Bensimon Diamonds Fraudulant sale of Diamond ring Worth of USD 51,050

I purchased an engagement ring from Bensimon Online PTY LTD for over USD 51, 050 on November 2020 and unfortunately have neither received the ring nor the seller processes the refund for the money i transferred as he keeps making excuses. I have trued every way but it seems he is playing around and delays every week. The purchase has official Invoices, payment receipts and telegraphic transfer slips.

The attached invoice shows the total amount of USD 51, 050 where the balance of USD 9, 000 is supported by the transfer slip attached that proves 100% of payment has been made on November 2020.
I need help as to which direction I can go to receive a refund and what legal options I have.

I would appreciate if someone can assist me please.

Desired outcome: I would need a full refund

I have had the same thing happen to me is month can not get ahold of the company or Ron super angry and upset as I still have not received any funds from the sale of my diamond . Let me know if you find a way

Bensimon Diamonds product or money back not received

I gave these guys 3.5 months to create me a beautiful Bensimon IVY ring for an overseas proposal. Whilst in the process of having our ring made, some negative reviews appeared online regarding Bensimon Online Pty Ltd not returning a ring to another customer. As a result I rang Ron Bensimon to confirm the date I was leaving to Europe and purposely told him i would be leaving 7 days earlier, just to mitigate any last minute stresses and problems prior to leaving. Not only did Ron miss the deadline, he also missed the extra 7 days and sent me to Europe to propose with a fake diamond because apparently he chipped the real one the day of our true departure date.

Whilst I travelled and proposed with a fake, Ron had organised me a new diamond and told me to send him the ring upon my return (August 12th) and he promised that within 3 hours he would replace the fake diamond with my new one and post it the following day. On the 26th of August (2 weeks later, not 3 hours) I told Ron I booked a ticket to Sydney to pick up our new ring and Ron said no problems. Surprise, Surprise I arrived in Sydney and Ron mentioned he needed another day. I informed him that I will happily take the stone and ring and would get my local jeweller to put it together. Ron admitted to a "white lie "and informed us that our new diamond (2nd diamond) was too Milky and he needed more time as the new diamond had arrived and he needed to set it. That replacement diamond (3rd diamond) according to Ron was perfect however the master jeweller was having issues with the platinum and he couldn't deliver it although I was anxiously waiting at Sydney Airport for a process that would only take 3 hours. It then occurred to us that we were being treated the same as the other customer who told his story in the Melbourne newspaper only weeks prior. We asked for proof that the diamond existed by simply sending us a photo of the certificate, in which he was not able to provide so we decided enough was enough and requested a refund which Ron promised would happen instantly.

After failing to refund our money, I reached out to the Director of the company on the 2nd September who promised everything will be rectified. There are three instances where Ron mentioned that money had been sent, however Ron failed to provide evidence of a receipt of the transfer. Today is Friday the 20th of September (almost 3 weeks later) and we still have not received all our money. Apparently because i requested a refund after 5 months of not receiving a product, i now fall part of the refund policy process although i never received a product.

This has been a 5 Month journey of lies and deceit and whilst our overseas engagement was amazing the entire experience has been tarnished. My 8 month pregnant fiancé has no ring on her finger because we simply can't afford another and is suffering from stress and anxiety daily due to the constant reminder of having lost $20, 000 of our savings, not to mention the additional pressures and complications of pregnancy.

We have uncovered that we are not alone so we strongly suggest you do your research and hang on to your money.
