For those of you who can't seem to find help with ASC, their address is P.O. If you make your payments on time by mailing in your payment, you wont have to worry about a fee. If you use their online service, there is a fee. Welcome to big business. Like all of the other "victims" of America's Servicing Company, I too have been dumped into the hands of ASC as of June of this year. I had no problems what-so-ever with Fremont Investment & Loans. I received notification of the transfer from Fremont approximately 30 days prior to the transfer. Thank goodness it included contact information for ASC. I awaited paperwork from ASC, but it never came. I then called and was given a loan number. They told me that the loan was not set up yet, so I could not make a payment. I had to call back after the 5th of July, 4 days after the first payment was due. Then, when I called back I could not get past the automated system because it did not recognize the loan number. After DAYS of trying to reach them, I finally got through. They said they had no idea where the number I had been given had come from, and gave me another number. They also graciously offered to take a phone payment fo the reduced fee of only $15 since my payment was past due. ERGH! I told them that I wasn't paying until I had paperwork to confirm that they had actually given me a valid loan number. They said that a statement had to be requested...they don't just print them out (?!?!). After repeated calls from ASC for collection, they finally sent me August's statement! So I sent a double payment via overnite mail. They received it on the 2nd, but did not post it to the account until the 11th! Obviously, I was livid! I called to speak with a supervisor to get it changed. Since that time I have sent everything certified with return receipt. Well, the saga continues. I just received a phone call from ASC wanting my November's payment. I have already received the SIGNED return receipt, and have tracked the mailing. They will not accept it. They said another company may have gotten it, so I needed to make an online payment for $10, a phone payment for $25, or pay for a stop payment and send them another check! Unbelievable! How is this company still in business? I think I am going to have to pay refinance fees just to escape them. The bad part is that there are no guarantess it won't end up back there again.
I too have had nothing but problems ever since our mortgage was sold to ASC, It has come to me having to either overnight or 2 day mail my pymts so I at least have proof from the postal service that asc DID indeed receive our payments. They call us every month to tell us they didn't receive it and they will have to put another 100.00 on to the mortgage pymt. I constantly have to argue monthly and let them know exactly what time and day they did receive the pymt. Then they tell me "oh yes we do have it, it just hasn't been posted yet" our pymt is due the 20th of every month, here it is the 27th and they just called this morning and I had it out with them again. I seriously want to refinance just to get it out of there hands, I just wish I had a guarantee that it would NOT get sold to them again! This is the most unorganized, ripoff of a co. I have ever had to deal with, I have turned them in to the BBB 3 times now. I have never had this sort of problem ever before with any other mortgage co. I constantly feel like they are trying to do whatever they can to get extra money out of us.

Reading over everyone's posting, it is nice to know we are not crazy. My husband and I are real estate investors and have several mortgages. Three of our mortgages were sold to ASC and it has been a nightmare ever since. Along with the harassing phone calls, (reminding me before the due date) that my payment was due, (mind you with three accounts we got triple the phone calls. We have two mortgage payments that are similar to the cents, different only by .10. Two payments were applied to one account mistakenly and one account showed past due, I was assured by an attendant that it would be corrected right away. Months later, after they threatened to repossess my house etc, and reported to my credit report, I finally had to pay an additional payment. They fixed my credit report, but I still have an account that is paid a month in advance. They refuse to refund that amount, saying if it's paid a month ahead I have them automatically draft my account because I am terrified I will fall into their nightmare web of customer (non)service.
We have recently been sold to ASC and already having problems with their customer service. We received a letter saying that our mortgage will be sold to ASC, mistakenly thinking that both our mortgages were transfered I sent our first and second mortgage to ASC. They endorsed both of the mortgage check. Later on we got a call from our first loan company People's Choice and they said we still need to pay them our 2nd mortgage because only our 1st mortgage was sold at the time. So here we are paying ASC and People's Choice, then when I tried to get a refund they said they don't know where the payment went to and that they cannot apply the overpayment to our next months mortgage. That is full of C***. The money is in their account regardless of what account we post it to. Why did they endorse the check if it wasn't even referenced to my account with ASC.
America's Servicing Company is anything but! Unless you consider that they are 'servicing' themselves to our hard earned money thru the tactics many here & on many other sites have expressed. No, Wendy you are not crazy. It is crazy that someone in the banking, financial or government can't put a stop to this! Despite having done what is now their 3rd attepmpt to foreclose on my home, they continue to call me on a daily basis trying to get money out of me only they don't know how much they want in total or even what it is for! Like many, my home improvement loan that they call a mortgage was sold to them 4th hand. I don't think anyone in their right mind would actually consider having a mortgage with them. Too many horror stories can easily be found. I had a 1st & 2nd mortgage at the time another real jerk of a contractor did work on my house. You can't have 3 mortgages am I right? He sold the note & some how after paying it off in the stated 10 yrs., ASC who had had it for the last 5 yrs. starts saying they have a 2nd mortgage on my home and I owe them an unknown amount of money but are attempting to foreclose because they don't show that I ever made a payment. Actually, that has only been a few of the callers with the others saying I'm 20 months behind on their 2nd mortgage. And how much is that 2nd mortgage? "We'll have to get back to you." I keep checking my title and no mortgage to them has ever been recorded. Maybe that is why the first company attempting to foreclose for them in 2005 never did it.? This recent group of attorney's is determined though having filed their 2nd foreclosure this year despite ASC having provided them with a payment history as requested by my attorney. This has got to STOP. An attorney in Md. has said he will file a class action lawsuit if any of you are interested. A local tv station may also be doing an expose. Maybe, we can finally get something done.

