Six months ago I contacted a loan modification company, Fortified Financial, to help me with a loan modification as I work full time and cannot spend my days on the phone. They charged my credit card $3000. Four months later they got an "offer" from my mortgage company that was actually higher (about $100) than my current mortgage payment! Despite repeated phone calls to Fortified Financial and many emails, no explanation was given other than, "This has to be a mistake." About a month later, another offer arrived that was exactly the same as the first. That was two months ago. My contract with Fortified Financial specifically states that I will receive my money back if they can't save me at least 10%. I have politely asked for a refund. No response. I've called many people and sent many emails to people in the company and have gotten no response. It would have been easier and quicker myself to deal with the mortgage company. And now it looks like I'll have to sue Fortified Financial, file a formal complaint with the state, call the local news channel complaint watchdog, and contact the Better Business Bureau...as well as modify my own loan. (Sigh) I wish there were more competent and honest people out there.

For all of us victims of the bounced checks please file a police report so legal actions can be taken against them. Also beware of them trying to set up another loan modification processing company that Jill will own. The reason Fortified failed was the processeing department. Another name they are trying is Fortified Academy owned by Scott Moffitt which is Dave's brother. City of St George turned the electric off at the St George office for Non-Payment!

I have had a ton of experience with Fortified. I tried to do a modification with them but since decided to work with a reputable company. Fortified is being run into the ground by Jill Hallows and she is destroying the loan modification industry with her lying, deception and unlawful practices. I have talked with several people and they have all said that Fortified never returns their phone calls and won't honor their money back garantee. In fact, Fortified has lost many of their good employees because they are so dishonest, bounced a ton of checks and have lost a lot of homes due to their disorganization. Don't trust these guys! My advice is to find someone honest to help you...

I am working with fortified right now. The lady I am working with told me that they changed their internal processes and that's why it's been taking them longer to work on my case. The employees used to be paid by salary, now she says they get paid by project. If the employees (loan processors) get the modification done, then they get paid, if not.. then they don't. She mentioned that many people left the company because of this change. Do anyone knows anything about this? I am wondering if she is just saying this to cover their terrible work done.

I am looking to file a Class Action Suit against Fortified. My number is [protected]. lukematthew@hotmail.com
I, like many others and even more who have not posted or said anything are completely dissatisfied and furious with Fortified. I am going on TWO years with them. I was one of their first client back in January of 2009 before they spent all their money on nice leather sofas and nice offices. They have not only botched and ruined my chances for a fair mod but they have ruined my neighbors and 4 others who I referred to Fortified thinking that Fortified could do something. ALL of us have gone nowhere with them and some have already lost their homes. I won't go through my torture and nightmare with them (it would take an entire page and then some). Let me just have the BBB say it, as of Aug 2010

Based on BBB files, Fortified Financial, LLC has a BBB Rating of F on a scale from A+ to F.
Reasons for this rating include:
• 36 complaints filed against business
• Failure to respond to 3 complaints filed against business.
• 10 complaints filed against business that were not resolved.
• BBB Accreditation was revoked because business failed to comply with agreed BBB standards.

I have 4 properties contracted since Feb 2010, and after countless voice mails, emails, and phone calls -- nothing. I finally scheduled a meeting with Jill Hallows and Virginia Burr in August to complain that nothing had happened since Feb. They were very pleasant for over an hour and promised me they would follow up with regular phone calls and emails to keep me posted. Nothing. I now find out in Oct from two of the banks that the only correspondence they have heard from Fortified is an authorization form received back in Apr. None of my financials were received, no documents, no phone calls to negotiate a modification -- nothing! Basically nothing has happened but the cashing of my check. I am now taking over my own modification and will pursue them in small claims court for a refund, although that sounds like a waste of time from what all of you are saying. I am all about a class action suit - not only for monitary damages (there doesn't appear to be any money), but for criminal charges. David Moffit and Jill Hallows need to be stopped, and taught a lesson!

I went to bunco tonight and 3 out of 12 people have lost their homes because of fortified financial. I have come to terms that i may never get my money back but I definately think we need to do something. crimal charges etc. This is crazy. Where do we turn and how do we start a class action lawsuit? It is apperant none of us have any money - do you think there is an honest lawyer who will take our case and get paid after we win? Please email me and let get the ball rolling - I'm done - Fortified Financial just keeps adding people to their scam.

