rainsoft water softener system
After being told by a sales rep that came to my door from Discovery Marketing that my new born would get cancer if she was raised on the tap water, and assuring that with the free items, and 1 year of salt refills that the system would pay for itself and I would not pay anything out of pocket (single mother with newborn and one other child).
The contract gave me only 3 days to cancel, and working full time with 2 children, it wasn't possible however I WISH I had!
The sales pitch was absolute lies. They installed the system with no salt and I was ensured that each month there would be a delivery. The delivery never came. I called Aqua Finance because the paperwork was completely confusing (Discovery Marketing, Aqua Finance, and Rainsoft all involved here and pointing figures at each other). After not receiving the services promised when signing contract, I made complaints and had to go from person to person to reach the right people. The system was not working as promised as I was ensured food would fall of the dishes and macaroni would boil without sticking (both false claims). Finally, Rainsoft came out and filled with salt, I made complaints and again, was told there was nothing that could be done as the system seems to be working "okay". Regardless, I wanted them to come get the system, and because I was unable to make the payments, I attempted to work out other arrangements since I never made enough money to cover the $95 a month. They refused to work with me or look into my complaints of the false claims made that got me into this mess to begin with. I never heard anything from them after I contacted them and told them I was unable to make the monthly payment. In 2013, I received a letter from an attorneys office in Miami, FL. I sent in a validation of debt request, no response, I left MANY voicemails for the number on the letterhead and never a call back. In the fear that I would end up in court, I did research and realized it was the Aqua Finance account (the letter had MBC Investments as the creditor not Aqua Finance). I sent in a check for $10 and requested additional information again, made several calls, no response however they did cash my check! I sent a 3rd letter explaining that they cashed my check and were not communicating with me! NO RESPONSE! Now, here I am in 2018 and was summons from a new attorney. Low and behold, they had my telephone number, never received any calls providing payment address as Aqua Finance had no information on file and was unable to tell me where to submit payments in 2013 when I called since the attorney's office never responded. Now they want a total of 10k for a system I have never been able to afford to run and it has been sitting on the side of my house inoperable.
This company is a SCAM and they do not play by any rules. DO NOT SIGN A CONTRACT WITH THEM. I have signed many contracts and never have I been so tossed around and ignored.
violating terms of agreement
I just got off the phone with a representative at Aqua Finance. I would like to pay more than my monthly payment with a Visa Card and they stated that I cannot do that. I asked where in my Terms of Agreement that is and I was told, "It is Policy", so I asked to have the policy emailed to me so I can review it and I was told, "NO".
So I would like to know if there is any legal ramifications for this illegal financial behavior?

Aquasoft water softener
5 years ago, 2011 I purchased a water softener from aqua soft. They installed it outside in the direct sun, the processor board immediately failed. I called Aqua soft in Fresno and complained. The service man said it hooked up ok but needed us to pay a high maintenance fee to have it repaired, I explained that I had just purchased it that month, the response was too bad. so I paid the fee, as I recall it was $150. I then called the company back for service. A week later I didn't hear from them so I called them Back again, still no response. This went on for a couple of months until I got fed up and called them to remove the system because it didn't work and they wouldn't repair it.
Aqua finance contacted some time later me and asked why I haven't paid them. I told them the story and was told they are separate and the problem is with Aqua Soft not them. They are one in the same, they just hide behind the created separation. I had a few requests for payments but stood by my convictions and said I would pay when it was repaired. I stopped hearing from them and assumed they dropped it. Fast forward 5 years. While applying for a refinance of my home loan I find out Aqua Finance put a lien on my home stopping the refinance. I called Aqua Finance, talked to a Jose whom indicated that I must pay $2500 to remove the lien. I don't have that kind of money but would make payments, I'm a Senior citizen on social security and would pay them the savings on my house payments with the re-fi but needed them to drop the lien. H refused, I asked to talk to his superior, was given a extension # called, left a message and have not heard from the since.

