Gmac is the worst of the 8 different loan co. I've had. Their different depts. Don't seem to communicate between them. It's taken months for them to fix my acct. As per closing statement in my loan docs and4mnts in acct. Is still not right! When you call, long long wait times to talk to people who are hard to understand and english is not a first language. Really bad service!
My horror story with GMAC began last night when I opened my mortgage statement and discovered I was past due. Why? Well, apparently GMAC doesn't know how to process cashiers checks. I sent GMAC a cashier's check. They posted it then reversed it claiming the bank wasn't able to draft it. Their so- called Customer Care, what a joke, a horrible joke. All they're programmed to say is "yes, maam", "no, maam". They couldn't explain anything, they couldn't find the check, they don't know where and who they returned it to. They pretend they have managers and supervisors. All they do is put you on hold for 10 minutes, talk to their other inept friends, come back to the phone, ask you the same questions again, pretend they're checking something on the computer, put you on hold, claim they're looking for a manager, put you on hold, tell you the computers are down, put you on hold, and then after about 30 minutes of this they basically never answer your questions. The reality is there ARE NO supervisors or managers, they will never connect you to one, and your questions will never get answered. You call back, you start over with the whole story. I had to miss an entire day of work and my issue is still not resolved. The president of this company should be fired. GMAC is the worst mortgage company out there.
I have had a dietec.com/gmac mortgage for years. Several months ago, I received an urgent phone message "about my account". The phone number left was for the foreclosure line and the only options were if I was already in foreclosure and if I wanted to stop foreclosure. I NEVER missed a payment on my house!
It took me 3 phone calls and almost a half an hour to speak to a live person. By the time I got to her, my blood pressure was through the roof (I am disabled) and I was furious. Know why they called? To tell me my payment was going down $12 a month!
I told her (in VERY clear terms) that gmac was never to call me again. But – ever single month now I get phone calls from the foreclosure line for at least 7 solid days. I have already filed against them in court for harassment.
BEWARE! NEVER do business with dietech.com or gmac - they will make you crazy!
I hate GMAC Mortgage with a passion!
I refinanced my home with them in 2003. Locked in a rate, and I should have seen it coming when I began the process with Them in Nov 2002, and didn't close till June 2003. At the time my refi amount was slightly over 80% like 83% of my appraisal so I was informed I needed PMI. Initially they gave me a figure over $300 per month, and I told them no way. Then they came back with another figure slightly over $200 and again I said no. The third time they told me $94.00 and since I was so close to have 80% LTV that I would not have to pay PMI for very long. I locked in at 6.5% with a timely payments rider to reduce my rate 1% after 24 months of on time payments. This has to be achieved within the first 4 years of the loan and will be applied on the Anniversary date following the 24 ontime payments.
We were feeling pretty good at first. Our first payment / Anniversary date was Aug 1st 2003 and in Nov 2003 we enrolled in the Bi-Saver program that automatically withdraws half you monthly balance every two weeks. Cost over $300 to set up, and had to be one payment ahead to start. Now No hassles having to send in payments AAHH or so we thought. In Jan of 2004, I started medical treatments for a illness I had which was going to run for a year. The treatments were once a week and make you really sick for the next 3-4 days following.
I started missing some work but nothing too serious, and we were still able to meet our financial obligations but it was tight! Late Feb, 2004 I received my escrow analysis and found out I was going to be charged an additional $480 per month for prior years escrow shortage. After an hour of researching this I found that Instead of paying $94.08 per month for PMI I was Paying Nearly $350. My monthly escrow amount at the start was $9.00 more than the amount I was paying for PMI. So not only did I have a serious negative balance for 2003, the additional charge for PMI was added to 2004. I contacted GMAC Straight away and explained my situation.
The first associate I spoke with was the first and only good customer care associate I would speak to. He pulled up my account and was even able to review my closing papers and contract and agreed that I was being over charged. Long story short, we had to cancel our bi-saver program because they automatically started taking the new higher amount out. I told them I had no problem paying my current monthly payments but the additional $500 was not in our budget. Their response was I needed to continue paying the incorrect amount till they completed their investigation and corrected the mistake. I told them I would only send them the agreed amount at closing and they could sort the rest since it really was an escrow account. They told me they would only accept the full amount and would not take my so-called partial payments. This added stress had adverse affects on my treatments and I only got sicker. We fell behind, not being able to pay the high amount. Fees in excess of $900 were added to my account. It took over six months to fix the problem. I used our tax return to pay the first two months we fell behind and they threatened foreclosure, then I had to take out a Hardship withdraw to pay the next couple months that we were not able to make the full payment.
Even after the issue was resolved it took till Jan 2005 to get back on track. They refunded $500 to me! But at that point the damage was done. Both our vehicles were repossessed one that was financed thru GMAC Auto/ how funny that actually we payed current the weekend they reposed it but then told us we needed to come up with the entire balance owed to get the vehicle back! We had to file bankruptcy, which was disolved July 2005. The only account we reaffirmed was our mortgage! Oh and I failed to mention I am the sole bread winner for my family which we have SIX children, our middle daughter is perminantly handicapped and was diagnosed with Cerebral Palsy when she was one. She is ten now and doing good and loves school.
Back to GMAC Scam, Though we reaffirmed our Mortgage, and were both driving $500 beaters with heaters (what a humbling experience) GMAC Began reporting our loan in default on my credit report. Even up till April of this year when we had 26 months of ontime payments they were reporting my account in foreclosure. Every time I called to get it fixed I was told the same thing that I didn't reaffirm and that was how they handled that. Even though we managed to recover from the first blow, and make our payments on time it wasn't being reported as such. Infact they stopped reporting my monthly payments in April of 2005 so it showed no current payment history but a Balance and noted in foreclosure. After countless phone calls and denials from other lenders for auto and home, not so much for the bankruptcy but directly because of the inaccurate reporting they were doing on my credit report. I would dispute it and they would dig in and say they were reporting it correctly.
I think we got that under control now but I have PMI of $94 per month which we are almost at 75% ltv now according to our refinanced home value but they will not remove it. And my 1% rate reduction which should have taken affect for Aug 1st 2007 hasn't been adjusted. In fact my OCT 1st payment will be credited to my account the beginning of next week so I will have made three payments at that point paying just over $200.00 more than I should be.
