I had complex foot surghery on 8/1/2013 and was granted 3 weeks of FMLA having to return to work on 8/28 where I requested an extension since I was still in my post-operative bandages having to keep my leg raised above my heart however, Sedgwick CMS who is the Leave Administrator for my employer, UnitedHealthGroup, denied my FMLA along with short term disability request saying that drving was not part of my job duties so that I can come to work (even though I drive to work, Sedgwick maintains that it doesn't matter - driving is not part of my job duties so they cannot consider that). They have continually denied my FMLA and STD claims although after they found they could not bully me back to work with the threat of losing my job, they did approve my FMLA a month later but are still denying my short term disablity - I have now lost my home phone, computer access, have NO food (i'm now living on cereal, jello, pineapple chunks, water and hot tea to fill me up) and am also facing eviction where my lanldlord has issued a 5 day pay or quit notice - that was 2 weeks ago. My provider has complied with everything that Sedgwick has requested but my request for short term disability is still denied. The provider wanted to keep me out for an additional 4 weeks but I dare not let him do that, even though I'm still under his care thru 11/30/2013; I feel I was forced back to work earlier than I needed to be (10/15/2013) even though Sedgwick says I could request an extension, I know I'm not going to get it. I am in pain, and am very very distraught over the fact that here I am unable to fully walk, I have NO food nor do I qualify for any assistance since according to the "state" I have means of employment, I have no way to call anyone should I have an emergency (I do not have a cell phone and even if I did, that too would be cutoff) and now I'm faced with having a court ordered judgement against me with request to vacate my residence - all because Sedgwick is crazily denyingi my short term disabiility. They denied my request for an FMLA extension but then upon appeal, that was granted however they are still denying my short term disability and that baffles me - my FMLA is directly linked to my STD request and this is a travesity. I know I'm malnourished at this point and I'm always nauseousI and of course now waiting to become homeless as well. Who lets this happen to an employee? Why am I having to sit here at work in pain, hungry, and crying because of my impending homelessness as well as not knowing where my next meal is coming from, To make matters worse, I can't even heal properly/follow the doctor's order because I don't even have the money to pay for all of the medication and medical supplies I require.. Who lets this happen to their employee's? Unitedhealthgroup was tauted as being "the best place to work" but if you ask me, that's a laugh and it's not a very good laugh. This has caused my so much stress that I am now under care for PTSD (post traumatic stress disorder) but guess what - I can't get the medication I need to treat that so my nerves are on end, I'm a basket case, and I'm hollering, screaming and crying. If my appeal with Sedgwick is denied again then that's it for me - homelessness for me means the end - I might as well jump. I have never felt so much hate in my llife and this just makes more upset; I just want to die.

I was denied Family Medical Leave Act (FMLA) due to paper work not being receive. I contact my mother nurse she fax the information again (2xs). I was denied FMLA because paper work wasn't receive in time. How can a company get away with this.

I to had complex foot surgery. Sounds like what they are doing to me. Though I haven't gotten denial of the FML just nothing is approved so I have not done the appeal process. Hope things get better. Have you tried a lawyer.
