This device does not work at all. The device has been paid for fully, and we were monitoring it for the last 6 months realising there are no difference. After watching carte blance tonight I want my money back. Please advice.

Electro Smart CANCELLATION OF CONTRACT

On 12/4/2011 at 22:30 I was basically bullied into signing a contract for an ELECTRO SMART device even though I said I can NOT afford it. As it was so late I suppose I just gave in (I am a widow - bt that not an excuse). The following day I emailed their Head Office to tell them I am cancelling the contract (I am entitled to 5 working days) to do that. On 15/4 they contact me for a time on the 18th to install the device. I told her but I cancelled. She then told me that the bank had already approved it. So I told her I was immediately going to contact the bank and inform them NOT to make payment. She then told me if I cancel I owe them 35% of the R8999 for "LIQUIDATED DAMAGES". How can there be any damages if I have not received anything yet? 35% is over R3000-00. This is now written in a clause in fine writing on the back page that one has to read at 23h00. The "agent" NEVER mentioned anything about it neither did he or I initial that particular page or paragraph which in my opinion makes it illegal. ALL pages of a contract if I am not mstaken should at least be initialed by ALL the parties concerned. So all I can do now s pray that the payment does NOT go through!

From the time of my complaint on 16/04/2011 I have been in contact with HANNO [protected]) a very WELL MANNERED gentleman working on behalf of Electro Smart. He absolutely understood my complaint and was not judgemental like Kenchem above. We treated each other like 2 civilized human beings and at the end of the day I was refunded the whole amount (without penalty) as I HAD NOT received any product and had cancelled the contract within the legal time span. I therfor RETRACT MY ABOVE COMPLAINT AS BEING SOLVED TO MY SATISFACTION!
Thank you very much HANNO for your professional approach to the situation and the odd smile you put on my face although I was VERY MAD at the time!

I really would like to know if your JUDGEMENT of me is still that harsh? Originally I was wrong yes but have since done my homework and done it well and I hope that the information I put here will help others. They make use of DIRECT MARKETING which is in itself In Breach of the Consumer Protection Act AND because of this a consumer has the 5 working days time to cancel such deal WITHOUT PENALTY!
So guys/ladies if anybody else made the stupid mistake I did you have 5 working days 2 rectify it although I suggest you 2 do it ASAP!

I am in total agreement with you but if you read my comment to Kenchem I acted within the law and am grateful for that. I thank you though 4 not just JUDGING me. I made a mistake I know but I have learned through it and as long as one learns through your mistakes then its o k!

O my friend I totally agree with you and believe me have learned a very very good lesson believe me and I do not need you to even tell me that. I am by nature a "good hearted" and "trusting" person and a widow (which probably makes it worse I suppose). He actually arrived at 21:40 and was ONLY there 4 a survey 4 ESKOM and PROMISING he is NOT SELLING ANYTHING. But anyway U have made your point and I have noted it as such. The company has though been reported 2 the SABS as suggested by SANU so now it is in their hands and luckily I did the right thing 100% and cancelled it in writing the following day (one has 5 working days according to law) to do that. Section 121(1) of the credit Act 34 of 2005 as Gazetted on 15 March 2006 refers.

Someone needs to stop these people, they bullied me into a sale as well and I could not cancel my order the unit has done NOTHING for my consumption and when i complained they said i must send them 3 electricity bills i am still waiting for their feedback. Please send another sales lady to my door electr smart I am sure to poison the ...

We also bought a Electro-smart months ago and did not cancel immediately. After promising us that there is a meter in and water will not go cold, we are now having permanently lukewarm water. During the winter time we had to put it off, as the water coming into the geyser was very cold and causing cold water in the geyser. I know they say you must set the times to suit you, but we are pensioners and are at home the whole day and using water different times, to set the meter so many times you can just as well use your geyser normally. Please let us know what we can do to get out of this thing without getting blaclisted.

I just watched Carte Blance and as the lady above said, my hubby alsop thought it was a good thing. We purchased our device in December 2010, problem is we paid it in 6 months. We cannot see any difference, is there anything we can do to claim our money back? Sad thing is, 5 other units bought that device in our complex, and they are all retired couples, what a disgrace!

After watching Carte Blance I realize we have been cond again, I wish you to refund me within 10 days of lodging this complaint, you have my banking details if however this has not been refunded within 10 days. I will commence with legal action, and you will be held liable for legal cost.

Once again we hae been cond...I had a gut feeling the night the sales lady came knocking at my door, but my hubby thought it was a good device to have after watching Carte Blance I would like a refund otherwise I am going to take this matter futher. Mr Bentley from Port Elizabeth. I would like a refund within 10 days of lodging this complaint.

All due respect to all those that feel that have been bullied into signing contracts, but logically no one can force you to sign any contract and it is your right to read terms and conditions on any contract and if YOU the client don't read the terms and conditions then sorry it is your own stupidity. How do you know that you not signing your house or your car away? Why are YOU the client so stupid to open your door to some one you don't know at 22:30pm? I sure as hell would not. So my point is don't blame the sales person/consultant blame yourself for being blind and stupid. It does not mean that the person is well dressed and mannered that he/she is not a threat. YOU might as well open your door to a vagrant or dangerous criminal.

