On September 5, 2012 Omar Ballesteros, dba Ballesteros Construction, entered into a contract #55460 for $9, 401.00 to remodel my master bathroom. On September 20, 2012, I issued a check for $1, 000 as a deposit. On September 21, 2012 I issued a second check for $2, 133.00. On September 27, 2012 I issued a third check for $2, 000.00. On October 3, 2012, Ballesteros requested $1, 877 for his worker “Francisco” and October 4, 2012; he requested $1, 000.00 for his fabricator, which I refused. Ballesteros had been given $5, 133.00 and all he had done was the demolition and dropped of some materials. I asked for the permit, which was stipulated in the contract. After that, on October 5, 2012, Ballesteros emailed and cancelled the contract stating personal reasons. He said he would refund my money. I called Ballesteros on October 5, 2012 and on October 8, 2012, to arrange a meeting. He emailed me stating he was unavailable and wanted to send me a check via mail. I told him he had to pay me in person. October 9, 2012, I still hadn’t received a refund. I left him a message and sent him another email. It is Nov. 8, 2012; he has not reimbursed me nor contacted me. Omar Ballesteros has committed premeditated fraud. He advertises in “Home & Design Consumers’ Guide” with his license, which is revoked. I called the publisher and her son, Mary and Mark Pompa, to put them on notice about Omar Ballesteros in hopes that this won’t happen to another consumer!

He ripped me off too! Started a bathroom remodel and worker walked off job second day because I told him he could not build the shower pan over rotted subfloor. He gave me a promissory note to give my deposit of $2170 back and never paid me. His license is revoked and he is selling himself as being licensed. He over charges the downpayment and broke the contractors license rules. He was given a second chance to complete the job and didn't get hold of me after promising to a few hours later. It has been a week and no show. I am filing small claims and he juste laughs about it! No fear in continuing to steal from people!
same thing happened to me beginning January 2013, but he got $12, 000 out of me before he refused to come back. He caused so much damage that my home was unlivable. He cut through 8 feet of a major bearing wall, had open wires in drywall, and had the plumbing altered so that the toilet would run into the foundation and cause hazardous waste and flooding. My understanding is that the DA will be filing criminal charges.
