Diversified Collection Services misleading informtaion/unproffesional service

I have been behind on school loans for a few years.I received a letters from Diversified Collection Services explaining i needed to set up payment arrangement sent me letters and called me repeatedly harassing me about paying them.They repeatedly called me until a employee named Bob Miller tricked me into agreeing $90 a month so my account wouldn't go into default to where the government would take my yearly income tax refund. I explained to them several times that the choices they were giving me to pay them were not under my standards and my ability to pay. I'm a single mother trying to pay my bills on time and they wouldn't understand that. They wanted too much money down which i could not afford to pay.I then recieved a letter from The U.S. Department Of Eduction stating to give them a call to work out the debt. I then spoke to an agent named Jose that was willing t0 help me out in my situation. He offered to send me a Financial Status Statement application to help me with a better plan to start paying my loans off directly to them and not the collection agency. He suggested that i call them and cancel any type of payment arrangement with them. I called diversified collection agency to cancel monthly payments and a very unfriendly agent named Tony Cardozo would not assist me to cancel payments. He was underestimating my intelligence and basically saying that i did not talk to the U.S. Department of Education.Well they were all lies and they were deceitful too. This is not a company to be trusted what so ever.

I am in the same situation with DCS. I received a call from them (not a letter) about my student loans. I was weeks out of a bankruptcy and in no position to make payments. Needless to say, I was told that they would accept nothing less than $436/mo. Now I am not working and missed a payment and I got a call today. The rep. laughed twice and told me "what does that have to do with your student loans." I hung up on him and his nasty attitude. Please forward me the number for the Department of Education so that I can see if I can make arrangements with them.

I have been disputing an old Sprint bill & previous account for years that is now showing on my Credit report. I contacted Diversifed and reached Mr. Hunt ph#[protected] who was VERY rude as soon as he answered the call. Mr Hunt contnued to talk over me and threatened legal action against me but when I was allowed an opportunity to speak he would cut me off and tell me how I was trying to get out of paying this delinquent account because I was asking to receive a copy of my payment/billing history on this account. I advised him that I believe I owe something on the Sprint bill but that I was questioning the amount requested. When he continued to be rude, I requested to speak with a Supervisor because I was tired of going back and forth with him. It was at this point that he decides to hang up on me.

If a collection agency buys our delinquent account, are we not allowed to request a copy of our account history if we want to dispute the amount being requested?

Diversified Collection Services unfair debt collection practices

I was first contacted by Victoria Campbell who is at [protected] ext: 7738. She told my account was in default and she would help me to do a student loan rehabilitation for which I was grateful. The deal was I needed to pay first $600 down and I told her i didn't have any money to put down. She then offered me $400 down and $137 a month. I only have $50 a month left after my bills are paid so there was no way I could agree to it. She told me to think about it and call her with my bank account info and they would start me off with only what I could afford. I said ok and gave her my information to debit my account for the $40 a month initially. 2 weeks later she called back irate stating my payment for $400 did not go through. I told her it wouldn't because I never have that much money. She told me I lied to her and I was trying to hide assets and income and that I was being sued for wage garnishment. I tried to ask her several times for a copy of the original loan information so I could understand my charges and interest rate and she said it's not her responsibility to provide them and I no longer had a right to see them. I contacted the Department of Education and was told they had not decided whether or not to pursue wage garnishment against me. I received a call on Saturday August 15 from Victoria again stating she was sick of my lies and that I was being sued and then she hung up on me. I have explained countless times to her that I only make $1200 a month full time and my bills are $1148 a month so there is no way I can give them more money.

CA push you around if they sniff you don't know your rights. So before you engage them to make any arrangement Google these and become an informed consumer.
1-what to do when you are contacted by a collections agency.
2-your rights under federal laws FDCPA and FCRA
3-Validation of debt (VOD), cease and desist (C&D), CMRRR
4-Your state's Statute of Limitations (SOL) on debt.
5-post your questions at debtorboards dot com if things get thick

