Certificate of Purchase which clearly states:
"I understand that points purchased are an investment in future holidays and are not primarily purchased for capital gain on resale".
This is unacceptable since I am not stopping membership after a short term OR because I want to achieve some form of capital gain.
Flexi club have not responded to these questions:
1. The portion of my contract that states that I may not cease to be a member (AT ALL ANYRTIME IN THE FUTURE). The 5 day period refers to a cooling off period. Does the contract indicate anywhere that you will go on paying for something and being part of an everlasting deal. No deal can be so set in stone. We (our family) moved out of South Africa on 31 March 2009 and now have Permanent Residency Status in Australia. I have no need for the product, at all. We did not realize we were going to leave and that was why I paid my 2009 usercharges in advance so that we could actually utilize our points. That didn’t materialize and we practically could not use our points. No or in future. EVER
2. The section in my contract that explains in what way I have not already had the benefit of an investment in future holidays (ie when do you regard my expenses and use of the points to actually be an investment)
The fact that when making bookings the charges have been considerably lower through my membership with the Club as opposed to if you had to make bookings through private concerns is irrelevant to my request to cancel. One takes out membership of the points-system holidays to obtain the benefit of the booking, variety, convenience and obviously costs.
They stated that membership is an investment in future holidays and implying that that was a reason why I may NOT stop membership in the short term. Initially we were members of Magic Breakaways which was later taken over by Flexi Club. So we’ve had the benefit for more than 10 years now and I believe that we had a considerable “investment in future holidays” and yes we did use our points a number of times. Please explain how we have not already had the benefit of an investment in future holidays ? and why that means we cannot cancel our membership?
If the point are so valuable why dont they but them back? I dont want to make a profit. What happened to market value?
3. The section in my contract where it explains how/when in my case I primarily purchased (Flexiclub) for capital gain or resale".
They merely referred me to the previous correspondence and the section in the contract, ie "I understand that points purchased are an investment in future holidays and are not primarily purchased for capital gain on resale" as many members are of the impression that they can sell their memberships for capital gain.
Again, I believe that we have NOT diverted from that in any way. (See my question in 2.) We are not wanting to sell for capital gain. The fact that we have been using our points and are fully paid for 2009 and have credit available is proof of that. We don’t have a choice now

Bad service
I bought my timeshare in 1998 and use it once. When it is time for booking there never is accommodation available. Ever year I have to pay my fees whether I use it or not. They do not have enough points for their system. They make lots off money from their users. Help me to get rid off this moneymaking scheme. Look at their web-page.
My husband and I purchased our time share in 1995 we only use our time share while travelling abroad. For the past 5 weeks we have tried desperately to get accomodation in the UK for the end of September, , 2012 Carlo the international reservation agent in Durban, South Africa will not return our phone calls, will not answer our phone calls, when he does speak with us it is a run around! as the UK has 1000+ units in the UK we are told that Flexiclub cannot get us any bookings, I took it upon myself to do my own research. I have found several RCI units which are affiliated with Flexiclub (as I understand their are 5 differnt timeshare companies that work with Flexiclub in the UK) in the UK that have accomodation at the time we require, , and is available! The other international reservation rep whom is female basically told me that they could do nothing for us, we had to take what we could get! in a very rude manner, so I ask you, why are we as Flexiclub's clients being subjected to such inadeqate service, rudeness and hostility? Are we not the reason why these people have a job? Doesn't Flexiclub rely on us the "Client" to keep their company going? I am extremely disgusted with the International Reservation Agents in Durban for the abusive way that my husband and I have been treated! and I feel as though their jobs should be under threat! Reversal of early payment discount
I paid my full membership contribution on October 1, 2011. there was an early settlement discount. This is apparently only if a debit order is signed. I have however for the past number of years settled my account early and in full, yet I am penalized and do not qualify for the discount. At first the discount was allowed and then three months later reversed and I received an sms warning me that I will be penalized if I did not pay the reversed charges. Is this lawful in terms of the consumer protection act?

