Defective Weapon Sold to Me
On 2/1/2022, I purchased a Smith & Wesson M&P40 Shield M2.0. Due to unforeseen circumstances at the time, I wasn't able to use this weapon until I took a basic firearm class on June 25,2022. During magazine practice, my firearm's slide was hard to load, and the mag release was extremely stiff. Hadn't fired the weapon.
One of the instructors took it back to our table and tried to oil it when the slide got stuck in an open position. 4 men tried to get it to close and nobody could do it. The class was being held up, so I resigned myself to not being able to finish the class. Another gentleman let me borrow his Glock G19 and class continued. I had a blast with his firearm.
I asked Guns.com to replace the firearm and they told me to call S&W. I'll provide a separate complaint about that company, but this one wouldn't refund the cost of this weapon, and left me high & dry. I bought the weapon, some ammo, a holster, and other things for this firearm.
I put the M&P Shield in the box with the slide stuck open and sent it to Smith and Wesson. They have yet to resolve the issue I'm having with a brand new defective weapon. That's another story.
I'm tired of the back & forth, and Guns.com wiped their hands of me 24 hours after I picked it up from a local FFL. How about it being defective before I even got to fire the weapon? Guns.com is cheaper than buying firearms from other places, but irresponsible when it's defective. I have all the emails, but can't upload them here as PDF files.
This isn't the first time that particular handgun has had problems with the slide and various parts, and S&W is just as irresponsible as Guns.com. It still hasn't been discharged by me. I'm trying to avoid court, but may be the only way to get satisfaction. I spent a good amount of money on this weapon and neither company should put my life in jeopardy over a weapon that could stick like that while using it. I want them to replace it since S&W told me they'd have to be the ones. I don't believe them, but am desperate for a resolution. Whoever does so first wins, or I lose.