I know exactly what you are talking about... I received phone calls for about 5 months straight from ASC telling me my payment hadn't been received. They would even call me sometimes before the 15th, which I thought was odd...almost like a reminder that I had a payment to make when I have owned a home for 4 years and have never had a late payment on any account in my entire life. They have also called me to say they haven't received my payment and when I check my online banking, the money has been withdrawn from my account!
I started paying via Bank of America Online banking and haven't had a problem since. If possible, I'd recommend paying directly through your bank...not through their website, which I heard charges a fee. Ugh...
During the transition of the sale of my mortgage from Freemont Investing and ASC (which happened within a few months of closing), I made a payment to Freemont as I had not gotten the documentation for the new vendor yet. They informed me that payment was not received and I finally had to go through so much to prove that the payment was received. They finally corrected it.
Also, they started sending me letters requesting me to provide proof of insurance. They informed me that their records indicate that I do not have any Home Insurance. Anyone in the industry or in the business or anyone that has ever bought a house knows that no mortgage company or title company will close a home without proof of insurance. I called them and told them that Freemont Investing should have all the paperwork and that they closed the loan knowing that their was home insurance purchased. They told me that I needed to go and dig my files and mail them my declaration pages and proof of insurance. I asked them if they can follow up with Freemont Investing since that is the company who they purchased the mortgage from. After another week, I received another letter from them telling me that they have imposed and purchased Home Insurance for me which from the attachment they mail to me was twice the amount of my existing insurance. They informed me that this amount will be added to my monthly mortgage amount. At that time, I had to go and dig in my files and folders to find my Home Insurance documents from the closing to send to them. I think it was their responsibility to get all the appropriate documents from the company they were purchasing the loan from. I do not think that they should be harrassing the customer for information because they have neglected to transition the files and documents appropriately.
I think that this company has the worst customer service and does not care anything about the customer and does what they want because they know that the customer does not have any rights and does not have any choice and or any say so when and to whom their loans are sold.
Please help. I wish I could change this company but it would just cost me more money to re-finance. And after that, it might end up back with them somewho anyway.
I think that this company should be fined and that the US attorney's office should try to help the customers with this company.
I wish I could do something to have them go out of business.
For over three months now, I have been attempting to resolve the myriad of problems which have arisen from two mortgage payments that were lost by ASC. I have sent them copies of all of the bank documents, proving that the payments were sent and received. They have yet to rectify the situation. I am frustrated beyond belief and concerned about the impact that their mistake could have on MY credit - which up to now has been great.
I have had quite a few mortgages in my time and this is the worst lender of all time. I will have to agree with all the other complaints I've read so far. I have received almost 30 certified letters sent to my home threatening foreclosure and have not once been late with my payments. I have been verbally abused over the phone by their awful call center. I've gone so far as to sign a Cease and desist order against them for the phone calls but still receive them to this date. They have changed my late fee date from the 16th to the 10th... only after 20 hours on the phone did they change it back. Payments have been received , but not posted for 10 days or longer... so during those 10 days you receive about 30 calls. Unfriendly customer service representatives, horrible time reaching them.