Of course I have been in contact with them since July, because I figured I would have received some letter about the reduction prior to the Aug 1st date but was told in very broken english I must wait till Aug to see if it was adjusted. And once again I qualify for the reduction, no questions about that. I am being told to continue paying the billed amount until they complete their investigation into my account and my closing documents, even though they can pull them up on their computer and view them as they speak to me.
What a joke, and I am sure there are hundreds if not thousands of others out there with similar if not worse stories. I am seriously going to investigate my rights to see if I have any legal rights to file a lawsuit against them. If I can, I will so do all I can to make it happen!
Let me tell you my store!
Where do i begin!
Let see GMAC auto repo my car back in feb of 07. Yes, i was behind but i made arrangement with Jennifer. They stated that they received my payment a day late. The reason why they received my payment a day late, because of Columbus day. WHICH NO MAIL RUNS THAT DAY! Tried explaining that to the stupid people and they just didn't get it. Now mind you this is the first time in 3 years that i was ever, ever late on this car.
So i called and called GMAC to find out how and where could i pick up my car. I was told the first time frankie the guy handling my account would call me back.. I waited 4 hours without a call back. I called again looking for Frankie and they transfer me to his voice mail. Left a message waited 2 hours and called back to get a manager (mark) who was a complete JERK! Told me that i need 1500 to get the car back. I was like where is the 700.00 that i just sent you. I don't have that kind of money. My husband was just called back from being laid off for a year. I have spent everything that i have. He really didn't give two dead fly about me.
So i asked again where is the 700.00 that i sent to you.. He states that he mailed it back the day the received it. By then i was pissed and i just wanted my car back. He told me that i needed to western union the money and they would tell me where to get my car. After i western union he told me where i could go and get it.
I called the nice repo man ( can you believe that) he gave me the address. However my vehicle was not there. GMAC called and had them send my vehicle to the auction place. The repo man states that he never had a company call the next day to send the vehicle away. I end up getting my car back but it doesn't stop there...
Months later, after trying to play catch up i file for chapter 7. I sent in all of my reaffirm papers. Everyone received theirs EXCEPT GMAC. As soon as it was discharged they start calling demanding full payment. My question was what are you talking about. I sent in reaffirm paper. The rude and nasty lady told me they didn't get them. I told her i had the confirmation fax and she was like so. We don't have them we want full payment or we come and get the vehicle. So after talking to my attorney we filed a motion to reopen the chapter 7. We are waiting for the judge to sign and GMAC is looking for my car. I talk to Mark tonight and he basically to me that he is going to sue me for the car. I asked him for the attorney name so i can give it to my attorney and he said he didn't know whom he was going to use. So i told him don't call me again talk to my attorney. I wish i could see them.
Don't ever get a car loan with them! I really hate this company
I have a similar experience with J. Wagstaff. I have automatic loan payments set up with GMAC so I never miss a payment but GMAC constantly calls me and urge me to contact their foreclosure department, and when I call that department they would tell me they have no idea why. More recently, the phone recordings have been slightly less vague in that it informed me of "opportunities to cut my rates" if I call GMAC. Most likely this is referring to the scam which asks you to pay semi-monthly so you can pay off your debt quicker, with the catch being a service charge of hundreds of dollars when I can just pay more monthly to get the same result, for free.
In any case, I have signed up for the Federal Do Not Call list for years now and I believe what GMAC is doing is actually illegal. The FTC just cracked down on some companies and they were punished for millions for tactics which GMAC is employing now.
OH MY GOSH is what I have to say about the complaints I am reading. I thought I was the only one going through a HUGE nightmare with GMAC. They have the worst customer service in the world. Each department doesn't handle whatever it is you need to know, they tell you to contact "such and such" that they handle my account. I get transfered, and guess what ? They tell me the SAME thing, they don't handle my account I need to talk to "so and so". Okay long sorry short. I was short my mortgage payment in July of 07. I called GMAC, they wouldn't accept the payment of $200 less, I was told to call back in a couple of weeks with a one month payment and at that point they would figure out a payment plan. to help me after I had explained my Financial Crisis,. I get the full amount, call back, they refuse my payment and also tell me not to mail it in either because they will just return the check to me, so save a stamp.
The reason they wouldn't take the payment was due to another month added on that I owed and late charges, wow they are completely out of it I tell you. This back and forth went on and on, me calling them every day trying to make payments, work out a plan. I was lied to, transfered here and there, told to call back, told I would get a call back. This is still not resolved after 5 months, going on 6 months, last month I called and had saved $3500 to pay them, again I was refused, I actually needed $3996 in order to save my account and house. He told me I had 5 days to come up with that amount and if not my house was going to foreclosure, 2 days later I call with that exact amount I was told to get. Spoke to someone else (of course) they said there were no note in the computer regarding this 5 day thing I was told to avoid foreclosure, she was very rude, continually cutting me off, I was so upset, (by the way I am on permanent disability and have been for the past 5 years with mental issues). They know that, I had told them because I am on a limited income and the reason for the financial hardship was my husband, who is a flooring contractor has no work what so ever.
She then told me that my house went into foreclosure the previous day, it was on it way to they're attorneys (she wouldn't give me they're name and numbers) they were going to contact me to discuss if I could save my house, she kept rubbing in my face all the fees I would have to pay since it went to they're attorneys. I was so discussed with GMAC.. MORE disappointed that anything, I call evenings and the Philippines answers the calls. SO in my opinion GMAC is having money troubles. I read they are laying of a tons of workers, they sold 51% of the company to GM Motors. Too many of everyones stories are similar, Are the employees trained to repeat themselves and transfer calls? I mean come on now.
Okay so I find out after more calls my house was NOT in foreclosure. Oh and also I had a friend look up my house with a password I couldn't look up, hes an appraiser, my house is in a different lenders name, it looks like they sold my house, I have not a clue they didnt tell me.