Changing of name on contract
I have been told one thing over the phone and received different stuff by mail, this is a legal matter and nobody seems interrested in getting the right thing done. Ashley Pillay has been trying bet the people in Cape Town is so slack that I am now writing to TISA to see if they want to help. My ex-wife and I have had these points for 47 years and it's been HELL all the way. Is there anyone that can wake up the people in the Cape Town area.PLEEEEEEASE!
No way out!!
Have tried to cancel my membership twice with no success. Last time was aug 2011. Declined and told to pay r5688.16 for 2012 levy and resubmitt application between jan and 1 may 2012 for it to be reviwed. No job, poor health no go. This is not acceptable.

Hi Everyone who is interested!
I am in that boat of being abused by Flexi club myself. i have howver spoken to a lawer friend who trapped herself into timeshare about two years ago, after paying up her debt of the points, she was still obligated to pay the annual resort refurbishment charges which continuouly rise. My cousin just stopped paying the annual fees and they have - as they threatened - listed her on ITC, with description as "Slow payer". She didn't mind this "label" because when she purchased a vehicle and took out a personal loan at a bank one year later, they approved her credit. Even though she was listed, they said everyone knows of this timeshare scam so it doesn't count against you getting credit. So i am doing just that! i am not going to pay my 2012 fees and every other year after that! TO HELL WITH FLEXI CLUB! And i think we should all use this approach and they WILL LOSE MILLIONS AND GO BANKRUPT!

I find it disgusting that you can prey on people like this. I have just discovered that one of my staff members, a labour, has signed up with Flexi Club and was told he will start paying in January 2012. His dream was to holiday with his family. Flexi Club painted the perfect picture for him and in desperation he jumped at the opportunity to fulfil his dreams not fully understanding the implications and financial commitment required. He has now been informed that he is liable for fees. I feel that he has been a victim of a company trying to make a quick buk at any means or cost necessary! As a consumer I feel he will be protected under the consumer protection act.
"The Consumer Protection Act permits a consumer to cancel fixed-terms agreements at any time prior to expiry, by giving the supplier 20 business days' notice of such cancellation. Consumers must give notice to the supplier in writing or in any other recorded manner". Is Flexi Club above the law? I don't think so.
I think it is disgusting that Flexi Club is allowed to continue in this manner and his contract should be cancelled immediately.

Never venue open for booking
We have been so annoyed with Flexi club. The do not keep there end of the bargain but when it come to us paying it’s never a problem. From Feb 2010 we have been phoning them for holiday bookings and they never have any openings for us. Every body in South Africa is on holiday it seems. We don’t even specify lately because we will take whatever open. Today they send us a sms to state that we will lose our points and we must make booking asap. We phoned them to make booking just to be remained again that there is no openings in any venue is Gauteng, We asked them when will there be openings and the call assistant said Jun/Jul 2012, buy that time our points will be lost. We phoned The account service nr and stated our problem, Bernette (call centre lady)told me that there is no way she can help me, and that’s the way it is! She stated as well that Flexi club is doing us a favour by keeping our points for us for 2 years!yes the two years we have been trying to make n booking. If we can’t even get a open venue in two years way are they still selling contracts to people if they can’t accommodate us that have been members for 6 years!
False information
goeiedag ons het dieselfde oorgekom soos petra zulch kevin het my gekontak ons punte verval 7 feb 2012 en kan dit nie oordra na di evolgende jaar dit is nie wat aan ons meegedeel was die dag roe ons aansluit nie. die t & c was aan ons verduidelik daar is geen xtgra gelde betrokke behalwe die 490nwat maandeliks betaalbaar is nou nou moet ons hoor dit is membership fooie en nie ons vakansie wat ons afbetaal nie - Annalise was ook geensisn vriendelik nie ons het nou reeds 7 maande betaal en ook die once off fee van seker R2000, 00 net om uit te vind ons 'huur' die punte en moet nogsteeds die volle bedrag betaal - waarvoor betaal ons dan die heeltyd dit is mos nie hoe timeshare werk nie - ons soek ons gelde terugwerkend terug. die bestuurder en agent het hierdie inligting verskaf en nou vertel die reservation en member info ons het nie die t & c gelees nie maar dit was vir ons voorgele en gese dit wat verduidelik was moet ons net by teken ook was daar gese van 'travel arrangements' wat ook deel uitmaak wat ook glad nie so is by verdere navrae met Kevin - nou vra ek wat staan my te doen ons weier om voort te gaan met hierdie kontrak want dit is 'useless' die gelde kan ons beter aanwend.