They serviced my favorite loan I've had, best service- but to own this company and allow them to give this terrible service is absolutely unacceptable.
I have gone to Wells Fargo to see if they'd transfer my loan (since it's one of their companies) they said "no". So I immediately closed my checking and savings accounts with their company.

I have always paid my mortgage through web bill pay and have never had a problem. For the past two months however, America's Servicing Company has been reported my name to the credit bureau and, most importantly added late fees to my monthly mortgage payment, because it claim that I have not paid my monthly mortgage bill. This is absolutely opposite to what my online account shows. I believe that it is purposely reporting late payment so that it can add a late fee. What a bunch of Crooks.
First of all i am a collections rep for asc out bound collections... and first let me tell everyone do you know what asc is... its a NON-PRIME Loan servicer for everyone who doesn't know what that means it services bad credit loans, wait let me rephrase that horrible credit loans, and it makes me laugh when im talking to you and your there talking about how perfect your credit is and i see when im calling you and i see your true double digit credit scores... also your payments are due on the 1st not the 16th people who have bad credit seem to find this confusing thinking the 16th is your due date because thats when you get your late fee... also have you ever wondered why you get stuff from wells fargo with your mort. payment stuff , because asc is affiliated with wells fargo but wells fargo just doesnt want to be labeled the company with all the bad credit loans... how does asc end up with your loans... companies suck as freemont, countrywide, emc... etc companies originate loans the, prime loans (excellent credit) sub-prime (mediocre credit) and non-prime(bad credit)... the originating company keep your loan for 2 months if your lucky ,then thats where the fun starts the prime loans get sold to a company the non prime loans get sold to a company and then asc get all the non-prime loans get sold to asc... so i hope all this info answers your questions to why you have this horrible company servicing your loan... all because you all have horrible credit no one to blame but yourself!
Oh yeah i know asc is a screwed up company but i also find it funny when i hear people talking about sueing asc... and winning... yeah right when you walk in the court room with your bootleg lawyer and then asc/wells fargo comes in with its all-star team of lawyers who get paid more in 1 day then your lawyer will make in a year... do you really think your going to win your lawsuit.
Customer service are two words that do not exist at this company. $15.00 monthly fee to pay your mortgage by telephone is ridiculous. Try to access their website to pay your mortgage online, you can't. Mail them your check and they will claim they didn't receive, have never had a bill lost in the mail other than ASC. We, the borrowers, are the ones being "serviced".
Do all you can to not do business with this company. If you already have, which is likely if you are reading this, it's too late.
Last year my mortgage was sold to ASC from Decision One mortgage. All of my problems started with ASC. First they claim that Decision One never sent them any payments so I was responsible for those payments. I contacted Decision One and was told that all payments were sent. ASC said something different. I have been trying to get this account in good stating since then, sending double payments. I explained to ASC that all of my payments should be 1 month ahead and not 1 month behind. I noticed that it takes them 3 -4 weeks to process my payment which causes my account to appear late and it accrues late fees. Another thing, the money orders that I send never was posted to account. I have spent more money trying to investigate where I brought the money order from, then there are fees on top of fees to have it investigated. Meanwhile ASC sends threatening notices and their representatives leave unacceptable messages on my voice mail. I do not trust their new website to make payments. Half of the time I cannot find it and when I do, it does not give you the option to modify the payment. So if they had not posted a previous payment to my account it will show a higher balance and it does not allow you to change to the correct amount. I want to refinance this mortgage to go with another company, but I don't want my new mortgage company to sell back to ASC. Even though I asked when I initially refinanced if my mortgage would it be sold and I was told that it would not be.
I have had many home loans through different banks that have serviced my loans and never have I had to pay a $15-20 dollar fee to pay online or by credit card. Countrywide, GMAC, MLN and several other companies have the internet pay option and never in my 12 years of owning several homes had this issue.
I am to say the least unhappy and severely annoyed by this company. We as their customers need to be treated with a little more care.