Oh and to make this all the better, I have 2 vehicles with GMAC, they were illegally reposed on September 11th 07, I have been wiring them the money to keep up the payments. I go the run around with that too. I just found out where my cars are. Can you believe this? I was having a breakdownю
Anyone want to do something about this LET ME KNOW PLEASE!
If GMAC is going to outsource at least they should go to a Country where they speak very good English.
The Representatives that they have in Asia especially in Philippines are the worst representatives in the world.
I am in total agreeableness with everyone here about GMAC. They stole my cars, they are complete professional game players. I think that's the training the employees receive. "How to deceive all our customers, give them the run around for as long as needed until they give up or give in".
THEY SUCK and need to be stopped. Every person I have spoke to has worked there a few weeks or less, they have a big turn around it seems. And the Philipine's? I don't believe they were even trained. I think they have all our numbers and names, randomly call and repeat themselves. No matter what you ask or say they will repeat themselves over and over, never hang up on you like the US employees. I am telling you PLEASE EMAIL ME IF YOU WANT TO DO SOMETHING ABOUT THIS! I need people , the more we are the more power we have... Come on, this is what they want, for you to complain on a board then go about your day. NO! We need to go further... It will be worth it in the end. I know this... Please email me!
My car was repossessed by GMAC on the 16th of December. I called the following Monday, the 17th, and was told to wait 24 hrs for a quote. I called Tuesday and was told to call back later in the afternoon. I got a quote. I Western Union'ed the money to them on the 20th for what they quoted, I was told there was nothing I could do until I received a redemption code. I waited 48 hours until the following Monday. I called at noon and was told since I did not call them back with payment information on Thursday I owed an additional $81.00 and it would be again 48 hours until I receive my redemption code. On Thursday I called and was told my car was in auction in Houston, I live in Austin (250 miles away). They have full payment for what was owed on my car plus all the fees. Plus, I have to go to Houston to pick the car. Still, they have not given me the redemption code. It is now 72 hours and I'm told that there could be additional fees for the garage in Houston. This is a crime. Is there a way to break through this impasse?
GMAC is the single worst provider of customer service on the planet. Even more so than the phone or cable company. I just received a refund for an escrow "overpayment." I did the math and saw they are wrong so I called them. I have been on the phone for hours. They usually put me on hold, this lasts for 20-30 minutes and then the phone disconnects. Trying to explain their error I show them my insurance costs have risen so they should be charging me more. They tell me I am wrong. I try to go through it line by line w/ them but I can tell they have no information on their end. I do not believe they could help me if they wantedto so they just put me on hold til the call is disconnected. Doesn't seem like a big deal? Read some of the other posts on this site. What will happen is they will bill me for the shortage. If you do not have it they will loan you the money within your original loan. This equals an incresed amount of interest for them. Many people will see a check like this as a god send and spend it. So when the bill arrives for GMAC's mistake, they will then be obligated to 'borrow' to pay it. If GMAC does this several thousand times imagine the windfall they could receive in additional interest. Times are tight so this is a very easy scam. The idea that no one is watching the wolf here is disturbing. My mortgage company literally refuses to help me on a mistake with my account. I am in good faith trying to head off a problem due totheir mistake and they don't even want to talk to me.
I wasn't shocked to see all the complaints about GMAC. I have made every payment of my mortgage on time or early and yet they found a way to say I was past due on my account. Apparently you can't split you payment and send 2 checks. WHAT THE He! Hey genius's at GMAC you are getting paid in full, ahead of time. I will buy you a calculator since you can't add. So the smarties after a year of applying my payments without problems all of a sudden start putting every thing towards principle. Not what idiot would pay an extra 1500 on principle and not pay the regular bill. Well according to the GMAC customer service rep alot of people. What? I can't wait to get rid of them.
GMAC SUCKS. PERIOD.
What's their CEO's email or phone number?
I need to talk to this stupid guy.
I AM LOOKING FOR ANYONE WHO WHAT'S TO HELP START OR HELP WITH A CLASS ACTION LAWSUIT .GMAC IS A BIG FRUAD AND NEEDS TO BE OUT OF BUSINESS AND PAY FOR THERE DAMAGE. IF THERE IS A ATTNOREY OR ANYONE WHO WANTS TO CONTACT ME PLEASE EMAIL ME AT diamondfoster2002@yahoo.com please use the subject: GMAC LAWSUIT BECUASE THIS IS A SERIOUS MATTER AND WE NEED JUSTICE!
I have GMAC. I tried to contact them after my fiancee passed away to see if I could refinance since I am now trying to make it on one income, nobody bothered to get back to me. I went 4 months trying to get someone to call or email me, nothing. You only get an automatic voice mail. They will however call and harass you and hang up without leaving messages or have somebody leave notes taped to your front door. My only option now is to put my house up for sale since now my credit has been affected by GMAC unwillingness to assist their customers in refinancing, hell, I would have settled for just getting rid of my PMI payments since I've been in the house over five years. These people are crooks and I hope every last one of them has to suffer the same experiences that all of us have had to endure because of their shady practices.
GMAC customer service is the worst in the world. I just called trying to get my attorney authorized to get info on my account, ironically to get funds paid toward my principle they are holding in escrow from my closing last year. I talked with a guy named Jeff who was a rude, obnoxious JERK. He kept telling me it couldn't be done due to policy, I asked for a supervisor more than a few times & he told me even if I talked to a supervisor it would not change the policy. I said ok but let me talk to supervisor, I was put on hold & then was told all supervisors were too busy to talk to me. I asked for email address or fax # & name & he refused to give it to me. When I asked for his last name I was told he couldn't give it to me for security reasons, same excuse for supervisor 1st name or any additional information. I then asked him what country he was in & he said the states, I asked him for a specific location & was told he couldn't divulge that information for security reasons. He then asked me was I discriminating because of the way he talked & I told him no way, it was because of his poor customer service skills & his hostility toward helping me find a solution to my problem. I will think twice before obtaining another loan of any kind from GMAC because of the worst than poor customer service.
I have to agree with the statement that GMAC customer service is the worst I have ever dealt with. When you obtain a loan, it is for a certain amount. Your payments go in part toward that principal amount and the rest to interest, insurance, or what have you. Figuring how much is left when a borrower asks should not be that difficult. My children could do the basic subtraction needed for this process. However, when you want to pay a loan off with GMAC, it takes an act of God to get a pay off quote.
