I am writing to lodge a formal complaint against Welk Resort Group Inc. regarding their non-compliance with the California Consumer Privacy Act (CCPA) in relation to the retention of a video that was recorded during a sales session with Hyatt Vacation Club, also known as WHV Resort Group Inc, and the Welk Resort Group Inc, on January 6, 2023.
My wife and I were recorded during this session, and despite our previous demands for the removal of this video from their records, our request has been ignored. It is crucial that our personal information is safeguarded in accordance with the CCPA.
As you are aware, the CCPA grants California consumers certain rights over their personal data, including:
- The right to access the personal information an organization holds on them.
- The right to know what personal data is being collected, analyzed, and monitored.
- The right to opt out of having their data sold or shared with third parties.
- The right to delete their data upon request.
- The right to equal service without discrimination, regardless of whether they choose to share their data or leverage a data request.
However, WHV Resort Group Inc (Welk Resort Group Inc) has failed to adhere to these legal obligations. Despite our explicit request, the video of our sales session has not been removed, and we have not received any satisfactory explanation for this refusal.
I am seeking your assistance in holding WHV Resort Group Inc. (Welk Resort Group Inc) accountable for their non-compliance with the CCPA and their disregard for our privacy rights. I kindly request that you investigate this matter thoroughly and ensure that WHV Resort Group Inc. is held responsible for their actions.
I believe that the organization's conduct is in violation of both the spirit and the letter of the CCPA, and I hope that through your intervention, we can find a resolution to this issue.

Dear Complaints Board,
I'm reaching out to convey my serious concerns and dissatisfaction regarding the timeshare agreement we entered into with Welk Resort Group Inc.
Our repeated efforts to engage with the company, the latest of which occurred in Jul 2023, have been met with total disregard. This absence of response has rendered us feeling abandoned and extremely anxious.
Our status as Platinum owners was represented to us as something prestigious, with specific advantages and safeguards. However, we are now finding that this level of membership offers no real opportunities for contract release. It raises the question of whether non-Platinum members are receiving more favorable treatment, and if so, why the same options are not being extended to us as Platinum owners.
The complete lack of equity, openness, and straightforward communication from the company is deeply troubling. Instead of offering us a just resolution, they are threatening to ruin our credit by defaulting our account. If this is their aim, we urge them to move forward without further extending our fiscal hardship.
Our experience further highlights the company's failure to adhere to the laws meant to protect Timeshare purchasers, including the failure to disclose that:
- The Timeshare is NOT a wise financial decision,
- It is NOT readily sellable,
- It does NOT hold value as an "asset",
- It's impossible to exit.
We have reason to believe that the sale of a Platinum membership to us was a deliberate action to constrain our future options, a tactic that feels all too manipulative.
We are in dire need of your involvement and a quick resolution. The continued burden of this timeshare is no longer bearable, and we cannot sustain any more fees. We are turning to your office, trusting in our nation's justice system, to deliver a just and equitable solution.