Forcefing to join
I was basically forced to join this "scheme" even though I was not interested. I went to a hotel supposedly to collect a prize (holiday) I supposedly had won. I was assured by the lady (telephonically) that I will not be required to purchase anything and that she would be there with my holiday voucher. This was totally not the case and this is nothing short of a scam. I am continually being harrased at work, telephonically, and have told them countless times that I am cancelling. They do not wish to hear this so I will be taking them to court as well as with the consumer protection act.
That is exactly what happened to me as well.
I tried cancelling that first month and was told that I could not afford it, as I told them when I supposedly went to collect my "prize" of a free holiday that I had one. The woman who made all the promises was never even there to meet me with the voucher. At no time was it even given to me. We seriously need to take a stance against them. They harass me continuously at work and at home.

We are in the same boat and so much wish we could pull them down together! Third Degree and the Government have to intervene in cases like these! It is like putting money in a bag with a very big hole which will in the end you will never be able to fill!

First of all I want to voice my disgust with Flexi Club consultants who go out and do presentations to potential customers on false premises. I'm one of those people who has become a victim of such misleading information. In December 2010, I was called by a consultant of Flexi Club. She used the Port Owen premises and gave me a business card from another consultant - Winnie Nel. But the lady who presented the special to us gave her email address: iqrah.[protected]@yahoo.com Needless to say that I don't get any response on this email address.
She scheduled a meeting with myself and my husband on a Sunday during our holiday at Port Owen. She told us that flexi club is running a special package for valuable customers (as we already belong to Flexi Club and already own points) So therefore we qualify for this perceived special, we were required to pay what was said to be a once of fee of R 3863 and a service fee of R1660 (annually) less R600 discount for members who pay via debit order. So we signed a debit order form for this annual fees of R1060. She told us that the other figures reflected on the contract were not part of the special, therefore they will not have any bearing on the deal, but the form they use was just a standard form.
In March I got a call from one of the consultants asking for a payment of R171.00 that was still due, I then question the amounts that she was referring to. She told me that this was a short payment of what we paid that day. I have asked her to send me a statement and bank details so that I can sort this out.
The next month they called me again about a monthly payment of R2890 that did not go through per debit order. I told her that I don't know about any further costs and I surely don't know about this R2890.00. She told me that this is a monthly payment for 11 months as per the contract we signed. I told her that we did not sign for any additional costs, as we were told by Iqrah Solomons we only had to pay a once of payment of R3863 and for the next year Flexi club will use our points as the need points for other members. By doing this our account will be credited. Also with this special we will receive 4 free weekend away holidays as she has to give them away. This we haven't received either !
When I checked my bank statements I saw that there have been two deductions from Flexi Club in April'11. One of R3263 and another R2890.00. In May one of the ladies phoned me again and I told her that I am still waiting for a copy of that contract and the signed debit order where we agreed to pay R2890.00 for 11 months, because I know we haven't signed for any of these amounts. I informed her of my intention to cancel and she told me it cant be done. They will summons me and I have to go to court to state my case.
For May I have stopped the debit order and emailed Iqrah Solomons to contact me and explain to me why she sold us a special with a once off fee, if this was actually false information and illegal. But I have not received any reply from her, so I believe the email address she gave me was also false. All I have is a business card of Winnie Nel from Port Owen, where the deal was done.
I want to know why Flexi Club send consultants to use false premises and give false information to people and when we query this, no one is able to assist and sort this out.
I request that this false contract must be cancelled and the two debit orders in April taken out of my account must be refunded. And I still request a copy of the signed contracts and debit orders where it states that we will have to pay another R31 790, after we were told we only have to pay a once off fee of R3863.oo. I will take this to court if I needed be.