Now you are ready to engage.
-Never ever accept/agree/acknowledge you owe/own a debt. First request/demand a VOD. Use CMRRR (you can call but not recommended. Be sure to record the call)
-Per federal law a VOD must be the original document with your signature on it, not a CA letterhead stating some amounts owed.
-If your state's SOL is expired on the debt it is noncollectable, you have no more obligation. They can only plead with you to repay. If contacted but you are not interested write a C&D by CMRRR, state SOL is expired and you do not want to be contacted over this debt in any way. You will consider failure to observe that instruction as harassment and you shall seek legal redress against the harassers. CC your state AG, your attorney, FTC, CFPB, etc. all of them.
-If SOL is not expired, debt is verified then negotiate a settlement (aim for less than a third of what's owed, the longer the debt has been outstanding the better for you)
-Next obtain a settlement offer letter (it MUST state "PAYMENT OF $xxxx WILL SETTLE THE DEBT IN FULL). DO NOT submit a payment without it PERIOD! If it's not written it didn't happen!
-If they tell you are you refusing to pay? Say a big fat "YES! No settlement offer letter, no payment, click!"
-Send payment via CMRRR (or signature required), check or Money Order only, no electronic access to your bank account (They will clean you out.)
-Upon completion of the debt payment (per settlement offer letter) obtain a letter stating the debt is settled in full.
-If you get the run around don't worry much hang on to the Settlement Offer Letter, attach it with all your payments proof and keep all those documents for life. They resell your paid off debt and then it's the same collections story all over again from another scammer collector.
OTHER THINGS
-If they call you too much or call family & friends or work C&D them via CMRRR. State that you do not want to be called at home, cell phone, at work or through family & friends and that you allow communication about this debt once a month, etc., by mail or phone (you choose). And that if these instructions are violated you will seek legal redress against them.
-If you talk to a CA ALWAYS write down immediately, who called, where from, said what, why, when, what, i.e. everything. This is acceptable evidence in court.
-If they violate your rights, state or Federal law, sue them. Each violation is worth $1000 to you if you can prove it. Many attorneys will take up your case for free if you have meticulous proof of the violations because the CA will pay their fees. You can also sue pro se - believe it, it's not complicated at all. Just post for guidance at debtorboards.com.
-Lastly I recommend all comm. with CA be in CMRRR form, ALL. If you must talk on the phone record ALL the calls. You may or not tell them you are recording. (They behave if they know you are). Instead use CMRRR it leaves a paper trail evidence against them that can turn into kaching! for you.

How to tell if a debt collector is lying? Ez. If the mouth is moving they are lying. You want proof?

And another lie. Kaching. And she decided that and her word is the new law above federal law? How is that even legally logical? These idiots will say anything but to me it's just proof that you are dealing with a high school derelict. If you don't have a right to see them I suppose you don't have a basis to pay anything either! So any collection attempt has come to naught! It is her responsibility to provide you with a VOD-federal law!

You are next to judgement proof. There's nothing more available for them to take if they sued you. But I will take that if they can't have intelligent idiots (oxymoron) who can work out a deal. You just might have a chance with a judge, they went to college you know.

I was also contacted by DCS and I also cannot afford the big payments they are demanding. They have told me they will file to also garnish my wages. I quit taking their calls because I am an adult and will not be treated as a child. They like trying to talk down to people. They are now harassing my brother and I did not give them his number. Something needs to be done to put these folks in check.

Diversified Collection Services harrassment/collection a scam

DCS is a scam. I was in a car accident a few years ago. I am permantley disabled and recieve SSA. Due to the rules of my insurance certain bills had to be paid by nationwide or the party that caused the accident. Well things didn't happen the way they were supposed to. I worked out a payment plan with the US Treasury Dept. to repay the debt myself. Currenty they take $90 out of my SSA payment every month, until the bill is paid. I also agreed to give the any stimulus payments given to pay them back. DCS has started sending my letters and phoning my home saying I owe them money on behalf of the Dept. of Health and Human Services. That I owe fees and a amount of over $900. They won't stop sending letters to my home. When I call I am told just to pay them the money that I owe in one lump sum and they will stop calling. These people are rude and a complete joke.

Diversified Collection Services harrassment of neighbors

Leah at [protected] x 3743 harrasses neighbors, family members, and threatens me to pay a debt that is not mine. I grew up in a town with three girls with the same exact name and now this person Leah feels that it is ok to call everyone in my hometown and now in my new neighborhood, because she happened to get someone that knew me. I don't know or care where the other two girls are with my same name, but if the harrassment doesn't stop I will get a lawyer and sue Diversified Collection Services and Leah.

i have been trying to settle a dispute i have with DCS for months. i was told the dispute process takes about 60-90 days and it has been 6 months. my wages were being garnished, but when the garnishment should have been paid off, DCS tacked on $3500 in fees and penalties. I sent paperwork to dispute the debt to JAMIE PENA at DCS Nov. 19, 2017. haven't heard from them since they got the dispute letter and stopped the garnishment. i think they are just hoping i will be grateful i am not getting garnished anymore and forget.