about a year and a half ago I sent in a water sample to home depot few months later a lady with aqua finance shows up at my door she gives this extended presentation on the product in which I like at the time I worked off so my wife liked what the benefits were or what she was told she asked about a 1 week trial so I said ok if a week would give enough time to see a difference next day some one shows up to do an in stall pluming skills were weak the very next day some other lady shows saying we forgot to sign all of the paper work for the trial by then I was gone to work so my wife glanced but really didn't focus on the to hard it was just a trial when I call to get their equipment picked up I was told the trial was for 3 dAYS instead of a week and everything had already went through on the financing so I am stuck with a unit that they wont even come out to service that is way over priced I will never deal with them again
Website Payments - Don't be fooled
The whole purpose of having a feature on your website to make payments is for direct payments to be applied to your account. I was informed today (10/5/15) that when you are making a payment online, Aqua Finance's billing/payment system is not capable of this feature. What happens in the background is you make a payment once it is cleared your bank, the Representative told me that my bank sends them a physical check which will cause delay in posting your payment amounts to your acount and increased interest fees. I have always overpaid on my account and because the posting was not applied by my next billing cycle, the statement reflected no payment posting and 2 payments due on that next monthly statement. Come on Aqua Finance, get with a current Billing/Payment technology software because your Representatives are not doing your company justice. I'm happy with the product line but your finance company needs significant help!
they pulled out of a loan they contractually agreed to
I and a solar panel company financed with Aqua Finance Company. The agreed to the loan. So then the work was completed. We then completed the phone exit interview and informed them all the work was completed. At that time they stated we now decided to not finance the loan. Leaving the solar company and me up in the air. They backed out of their agreement but they did take all my banking direct withdrawal information.
I wish we read about this company before.

We purchased a water softening system for our home and financed it through Aqua Finance, Inc. We hadn't asked, which was stupid, how much the finance charges would be and when we got the first bill and saw how high it was, we immediately decided to pay it off. We payed what they financed and the finance charge shown under the "New Balance" portion of the bill. We thought that would be that and didn't receive another bill until June 17th. This bill showed that we owed $21.37. I thought this was in error and called and talked to one of the Vice Presidents of the company, Scott Chittum. I informed him that we had paid the "New Balance" when we received the first bill, in April 28, 2011 of $3022.19, which should have brought our balance to zero. Well, I called the phone number provided and spoke with a representative that told me she'd have to give me to someone else who could explain it to me better than she could. His name was Scott Chittum, a vice president of Aqua Finance. He told me that I owed the money as they charge interest daily and that I should have called for the "pay off" amount before I paid it off. He claimed it says it four times on the bill and insinuated that I was negligent for not noticing. I told him that I didn't see it even now (it is there 1 1/2 times but not prominently). But, what I did see was the "New Balance" amount which infers that is the balance to pay off, and a statement that says, "You may pay your entire balance at any time." It does NOT then say, "Call for your payoff amount." anywhere but does say, "For questions regarding this statement, to report a lost or stolen card, or would like a payoff quote, please call [protected]." It doesn't say you have to call for a payoff quote. It warns that if you make a late payment you will be charged a late fee and more interest. It warns that if you make only the minimum payment it will cost you a lot more because of interest. It draws your attention if you are a check writer to the fact that if you write a bad check they will charge you non-sufficient funds fee. But it does not warn you that if you only pay the "New Balance" you will still have to pay another payment and finance charges!
The complaint has been investigated and resolved to the customer’s satisfaction.
Terrible experience
3 years ago, we purchased a water softener system and receiving financing through Aqua Finance. Approximately 2 years ago, we defaulted on our contract and were sued. Judgment was entered against us 1.5 years ago.
From the month that judgment was entered against us, we submitted to Aqua Finance a repayment plan, to which they never responded. We immediately began making payments under our proposed payment plan, exceeding our original payment plan, and to date have not missed or been late on one payment since initiating the repayment plan.
Today I was contacted by an attorney's office representing Aqua Finance stating that they had a judgment and wanted to make payment arrangements. I explained to the attorney's office that I was making payments to Aqua Finance and he stated that he does not have any record of payment for 1.5 years (since the judgment). Clearly I have proof through my canceled checks that payment has been received, and I've also received confirmation directly from Aqua Finance in the form of letters stating they've received my monthly payments.
I suggested to the attorney's office that he contact his client for proof of my payment history and he told me it was my burden to prove I've been paying. I explained that my obligation under the judgment is to repay Aqua Finance and that is where my obligation ends. He said he would initiate garnishment proceedings since I'm not paying. I reiterated that I am paying and have been paying and he told me that I need to provide him proof. We went back and forth for some time until he became very belligerent and eventually hung up on me.
I immediately called Aqua Finance and spoke to a representative. The representative told me that she cannot discuss my account with me and that I would need to speak to their attorney. I explained that I have tried to but that he refuses to contact you and that you need to provide proof that I'm paying. I requested a full accounting of my history and she stated she would mail it to me. I asked her to provide to me the name and address of the attorney and she said she did not have that information available to her. When the attorney's office contacted me, they had blocked their number.
My frustration with Aqua Finance is their obvious complete disorganization with collection accounts and their practice of contracting with attorneys and agencies who resort to bully tactics in an attempt to collect on their accounts. While I'm an exception (as I am paying on my account per the judgment), how many others are out there experiencing this clear violation of their rights under the Fair Debt Collection Practices Act? I fully intend to file complaints with the Consumer Protection Division of the district attorney's office against both Aqua Finance and the attorney representing them as well as with the Kansas Bar Association.
My advice - stay away from Aqua Finance. They're unscrupulous and have extremely poor business standards. Perhaps we'll soon see them on Capitol Hill asking for a bail out.