My house has been on the market for more than a year now. I have had contracts on it, but the financing always seemed to fall through for these buyers. FINALLY, I get a buyer and everything is ready to close, except the payoff quote. The attorney's office tried to obtain this information, only to be told after a week of requests and calls that GMAC would only deal with me. I called and was told an inspection would have to be done before I would receive my quote. An inspection? To pay off a loan? The woman I talked to was not understanding anything I was telling her; English was not her strong point.
So on to another agent the next day, who was very polite and told me the quote would be faxed that day. Needless to say, it was not. Although I appreciate the attitude of this young lady, just telling me what I wanted to hear was not an effective way to conduct business. If I had been told the truth, and the policy explained at that time, I would not have as much of a complaint because the closing could have been scheduled to accomodate it.
When I called back this morning to find out why it hadn't been sent, I was told it would take 5 - 7 more days to evaluate the account before a quote could be given. When I asked why, I was told that it was procedure. This 'customer service agent' could not explain the procedure, only that it was one...like it was a Commandment or something and I had no business questioning the authority. When I asked to talk to a supervisor, the woman, Cindy, told me no and hung up.
I immediately called back, and talked to a gentleman who got more than an earful he didn't actually deserve because of Cindy's actions. When I again asked to speak to a supervisor at the onset of this call, I was informed that he would have to try to help me first. When the story was relayed for the 4th time in 3 days, he gave me the same answer as Cindy, however he did tell me he would try to connect me with a supervisor when I asked for the 3rd time. After 8 minutes he advised there was no supervisors available. I told him I would wait, time was not really a concern for me at the moment. Approximately 30 seconds later a woman claiming to be a supervisor picked up the phone. She said she would monitor the progress and call me back as soon as the quote was prepared. She could not, or would not take the time to tell me what the problem was, or how to fix it. Although the called ended there, I was not satisfied.
So, I Googled GMAC, and called Waterloo, IA direct since the foreign speaking nations could give me no answers or explainations. I still got no further than customer service, but at least this time we could understand each other. He told me that because I didn't actually live in the house any longer it would take a week to manually figure my pay off. Why? I only owe the remaining balance on my account, and maybe some prorated interest for the month. Whether or not I am residing at the house or not, isn't that balance the same? No answer for that other than, that is our procedure. When I asked to talk to someone in the department doing the quote, I was told that they had no phone. Seriously, do they keep these accountants locked in the basement with no communications? I think that is illegal even in the country where the phones are answered!
Regardless, there is no one to talk to outside of "customer service", which is an obvious contradiction of terms to say the least. In the end, the quote was faxed about a 1/2 hour after I placed the 2 final POed calls this morning and given the 5-7 day waiting period answer, however the phone call I was promised as soon as the quote was ready has not come. It irritates me that I had to waste hours of my time, both at home and at work, to bully these people into providing something as simple as a payoff quote. In these days of mass forclosures, one would think getting a loan paid off would be an event for celebration, not one for neglect and abuse.
I am going to close on my house in about an hour, but my anger with GMAC has not been quenched. I am still looking for addresses of executives to contact to about the sorry service the company provides. One voice may not be heard, but after finding this website and realizing I am not alone, maybe a difference can be made. I have no desire to obtain a ditech or GMAC loan ever again. Like the old saying goes, "Wrong me once, shame on you, wrong me twice, shame on me." I won't make that mistake again, nor will anyone I know if I can help it. I will pass on my dissatisfaction to anyone who will listen! Thank you for a place to rant!
Hello, I have been a GMAC customer for many years. I was recently 2 moths behind on my mortgage and was sent a letter to warn of foreclosure six days later I was foreclosed on. My home has good equity. GMAC is totally unethical and is responsible for the mess our economy is i today. There latest service to the citizens of the United States is to look for loans on homes with equity and rush them through to foreclosure. They know they will either get a valuable asset or get you to pay massive fees. GMAC is an american company that is causing more financial damage to america than any terrorist group on earth.
Its time to expose these thieves and give them a taste of ruining peoples lives.
I am planning a nationwide protest that will bring major attention to this company and hit them right where they have hit me, my neighbors and our country.
Please contact me if you are interested.

Good to know others have had problems with GMAC customer service. I'm a Realtor in Orange County, Ca and am selling a home thru a short sale. GMAC is the sellers mortgage company. They have the 1st and the offer I sent them 9 weeks ago is only short about $20, 000 in what my client totally owes them. I have a buyer for the house that has sold their home and is currently living in a hotel with 2 small children waiting for GMAC to finish the approval. They have over 30% down cash payment...I'm sorry...I thought that was considered a GOLD buyer in this market?I call the short sle department daily and am
placed on hold for over an hour each time. Last week, a rep didn't like a question I asked and she hung up on me. I've called them about 30 times in 9 weeks and can't get past the cusomer service reps. Trying to explain that if this home goes to foreclosure, it will cost GMAC minimum of $50, 000 to process to sell doesn't concern them. At least I know now that they are this unprofessional with all their clients...to bad.
HAS ANYONE HAD A PROBLEM WITH GMAC CALLING YOU AFTER THE FORECLOSURE AND TELLING YOU THAT YOU STILL OWE THE ENTIRE AMOUNT? ANY ADVICE?
WE KNOW THE HOME HAS BEEN SOLD AND THE AMOUNT IT SOLD FOR, BUT CANNOT TRACK WHERE THE PAYOFF WAS SENT. GMAC IS STILL SHOWING THE ENTIRE BALANCE AS OUTSTANDING... THANKS
I worte about my experience with GMAC a while back, actually I just looked and it was 196 days ago. Since then GMAC mortgage gave me no notification, put me in default, then foreclosure, then sold my house, I found out because the new owners tried to evict me. I told these people to get an attorney, they did, I told the fraud story to the attorney, as far as I know within 2 weeks, GMAC returned they're money and now have my house titled as bank owned and than I sold it to them. Ya right whatever!