Well, I haven't checked back into the post in awhile and it looks like many more people have been hosed. My court date was postponed once again, and that little weasel Dave Moffit was notified by the court and Dave was supposed to notify me and he did not - big surprise. So now we go in next week on the 19th of October at 9:30am. I'll call first this time, but this crap has been going on for over a year now. Fourth District Court 75 E 80N American Fork if anyone wants to come. I'm hoping the judge gives me a choice of 2 to the head and one to the gut and my money back plus sanctions for neglecting to notify me. Just an FYI - Bryan Booth - Dave Moffits attorney has decided to no longer represent him. Hey, he might be a good attorney to use? I'm betting he is owed a bunch of money. I'll pop back in here after court next week with the verdict, but if there is justice on this planet I expect an easy win. If anyone has Mr. Moffits home address it might be humorous to post it everywhere and let karma fall where she may...karma is a beautiful woman that will eventually visit those in need... Hey Dave, if you're are reading this, see you next week you slimy piece of pond [censor]! Sleep well until then...

I too have been scammed by Fortified Financial. I started in August of 2009 when I paid $2500 by check for them to get me a modification of my loan. It took months and months with continued submission of updates of pay stubs and util. bills etc. and finally in May of 2010 I was notified by my lender and Fortified that my application had been denied. I tried to get a refund but Fortified said no as they felt they could get me something else through my lender that would help and they needed time to reply. I fought this but finally had to agree to allow them more time to try as it seemed I had no other option. I resubmitted the whole package of application material again, as per their request, and waited for a response. Heard nothing from them for a couple of months despite my repeated attempts to contact them and get an answer. I finally heard from them stating they were continuing to negotiate and they now needed more updates of my pay stubs, util. bills, etc. I finanly called my lender and got through after much time to the department that handles loan modifications and was told by the person their that has access to all the information on my loan and requests and all for modification that they had no contact with Fortified since my denial was given way back in May. I had been totally lied to about Fortified continuing to work with my lender for some other modification help. That was the final straw and I got the forms for taking Fortified to small claims court when I found for the first time this site with all the various complaints against Fortified so I am now wondering if they are even going to be solvent enough to get any money out of at all even if I win at small claims. Should I waste more money and time in filing this or what are my options now. Any comment will be appreicated. My email is dgsatt106@gmail.com and if anyone in Utah County wants to call me who has had the same kind of problems with Fortified as I have then call, Doug at [protected] or my cell of [protected]. Thank you and good luck to the rest of you who have been taken by this fraudulent company.

I have been following these blogs and keeping my finger on the tabs of Fortified Financial for the last year as an investigator and meet with the owners on several occasions. I believe their intention were good and they did help a lot of people, but you know what they say about good intentions. They have closed and are out of business and preparing for bankruptcy, however in their attempt to try and help their clients they have contacted a very reputable organization with a 9 year track record to try and assist old FF clients. My understanding is that an email is being sent to all clients of this notification and should see something shortly.

My understanding is that clients will be given an option to work with this company for a deeply discounted rate of around $200 per month. They are a consumer education and protection company who looks after the best interest of American consumers and have as part of their program a law firm so you know what your rights are regarding your bank. FF mistake was guaranteeing and promising certain outcome and selling people who did not qualify for a LM. No one can guarantee you a particular outcome, if they do, run don't walk as fast as you can. The company that has agreed to come in and help in not a LM company like I said, they are part of a law firm and provide a wide range of financial recovery services. They have been helping consumers raise their credit scores by educating them on the laws and using strategies to lower payments on debts including mortgage payments. My understanding is that past FF clients who still want help will be given explanations of what their options are to save their homes, including having your file emailed to you so you can proceed if you want on your own.

There are other options other then LM and lets face it people, sometimes it does not make economic sense to save your HOUSE. Your HOUSE is not your HOME, your family makes the home, and if you can't afford the payment, don't blame anyone but yourself. My understanding is that 98% of FF clients were not making payments to their bank while under the care of FF. I look at it like this in a way, if that is the case then for most of you the $2500 too $3500 you paid was the cheapest rent you could have gotten. Still does not make it right if you got promised something like a refund, they should have set enough aside to refund people they could not get modified.

If America is going to turn around it has to start within the walls of our own homes. Like I said, there are other options, Short Sale, Deed in Lieu of Foreclosure and get keys for cash. Maybe its time to rent for a little while, rebuild your credit and see what happens to the market. The owners of FF I know feel bad and it looks like there are some bitter employees, because of bad payroll. My understanding is that this organization has even agreed to move people into the old FF office to still try and accommodate people with face to face help if they need it and they are setting up a hot line to call.

I see this a lot of this unfortunately, companies with good intentions who just could not hold it together. I am hopeful we can all do our part to rebound this country. Again their are options out their to minimize the damages, there is no guarantee that any one thing will work. But if your willing to detach yourself from your HOUSE then sometimes you can see more clearly. Good luck to all the people on this blog.