I informed her of my intention to cancel and she told me it cant be done. They will summons me and I have to go to court to state my case.
For May I have stopped the debit order and emailed Iqrah Solomons to contact me and explain to me why she sold us a special with a once off fee, if this was actually false information and illegal. But I have not received any reply from her, so I believe the email address she gave me was also false. All I have is a business card of Winnie Nel from Port Owen, where the deal was done.
I want to know why Flexi Club send consultants to use false premises and give false information to people and when we query this, no one is able to assist and sort this out.
I request that this false contract must be cancelled and the two debit orders in April taken out of my account must be refunded. And I still request a copy of the signed contracts and debit orders where it states that we will have to pay another R31 790, after we were told we only have to pay a once off fee of R3863.oo. I will take this to court if I needed be.
Winnie Nel, sorry to involve you in this, but your office and business card was used for this illegal sale.

Mine is only R11400 worth but we have to pay R4000 a year levy we have this crap for 12 years paid in thousands and never was able to have a holiday at the time when we needed to only to be told we have to invest in more points we pay more levy than what people pay for a house, we tried ITRA they want us to pay more money just to sell and get rid of it and we are pensioners.Flexi deducted every month from my account now that they need my permission to continue they are taking me to court for 2011 balance of R2, 2 22 to court the letter i got from the lawyer is this they were instructed me to pay the balance and was instructed to cancel the club, I dont mind the canceling but i am not paying a cent more .we are in court in this month of November.I have had so much stress my health deteriorated, i have hypertention because of Flexi club.Leisure club has many names, my friend bought into holland moorehouse for more than R30, 000 stress has killed both my friends now there children has this legacy they never went on any of these holidays.Flexi took over holland moorehouse and the story goes on.thank you estelle and ben +[protected]
I is a shame
We have been sucked into the same few years ago and were chasing flexi Club for a way of exit for more than 3 years of ongoing request pleadings for assistance in termination of this agreement. For sure no luck and no feedback from Flexi Club but one thing, more money more and always more, Flexi Club is about sucking funds of individuals dressed up by con holiday makeup. Number of time they even deny / ignore the receipt of payment we made and demand the same amount again under treat of summons repeatedly day after day with treats.
To summaries it we decided to put end to it by advising Flexi club that we done with them and can’t pay them any longer and on top of it we demanding a termination of this contract immediately, we know that we will get no positive reply from them and in fact we been summoned to court by them for refusing to pay the levy this year (we paid only a deposit of R2000-00 and stopped at that). Now that’s where we heading.
We need more court cases and more expose into the media with regards to Flexi Club and my advice to you all is get together (I’m willing to join too) and fight them to the ground.
Flexi club is unlawful organisation of con artist (clever one) that operate like it because of bed legislation in South Africa and because they can and allowed to.
The terms and condition that Flexi Club structured are devious and the public that get sucked into it are all victims, so as we.

I had a similar experience with flexiclub. Also misrepresentation. Never was I told that I could cancel within 5 days. We were coerced into signing the purchase document on the same day as trhe presentation without fully understanding or reading the document. I also discovered later on that not all amounts were filled in on the purchase document in our presence. I've had contact with several people from flexiclub and finally with one Sherome who is suppose to be the customer relations officer, but they all sing the same tune. As far as I'm concerned this is business being done in bad faith. Their attitude is also devious as it gives one the impression that you were caught by them and you have nowhere to run . They are not prepared to discuss and consider each case on its merits.
Cannot get out of contract
I have been a Flexiclub-member for the past 12 years, but my situation has changed, so I cannot afford the holidays / annual fees anymore. All I want to do now is to cancel my membership, but they keep telling me that I cannot because I have signed a contract. I have asked several times for a copy of the signed contract so that I can take it to my lawyer, but received nothing yet. They want me to sell the points to someone else, but I do not want to "dump" someone else in the Flexiclub mess! ! I am using my children's school fee money now to pay for Flexiclub, and just want to make sure that once I have paid the outstanding R1500 for 2011's fees I can cancell the contract!