SO, now GMAC is suing me for living in my own house they stole, they are stating they gave me some noticed but they didnt I am fighting it. I am so freakin mad!
I also spoke above about my cars being repossed illegally by GMAC, they addmitted wrong doing, can you believe that? then promised many times they would bring back the cars and give me the pink slips since they were in breach of contract. Well, after I called and tried to get the cars myself, no one knew where they were, then more excuses, and the whole time exept the last month when they told me to stop making payments which I did stop, they repossessed my cars while in theyre hands still illegally repossessed then they sold them and are after me for the difference in money...
CAN any company be more fraudulant?
This is the worst year ever!
I notice these are mostly about GMAC mortgage, with whom I've also had a bad experience, but my latest trouble has been with their vehicle financing. I might as well give the Cliffs Notes versions of both nightmares. . .
Our home was financed with Homeside Lending, a GMAC company about 4 yrs ago. The payment was due the 1st of the month, then there was the 10 day grace period, so we had till about the 10th to get it in. I'm very timely with my bills, and always mailed the next months payment from my middle of the month pay, usually around the 17th or 18th of the month, so like 2 weeks before the due date. In spite of this, my pymts kept posting around the 11th or 12th, just late enough to be past the grace period. Mind you, they had been mailed nearly a month earlier, and the checks were always clearing early. My calls to customer service were much as described by others here, contantly on hold, transferred to other people, no one able to help. So I set up automatic payments, thinking they can't screw that up. Wrong! It was supposed to deduct the payment on the due date, so the 1st of the month. For a few months it went okay, then started deducting later and later until it was again not taking the payment until after the grace period had expired. Again, customer service was useless, and I ended up refinancing with a local bank. I've never had a problem with them!
Now to the vehicle issue. We tend to get GM cars since my husband's step dad is a GM retiree. We've been financing them through GMAC for about 7 yrs, 3 leases and 1 purchase. The current lease is up in September, and everthing has been on automatic payments, with no problem until April. For some reason, they failed to deduct our payment. We waited a few days, thinking there was a computer glitch or something, but when it hadn't come out by that Monday, we called to inquire. The Customer Service rep said unhelpfully that the payment had "failed", but they'd try it again. My husband requested they send a paper bill so we could just send a check, not wanting it to get any further behind, but she declined to do that, saying it was just a computer error, they'd put it back through. Again, we waited a week, 2 weeks, nothing. Payment still hadn't come out. It was close to the May due date by this time, so we waited to see what they'd do, and again, the payment wasn't taken. So my husband called and got another cust. serv. person. This person told him that of course they were no longer deducting the payment, we turned in the car on March 16 and leased a new one. My husband expressed his surprise, since this was not the case, and explained that, no, we still had the car. The cust. service person replied "are you sure?". As if we would not know we leased a new car. My husband asked what we had allegedly leased, and was told "I'm not at liberty to give you that information". What?!? He then asked why we hadn't been billed for this mystery car and was told the same thing. So at this point, angry and tired of this runaround, my husband told the guy he was happy to not pay if they didn't want our money, we'd just drive it till the lease was up, turn it in, and they'd be out 6 months worth of payments. Well, this got a response! The customer service person stammered that, no, we couldn't do that, we had to rectify the situation. My husband stated that we were trying to do just that, THEY were the ones being obstinate. He said at that point that another person would have to investigate, and that they'd call us in a "few days". Well, as you might imagine, we never received a call. We did however get a notice from GMAC with our acct number (for an account we supposedly no longer had), and thinking it was the long-awaited bill, I opened it only to find a copy of their updated "privacy policy". At this point we were weary of dealing with GMAC's so my husband went to the dealership where we originally leased the car and spoke to our original salesman. He advised just driving it till the lease was up, turning it in, and never paying them. We did not want to do that, being honest people; all we wanted to do was pay the stinking bill! So the sales guy called GMAC customer service, and this woman told him the same thing - we turned in the car and leased a new one. She wouldn't tell him what we had either, or how we financed it, but when he inquired about the fate of the car we allegedly turned in, she said it had been inspected and was now at auction, awaiting sale. He told her that was pretty funny since it was sitting in the parking lot of the dealership at that moment. She stammered that it was impossible, the car was turned in, and he explained, yet again, that they had made an error, it was not turned in, and we wanted to pay our bill. he told her we wanted a paper copy of the bill sent immediately so we could make our payments. She continued to insist we didn't have the car, so he hung up on her. he told my husband, we may or may not get the requested bill, and again advised just getting something new and pretty much screwing GMAC. But again, we just want to pay the bill!
Now the piece de resistance - the very next day, we got a call from GMAC's collection agency, demanding to know why we were 2 months behind. My husband pretty much went off on her, gave her the whole story and told her we'd pay if and when the paper bill came, he would authorize no more automatic payments since they can't be trusted to take the correct amount. He stressed that we are not past due, and that our bill better have no late fees or indicate in any way that it was past due, since this is GMAC's error. 2 days later (friday), we got 3 bills from GMAC. 2 of them were for the current payments - April, May, and June, and said clearly "Past Due", the other was for JULY!, not even due till July 9th or so, also saying "Past Due". I wrote a check for the current payments, and enclosed a strongly worded letter to the effect that we did not want to be penalized for their stupidity, and stuck it in the mail. On Monday, we got another call from a collector, this one rather abusive, acting as though we are deadbeats, again demanding payment. My husband is now at the end of his rope with this and is a middle school teacher, so he immediately reverted to his "teacher voice", and told the guy off, then asked to be transferred to a supervisor. The person he spoke to was also rather nasty, but agreed that there was no way we could have received a bill on Friday and gotten them payment by Monday, and after much discussion, agreed to mark it as a "do not call" account, since we are getting really pissed about these calls. Less than a week ago, they were insistant that we didn't have a car, now all of a sudden we are delinquent? I'm just fed up. I was disgusted about the mortgage problems, but had never had a problem with vehicle financing, so against my better judgement, got another GM car and did GMAC financing. Now they are making me regret it. And they refuse to take any responsibilty for this, even though it was clearly their error. We suspect since we have an extremely common last name, and both of us have popular first names as well, that somehow, someone with the same name turned in a car and leased something new, and GMAC mixed it up, probably failing to check the address and SSN, and such. But they just won't acknowledge their mistake, and are intent on penalizing us for it. Frustrating to say the least, and I can tell you I'll never lease or buy another GM car.