It is a little disturbing that people actually think the owners of Fortified cared. They shut down and moved on with out a bit of remorse. I was personally paying my mortgage until I was instructed otherwise by Fortified. It is no wonder that 98% of their clients were not paying their mortgages - Fortified instructed us NOT to. At the time we trusted them -BIG mistake. I'm sorry that things have gotten so ugly and Fortified should get in BIG trouble and honor their guarentee! What did they do with all the money that they were given - cause we sure in the hell have not seen it! It is our money - give it back. They will get their judgement in the end. Hopefully from us (courts) and from GOD.

Yes (UTInvestiGator) just in case you are unable to finish that quote, the quote is “The road to hell is paved with good intentions” oddly enough I think you, your brother, sister and everyone else involved with Fortified SCAM are speedily headed down that path and if you want to help yourself you’ll want to come clean and STOP abusing other families and lives.

UTInvestiGator, seriously? Couldn’t you think if a better avatar name? Something like FortifiedScammer, TakingPeoplesMoney, IDontThinkIWillGetCaught,

If you truly are an investigator you will provide your contact information. For example, ANYONE including Fortified can contact me at [protected] lukematthew@hotmail.com . By the way, if Fortified was as great as you say, why would you need to investigate Fortified?

Amazingly, though, I think this is the MOST that anyone has heard from Fortified in MONTHS?! Good to know that you and your brother are still around and have not left for the Cayman islands with all our money.

Fortified bankrupt? Hum who didn’t see that coming… by the way in the last two years assuming that you had 1000 clients at $2500 each, that’s 2 ½ MILLION?! How did you guys blow all that? Could it be the big billboard on I15 or the lavish new offices etc? Oh I know, it’s because you had to pay your employees… wink…

“If America is going to turn around it has to start within the walls of our own homes” …. oh very nicely stated… Let me give you a what the Bible says “In those days was Hezekiah sick unto death. And the prophet Isaiah the son of Amoz came to him, and said unto him, Thus saith the LORD, Set thine house in order; for thou shalt die, and not live.” – 2 Kings 20:1 KJV Okay I may have gone too far but before you or I or anyone else meets our maker “maybe” YOU should consider putting YOUR house in order and setting “right” with your fellow men.

As for giving you guys another try for modification? (although it’s under a different name) “A stench by any other name is still a stench”. As for a hotline number… hum I won’t hold my breath for that. Trust me if you had a hotline number to call I’d be the first to call it.

In the end though, "The truth shall set you free". No one is free, however, from the consequences of our actions... you can run from the law but you can't run from God.

PS... I actually DO know of people that can help you if you (like myself) still need help with your modification. Even though I have gone with a firm in CA there are legitimate companies in UT. I am sorry to say that you will probably need to pay a fee but I am sure they would be willing to help. Contact me if you would like their information. As for my case, I had to pay another $3000 to another company to start this process all over again after 22 months of Fortified excuses.

All that any of us were asking for was our guarantee money (AND our stupid files) so that we can hire a legitimate company to start all over again. I am sickened by stories of all those who lost your homes because of Fortified.

Matthew... you deserve a standing ovation. Fortified (otherwise known as the big "F") has committed crimes against so many people. I know a family that they (Jill) actually took their money, deposited the check and the same day denied the file. They were never reimbursed. Let me know if you want their number...they are willing to go to the FBI and the Attorney General with their case.

Deception was not uncommon for Jill Hallows and Dave Moffit. Jill has written more bad checks than anyone I have ever known and the employees have also started a class action suit against the big "F". I seriously hope Jill and Dave not only get their licenses revoked, but they serve time in their new "modified home" at the point of the mountain in Bluffdale, Utah. Beware of anyone associated with Jill Hallows or David Moffit.

I too was ripped off by Fortified. I am grateful to see that people are taking action. My feeling is that the more people who contact the media so that the story and the names of the rapists( aka Dave Moffit and Jill Hallows) are out there for everyone to see so they know who to avoid. Here are some contacts: Fox 13: news@fox13now.com, 2 news hot line: [protected], Channel 4: www.abc4.com at the bottom of the page go to Station then click Contact then go to Report News/Take Action, Channel 5: [protected].

Things that I will include in my info I am sending in are: that I have heard they are working with Accelerated Mortgage in South Jordan and Fortified Academy. I have also heard that they were looking in to working with his sisters non- profit organization I am researching to find the name, but that they were going to offer people ways to get grants for their homes through the non-profit org, at this point that is hear say so I am making calls to get more info, also the news reporters I am sure will do their own investigation on both of them. I heard that Dave took over $200, 000 out of the company before he closed doors, if that is the case there is a possibility that he pierced the veil of his LLC which he thinks is protecting him from any personal responsibility. If there is an investigation and he has co-mingled personal with business under the LLC I believe that pierces the veil and he looses his protection, any info on this could assist in taking action against him. I am also looking to see what info I can find to have the IRS investigate him for fraud. I feel the media can assist with all of this so the more info we can get to them the better. My greatest desire is to assist unsuspecting families with knowledge of these two violators.