My name is John L Turner and I received a call @ my resident around the hour of 7:00PM and I was very disturbed by it because of the nature of the call and the strong pressure that was place on me of oweing back taxces in the state of Virginia back to year 1991. I have never received any communication involving this situation and levy on my account will commenced 11/16/2017 in the amount of $19, 720.08. I just want to satisfacory solution.

I have been constantly harassed by DCS especially Juile.Then I called to speak to a supervisor and he just judge me without knowing my situation. They were trying to get me to send them 50 dollars a month for the next 3 months.I dont have it I am currently unemplyed and my income is limited to 100 dollars a week.The guy I spoke to told me I would never be able to go back to school with my loan being in default.He was very unprofessional and I dont care how long he has been in this kind of business.I took it one step futher I called called the loan consoildation department myself.Which informed that I could do a in school deferment becasue I will be going ba ck to school next month. Your employees are not God the Ultimate Authority they need to become humble instead of getting humilitated by other people.Top be honest they need some people skills.

Diversified Collection Services... has called my house numberous of times.. looking for a neighbor. This is againt privacy laws. They are very, very, rude. I don't even have contact with my neighbor, and they giving their personal business away..

Diversified has contacted my dad who is very ill with cancer and continues to harrass him, my father-in-law and myself. They stated they would refinance my loan for $50 a month but upon receiving the papers, there was no mention of this and they stated they did not have to put that information on there and in the next sentence stated it was on there. They were asked to make all contacts by writing and they said they did not have to. I asked for the address to request them to stop calling and they told me to find it myself. So I did. And so the saga continues...

I just received my umpteenth call for someone named "Joshua Myers." I have no idea who this person is. At first it was non-stop calling from a Student Loan Company. Now it is from "Diversified, " but the guy calling wouldn't tell me what "Diversified" was, nor would he tell me why he wanted to talk to "Josh." I told him there was never a "Josh" here, never would be, I never knew any "Josh." I asked him how he got this number. "Josh gave it to us." I found the guy to be uncooperative, deceitful. He never gave up and still would not give me any information. I finally hung up. BTW, I told Student Loans to take his name off of my number (I do have a Student Loan, and I am on top of it).

Jennifer Owen from Diversified Services called my neighbor and left a message for me to call her. When I called I asked why she was harassing my neighbor instead of calling me directly. She said it was because she did not have any other way of contacting me (in which she later contradicted herself). I asked her what this was in regards to and she told me it was for my student loan.

I asked several times why I haven't received any notices in the mail. She told me attempts had been made to contact me via phone and mail. I have NEVER received a phone call or mail correspondence from DCS. I asked why I had never received anything and she said they are not responsible for the postal service. HAHA How about you never sent anything?!

She started to give me the information of the company and when I told her I didn't have anything to write with she started being nasty and said she told me three times to get something to write with, which she never said! I asked her to repeat it and she said she would not repeat the information. She also said that she will hold the account until the 21st. It just doesn't make sense. If you want to get paid... then why be nasty about it?!

I have read through all of the complaints regarding DCS and their alleged harassment and third party disclosure tactics. Please, learn the law, read it thoroughly. They can call you at work, that is perfectly ok and right for them to do. UNLESS, you tell them verbally or in writing that you can lose your job if they call again. They can call your family, neightbors, landlord, even the corner bar all in the hopes of getting you to call them. They cannot disclose your personal business, however the person they contact assumes it is a bill collector or looks it up on line that is not DCS' fault nor is it their disclosure. I see the nasty customer service comment all over the place in these blogs. One answer: they aren't customer service they are bill collectors, they don't have to be nice or accomadating. They do have to be respectful and give you full knowledge of what you are facing. That means when they tell you about the Treasury Tax Offset Program or Administrative Wage Garnishment, they aren't threatening you, they are informing you. BIG DIFFERENCE! Also, look up every major collection agency in America, they ALL get sued because of misinformed debtor's becoming money hungry and thinking that the bill collector has done wrong. Nobody is perfect, i will admit that however most of these cases are settled not won, due to the money saved with settling not because they collection agency cannot win their case. Please again read the FDCPA and learn your state collection laws, most of you are highly misinformed.

at 8pm as i was begining to sit down for dinner the phone rang when asked to speak with me i said this is she . i was informed of a 14, ooo dollar debt that had apparently been in default and was told that in a couple of days they were going to attempt to garnish my check the female on the line made me feel like i was being robbed at gun point from her nasty tone to being very short with me the moment i asked to speak with her supervisor she told me that she was not going to allow me to do that as if i wasnt an adult and that she wouldnt waste her supervisors time with me then hung up on me . when i called back the second time she pretend to be someone different and when i asked if she was a supervisor sheMARLA WHITE hung up again . the third time i called i got a guy named BRENT KING supposedly he seemed to be a little better until i asked for the website for the company and he informed me that if i choose to make a complaint the would automatically forward the account for garnishment though i was attempting to defer it and that because i had an account in default i had no rights and they only had to collect a debt not be professional or courgile to me .