GMAC is going to get my house back! I've tried to get it refinanced into a cheaper interest rate that I can afford & constantly am told "NO". My ARM changes in Nov. & I know, even though I've paid on time for the 2 yrs I've been with them, it will go up. They have argued escrow with me since day one. I've shown them my original papers from closing where my payment includes escrow & they've told me no over & over again. They can just take this house & put it in their stock pile.
It is a mystery to me how GMAC stays in business. We too, had a sale for our home last year. I begged GMAC via phone and fax to send me two simple documents that the buyer's attorney required. They stalled, stonewalled, and outright refused. Months later, after the usual disconnects and long wait times, someone named "martin" agreed to send me the documentation. I received instead the mortgage papers of some guy named George who lived in another state!
My husband actually stopped me from having a nervous breakdown over the whole thing, as our house went into foreclosure because of this. If GMAC would have just COMMUNICATED AND COOPERATED with one simple request, we could have sold the home. This place is unbelieveable in the way that they operate.
I advise anyone and everyone to never, ever do business with GMAC for any reason. They are like a cancer.
If you have an escrow account with GMAC, examine your next escrow analysis very carefully.
Specically check the Projected Starting Balance - Mine said $400 as of November 2007. But at the bottom it gave the actual balance as $810. The result of the low starting point resulted in a low balance $40 the required maximum low point was calculated at $340, so GMAC jacked up my monthly payments by $25/month. Had the correct starting balance of $810 been the low point would have been $450 - which is $110 above the maximum low point of $340. This would have meant a LOWER morgage payment instead of a HIGHER one. As of next month I wil have $800 extra in my escrow instead of $340 they are supposed to have. I suspect GMAC and other companies with tons of bad loans are inflating escrow balances to float themselves an interest free loan using their own customers money! Multiply that extra $400 in the account by millions of customers all over America and its probably over $1 billion.
Granted once the loan is paid off you get the excess back (but that is, of course, with no interest paid to the customer). This sort of thing should be illegal. They KNOW what the real starting balance should be, but instead they make up some lower number out of thin air. Some lawyer should investigate this practice.
my mother has been battling gmac for over a year and a half now concerning foreclosure proceedings that we still cannot figure out how/why they were started. she recently sent documentation/proof that the supposed "missed" payments were indeed made, and cashed by gmac and yet she is still being forced to pay the lawyers fees for sending a foreclosure form letter, which never should have happened to begin with, and which amount to two thousand dollars.
gmac said she was missing payments----she showed them that indeed she had made those payments, that her checks had been cashed during the months in question. this whole thing is made all the more spurious by someone at gmac who did indeed tell me my mother that the house never should have gone into foreclosure and that she would fix the problem---and then shortly afterwards this person wasnt working at gmac anymore.
something is just plain not right---can anyone else please explain this to me please?
I learned to send walmart quick bill express payments which give you absolute proof they recieved funds etc. well worth the 8 bucks countrywide was sent money orders but if they demand front and baCK COPIES YOU HAVE TO PAY 35 BUCKS TO MONEY ORDER COMPANY TO GET IT
Automatic payments nightmare.. Well it all started when I noticed you could get your payment withdrawn from your account. Sounded good, we checked the box and sent the payment in. GMAC ITSELF got the numbers off the checking account and inputed them in. Well they input wrong so the next payment check 'bounced'. Called up to fix and was told, sorry you have to wait 24 hours to cancel the auto payment. Called the next day, told the story to several people who couldn't help, finally got one who said, just send in a check. Called to verify they got the check and all was ok. Next payment, you guess it shows late fee. Called again, got late fee reversed. Now, just had my credit pulled, and they reported me 30 days late on my mortgage. Called again, ok we will fix it as A ONE TIME COURTESY. Courtesy for screwing up? Courtesy for being a big pain in the ... Don't do me any favors!
GMAC's so-called customer service is a joke. They hung up on me when I demanded the address for the Escrow Analysis Department since they no longer accept phone calls, so I am told. A second call to speake with a supervisor was met with: "All the supervisors are on the phone." If there are any supervisors, I imagine they are dealing with the complaints of how they were treated by the foreign speaking Customer Service Reps.
My initial complaint was about their so-called Escrow analysis, which consists of nothing more than regurgitating last year's tax and insurance figures. Like taxes NEVER go up. Right! They do no analysis.
Getting an address was like pulling teeth.
GMAC should really appreciate the good customers it has because they sure have their hands full with bad loans.
Customer Service is not in this company's vocabulary.
Be warned about GMAC - they subcontract their escrow to a company called First American. You have to watch your account like a hawk. When tax bills allegedly dont show up at GMAC and this other company they wont tell you. Then they expect you to do all the work finding out what the problem is. This on top of them making money off your escrow funds in the form of interest - of which you the customer gets NONE. I had to ask why my property tax had not been paid and they tell me they dont have the bill and to send them a copy, which I dont have - it was sent to GMAC. Last year they screwed up another property tax bill. My best advice? Tell them to close your escrow account, send you the balance so you can collect interest yourself then pay the taxes when due. Usually you can cancel escrow if you have been with GMAC for at least 2 years. They wont tell you this unless you ask about it. Its time for consumers to fight back against these incompetent sticky fingered jokers by taking matters into their own hands.