So this is a little random - Fortified contacted me for the first time in months today. Guess what guys - they have another option for us! They obviously closed their doors and are claiming bankruptcy (like we didn't know that). They acted like we should be surprised - oh wait we heard it through the grapevine aka complaints board awhile ago. Any way here is the option they had for me. The people at Fortified feel really bad so they have hired an attorney to finish our loan modifications for us - but wait there is a $250 fee that I am responsible for paying! Oh yes this is really what option they gave me. Wow - I definately think that I should give FF more money #1 because they are trustworthy (hehe) and #2 they haven't already made enough money off of us! Seriously fool me once shame on you - fool me twice shame on me. I think I have a better lawyer that I will pay my $250 to. Good luck everybody!

Mr. Luke,

Lets get something straight first and foremost. I am not related too, friends with or associated with Mr. Moffitt or Mrs. Hallows, and yes your Bible rants are a little overboard.

It is likely that Mr. Moffitt will face some jail time, if he can not prove that work was done on files, unfortunately these investigations and subsequent subpoenas take time and me reveling my true identity to satisfy your curiosity would only hurt your outcome believe me. Of course you can always create a lynch mob and take your own vengeance, its sounds like this is eating at you non stop and it may be easier for you to extract justice because the owners of FF may never face any real jail time, fines or anything.

FF was given directive to contact past clients too inform them that a consumer advocate company and law firm has offered to help. By the way they have been around over 8 years and have an A rating with the BBB so Mr. Moffitt or Mrs Hallows having anything do do with them other then the transfer of files is ludicrous for you to ASSUME and you know what that spells. Of course this company is taking on a risk and my personal feeling is that a week or so into talking to past clients they may just retract the offer because it wont make sense to them to take on all the problems from FF. They are currently helping over 2500 families around the country in saving their homes who pay $3500 per file. I knew they had agreed to reduce their fees, it sounds like they are offering to work on FF files for $250 per month. Sounds like a pretty fair deal to me, and you need to realize this company has had nothing to do with FF up until now. In fact, I hear that they were looking for additional space in UT county and the building FF was located in was were they were looking and that is how this came to be. They have agreed to take over the lease and the clients, not sure taking over all the FF problem clients is a smart business move, but if you knew the owners of this company you would realize they are patriots who have a passion about helping people.

I would advise people to go to http://makinghomeaffordable.gov/modification_eligibility.html to see if you qualify for a Loan Modification. I am guessing that the majority of the dissatisfied clients never qualified and should have never been offer or sold loan modification. You can also visit NACA http://www.naca.com/index_main.jsp?language=null NACA has also helped a lot of people but their terms are not as good as hiring a legitimate attorney firm of loan modification company, it could be the answer for you.

I am truly sorry that you have all found yourself in this situation. There are many areas that one could point the finger towards, FF certainly should take blame, so should each of us, but most of all we should all be rallying and taking a post to take our county back from the banks. The banks are too blame, our banking system is too blame, it is the most fraudulent cartel in the world. The privately own Federal Reserve Bank, (yes you heard it right the Fed is a Privately owned bank by 13 very powerful American and European family's) is the real one to blame for this mess.

I would encourage anyone that is seeking assistance to do their due diligence on any company and if they promise a guarantee of any particular outcome you should run not walk as fast as you can. My hope is that justice will be done, first and foremost for families who are on the verge of losing their homes, by finding a way for their homes to be saved. Second is that justice will be served on those who took advantage of anyone, its not fair if money was taken and work was not done on your behalf or that you were not refunded money as part of your agreement. Good luck to you all.

UTInvestiGator if you really were an investigator you're probably breaking laws yourself by posting your so-called findings and investigations on the internet especially if it's an ongoing investigation DUH! Secondly, you can't retract the guarantee offer unless both sides agree it's called "breach of contract”! 3rd you say Fortified has been around 8 years? Quote from their website, “Fortified Financial was incorporated in 2004” umm I asked my 8 year what is 10 minus 4 she said 6… yes that’s 6 years NOT 8 years as you say. WOW and you call yourself an investigator? You are doing just as great of a job lying through this post as you were helpful at Fortified. As to your point about the Federal Reserve Bank being privately owned… YOU ARE IN IDIOT. The Fed is composed of mostly 12 regional banking districts and yes some or even majority of the “stocks” may be owned by families here and in the US. Sheesh just look it up in Wiki. You really do suck as an investigator. Finally I’ve been asked to not to post anymore via my lawyer… we’ll see you, Moffitt, and all the others liers in the Class Action Suit. “Truth shall set you free” lukematthew@hotmail.com