When we refinanced our home our loan was with litton loans then they sold it to asc. We got behind in our house payments as my husband had been unemployed for almost 4 years. So they said they would try to do a loan modification but it was taking them for ever and in the mean time they were tacking on fee after fee. So we put our home on the market to sale. It was up for sale only three weeks and it sold. Now we need to do a short sale and these people are dragging their feet. And has told us it would take another forty five days for them to make a decision. Now we are in jeopardy of loosing the buyers. We have been working on this now for a month. And we are no closure . They kept saying they didn't have the papers; our realtor and the escrow company faxed them everything five different times; before they said they finally got them. These people are robbers and need to be stopped. Isn't there anything that can be done. They are in the mean time just raking up fees right and left.
My loan was transferred to ASC a few months ago. Since that time my payments have been reported as late or not received. I had no problems at all with my previous company but somehow now I can't get a payment made on time. There is no website and calling is fruitless.
This has to be unlawful but I am in no position to afford an attorney right now. All I can hope for is that enough of us complaint so that there will be a class action suit against these thieves. What is scary is that so called "reputable" companies use these people. Hmmm.
I was called this morning after my payment was processed after the 15th. Apparently I have a $39 late fee now. Patrice had called this morning from America's Servicing Company to tell me that unless I pay my late fee immediately, it will reflect poorly on my credit bureau! When I asked for Patrice's supervisor she put me on hold and never returned.
I tried to call back to the number she called me from and received a "Please wait. Extension not valid." Message before it disconnected me.

The problem I have with this company is that you have to mail off your payment. Or you could pay over the phone with a 15.00 fee. Or better yet you can pay online for a 10.00 fee. I think that this is ridiculous. Almost every other mortgage company doesn't charge for online bill pay. It wasn't even my decision to switch mortgage companies. I am not at all satisfied with this company, and I can't wait until we refinance. The reason why this company has to buy out people's loans is because no one would finance with this company knowingly.

I totally agree that is ridiculous for any company to charge for an online payment. It's also a shame that you can't trust the United States Postal Department to get your payment delivered on time. Fortunately my bank has an e-pay service (for no charge) and I make my monthly payments through them. I have been doing this for months with no problem. My payments are always posted on time. (Probably because ASC can't argue with Bank of America). You may want to check with your bank to see if they offer this service.
As of today We have had 2 missing payments with ASC. We have been fighting the first one since Feb 2007 and they have now lost our June 2007 Payment. We have tracking numbers, bank statements and help form people at our bank to prove that we have made these payments and still have not been able to get anything resolved. Everytime you call the company you speak to someone different and we are told different things all the time. We have been told several times that they will investigate our complaints and they never get back to us. This company will scam you out of every penny! They take forever to process payments and turn around and charge you late fees. It is a night mare everytime you call. Beware and run when you see this name.

Thanks for the information about how terrible my credit is and why I'm so lucky to have ASC as my mortgager. However, that STILL gives NO reason to have incompetent and heartless customer service. My loan has fallen one month behind because when I refinanced and was lucky enough to have ASC assume my loan, you fine fellas didn't do all your research! I had to do it! My taxes are included in my loan, which of course are paid by my mortgager. When ASC purchased my loan, my taxes were past due. The previous mortgage company "paid" the Jan. taxes, but the check never cleared and/or didn't reached my counties tax department. Therefore, I was behind. Instead of ASC researching or inquiring about the past due balance, it was paid including late fees and penalties. Thank you very much. That was very kind. Then in November when the escrow statements are mailed for the upcoming year, my payment went through the roof! Almost $250 more each month. I called customer service and the heartless b--ch told me to sell my home. Who says that?!? And tell me why I would want to do that! I wanted to know why my taxes nearly doubled. "I don't know, ma'am. Maybe you should contact your taxing authority". So, I did. Do you want to know what I found out? My taxes weren't paid in Jan. like the original mortgage company claimed. Then I called them. They showed a check number and everything. I asked for a cancelled copy of the check. After waiting for six weeks and getting the run-a-round, I was finally told that the check never cleared. Several times, I requested for ASC to research and then run a new escrow analyst which should reflect the correct amount of taxes due. Not $700 in Jan. and $1550 in July, but $1550 for the whole year. Still nothing. Finally, in March everything is clear. The original mortgage company forwarded a check for the past due taxes, my escrow statement was correct and my payments are back to where they should be. Five months I dealt with stupid crap that I honestly shouldn't have had to deal with. My mortgager SHOULD be the ones to make sure that everything is smooth since I'm holding up my end of the bargain and making my payments on time. That is the reason you have a job. Your research department is lousy, your customer service department is lousy and your tax department is lousy. A bunch is heartless souls! Just because I don't have a Prime loan, doesn't mean I'm a piece of crap or should be treated any different. I'm a hard working individual who pays her bills on time and would like a little respect!