GMAC MORTGAGE has the absolute worst customer service imaginable. No one speaks the English Language and all of the customer service people answering are rude and arrogant and condensending when you express your frustration with them. They are all basically stupid and try to stall by placing you on hold for 10 minutes at a time when they can not help or understand you. Many times I have been disconnected intentionally. They really hope customers will hang up before they disconnect you. There are no words for this company and the broker that placed us with this so called mortgage company has left himself for greener pastures. GMAC should be named right along with the other mishandler in the mortgage business. They are a sham company. When we finally got our equity line away from these creeps, they outright refused to give us the required RELEASE on our title to our County Recorder Office. This took legal action to get processed. These stupid idiots at GMAC kept telling me that they don't prepare releases, the recorder's office does. DUH! Once I pay off my loan idiots, I want your ### off my property deed. They simply don't get it. The real problem is that they don't know or understand the English language or the job they are being paid to do. GMAC hires foreign speaking idiots to manage our most important asset, our home mortgage and so it is. STAY AWAY FROM THESE IDIOTS! I SAY THAT BEFORE YOU CLOSE ON A MORTGAGE WITH ANY LENDER, ASK FOR THEIR CUSTOMER SERVICE NUMBER SO YOU CAN BE SURE THEY ARE NOT IN INDIA OR INDONESIA AND MAKE SURE YOU CAN SPEAK TO THEM ONE ON ONE. IF NOT, TEAR UP YOUR MORTGAGE APPLICATION AND RUN!
GMAC is terrible.
During Hurrican Ike--we were treated like second class citizens. They did not or would not understand that when you have lost your house --you cannot take the payments in thirds. the amount of wait time with customer service is a joke--and you keep moving from department to department.
I also do not understand where local banks are signing the checks locally--that I have to send my to Arizona to be signed.
It is really terrible that we can't have them work with us. I will be looking for a new mortgage company after this.
GMAC pays property taxes after the due date and only a few days before the penalty date. I had problems with GMAC having generated a non existant address for my mortgage statements and had to go thru 3 months of work to fix the address, so I called to make certain the taxes would be paid per my tax bill. 2 days before the due date I finally found someone at GMAC who could confirm they had paid for the wrong address with a different parcel number then what was on my tax bill. They insisted it was to late to fix the problem and that I would have to pay the property taxes myself and wait 6 months to be reimbursed for the property taxes paid to GMAC. I have made several attempts to get something in writing saying I will be reimbursed and am still trying. So far no luck, have tried to get them to work with a third party and been refused. GMAC doesn't acknowledge the better business bureau and so I guess I have to hire an attorney to get them to pay reimburse my property taxes and pay them in future. I have asked to get out of paying taxes into escrow and been given differnt answers on how to do that, but most importantly have been told GMAC refuses to put the prodecure to get out of escrow in writing or to let me speak to a supervisor about the differing procedures.
Feel free to contact for what documentation I can get at hallkinghorn@yahoo.com
GMAC is the mortgage company on my home. I sustained $20, 000 damage from hurricane Gustav. State Farm sent out an adjuster and wrote up the claim, and mailed the claim check made out to me and GMAC.
I called GMAC to ask how to handle. A guy named "Rob" told me to mail the check to them in Arizona. I said I didn't want to put it in surface mail, and that I would FEDEX the check, and asked for their physical address, and sent to "Rob's" attention.
Didn't have the courtesy of a call when they received the check. They waited a week to have some jerk call me on the phone to say they were returning the check to me because it wasn't endorsed by me and I didn't follow their guidelines for reimbursement? Excuse me? I followed your directions to a T and even paid for FEDEX delivery. When I said I followed Rob's instructions, they said they didn't have anyone in the department named Rob? Did I make the whole thing up?
A "Jeffrey Smith" then faxed me a copy of a letter with a list of check boxes that should have been given to me when I first called. So I filled out one of the forms they requested and faxed back the next day. Still heard no word, and the following week, I received the check back in surface mail for me to endorse first. THEY WAISTED A WHOLE 2ND WEEK PUTTING THE INSURANCE CHECK "BACK" IN SURFACE MAIL TO ME, after I'd paid $30 to send it in by FEDEX?
Now I don't trust anyone at GMAC Claims Division, so I started sending them a fax asking for their written confirmation by email or fax that if I attached the documents they requested, and endorsed the $20, 000 insurance checks over to GMAC, would they confirm that's all that I needed to do for them to give me the money back to pay the contractor who already performed the repairs.
After 9 faxes and no phone call, email or fax response, I filed a complaint on www.gmacmortgage.com and STILL not response 2 days later. Then I filed a complaint with the BBB today. I then faxed Jeffrey Smith, "Rob"ert Lopez and "Rob"in Hunter letting them know I'd filed a complaint with the BBB, and still no response.
Does anyone have any other ideas on how to make these people play fair and just put something in writing? I'd be dumb to sign these two insurance checks over to a company that won't acknowledge receipt my customer request. Is there any government agency I can report them to? I'm willing to do whatever I can to make them change the way they service customer accounts. There's got to be some agency to report them to of have them investigated?
I know if I send in the endorsed checks over to them, it will be MONTHS before I get the monies back from them to pay the contractors. Please HELP with any ideas you have.

WOW! I did not realize how many issues there are with GMAC.
I have had a horrible nightmare going on for for about 4 months. The combination of being unemployed for about a month, the economic crisis and some unexpected expenses I found myself struggling to make my mortgage payments. Thinking GMAC would be willing to help me with my mortgage I contacted them. This is when my nightmare began. Just to get to a live person takes about an hour of being on hold. Then you get a person that you can hardly understand due to out sourcing jobs. My first attempt after explaining to several different people, I was told there was nothng they could do. I contacted my real estate agent that sold me the house. She agreed to do a conference call with me. This was on 0722/08. We spoke with "Sunsine" she advised us that they could not do anything until the payment was 3 months past due, I told her I did not want to get behind in my payments "sorry nothing we can do" My agent request to speak to some one in the lost litigation dept. Again repeating the whole story again we were advised to re-finance, advised this was not an option. After alot of bickering back and forth my agent demanded to speak with a supervisor. Again after a long wait "Brock " answered took my information and advised me I would hear from GMAC within 30 days. I waited and waited finally I called, again on hold for a long time. I was informed my request had been denied. I ask why I was not notified. I was informed GMAC wasn't required to notify me.
10/21/08 Now I am 2 months behind with my payment so I have contaced GMAC. Now that I am deliquent I spoke with "Michael" the account service manager. I was transfered to "Reggie" in the loss mitigation dept. Again I have given my financial information with the hope that GMAC will consider a mortgage adjustment. It is 11/14/08 and I have not heard from GMAC. I am one of the many that is facing forclosure and I need help!