Mr. Luke,

You need to read the post people place thoroughly before you assume again. First I said the company that has offered to help old FF clients is an 8 year old company not FF. Secondly I said nothing about retracting a guarantee, I said they should never have given guarantees. Thirdly who is the idiot? Do your research into who really owns the Federal Reserve Bank Sir, your ignorance is stunningly obvious now. Is Wiki were you get your education? Wow the wool has really been pulled over your eyes, or maybe you have not spent enough time in this country too figure who runs the world. You probably think BILL Gates and Warren Buffet are the richest people in the world too don't you. Lastly as part of my privet investigation I looked into your account with FF. Answer me this fine Sir. Did you in fact only pay FF $1500 and not the full amount as you agreed too? Did FF in fact get terms for you on 3 different occasions? Did you in fact find a job and therefor your hardship was no longer valid with your bank? If this is the case then I would say that you would be the one who is in breach of contract. Lastly never I have I once said that I was an investigator with any state of federal agency, not all of us work in the department of CP, or the AG office. Your rants, name calling along with your complete lack of understanding of how our banking system was established only cements the fact that your ignorance and that you are looking for a scape goat and someone to blame. The truth of the matter is, from what I have gathered to date, FF successfully got terms for nearly 1700 American consumers and there is only a handful of people that they were unsuccessful in getting terms for, and you were not one of them. They went to bat for you and got terms 3 times, which you did not follow through on and now thankfully you are back to work and do not qualify for a Loan Mod. Your anger and bitterness is destroying you down to your core and you are looking for someone to blame for the pitiful state you find your self in. Never once in these blogs have you taken responsibility for your own actions, never once have you stated that you took out a loan you could not service. The truth will eventually all come out and set us free you are right, and perhaps now the people you are rallying to anger will know a little more about you and the truth about your relationship with FF and all they did for you.

I would love to know how UTInvestiGator has ALL the inside information about the new comany that is supposedly taking over FF files, since the meeting with processors and agents was not until yesterday. The one thing that this person has failed to mention is, most of the former FF's management team (Dave, Jill and Becka) are working for the new company--which by the way is called ACIB/Patriot Law Firm (American Credit Information Bureau). At the meeting yesterday, it was Dave Moffit who did most of the talking. The new owner did stand up and introduce himself and basically told everyone who was there, he is afraid that maybe they have bitten off more than they can chew. Don't be fooled by th new company name, it is the same people who screwed up all the files before, doing the work for the new company.

As to the fantastic reputation this new company has--how great can they be and how much integrity can they really have if they are joining forces with Dave Moffitt and Jill Moffitt Hallows Howes? These people need to be stopped from working in this industry once and for all. They are monsters who do not care about the families, and are only out for their own interests.

Please let all your friends and neighbors know--it might be a new name, but it is the same criminals working on their files.

UTInvestiGator, you crack me up… “Oh what a tangled web we weave when at first we try to deceive.” Yes I would rather get any information from Wiki than from your deceiving lies and posts. But SINCE you don’t like “facts” and choose to make up your own facts (oh kind of like what Fortified did). Let me direct you to the FRB site http://www.federalreserve.gov/generalinfo/faq/faqfrs.htm . It does have stock holders thus my point about banks and families that can hold stock in the 12 regional banks but the FRB in itself is an entity within the government.

By the way, private is spelled “PRIVATE” not privet and there too many grammatical and spelling errors on your posts that clearly shows your ignorance.

As for your “so called” investigation on my file, FACT is my family paid more that $1500 (if you were really an investigator you would know that sheesh –PS we have a copy of the “cashed” check to prove it oh yeah try to fight that one in court LOL ). Also, because we started back in Jan of 09 you’d realize that back then David wasn’t scamming everyone for $2500 or $3000 that those after me were scammed for. So ours was paid in FULL.

FACT, YOU DUMB IDIOT how can I have had 3 terms IF THEY NEVER CLOSED MY FIRST MODIFICATION WITH CHASE WHICH I DECLINED BECAUSE IT WAS A HIGHER MODIFICATION THAN WHAT I HAD. IF you were an investigator you’d realize that my first request from Jan of 09 was still open up until last month when I told them to CLOSE IT 22 MONTHS LATER!. YOU CAN’T HAVE MORE THAN 1 MOD REQUEST ON FILE WITH CHASE UNLESS THE FIRST REQUEST IS CLOSED. I told Jill that for months and she still didn’t close out the FIRST! Seriously you suck as an investigator. As for a job, again you are an idiot, I changed jobs in 2008 and NO that was not the reason for my hardship my hardship was because Chase upped my mortgage from $2, 000 a month to $2850 a month in 1 year! AGAIN proving how much of an idiot you guys at Fortified are. SHEESH you have my files READ it before you try to post something that obviously you know nothing about.