The company does not know what the word "ethics" means, but is the the epitome of "greed." The representatives who work for this company are inept, incompetent and almost illiterate. The reps are not "people oriented", which means they lack people skills and were probably employed for that very reason. Their collection practices are antiquated and are designed to intimidate and motivate fear.
After having said all of that, I have read several articles from the US Congress, HUD, NFHA, NACA and others. Some of these agencies conclude that sub-prime servicers, like ASC, thrive on default, late, etc fees because they are greater than normal fees. That's why they to push the loans into default and refuse to respond to borrowers who only want to keep their homes.
I recently had my home foreclosed on due to their deceptive business practices. They (the loan counseling department) will eat up the time ( as I also read from someone else's comments) at 40 to 60 day intervals. They are unresponsive, and will lead you to believe you are speaking to loss mitigation. I don't believe they even have a loss mitigation department, so they are perpetrating a fraud. Will "blow off" HUD counselors and lie to and deceive them as well. The HUD counselor would call and specifically ask if she was speaking to loss mitigation and then later find out she was speaking to collections. Correspondence from them was confusing, and the right hand definitely did not know what the left hand was doing. No coordination of effort or communication in this company. This company could care less about the borrower and their representative, Eric Lopez, (if that's really his name), confirms this. He is a reflection of his company's mental attitude. They treat borrowers with disrespect because they think they can. What really needs to happen here is that a class action suit needs to be filed against this company. Also letters of complaint should be written to our congressman, as well as formal complaints filed to the Federal Trade Commission and the above mentioned housing committees. If we have taken the time to voice our discontent on this website, then we must be disturbed and irritated enough to follow through. I had surgery and they stretched out my past due balance. However, if I am a day late on my payment, I lose the Temporary Forbearance Agreement and owe them the total amount. I have tried to find a site for them to no avail. Now, I have to pay them by telephone which is a $15 charge per mortgage... and I have 2 mortgages. It seem that in this day and age, i should be able to just pay them directly on line!
They also paid last years taxes in December before they were even due! My taxes are not escrowed. They claiming that they had to pay the taxes the previous year... which I paid! After over an hour on the phone, they finally realized that I was right... but instead of refunding the debt, they spread that out across this years payments which of course increased my payments. They have helped some, but been a real hassle to deal with!
This company is really starting to make me angry. The bought my mortgage note from my previous lender and when they did, they didn't send me any contact info for over 2 months. The very first contact I received from them was a notification that I was 2 months behind on my payments. I explained to them the situation and ended up paying for those two months with included late fees tacked on... as well as having them report to the credit companies, which needless to say didn't do anything to help out my credit score...
Now my newest issue with ASC is that I sent my mortgage check by mail. I had expected a wire transfer to hit my bank the next day to make sure funds would be available to pay mortgage. There was an error with the wire transfer and had to be re-sent. I called the mortgage company to see if the check had cleared or if they needed me to do an electronic funds transfer to make the payment. They stated that the check did NOT clear, so I did the Electronic Funds Transfer to make sure my mortgage got paid.
The next month I receive a statement saying that last months payment was never received and a late fee will be attached an I will need to pay the late fee, last months payment, as well as this months payment. This struck me as very odd so I went and got an activity statement for my checking account from my bank. On the statement it shows the check written as cleared, followed by the next day the Electronic Funds Transfer clearing. So my understanding is that they expect to charge me twice and claim not to receive two payments and charge me a late fee on top of it.
I am planning on contacting them regarding this and will have my bank fax them the statements as proof of both charges being made. I will ask that the late fees be waived as well as being credited for this months payment, either that or they can send back the amount of the check so that I can turn right around and write them a check for this months payment... Simply ridiculous, I am seriously considering refinancing just to get away from this company, I will have to pay the prepayment penalty but I am beginning to think $2k might be worth it to get away from this company and their seemingly ineptness.
I agree. ASC called me the day before my mortgage payment was due because they claimed they had not received it. I told them that I had paid on-line earlier that morning which is also crap because who charges you a $10 fee to pay on-line. This is 2007! Anyway, ASC claimed that I would now have to pay a late fee since they have not received my payment yet. I told them again that my payment wasn't even due yet; I am actually a day early!
America's Servicing Company took over my loan from Mortgage Lenders Network when they filed bankruptcy. When I was with Mortgage Lenders we signed a contract to defer 2 payments. Now ASC is adding this amount to the payment I currently owe. When we called them, they stated that "this is how it is" and that they "have no field to enter this deferment into". This seems like an unfair practice. We shouldn't be put in a position where we have to worry about possible foreclosure.
I had original home loan with Aegis. I refused to accept early termination fee, so accepted higher interest rate. I have all of my original loan docs. ASC purchased the loan and now that I'm selling my home, they are trying to extort 14000.00 in early payoff fee. You cannot talk to anyone on the phone about it, they refuse to send you to another dept where you can talk to the payoff people. I sent all of my original loan docs with a detailed letter over a month ago, no one has responded. They are crooks and they are hiding behind the internet.
I called to pay my mortgage payment which was not late and the rep. who answered the phone had the nerve to ask me where i get the money every month to pay my mortgage. That is not there business. I work hard for my money and they have no right to try and dig into someones personal finances. Also from what I read from ERIC LOPEZ'S ( the one who works for asc) is that they see our credit score when they pull up our loan information. Isn't that against the law to be going into someone's credit without there consent. As for Mr. Lopez talking about people having bad credit to be with this company, why don't we look at his credit score and his payment history and see how he has been paying his bills and if they are all on time always. As for having to pay 10 dollars to use the website or 15 if you call and 20 if you have to talk to a representative is robbery. Mr lopez how do you expect people to pay their bills on time when your company like so many others takes advantage of people like that, Also keep in mind Mr. Lopez that if there weren't people with not so good credit out there YOU WOULD NOT HAVE A JOB...
You are not trying very hard if you can not find ASc's web site. Google shows it two pages in, yahoo the same. Dont want to use the phone? Set up an automated payment with your bank. Send out your payment when you get the bill which comes about two weeks BEFORE the bill is due. Having trouble paying your bills? Drop your monthly payments by getting rid of the stuff you do not need. Things like internet service, cable/satellite service, if you have both cell phone and land line, drop one of them. You were most likely behind before the surgery, the forbearance agreement came about because enough time went by with missing and late payments that foreclosure was threatened. The very fact you have a forbearance agreement shows that ASC is more than willing to work with you. It would seem to your betterment to work harder at honoring your original contract and the forbearance contract.