Diversified Collection Services harassing misleading phone calls

April from this company just called and didn't tell us who she was where she was calling from. She said she wanted a personal reference. This company has v=called many times before trying to locate a woman who worked for us 15 years ago! Philip Herman apparently was given as a reference at some point.
The whereabouts of Brigitte Antonocci from 15 years ago is not known to us any longer.
I want them prosecuted by law if they harrass us again!

DIVERSIFIED COLLECTION SERVICES IS AN ABUSIVE SCAM COMPANY. They contacted me about an overdue student loan. Jen Decker told me my paycheck would be garnished this week unless I joined a repayment option/opportunity. I wanted to pay the loan more than I wanted my check garnished so I gave them allot of personal contact information. At the end of the call I was told they needed a $400 "deposit" to gain acceptance. The company that they say they got my loan from isn't correct and doesn't appear on google anywhere. When I asked for them to put the agreement in writing and I would sign and return it with a check they said they wouldn't mail a letter (even after stating they have made several attempts to mail me one, lie) and needed my checking account #. This loan has been in default for years. My address and phone # have not changed for 10 years. They said they got the loan a year ago but couldn't contact me. When I spoke with the manager HAILEY PERRY she told me she would not give me the contact information of the co. they got the loan from and urged me to give her my checking account # to be approved tonight or have my check garnished tomorrow. I told her I would contact the attorney general and the loan originator and get back to her. She was not happy, was harassing and abusive over the phone demanding my credit card or checking acct. # This is a nasty unethical business at best and should be avoided by all business and personal interests. Roberta Herman, I have news for you:

BY LAW a debt collector cannot identify themselves as a debt collector to anyone other than the person who owes the debt. They have every legal right to skip-trace. If at some point you were a reference, they have the right to use it to track the debtor down. Unless they are repeatedly calling, there is nothing you can do.

That's a pretty big bill...did you not contact TMobile to have the phone shut off once it was stolen? You don't state how long it was between the time you were "carjacked" and the time you were contacted by DCS. TMobile generally doesn't send an account to collection until it is 90 days past due (so you would have had 3 months to dispute it with them), and collectors generally send a written notice giving a 30-day dispute period before collection activities begin. Hmmmm... By the way, if you DID receive a writen notice from DCS prior to them calling, you only have 30 days to send a written dispute. After that, legally the debt is yours and there is nothing you can do about it. And DCS has every legal right to do whatever is necessary to collect.

Sorry folks. You have rights. But so do we.

I had got carjacked and My T-Mobile phone was stolen as well.Somehow these thieves racked up a 980.00 bill!They finally after 3 nasty reps told me if I send them proof they would take it off!They'd better!I'll help anyone I can if they do ...I have to get back with T-Mobile!They're great!Diversified better not have lied to me...be back with the news...good or bad!

Diversified Collection Services taking tax refund

DCS took my tax refund last year and are trying to do it again this year. I would gladly pay my student loan back if I was able to afford it. I have a documented chronic disease and have been on chemotherapy for over 2 years. I am still working, but my health care expenses are 50% of my gross income which is less than $18, 000 per year. I also take care of a drug addicted 19 year old daughter in which I had to take out a personal loan for in order to pay for her 30 day court ordered drug rehab which was over $10, 0000.
I lost my car and am borrowing a friends vehicle to get to work. If they take my tax refund this year I will not be able to get a car or get to work. I work for a real estate company and have to have a car. It is a requirement of the job position. So, if they take my tax refund I will lose my job which in tuen will make it impossible for me to pay my rent. Are they so ruthless that they would harass to the point of someone being unemployed, homeless, etc.? I find it especially hipocritical when under the new stimulas plan that thousands of lawyers have been waived their financial debt connected to their law school student loans. An attorney should be able to pay them back, especially considering that without their student loan assistance they wouldn't have their high paying job.What does it take to stop this company from their means of tormenting and harassing hard working people? It has to stop. Their actions are causing me incredible stress at a time when my health and the economic situation are enough to deal with. Tracy Berry [protected]

I don't understand how DCS still intercepts your tax refund after you have payment plans set up with them and pay diligently without fail! As hard as times are, why is it that NO ONE seems to care that services like this are putting the poor people in even worse shape! I could see if you didn't have a payment plan or wasn't paying like you should be but that's NOT the case.
What's REALLY wrong with this picture! Something has to be done!