ARE you KIDDING me? FF successfully got terms for 1700 Americans? Everyone reading your post is ROFL with tears in our eyes.

You are right about 1 thing, my anger and bitterness against the liars, cheaters, and deceivers at Fortified IS what is fueling my reason to bring all of you to Justice.

PS you claim to have “looked” at my file, unless you are part of the “government” you do NOT have access nor rights to access my “file” (you’d know that there are legal and criminal issues if you did) UNLESS of course you are “lying” and of course I am right and you are indeed Jill, David, or Julie.

Wow...where to start. First off, y'all have every right to be mad as hell. You put your most valuable possession in Fortified's hands, both monetarily and emotionally. And you were let down...scammed...kicked-in-the-crotch, as you will. Yeah...rant on, I say.

When we’re wronged, our instincts tell us to right that wrong. We want justice, and even revenge. Suing Dave is your God-given right. And in a different situation, we all could come out of this feeling that justice has been served.

That said, I think...no, I KNOW that the things that UTInvestiGator are all TRUE. I know who he is and I can tell you that he knows his stuff. I know this because I was a Modification Processor for Fortified Financial.
My story--- I started in July, and during my short time there, I was able to get terms for 5 families, and it felt dang good. 5 is not a lot, I know, but I felt like I was just getting started, and became addicted to helping families stay in their homes.

My clients weren’t just clients. They were families. MY families. I loved my families (still do) I found out that by the time I got assigned to them most of my families were plain pissed off because they HADN’T been taken care of the way they wanted. I aimed to earn their trust, and I did. Mostly, anyway. I worked most days from 9 am to 9 pm. I didn’t get half the training I needed (I know now it was because of the state of emergency the company), but I managed to ask the right questions and get kinda semi-good at what I do, and actually learned how to kick lenders’ butts and actually help some families. Best feeling in the world.

When I came to understand that the company was in trouble, I was one of the last to jump ship, even after the whole management quit. Call me gullible or just plain stupid, but I believed Dave and his plans to keep the company going. When it closed its doors, The Company owed me over $1000.00, and I realized that I had been working the last 2 months for free.

Yeah…I was pissed. I got screwed too. That $1000 is a huge amount for my family and me. I too, wanted justice. I joined this group. Read everything you angry people had to say. Though your anger is justified, it scared me a little to see that in a lot of you are no longer out for justice, but you were out for revenge. Big difference. Your anger has completely taken over, and you CRAVE any bit of information that feeds your anger, whether truthful or not. Like heroin. I decided I didn’t want to wind up like that.

I spent my days writing tutorials to send to my families…showing them how to handle their own modifications. I looked into helping them myself (couldn’t do this, btw). And then I was told about the meeting on Monday. ALL I was told was that a Law Firm (Patriot Law Firm/ ACIB (American Credit Information Bureau) had moved into Fortified’s old office, and were looking to hire.

I researched the heck out of these firms. They’re an 8 year old company with an A+ rating with the BBB. (check it out yourself) I found out that they not only do loan mods, but about a thousand other things to keep people in their homes and/or walk people through the process of facing harsh reality. I was sufficiently impressed.

I showed up at the meeting, nervous and hopeful, and you can imagine my shock when I found that Dave was there. The nerve! I think every one of us was staring daggers at him. But read on…here’s where it get’s interesting.

I’m afraid you’ve been mis-informed about what happened at that meeting. Here’s what happened:

My new boss stood up and introduced himself and his management, and what they do, blew us all away…yadda yadda yadda. Then, yes…he turned the time over to Dave. More daggers were shot his way. But then something changed. The man who stood up in front of me was NOT the same man who hired me. I saw a man going through hell. A man who knew he messed up. He read a letter to us. The one that many of you have received this week. He was very emotional and finished by telling us how very sorry he was. (I suspect that many of you will see this as his latest “ploy, ” but if your hatred goes that deep for a man that you’ve never met, then you probably won’t believe me anyway). I
looked into his eyes, and I believed him.

After Dave said what he needed to say, he sat down. The meeting lasted from 10:00 am to 1:15 pm. Over 3 hours. Dave’s part? 15 minutes. Whoever is telling you different…all I can say is the truth. You have no reason to trust me, I know. But that’s what happened.

I found out through the course of the meeting that the ONLY reason Dave was there was because once he figured out what this law firm did, he spent 2 weeks with the CEO trying to convince him to take on Fortified’s clients, to finish their mods. I’m sure that my new firm resisted because they have such a great reputation, and the idea of taking on 600 angry clients was risky. But even all of you haters will agree that Dave is silver tongued and a very good salesman, and after 2 weeks he wore the CEO down.