You mean late calls after you missed paying the bill on the 1st when it's due. Nothing illegal. If it happens every month you need a reminder.

BS, loan payments are applied by loan numbers not a check dollar amount.

You missed a payment and did not "catch up", what do you expect? If one of your renters did that you would evict them. There is no additional payment, the payment they want is the one that you missed.

You need to run your "investment" business like a business. You need to hire a manager as that it is obvious you have no clue how to run your business. With the level of incompetentance you show you should be foreclosed on, I just feel sorry for your renters.
My mortgage got bought by ASC in Dec. of 2006. I have had nothing but problems with them. My mortgage has been sold many times and have never had a problem with any other company. Not only do the continuously call me on my cell or at work if my payment is not received by exactly the tenth of every month but they also charge astronomical late fees. I have had to call them numerous times regarding payments that they had not posted to my account. Everytime I call I get 10 different people who tell me 10 different things. I wish they would sell my mortgage to someone else already. I'm glad it's not just me, and everyone else has a problem with them too- at least now I know they really do suck!
This company bought my mortgage 3 months ago and there trying to make my payment go up from $504 to $659/month... and there trying to perforce place flood insurance on my escrow acct when they haven't furnished me proof that I'm in a flood zone. I want a lawsuit against this ### company... I'm on fixed disability income and these people are already trying to take my home.

I am in the mortgage industry so I should have not fallen into this trap but i did... I was refinancing my home. The loan closed 3 days before the end of the month - I have a copy of the wire transfer paying off my loan in full... ASC reported me late anyway - 2 months after my loan was closed and paid off.
I have sent them a formal RESPA complaint , and filed a complaint with the FTC. I also sent a copy of my dispute and FTC complaint to all three credit bureaus. It remains to be seen if they will fix the problem. The rep said " I can tell you know they won't take it off" and She said it with attitude too. NICE. I know I should have made the payment earlier - my bad. However it does not mean that ASC can willfully violate federal law... We will see.. Looks like I am not the only victim... I just may have better documentation...
Mr Lopez... and there was another rep from ASC have not violated any privacy policy law because they are not disclosing information on any one specific person BUT clearly they have really poor attitudes and should not be in customers service. They should not have asked you about how you make your income unless you were looking into doing a refinance or new loan. Since ASC only does servicing, they would have had no need to ask... Plus in general that is just random and rude...