I just went to DCS's website and now I understand why the "recovery specialist" I spoke with had difficulty understanding what I was attempting to communicate to him. And please note...I called them they did not call me. I had to get their number from the student loan corporation.

We are always looking for top-flight candidates; all positions require:

* High School Diploma or GED
* Free of defaulted student loans, state or federal liens
* Strong negotiation and communication skills
* Enthusiasm and a great work ethic

Experience in accounting, finance, or banking; debt collection; investigative skills; skip tracing; call center operations; sales; or loan servicing is especially relevant.

Current openings include:

Recovery Specialists
Education Recovery Specialists focus on defaulted student loans and individuals who have fallen out of payment programs. The work entails skip tracing to locate the person, initial contact to present options, negotiating appropriate and follow-through to completion. Minimum requirements:

* 2+ years general work experience dealing with people. Related experience could include debt collection, investigation skills, skip tracing, call center background, sales, loan servicing, finance or banking.
* Solid negotiation and communication skills; ability to stay calm and control the conversation
* Internally motivated and goal driven: this is a commission and performance based environment
* Previous collections experience a plus

I agree with Caroline Earnest, It happen to me with Huracan Charley in 2004, after FEMA sent me a letter explaining to me that I was not elegible to received help, due to my Home Insurance, they did deposit money in the account, I was confused since my Home Insurance went to bankcrupt and the Goverment institution took over my case. I thought that the money was part of my Insurance, later I found out it was from FEMA. After 4 yrs. DCS sent me letters and phone calls constantly, demanding me to take a loan, borrow money from family, and the procedure was the same as Caroline, after I set up a payment plan, they were not satisfied with this, until now they taking over everything, I have not stop making my payments but this in not enough for them, my taxes are gone for 3 yrs. The worse is after I agreed to send a monthly payment...boom! They charged me a Huge Interest rate. Well I know my story is similar to thousands and thousands that agreed with these Institution terms. I wish I had the opportunity to talk to someone that can understand our situation. THEY have made the mistake and now WERE paying for it!

I totally agree Caroline Earnest. I rec'd a phone call Dec 08 from a DCS rep (I dont remember her name), but she was really rude. She told me that since I defaulted on my SBA Disaster loan from Hurricane Katrina, I had to pay the full amount of the loan, plus interest in 2 days. Of course, I had no means of getting that amount of money. I then asked her if there was a payment plan I could do. She then told me she would get back with me. About 2 days went by and she called me back. The terms for the payment plan was outrageous. The terms included a downpayment of $7500 and monthly payments of $398. That was the lowest term agreement. I told her that there was no way I could come up with that money. She then told me I needed to borrow that money from family and friends or sell my house or car. Being as though myself and all of my family and my friends lost everything or close to everything during Hurricane Katrina I was left with the rep telling me that my paycheck will be garnished. At this point I had no choice. However, I was never told that my income tax refund would be taken also. I will admit that I did default on my loan (due to economic downfalls and my husband losing his job), I dont think DCS has the right to speak to anyone in such a rude manner. As a result, 15% of my paycheck is being garnsished as well as my tax refund. Times are even harder now than they were a year ago. My new rep at DCS is Jaime Pena, Ive left her a couple of messages and sent emails, but I have not received a response...well I take that back. I did receive paperwork in the mail, but I do not understand it at all and have been trying to call her so she can explain it to me. I think you should be given a choice for the repayment of your debt. Such as: take your income tax refund or garnish your wages. In my case both are being done.