After reading the numerous complaints I wonder how this company stays in buisness. Unfortunately the lending industry has lost the focus on true "customer service". I don't blame the foreign people I have had to deal with, I blame the companies that aren't willing to step up and truly "help" their customers. I feel like I live in a country where I have no choice . I have never felt so oppressed !
For the first time in the last year I feel like I have finally found someone who understands what I have been going through. It is a long story but one that will be similar to everyone elses.
I am all for suing GMAC Mortgage Company and think it is worth looking into. Feel free to email me and lets get this ball rolling.

My story is very long and if we actually do this I have no problem sharing it. The end result is:
GMAC MORTGAGE WILL TELL YOU ANYTHING YOU WANT TO HEAR AND TAKE ENORMOUS AMOUNTS OF YOUR MONEY, DENY YOUR MODIFICATION ( YOU WON'T EVEN KNOW UNLESS YOU CALL) AND THEN TELL YOU OH SORRY YOUR HOUSE IS GOING TO BE AUCTIONED TOMORROW.
THAT IS WHERE I AM NOW AND THANKFULLY THE CSR'S ARE NOT BRIGHT ENOUGH TO THINK I AM DOCUMENTING EVERYTHING THEY ARE TELLING ME. IMAGINE WHAT THEY WILL HAVE TO SAY WHEN THEY FIND OUT THAT THEY DID INDEED SUBMIT NUMBERS INCORRECTLY AND THEREFORE SCREWED UP THE MODIFICATION, AND THAT MOST IMPORTANTLY THEIR LOVELY CSR READ IT ALL TO ME WORD FOR WORD...
I am going to see about contacting a lawyer. If you all want in definately email me. I am going to do it either way but what a wonderful thing for them to have to answer to thousands...
As an employee of GMAC in the Loss Mitigation department, I can honestly say I didn't know how difficult customer service was to deal with. Your complaints seem about 80% legitimate, which is staggeringly high for a random message board like this.
I saw several comments about GMAC wanting people's homes or hoping people default to get more money. This is categorically, absolutely, 100% untrue. We make no money on attorney's fees, escrow impound (not even interest!), insurance policies etc. Late fees are income for us, but only if you pay them. If we foreclose, we get none of them.
Foreclosure is a losing proposition for us, literally, 95% of the time. We simply do NOT make money foreclosing on homes. If you have the ability to afford your home and can put up with our increased turn around times, exploding inbound call volumes which leads to high wait time to get to somebody and a little attitude when someone who works 10 hours a day helping people KEEP their homes and modify their loans or work with them to get them sold, then be sure you are asking for options to help you keep your home when you talk to customer service and collections. Those departments make referrals to Loss Mitigation and gather the info we need to begin the process.
Also keep in mind that we do 10, 000+ loan modifications and 1000+ short sales and deeds in lieu a month. These numbers are staggering when you think about the time it takes to answer phone calls, report to investors, calcultate loan terms, write up justifications for why a customer needs a mod or why it makes sense to take $100k less than we are owed in order to do a short sale etc. Quite simply, we are overworked but GMAC pays us an incentive to help as many people as possible save their homes. In fact, we have minimum number of people we have to provide a solution for every single month and no one I know is in any danger of not meeting that minimum, there are an abundance of borrowers asking for help and we do our best to help every single person that qualifies as quickly as we can. We don't get paid otherwise!
GMAC is the single-most slimy, underhanded organization I have ever dealt with.
In 2005, I paid the total amount due on an auto loan. (Paid off in year 2 of a 5 year loan)
In 2008 they told me I owed them over $1200!
I haven't got a single statement, a single phone call, a single notice from them in over 3 years! What's going on?
Apparently the "total amount due" is different than the "pay-off amount" and in 2005 I owed them and additional $400. THEY HIT ME WITH DAILY FINANCE CHARGES FOR THREE YEARS!
That's over $800 in finance charges on a $400 balance!
When I called to beg them for a break, here's the response I got:
"No one at GMAC is going to help you." Click.
They hung up on me!
Never EVER do business with these crooks!
If gmac mortgage is loosing so much money on forclosures, why are they impossible to work with. I am going through hell right now thanks to the Loss Mitigation Dept, thank you very much. Absolutely now help, I do believe you are trying to force me out of my home. I have, or thought I had a contract in place, and have been making payments as per the first contract I recieved in August. I have now recieved a third contract, you have added $5000 to the loan, and showing me in default. For 3 months we have been told everything is alright, don't worry about the statements showing the loan behind.
Seems gmac in more interested in srewing their customers after taking thousands apon thousnds of dollars from them. That does not take into consideration the mess they made of my impound account. Never once in four years adjusting for property taxes, my wife have to figuire it out and adjust for it, after they wanted the $15oo we were short.
An incompetant company run by greeding uncaring cold heartless people, not sure its fair to even call them people.
Wish I knew a good lawyer or hopefully one reads this. I pay my mortgage every month since 2005 with GMAC. Lately I have made good money and try and make extra payments toward my morgage. Usually two extra payments a month totaling 600 extra towards my principle. I do this through my bank and they wire the money to GMAC. I recently looked at my statement and noticed that they note when they receive my payment but they do not apply against the principle until the end of the month so sometimes they are holding the money collecting interest for 3-4 weeks. When I called the Customer service rep she said when we receive payments like this, they do not know were to apply the money towards and they hold it till the end of month after they receive my normal payment. I said that makes no sense and she said well you could sign up for bi-monthly payments and of course pay a fee or I could use their web site and make the extra payments. I said I like to use my banks web site and process payments that way and keep track and she said nothing she could do. I wonder who is keeping the interest from these payments for I cannot imagine I am the only sap out there doing this. So instead of trying to pay down my mortgage like a good customer I am holding my payments now.
Another thing just called to see if they could re-finance my mortgage just for lower rate since mine is 6.5 and right now you can get about 6 or 5.5 and they wanted me to pay two points. Customer Service was rude and said you already have a good rate nothing they could do. Wonder if they are getting any bailout money, I hope not but does not matter going to refinance for 15 year 5.5% with no points from someone else.
Rot in hell GMAC