There is no doubt that when you get behind on payments there is blood in the water, but after being 1 day late! Asc threatens forclosure after one day! I made a re-payment plan with them, and now my payment is $500 a month higher! I hope they lose their ### along with the rest of the vultures! They deserve jail time as far as I'm concerned.
If you are in the mortgage industry then you would know that if you are that close to your due date on your closing date you pay the mortgage. By law you will be refunded the overage. So I'll assume you are not in the mortgage industry, or just not very smart.
This company promises to work with you. You fax them all the information they ask for. In the end they do not work with you. They add hundreds of dollars to your payment when you get behind. I borrowed money from my 401k according to the paperwork they sent me. I then got a letter saying i was already behind 2500! If they had sent me the correct paperwork then my 401k would have sent the correct amount. Since the check was already mailed I could not get the rest to catch up. They make it hard to catch up because they add hundreds of dollars. This coming is a nightmare and am sure there are many that have lost sleep over this. I use to think they want to work with you, I no longer do. I think they want to foreclose. They dont care about the people. They are not willing to work with the people to save their homes. I wish you all well and hope that you can find another way to get your life back, be sure it will not be with this company.
On June 28th 2007 I called America’s Servicing CO (ASC) to confirm that my June payment was received on time because I mailed the mortgage payment that month only to learn that it did make it on time but it was applied to my May’s payment, which now was considered 30 days late and my June’s payment was still due. I asked the rep how could this happen and he stated “maybe your May’s payment was returned do to Non Sufficient Funds.” Not fully comprehending what the true cause was and without hesitation I quickly hung up the phone, got on the internet and paid the full June’s balance with May’s late fees.
As I finished my online transaction I began to research the scenario and discovered that my May’s payment was received on time (via online confirmation number ) and there had not been any payment issues with my bank neither. I called ASC back and enlightened the phone Rep supervisor BRANDY G2U with my new information, she conducted a phone conference with my bank, myself and ASC and she also discovered that my information was accurate. That being revealed she submitted an investigation request, asked me to fax in any information I had to support the case and informed me to call back in 15 days.
I called back on the 18th of July and the investigation was complete and ASC discovered that all the confusion was for my April’s payment and not my May’s payment. The Rep informed me that after they received my April’s payment it was was revoked in June by my bank. After speaking with the Rep I contacted my accountant and bank and researched the details in full and learned that I had submitted my April’s payment on time (via U.S.P.S.) and the full amount was deducted from my account. After concluding my own investigation I discovered and recalled that in Mid-May my accountant contacted me asking information about a check payment that was made to WFHM (Wells Fargo) on April 16th and did I have any knowledge of the payment because I have never made payments, nor have I conducted any business and I have never had a mortgage with Wells Fargo Bank in the past. Ignorant and confused at the time because of the growing ID theft problem, we quickly contacted my bank explained the situation and SunTrust Bank began an investigation on the check. Unbeknown to me at the time that check was my April’s Mortgage payment to ASC. After concluding their investigation nearly one month later my bank deposited the money back in to my account. We attempted to gain more information at the time to find out whom the Wells Fargo mortgage belonged to but my bank wouldn’t disclose any information, stating it was for “Privacy reasons.”
I absolutely had no Idea that at the time that Wells Fargo and America’s Servicing Co. were affiliates. When America’s Servicing Co. purchased my mortgage from New Century a year ago, they never informed me formally or informally that the two companies were connected.
I have contacted ASC constantly over the last two months to resolve the matter and wipe the blemish from my account and credit file but they denied me. Also, my mortgage is due to begin adjusting this December of 2007 and if I don’t refinance it I’m afraid I won’t be able to afford the payment.
I understand the growing mortgage problems in our country at this time and I fully understand ASC’s concerns and position but this was a very honest and rare mistake that could have happened to anyone at anytime. I have never been late on my payments in order to build my credit up. When I purchased my home in 12/2005 I had a 610 credit score. Over the last two years I haven’t incurred any new debt, I have paid off all credit card debt and the only thing on my credit is student loans and my mortgage payments, which I have paid on time and consistently. Before the thirty day late from ASC hit my credit file I was comfortably at a 692 middle score credit rating 6/6/2007, perfect positioning to re-fi my home to a fixed rate.
