This is a formal complaint therewith, against three employees of Speedway, Eric/ Customer Service, Assistant Manager/Richard and Huff/Store Manager, located at 1531 6th Avenue Huntington West Virginia 25705.
I am thinking around in the year of 2020 and the month of June, I entered Speedway get the items that I am going to purchase which consisted of 3 pizza's that was on sale. I went to the checkout line and a person I use to work with, Eric is behind the counter as I am next in line to check out, I place some of the items on the counter, he started the process of checking me out.
I trained Eric at Wendy's so we were familiar with one another so we interacting back and forth and than he tells me my total some of the items were to purchased by EBT.
I slide the card and did not have enough so I thought maybe I was entering the wrong pin so I ask Eric to take off the pizza's because I did not have enough to purchase them. He instantly caught attitude by the look on his face and the body language that followed, finally he told me to get my dumb____ out the store. I said I am sorry if you are having a bad day left the store.
I accepted the encounter, and did not say anything about it to anyone but the next day my boyfriend went to Speedway and when he returned home he said Eric told him I was banned and I said for what? "So, I called the store to verify with Eric why I was banned and he hung up on me.
I continue to enter the store because, I had no regulation of why I was banned at first, and Eric never seem to be there as much. I enter the store on all three shifts and had interaction with all three named above, no one said anything to me about being banned.
One night, I make my entrance and as soon as I walked in the door Eric and I made eye contact, the assistant manager was in the awl placing items on the shelves, no one said anything to me.
I followed the line until it was my turn in the process of laying the items on the counter, Eric signals for the store manager, he enters the permitted work area and Eric begins to whisper in his ear, immediately the assistant manager, which I believe his name to be Richard, came from around the area, straight to me and started snatching items out of my hand and told me I was not supposed to be in the store.
I tried my best to reason with Richard, but he became louder and there was a long line of customer's and this embarrassed me, therefore as I said to Eric you have taken this to far and than I said to Richard before he yelled me out of the store, what am I banned for and he stated, "If my employee says you banned, than you are banned as I exit the store, I asked for the complaint information and he gave me a number rudely of course.
I called the number and filed a complaint for second time on the two of them and nothing was ever addressed but they still doubled team me.
I tried to speak to Richard, he got loud and told me to get out the store, I did because he was eventually call the cops but his reasoning of the banned was that if Eric says I am banned as he stated his employee bans me than I am banned.
I went on day shift, spoke to Huff, "the store manager, " which said he would take care of it., Eric could not banned me only the higher held positions and this is the same outcome with the customer service assistant said. I thanked Huff and he went on with his work.
As I, continue to go to the store, I have no encounter with either of them so I proceeded with routine and I would majority of the time have my grandchildren with me.
After realizing that Eric was fired, it was a sigh of relief. I enter Speedway, Mr. Richard has became the man of torments' and in brief detail several occasions, he watch me enter the store prepare to checkout, he would hollowed at me in front of customers and put me out the store, two times without my minor grandchildren who was in foster care. I went to Huff again and he said, I was not banned and he would talk with Richard when he came in.
Once again believing Huff I went into Speedway. The last 2 encounters I had with Richard was quite overwhelming, one being on day shift, he came out of the office and seen me but did not approach me until I was at the register.
There was a new employee and he was coming down from the ladder to check me out and Richard told him not to, a store full of people, he starts his ritual and tells the new employee to call the police.
I asked him to allow me to get my minor grandchildren and he threaten, me with the cops, this was definitely starting to stress me out so I did my best in following chain of command, calling the complaint line and still the harassment, disrespect, mental aguish, deliberately continued. Finally, someone who knew me was at the store we all walked in on the night shift, this man literally looked at me and continued on stocking, when I got to the counter, in front of another dude, did his thing again, my boyfriend happen to be one of them in the store and Jackie who rode with me to the store was at the checkout when his screaming voice aimed at me, I said I have had it and I am writing you up.
I called the above location a few days later after calling the complaint line, which had everything documented but instead of adding the assistant manager to the complaint, they had only mentioned Eric and I said he no longer works there and they redone the documentation.
As a Paralegal, in the state of West Virginia, I am able to prepare formal complaints, so I had taken one to Huff, he handed back and said he would handle the situation, if had addressed the issue before it got this far than I would not be preparing this documentation. My complaint against Huff is lack of resolving a situation when he was suppose to, lies, and allowing a customer to be harassed by an employee.
He abused his position also when I called to speak to him, he accused me of spitting on a employee and that I refused to move off the parking lot and I said that was not me, than Richard told my sisters that I shot two people on the parking lot and this is also untrue, I served papers own Richard and Huff and gave them to a fill in manage, he stated, "that they would get them."
The actions that I had taken was:
1. Spoke with the store manager.
2. Went to the 5th Avenue store to find out who the district manager was and how to contact him.
3. Called the complaint line.
4. Went to Huntington Police Department to see if there was paperwork stating that I was banned, and there was not.
Enclosing, I contacted the complaint line, they transferred me over to the man that had my case and he said that he agrees with Huff and I am banned. The only thing that could come to my mind was in 2014, I was being beat by my x-boyfriend on the parking lot and my son trying to get him to stop, took a bb gun and shot at him, he hit the window of speedway, the cops was called, we were willing to help with the cost but never banned and I find this to be unethical for them to try and use this as leverage to cover up for an employee that is abusing a customer this is a shame to the Speedway way.
In my relief and the mental anguish I have experienced, I am asking for $15, 000.00 and for my two minor grandchildren that I had to leave unattended in the store because I was threaten by an employee at speedway and the means of the cps case we were experiencing, I ask on their behave for them to receive $5000.00 a piece to be placed in a savings account until they are 16 years of age.

Well if you are banned then stop going there anyway for your own good. Richard sounds like a psychopath and it was most likely him who shot two people in the parking lot, which is another reason you should go somewhere else. There are probably a lot of other better places in your area where they don't treat you like sheet.
All Speedway stores have many, many cameras that record every action. Having said that, I find it hard to believe you are an actual paralegal. If you truly were, you would know not to discuss legal situations on 3rd party public websites.