Suzy re-check your F.D.C.P.A, and you will surely find that you are allowed 1 and only 1 call daily between the hours of 8am and 9pm, for the specified time zone. If you do not get an answer, you are still legally allowed 1 call. Now if you take it upon your self to call again you could open your company for a possible claim, also you are allowed to leave 1 and only 1 message daily on any machine. I may be guessing but you seemed to take offence with Stacey Freeman's letter. Are you aware that the average consumer has a business knowledge comparable to that of a 5th grader? That other than credit card debt, most people incur debt due to life changing situations. Such things as large medical bills, foreclosures, student loans, and some tax debt to name a few. Certainly we all should be responsible for expenses we incur and in the 20+ years I have been a collector, I have learned that no matter how great I think my skills are, I CAN'T MAKE A PERSON PAY IF THEY DON'T WANT TO! Secondly there is a better than even chance that no one has taken time to just listen to that person or the circumstances that have occurred. If I call a person and immediately begin with "slamming" them, you know brow beating them, pressuring them, threatening them with legal action that not only am I not prepared to take, nor in all probability going to take I put them on the defensive. Now I am sure there have been times that these tactics have worked, but I believe they are unnecessarily stressful for the debtor as well as myself. I developed a style where I call a debtor and if I can get them talking mention their debt and always ask how it came about. I cannot tell you the wealth of information I get and the relief that debtor feels because some one finally listened. Instead of demanding payment I help them to see how they can fit this debt repayment into the budget no matter what that budget maybe. The point is to take an antagonistic attitude makes something relatively easy difficult. I have worked with collectors who immediately and routinely label debtor as a dead beat. Who become the voice of doom over the phone and no matter how we describe it mistreat people, you may know the type, who have a flare for office theatrics, raising their voices, rudely hanging up on debtor, just plain being A__ H____. Owing a debt doesn't make you a bad person, it makes you someone who owes a bill and can't see a way out. Good effective collectors help people see a way out. Personally I feel when you respond the way you did it makes a industry already under attack appear particularly ruthless and low class. I wonder how you will respond if something changes in your life and you incur debt. I have been on my present job since March 2007 and last month was the first month I did not have the top total. My last job was collecting defaulted auto loans from people who had marginal credit to begin with that were set up in loans that were set to default from day one. I was there from 1999 to 2005. I was the top collector my whole time there and 22 months in a row exceeded 200%of goal. So remember debtors are people too, treat them as such and 2/3 of them will pay!..P. S you can pan my spelling if you like, don't need to spell to collect big $$$$$

Did you even read what you wrote before hitting the "Submit" button? This is the most immature, unprofessional letter I have ever seen, and I guarantee that if you did send it to DCS, it's hanging on a wall as a joke. No one would take this seriously.

What was the point you were trying to make? The fact that your annual beach trip was ruined because you had to have your unpaid taxes forcably deducted instead of paying them? That you don't know THREE PEOPLE on this entire planet that would vouch for you as a reference? Or that you don't know the difference between federal (IRS) or state (VA) taxes? If you charged clients $75 an hour as a consultant, you better start kicking out some refunds. I wouldn't hire you to consult on a second graders homework.

Once a debt ( that's D-E-B-T, not D-E-P-T) is turned over for collection, the agency has every right to speak with you once a day every day until the debt is paid. If you chose not to answer your phone, that's your problem, we can call you hourly trying to reach you, as long as it's between 8am and 9pm. It's not illegal and does not violate the FDCPA. Once the debtor receives the written notice (which DOES NOT need to be certified, we are private businesses not government agencies), they have 30 days to respond IN WRITING to dispute. Once that WRITTEN notice is received, collection activities are put on hold until the dispute is resolved, which, by the way, is usually in the collection agency's favor. If you don't respond IN WRITING, guess what...you acknowledge that debt as yours whether it is or not. Too bad, so sad, you will be the one paying. And guess what - that IS in the FDCPA.

Dear Stacy:

As per our telephone conversation yesterday, February 24, 2009, I reviewed my tax returns and while I only have actual copies dating back to 2002, I have sent for the IRS transcripts for 2000 and 2001 in accordance with the H&R Block files submitted. I do confirm that due to loss of my business in 2000, I owed VA state taxes. My 2001 tax returns were a big disappointment since they were e-filed and the IRS paid the state taxes owed for the first time, sending me less than $100 thus ruining my annul trip to the beach. I was also refunded $130 from the state of VA in 2002, which is a clear indication that the only year I ever owed taxes in my life was paid off. Since 2003, with the internet capabilities I have filed and have copies of all my tax returns.

Luckily IRS keeps records for 10 years despite the fact that the tax payer is only required to keep state records for 4 years. Whew, I just made it in the nick of time, plus since the e-file was started in 2001, I am sure it is so much easier to keep computer records besides all that giant bulky paper work they had to store and juggle around the IRS offices.

During my research for almost a decade old tax records, I had the opportunity to do some research on you personally and DCS as a company. Your presentation yesterday was excellent and you actually had my credit card in hand ready to make installment payments on a bill I did not owe, after loosing my job due to the Lehman Brother’s curse, and despite negotiations to get my mortgage rate reduced due to severe hardship. You lost me when you had to have 3 personal references before approving the payment arrangements. Do you know how many people die a year and no one knows them or even claims their body? Everyone has a credit reference or two but not all have three personal references, especially in a country where people leave jobs at an avg. of 2.5 years and move across country or just a few miles away and loose touch without a common thread like a job. I have lived in my condo for over 3 years and I still don’t know my neighbors; I did read up on your illegal techniques to find out if someone was still alive. Having little old ladies slipping notes under unknown neighbors’ doors-WOW!