-They lost our payment and then tried to extort another payment out of us!
-They illegally call outside of business hours - even when I explicitly told them it was illegal to call outside of business hours and clearly told them to only contact us during business hours. It appears others have told them this, as well!
-They changed our contract and then tried to slip it by us by telling us to sign another contract. They even said it was the same contract - until I read it and saw they had taken my husband's name off of the contract and the financing terms had changed.
-When I refused to sign their illegal and non-binding contract, they processed in anyway.
-They call at all hours of the day and night, repeatedly and when we answer, no one is there.
STOP YOUR SCAM, AQUA FINANCE!
I have been trying to make a payment for better than a month with debit card on their FREE online payment system with out success keep being told the site that I am sent to DOXO is not affiliated with them. Now I have a site address that takes me to online payment which turns out the only option they give me is to give them access to our checking account which I am not going to do as I don't trust them not to misuse my account information or protect info. I have been assured that a debit card payment is acceptable but evidentky that is not an option. Now I get an email saying that my payment due is doubled after being late because of their incompetance on bill payment if not blatant lies on what method of payment is accepted.
Aqua Finance is a company that wants you money, call you and tell you to ensure you are paying on time. I received calls from them, I was never late and actually paid off early, They called because they charged me interest the month after everything was paid off and said I owed .46 cents. I argued, that I paid off and interest should have stopped on the day I paid in full, they stated they have 15 days after payment to ensure my funds cleared, it was an electronic transfer, [censor]. I also, asked why it says I owe .46 cents, billed 30 days later, and they owe me $104, how can I still owe .46 cents. They are a scam, they also said it take 8 weeks before they refund me, they have to ensure I have no other charges. Again, it was paid in full, give me my money back.

I tried in the first few months to get out of this racket and tell them to pick it up, but as everyone has reported, they
don't take any responsibility. I guess that's why they finance the useless systems and the seller (who is local)
never responded to our inquiries. We knew where he lived, but were afraid he would say that we were harrassing him.
It is a crazy world we live in that their are people out there that will sell you crap without a blink of an eye. How do
they sleep at night. Well I'll just add, his house was three times the size of ours, so figure.
angry this had happened to my son which is a new home. He went to Home Depot and I guess he felt safe and had issues with auto pay and I got involved and it kept happening with auto pay so I looked into paper work and saw 17.99% interest rate revolving credit and I died. My husband owns irrigation company and his gut said same system $1000. So why is anyone not getting on Home Depot for the third party in transaction ?