The firm agreed to take on Fortified’s clients for basically the cost it takes to pay us, the processors. Yeah I’d say this is a big risk. But Dave made it happen. And homes WILL be saved.

At one point in the meeting Dave stepped out. Someone brought up what was on all of our minds. While many of us were still trying to form our own opinion about Dave’s intentions, we all agreed on one thing: We weren’t going to trust Dave again anytime soon. We wondered WHY Dave was there and what his role was. We were assured by the CEO that Dave was not, nor will EVER be part of management. If he chooses to stay on, he’ll be one of dozens of sales people, on commission, having to earn his keep like the rest of us. In fact, if I show my talents and initiative to my new bosses, someday I could be HIS boss. Wouldn’t that be a kick?

There ya go: The meeting AND the truth. Take it or leave it. But please, no hate mail. It makes me cry…seriously. I’m so very sorry for everyone’s pain, and wish you all the best of luck!

I feel as though Dave has screwed us over badly. I am so over being hurt by FF. Whether it is revenge or justice is up to us. My personal feeling is if I never saw a dime and Dave lost his home and went to jail that would be fine with me although I hope to get my money back. I do feel as though Dave should feel the same pain as we have. Not only have we lost our homes - we have lost our pride, our credit ratings, or reputation (by refering this company to our friends). Justice will be served when Dave loses all of those things also! For me it is not about revenge - but he and partners should be held accountable for their actions. I think he was out to make a quick buck and now that he can't pay our guarenteed refunds he claims bankruptcy! Wow how would it be? Screw over hundreds of families, take millions of dollars and them claim bankruptcy so you don't have to pay them back - sounds like an honest man. I hope that we get justice and I hope he feels the pain that we have all felt and I pray he does not get away with what he has done. At first I felt bad because I'm guessing that he has a wife and probably has some kids - then I thought about it and I have a family and he didn't care - I'm still losing everything and so should he. I have to rent a home and move my children from their friends and school because of his negligence. I hope you understand where I am coming from and that while it might seem spiteful - it is justified and deserving. I gave FF and Dave Moffit himself plenty of time to make things right and they refused. I'm sorry it has come to this but I'm not turning back.

Justice does need to be served. However, you need to be brought to reality. Dave does not own his own home, and chances are he will serve jail time for the amount of money he owes his processors and salesman and the bad checks that have already been written to them. There are several processors, management members and salesman that have gone MONTHS without pay because they hoped and believed that Dave would pay them and most importantly they cared about their families. So don't even think you will get a refund before past employees and bad checks are made right. Also, you might want to ask yourself these questions "Who didn't make their house payment" or "Who chose not to make their house payment?" either way when you buy your home you are agreeing to make a mortgage payment. When you stop the bank will start foreclosure proceedings. How long do you think you can live in a house where you aren't making payments. Regardless of the fact that you were trying to get a loan modification. Don't lie to yourself, you are just as much to blame as Dave. I am not a Dave fan nor do I trust him. I hate that hundreds of families are now left to figure out how to do a loan mod on their own but the fact of the matter is...it is what happened.

Just so everyone is aware, FF employees only did as they were told. Going after or slandering any of their employee's is ridiculous and will get you no where. It is hard when you want to blame anyone and everyone for your mistakes but when it comes down to it...if you are losing your home or have lost it, that is your fault for not making your house payment. I am aware that FF has got a lot of families loans modified and that they have successfully postponed sale dates on hundreds of properties. A lot of the properties the sale dates were postponed 5+ times. Each time getting harder. Also, you should remember it isn't a choice of FF or it's past employees to postpone your sale or even give you a loan modification. That is solely up to your lender and investor to decide. The employees can try to do those things, but if you don't qualify you don't qualify.

Dave did screw a lot of people, I am not defending him in anyway. I am however, defending his employee's that including anyone in management, processing and salesman. They all did their jobs to the fullest extent and tried to and did do right by their families. Also, slandering people on the internet isn't going to get any of you anywhere. I hope that you can and will see this and stop this childlike behavior. Besides the fact that most of the comments on here are from people who have no clue as to what has and is transpiring. So grow up and stop assuming you know exactly where everything stands.

Like you said the employees were only doing what they were told - We to were only doing what we were told. FF specifically told us not to pay our mortgage. We trusted them. I do hope that the employees get paid. We are not mad at them we are mad at Dave, Jill upper management who knew what was going on. At least as an employee when you didn't get paid you had the option to leave. We as customers have no option besides pursing this legally. Instead of bad mouthing each other why can't we see that both sides got screwed and in the end its Dave and family that did it! And by the way TRUTH is an absolute defense against slander. I have made sure that everything I have said has truly happened - Lets take down the bad guy and be a team - not against each other - in the end he screwed us both!