Those who work in manufacturing... like construction worker
Those who work in services... like hair-dresser, doctor, teacher
and those who work only for themselves, doing nothing for anybody, do not provide a service or a product. These used to be called thieves, kings or noble-men. We used to hang the thieves and put-up with the kings... we suffered with dignity. Today there are far more members of the 3rd group and they all walk a thin line between crime and legal business.
My suggestion to re-instate the 10 commandments.
If the customer think it is fraud: then it is !

Electro Smart is a electronic unit that is suppose to save money on electricity . I have proof that it does not work. They supply a three month money back guaranty . I paid the full amount over a period of three months. I sent emails to pay my money back but no response. I am a pensioner and can not afford to loose that kind of money and pay more a month on electricity bill. Thanks Erich

We installed this devise under the pretext that it was goverment subserdised and would save us 25% to 50% of out electricity cost per month. this did not happen. then when we contacted the local municipality, they informed us that they nothing of this. we approached C T international and informed them that we are very unhappy with this devise and they are...

Electro Smart Power Saver

We purchased a Power Saver from Electro Smart on 26th March 2009 with a three month money back guarantee if we do not save a minimum of 25% on our electricity bill. We did not save any money. We cancelled our contract within 3 months and demanded our money back. I had to fax their money back guarantee to them as they did not know what I was taking about. Their finance company, CT International issued us with a letter of demand as I cancelled my debit order. I went to my attorneys and and proved through our local municipality that we did not save any money. They offered to replace the device, but after a year of letters and demands, we are not interested as we lost all faith in this company.

I have seen they tend to sell one product and then move over to the next product again when people start smelling a rat, normally a foot spa or something of that kind. They have gone back to the timer now, just changing the name from Electro Smart to Eco Tech, but all their "referral letters" have all of a sudden been changed from Elektro Smart to Eco Tech. And when you question them about the Elektro Smart, they just tell you it was the previous model and that with the technology that changes the product have to change to stay up to date with the technology as well. Even go have a closer look at their SABS certificate (which by the way has expired in 2014 and isn't in the companie's name) and the ISO certificate is to some company in China. A real bunch of crooks. And the people they "train" as sales people, they give them a nice contract covering themselves, to say they are only independent distributors, which means they cannot earn a salary and then also that they the "training" received will cost them R2 500 unless they sell 5 of these units when this will then cancel the training fee.

I have the same complaints as all the posts against Electrosmart. It is a well invented scam with CT International backing the finance. When I did not pay the deposit they blacklisted me & I was forced to pay before a bond application was approved.
My question to everyone is have you had any success reversing the contract or getting a refund? Please reply to kit@whoop.co.za

i worked for MAT International then they became Leberty in Goodwood i know all about the lies as i did it for 1 and a half years, i feel so ashamed to be apart of this as i had purchased one too and now im sitting with the payment apart from all the other people that i have scamed, they made u feel like u were the best sales man when u made a sale but i went against all my values when i started this job.i wanted to resign but they made me feel like a failure in my life if i did, im sorry for everyone that i sold to, i hope God can help me help everyone that got scammed, how can i cancel this contract as i know with the new consumer law it is easier, this company is one of the most messed up as they brain wash you, only when i resigned with much heart ache did i see them for what they are, their day will come as mine has come now as i sit with this device thinking the company was honest.

I had my fair share with Electro-smart as well as CT international, sister companies. After months of trying to contact Hein De Goede(owner of Electro smart)leaving numerous messages with his P A, never receiving returned calls...I pretended to be this"property developer" and I was interested in installing his Electro-smart devises into 48 units...It was amazing how quickly his PA could get him on the line...During my conversation with Heine, he promoted his "fantastic" Electro-smart", when I mentioned that I had heard of some dissatisfied clients, his response was "those complaints are from people who cannot afford their installments, there has never been a faulty unit"When I eventually told him my true identity and told him that I had left over 30 messages with his P A and that his Electro-smart is crap, he quickly blamed the "rep" and tried to back-track...He guaranteed me that he would sort this mess out...2 years down the line and nothing has been sorted out...I am taking this thief on, who would like to join me, keep in mind, it is going to cost us money...we will succeed...contact me via email robbiebreakspear@hyperlink.co.za

All Electrosmart victims please flood this woman from the National Consumer Comission with your stories, Mamzo Lefakane, MLefakane@thencc.co.za. They will give me a date for a mediation meeting. I think if a couple hundred people show up for the meeting, maybe they will do something. I will post the meeting date on this site. luciac@vodamail.co.za

Sad to say, but I worked for them for a month, and was even the best salesperson in my first and only month with the company. I realised that the product is the biggest scam ever. They train you to say only the right things at the right times. In other words they made me steal money from poor people, old people, friends and family. The contract in written in such a way where it is extremely difficult to get out.
Please people, do not buy this product, you will throw your money away!