After same thing happened me with with two years paying on time and having 0 awareness they opened a line of credit and the balance being near the original amount called my bank and they investigated said the site did not look legit and i even told aqua they can come pick it up! I never would have agreed if I knew it was a lone of credit!
Here is my experience with them.
I got a Rainsoft system from Home Depot. It will probably be the last thing I ever get from their services after finding this out. They came in did everything. The contractors that did the service here in Jacksonville was call A&B marketing, these people in my eyes try to nickle and dime you for service that is not even needed. That is not the worse part, they used Aqua Finance to do the financing of the system, told me the whole sales pitch, and ect. I signed and although it is partial my own ignorance in the laws and understanding credit at that time, it is still an evil company for what they do.
Here in the state of Florida we limit the APR on a loan 500, 000 or less to 18%. How can a person with outstanding credit scores be assigned a number of 16% APR. Almost half of your payments go to the finance charge for this company. I would advise not dealing with rainsoft, A&B marketing, and especially with Aqua Financing, and just getting a contractor of your choice to install one into your home then going or coming close to dealing with this company, all they do is generally rip money away from the people who work hard for their money, and they use the absence of state laws and credit understanding to do this. If you deal with a lender and you have good credit, my advice is if it is in double digits start looking elsewhere.
This company needs to be sued for over charging for a machine that only cost about 700 dollars and they charging almost 5, 000 dollars for it just sad I am having the same issue a rip offer and a scam company

Aqua Finance has got to be the most unscrupulous company I have ever had the misfortune of dealing with... I opened an account in 2013, was billed the first year on a monthly basis... the second year they became sloppy in there billing practices: sometimes you got a monthly statement then they could not find an account in my name, social security number or the account number they provided to me... They recently told me that I should have continued to pay them monthly reqardless. That they were not obligated to send me a monthly statement period! So the bottom line is they have increased my balance This company has no scruples, they are just out to steal your money! and keep adding to your bottom line anyway or anyhow they can...Connexus Credit Union was also involved in this mess!

Last year a salesman arrived on my door. Stating he had the newest in water purification. I listened to a 3 hour demo. by the end he promised that I would be showering in Aquafina quality water (after finding out my wife drinks aquafina). Also stated the system was used by Coca Cola. He also promised 8 years of free soap prducts, stating all the hosuehold soaps sold in stores were no good. He also stated the system would help with my sons Exima. After intense begging form my new wife i bought the system. I was able to notice a difference at first, but shortly noticed it was not working how it should. I was aslo told if I moved, the system could be moved to the new address by them at no cost. I recieved about 6 boxes of soap, with the remaining promised to be shipped. After several attempts to contact them, I have found all numbers had been disconnected. and no number to reach them at. The system was a $6, 700.00 doallar system. Needless to say I did not have the money. I was informed that I would be able to get the system for round 10% interest. I was contacted by the person who instaled the system, and found it would be at 17.99%. I was ok with this, Because it seemed like such a great system. Well about the same time I was not able to contact the company that sold the system, Aqua Finance had reaised my interest to 21%. They had also raised my payment to 2.2%. After several phone ccalls to the company, I am still at first base. Still confused. After a year of paying the minimum $136.00 month, I have only paid off about 200 dollars (started 6, 799, now 6, 500. This does not make much sense. they will not even tell me how long it will take to pay this off. After looking at the monthly statement i saw that I had $167 dollar finance charge. They changed my monthly payment to $143.00 month. To my calulations I am not paying off anything, I am adding 15 dollars to my balance every month. After asking for an explanation, they stated it was an estimate, but it clearly says FINANCE CHARGE on the statement. Any help with this situation would be great. I do not looking forward to paying for a system that does not woek properly, and i have to pay all this money for.