Last year this time, to be exact, February 2008, you were one of the top performers of Starfish Home in Ventura WOW! I would hire you in a second to cold call properties for concierge services to get my company started! I have trained leasing agents for over a decade and you definitely have a special skill with closing a phone deal. In addition, while you were doing a great job, CDS has had more complaints filed at the BBB than cases they could settle. Just for fun, 113 cases regarding improper billings alone; I am sure you are aware of the rest of the laws suits and that CDS is not approved by BBB and not even an Inc.

While we had our chat yesterday, you were not aware that your initial letter dated February 19, 2009 arrived via mail a few hours before you started calling and not leaving messages. I would leave a polite message and ask for a call back instead of constant ringing The FDCPA has strict guidelines for fair credit dept collections to include rights of recipient to respond. A letter dated February 19, 2009 that gives you until March 1, 2009 to validate debt and date stamped February 23, 2009, with an urgent call from you stating that payment is due now and you have to make payment arrangements before tomorrow February 26, 2009 or assets/wages will be debited, are consistent proof of strong arming a debtor, not to mention an innocent person whose dept is not yet validated or ever will be, since it is inaccurate.

This is your job and you have the right make certain calls and send correspondence within guidelines. You must send tax collection notices certified [the IRS does], have accounts readily verified [unless planning on willful fraud], and allow the full 30 days as inconspicuously written on the back of your notice. Your letter alone with the record of calls placed to my home and cell yesterday, has already violated FDCPA laws and regulations. It is not my job to explain FDCPA regulations, but we do live in America, not all dept is actual, we are innocent until proven guilty; we don’t behead or stone to death without proof in this country; that I know off?!? Did something change since 2001?

Unless, DCS tries to defraud a large number of tax payers who owed 2000 taxes and in accordance with the 2001 e-file the IRS paid their outstanding state balances before issuing a refund if any. Many can be fooled into actually paying for funds they do not owe. They will have an honest recollection of dept owed, once reminded a decade later and feel threatened, or just tired. While I do not have 3 personal friends I do have some acquaintances in the real estate market and some pretty cool internet connections; just for the innocent. I was shocked to hear how many people were sent the same type of letters for past due taxes for 2000 paid by e-file in 2001 by the IRS to the state. I would give you my number to date, but that would not be as much fun as spending my day researching a bogus bill over twice the amount owed to the state of VA in 2000 paid in full in 2001 by the IRS. I am sure DCS has the number they attempted to defraud and so will the BBB and FDCPA regarding actual cases and attempts at defrauding innocent victims.

This is not personally against you, you were great, doing your job and almost had me, just pushed it a little too far and lost the sale. This letter serves as a response to your letter dated February 19, 2009 as a dispute of dept. All further correspondence will be in writing via email, fax or regular mail.

I bill $75.00 per hour for consulting services and I suggest you verify your dept and send an apology letter for needlessly wasting my time!

I have called this company over 30x's no return call. They want offset my taxes but have not given me the right to speak with someone and pay the debt. They send you to voicemails all day, and the customer services is nasty.

Diversified Collection Services awful company

I could not believe the gall of these people. They contacted me several weeks ago by letter, how they got my address I don't know---but I've disputed how much they say I owe on my student loans and have yet to hear back with any proof about that. Then today the lady I am currently buying a home off of calls me to let me know someone is trying to reach me. It ends up being the same lady who sent me the letter from DCS! Is this even legal? I can't believe they would go and contact someone who has no relation to me about this loan! How did they even get her number? I am in disbelief over the whole thing and will absolutely be getting in touch with them tomorrow. They are horrible in my opinion and the other posts on this site back up that sentiment.

DCS tried to collection a debt that wasn't mine. Jennifer Garcia was the collection agent and she is horrible in my experience. This company does not do their due diligence in confirming the debt to the person. Make sure to send a letter of dispute & cease and desist letter and it should stop them from contacting you on a debt that isn't yours. Send it certified mail. JUST DON'T sign the letter - be aware this company has had several deceptive practice lawsuits against them. You don't want them to have a copy of your signature. When I called, they keep saying "for verification purposes, please confirm your..." They aren't confirming anything, just trying to get as much info on you as possible.