LowlyProcessor is correct. I agree word for word, because I also was there. Believe me, I was very upset at working for months for free. I have a lot of medical bills to pay and the stress of no money has just made me sicker. But I have also done research and come up with the same results. I am so sorry to those people who have lost their homes, but to those that haven't, there is still things that can be done. I am not corrupt. I am not a liar. I am a processor, and I choose to help families save their homes and rebuild their lives.

Hey, I have an idea...how about someone find David Moffitt's home address and post it here so all of us can drive by and drop off a sympathy card? The crooked son of a [censor] took my money, lost in court, appealed it and lost again. Not that it matters because he still has his Beemer and his house and I'm betting a bunch of cash rat holed somewhere and yet is doing the very noble act of protecting it all via bankruptcy. He had over a year to come clean and do the right thing with just my account but he continued to screw more and more people. I think jail time is definitely in order and if I can help anyone facilitate that I would be more than happy to assist. If I were Dave I really don't think I'd be able to sleep at all at night because there are some very vengeful people out there and not far enough places to run and hide. Lies and fraud and deceit. There were NO good intentions paving his road to hell other than the intentions to line his pockets. These guys are such con artists that ANYONE posting ANYTHING in their favor here - I guarantee is either hired by them or is them.

http://www.sacbee.com/2010/11/07/3166545/homeowners-say-loan-mods-led-them.html

The link is to an interesting article that explains that many banks are not modifying loans permanently. The root issue for many loans that did not get modified is the banks sitting on the loan modifications or purely denying them. Did you qualify? Was the bank willing to work with you? There were times that the bank would give out different responses depending on who you talked to - did the bank receive your documents from FF? Yes, but if you talk to person X, they would say no. If you talk to person Y, they would say we already have those documents.

Let the courts deal with it and move on with your life. Many employees were screwed over through no action of their own. The homeowners have been screwed over, but most often by the banks and themselves. FF was paid to be the middle man. What they did could have been done by the homeowners, but they had more knowledge and were being paid to nag the banks.

There is a lot of anger and pain here. Some likely justified, but not all. And no loss of money is worth breaking laws. I don't care what you perceive others have done to you, why would you take it to the next level by threatening violence? Yes Elmo, I think your post could be considered threatening.

And I am not related to FF, did not work there, but know someone who did. Someone who was not paid for 2 months but kept working because they could not abandon their clients... and truly hoped that things would turn around.

The anger is not productive.

First off, last year when the economy went down, the company I worked for went out of business and I lost my job. A "family friend" told me about Fortified Financial. I started the whole process in March of this year. They made all these promises to us that they didn't keep. Then when I asked for our money back, they informed me that it had to go in for review. Of course we were denied. (Surprise, surprise) We had no choice but to deal with them. Our file was passed around to different people that worked there. That, in itself, made me uncomfortable. So we just took a deep breath and felt totally helpless as they "worked" on our file.

I was contacted today about Fortified Financial filing bankruptcy. Like some of the others, they told me that a company called American Consumer Information Bureau could take over our file for only $250.00 a month. I called the Better Business Bureau and found out that Fortified Financial has an F rating, 47 complaints that they never even responded to and 13 complaints that were never satisfied. So I have to agree with Luke Matthew, the "Investigator" person that keeps backing up Fortified Financial, obviously isn't that great of an investigator if he doesn't even know that the Better Business Bureau accreditation for Fortified Financial had been revoked as of Aug. 23, 2010, and they gave them an F rating. THEY DO NOT HAVE AN A- RATING!

I also asked about this other company that they referred me to, American Consumer Information Bureau, and they have no record of this company. This is a giant red flag for me! I will not be doing business with them either. I'm better off trying to take care of this myself. Like the old saying goes, If you want something done right, do it yourself. We will not loose any more money that we do not have, trusting anyone else to do this for us.

If the new company is so legit and honest and all the things you want us to believe they are---why is their office in Bountiful closed up with no forwarding address? If this is an error, please correct it. I went to check out their office in Bountiful to see if it was really a company we can trust to finish our modifications, the office was vacant and when I asked around I was told they left very suddenly and left no forwarding address. Please find out the facts on this if you will. To me it sounds like a company that is no better than FF and Dave Moffitt's crew.

Well, I was contacted by a very nice officer from Lehi Police Department. I can't find a way to pull my comment so let me reiterate - I was HOPING the judge would give me the 2 to the head and 1 to the gut. Of course without the judge granting it I would never resort to violence. Let me be clear on that - I am not threatening Dave Moffitt in any way, shape, or form. However if he accidentally slipped and fell on a baseball bat and it went up his pitooty and I was standing there I WOULD laugh.