On October 17, 2018 i payed the balance of $15,781.43 on the account and monthly since received a notice the balance and amount due is $0.00. Suddenly they send me a bill for $270.46, with no explanation or response to inquiries. Today they reported it as past due and dropped my near perfect credit score 30 ponits.
I never got anywhere with them. I cintacted the guy who sold it after rummaging through some papers and the copy I had has 0 signatures but then aqua/connexus Swnt me a contract that was signed, through and through. They have called a thousand times and sent numerous threats. I just keep ignoring then cause I dont know what else to do. I was contacted by another consumer minths ago, who was trying ti form a class action lawsuit but cause they lived in georgia and I live in PA there are different laws and he had a different softener system and was approached in a store. He filed in small claims court, and won. Thry cancelled the contract, and he got his money back but I still have yet to find some lwgal representation for myself. Every case is so unique and there are too many companies out there who scam with a different name doing the same thing. They threaten to put a mechanical lien on the house but I found out they can only get what the amount of the item is for. Everything is in my mom's name though. I am the one who takes care of all the household funds, billing, etc.. on her behalf. I've pretty much given up on this getting resolved. I have so much other stressful stuff in my life this is the least of my worries at the moment. GL..
I just got nailed with their raising APR saying I signed and agreed to this. We have no contracts to review, not one single statement mentions a promotional rate period. We pay double payments and they are jumping my rate 8% higher than what I was paying. They said the sales man should have told me. Well he didn't! I even called and asked why the statement never mentioned any promotional period, he said he didn't know. I asked where in the contract does it mention this? He couldn't tell me. I realized, I never received a contract from them. I asked him to send me the contract and he verified my email and here I am still no contract. It says on all of my statements "Interest charge Calculation - Your annual percentage rate (APR) is the annual interest rate on your account." and it has a rate of 5.99%. So if it is based on annual why is the promotion ending in 9 months? That is not annual rating. How do we get them for misleading and misrepresentation of the lending stipulations? Please advise!
I have been looking into this since I noticed that there was a mysterious bill that showed up one day under aqua finance. I have this water system too and was promised all the years worth of chemical free cleaning products as well. Never got my free cleaning products and upon opening this bill it showed this as a line of credit which was never stated when the lady came and my mom was there too. She said all you have to do is pay $100 a month and after two years of that and noticing that the balance was close to the original price which was $5, 000. I tried to contact the company a few times and tried to tell them that I had no documents that the lady must have never gave us them. But originally it was under connexcus and then all of of a sudden these aqua finance bills started showing up. I don't know how to get out of this, and I even contacted my bank and they said the websites did not look legit! So I put a stop payment and now they are saying they are putting a UCC something on the house and that I may not be able to sell or move. I told them that they can come and get the system out of my house because it wasn't that important and I can get another one probably next to nothing. I had just moved to this neighborhood when this lady came to my house and did this water testing and I never heard from them again. I contacted them several times before noticing the change over to aqua finance. The people at Aqua finance sent me a document with my signature but the part about it being a credit line was never conveyed or mentioned when the lady came here. I would have never signed on if I knew it was a line of credit! And then to see that I was being charged about $70 finance charges which is absurd! I don't pay that much for my car loan! I have been trying to figure this out since about Oct of 2016 and then I find all these complaints but there is nothing new. Can we file a class action lawsuit against them?
Oh and the finance charges are a different price every time! On the paper it says apr % between 5.5 and 17.99 but they never had any intentions of billing anything other than 17.99!
Filing bankruptcy is the only choice. If you don't, they will come after you like a very hungry and angry lion. Believe me.

IF YOU STICK TO YOUR MINIMUM PAYMENT, YOU WILL END UP PAYING IN AROUND 84 MONTHS(USUALLY), NOW, IF YOU PAY THE MINIMUN PAYMENT ON YOUR CREDIT CARD, AND YOU PAY IT LATE, WHAT OTHER CHARGES YOU THINK YOU HAVE TO ADD TO THE BALANCE, AND HOW MUCH WILL GO TO THE PRINCIPAL(EASY!)