I spoke to Joe Johnson from Diversified Collection Services, regarding student loan debt. The amount that I borrowed in comparison to the amount they want me to pay is at least 4 times greater than the original Student loan. I told him that I can't pay that amount. (I am a 57 year old person that has been suffering from chronic body pains to the point where I am unable to walk and at times unable to care for myself and am unemployable). Anyway, in an arrogant and pompous way of speaking, he told me that I have to use my charge card to pay the debt. That's a bunch of bull and his threat is a violation of the Fair Debt Collection Practice Act. Furthermore, he said that my SSI check will be offset by 15%. As far as I know, the law exempts SSI recipients. He further made no effort in telling me of the various programs that can assist me, according to a letter that I received from them, thus violating the Fair Debt Collection Practice Act again, this time by writing a false and misleading letter that seemed hopeful. In conclusion, the uppity snobbish guy hung the phone up on me. Nothing was resolved, so I'm sending a "certified mail, receipt requested", stating that I dispute the validity of the amount that they want me to pay.

Diversified Collection Services harrashing

Dwayne,

Could you please be more specific? I have dealt with this agency and complained about their techniques to no avail. I even complained to my Congresswoman, and I got a copy of a reply from a government agency saying they looked into the matter and could not find any evidence of harassment or wrongdoing on the part of the collection agency. As if the collectors are going to say, "Oh, yeah. We were rude and insulting and told her to get off her lazy ###, get a job, and just pay the bill or we'd assign her account over to the Dept. of Justice."

What was your experience? I'd like to know if others have had problems with this company as the U.S. Congress chooses which collection agencies to contract with.

These people are outright scoundrels! They have harassed my mother, my poor grandmother, and EVEN MY Ex-WIFE! They have no right to contact these people to discuss a debt collection! It's a shame my student loan company refused to work with me through my economic hardship and sold my debt to these creeps.

In most states such practices are illegal regardless of wether or not the debt is legitmate. Contact your State Attorney General, in Pennsylvania there is a web site to go to. You do not have to pay an attorney to stop the calls to friends, neighbors and relatives.

They contacted a neighbor that I do not know concerning my debt. I reported them to the FTC. The lady at the FTC told me that DCS is clearly in violation of the law.

I'm not a deadbeat. In fact, I've probably worked harder than you have in your entire life. Guess what...the economy is motherfu#$*d! I spent 6 years in college and graduate school for NOTHING! There are no jobs in my field so I've worked in hard, body-destroying labor jobs for the past 10 years! Yippee!

Don't call me a deadbeat when I've spent years crawling around inside coal boilers scraping scaling, years lifting heavy steel for metal fabrication, years in power generation and electrical work so lazy people like you can have electricity, heat, and all the nice shiny things that my hard work and many others like me have provided for this corrupt, sad, and dying culture of excess.

All I want at the end of the day is a little peace and quiet and not some [censored] bag from DCS calling me to tell me I owe money I already know I owe but just don't have to give...

most people aren't deadbeats! the entire country has fallin on hardtimes, hence why all the major auto makers have files bankrupt. i had a woman call me today about an old student loan i had totally forgotten about. i would be more then happy to pay it back, its not that i don't want to "REPAY THE LOAN" but i am among the many collecting umemployment due to companies closing. i cannot pay my bills put food on the table for my 2 young children, that i raise alone, but i make too much for foodstamps or anything like that.
when i tried to make arrangements with her she told me i had to pay it all back or they were granishing my unemployment, i asked if i could just pay so much a month & was told that because i don't have a checking account & they don't think i will be able to pay they won't set up payment plan, her exact words were "they don't want to set you up for failure. she took my monthly income, i make apx. 750 monthly, anyone in their right mind knows you cannot live off that with two kids. finally she told me to get a job, after explaining to her that my company closer last year i've been searching for a job since, her tone was so rude that i told her to go to hell & hung up on her.
i know these people have a job to do which is all well & good but when people are being honest & trying to make some kind of arrangement to attempt to pay why are they being so unreasonable wasting my time if they refuse to help unless you do exactly what they want you to do.? There is also NO NEED for these people to get loud rude or anything of the sort, especailly when the person they are talking to is trying to work something out, thats a great way to make people never wanna pay! i am going to try & work directly with my loan company i want nothing to do with these people.

I have been having problems with Alice Truman concerning a student loan my daughter fell behind on. Ms. Truman coerced her into signing a contract to pay 50.00 a month to prevent her taxes from being offset. Her taxes are being offset anyway. I am on the account as daughter's representative as she cannot afford a home phone and cannot accept personal call...
