Six months ago I contacted a loan modification company, Fortified Financial, to help me with a loan modification as I work full time and cannot spend my days on the phone. They charged my credit card $3000. Four months later they got an "offer" from my mortgage company that was actually higher (about $100) than my current mortgage payment! Despite repeated phone calls to Fortified Financial and many emails, no explanation was given other than, "This has to be a mistake." About a month later, another offer arrived that was exactly the same as the first. That was two months ago. My contract with Fortified Financial specifically states that I will receive my money back if they can't save me at least 10%. I have politely asked for a refund. No response. I've called many people and sent many emails to people in the company and have gotten no response. It would have been easier and quicker myself to deal with the mortgage company. And now it looks like I'll have to sue Fortified Financial, file a formal complaint with the state, call the local news channel complaint watchdog, and contact the Better Business Bureau...as well as modify my own loan. (Sigh) I wish there were more competent and honest people out there.

I get the feeling that someone is spamming the site with sales crap do dilute the actual comments. Is there a site admin that can clean that crap off of there?

does anyone know how to file a class action law suit against FF. And has anyone talked to the state attorney general about filing fraud charges against Dave Moffitt. One more thing, anyone talk to Gephart?

Don't know about the class action, but I think it would be better to pursue the criminal fraud charges, find out how much money he took, piercing the corporate veil, so that we can attach to personal property.
I talked to Gephart - total [censored]. He wants something that is easier than pie, takes no work and makes him look like a hero for 1 phone call and a little camera face time. Maybe now that it has all caved and proven to be a scam beyond any doubt, maybe now they would take it, but only if they can make it look like they single handedly killed the giant with just one little stone taken from the riverbed.

I've had all of the same problems as everyone else. I also filed a complaint with the FTC and the Consumer protection agency. If everyone that has complained here would complain to them as well the governent would do an investigation into the fraud and potentially sue them or even put them in jail. After being away 2 weeks from the advice of our lawyer not to post anymore I just had to comment and say to Elmo that I have been ROFL about you being contacted by Lehi police and your follow up response (Elmo contact me I’ve been trying to locate you). How the hell is that that they can track you down by your post but they wouldn't do a damn thing for me when I went to the Lehi police to get their help against FF? Our system sometimes truly does protect the "guilty".

It seems from the spam that is being posted that my contact information is being muddled. LUKEMATTHEW@HOTMAIL.COM; [protected] I will put you in contact with our lawyer.

I don’t know when I’ll post again, again on the advice of our lawyer. However, I want to make it clear we are not faulting “employees” at least not ALL of them. Just as the Nazi’s where following Hitler’s orders. Yes there were and still are some “willing” accomplices of the Moffitts and yes there are some who are actually honest and YES some are even still working on cases out of their own time and money (however those honest people have since left FF and have been doing it on their own).

HOWEVER, simply put, IF you are the “honest” employee our anger is not specifically directed to you, you have no need to try and protect your action at FF nor their supposedly “good intentions” (see my earlier comments about this). Everything will be brought out shortly enough. As for complaining and deriding (Concerned Consumer 10) against those of us who were scammed for our anger and what you think you know about my case (UTInvestiGator) or any other cases (LowlyProcessor) etc etc I just find it amazing how “stupid” you are in posting your comments.

Don’t you realize you are further “condemning” FF and proving our case by the various comments that you idiots have posted? Comments such as FF mistake was to offer a guarantee, saying that there are still 600 unhappy customers, saying that 1700 were supposedly processed, employees not being paid, bounced checks, you guys didn’t trust him etc etc. Holy hell you idiots have single handedly won our case by you own posts!

If I were Dave Moffitt I’d ask you guys to shut up because you are seriously damaging him. As for myself, PLEASE keep positing as I laugh at the things that you are saying which are only solidifying our case against Moffitt!

As for my final comment (or at least my final comment on this board) on the subject of our anger “My house shall be called the house of prayer; but ye have made it a den of thieves” (Matthew 21:13). There is righteous anger.

I'm not sure about UTInvestiGator or LowlyProcessor...but for me I was simply letting you know the inside of what happened so that you wouldn't blame anyone but Mr. Moffitt. Even upper management had no idea what his plan was going to be until after the fact. I want you to realize that the employees did get screwed over and that no anger would be directed at employees. I would be perfectly fine if Mr. Moffitt goes down and goes to jail. Justice does need to be served and I don't like that our system is protecting him at this point. However, true punishment will come to him and he will one day regret everything, as for right now he doesn't regret it. Any processors stating that he does regret it and feels terrible have been taken by a salesman, who could/did sell anything and they are foolish.

Like it has been said several times before...no one should be vigilantes and go after Mr. Moffit themselves. Give the justice system time to work and he will pay for the horrible acts he has committed on someone families.

To start off, I am deeply troubled by the activities of Fortified Financial and am deeply sorry for anyone who lost money and more importantly their homes over the past few years while dealing with FF. I am the CEO of American CIB (We are known both American Consumer Information Bureau and American Credit Information Bureau) and yes it is true that Dave Moffitt came to us to try and help his past clients. We were looking for new office space in UT county when we found a space in Lehi that meet our needs, it was the space the FF had been occupying and we were going to take over the lease. In the course of a couple of weeks of us working with the landlord to find out when FF would be out, Mr. Moffitt explained his situation and beg us to assist in helping their clients. I very reluctantly agreed only because I have a wonderful staff of dedicated crusaders that have helped thousands of people in difficult financial situations. I however soon discovered within a 10 day or so time period that I was dealing with someone that did not know how to tell the truth and that we had gotten ourselves into a real hornets nest. Sense that time we have issued a trespassing warning against Mr Moffitt his is not allowed in our building at all and he is in no way affiliated with us whatsoever! We wanted to assist and help, but 10 days ago we were contacted by the DRE and asked not to get involved in helping the past FF clients. We asked the DRE what was going to happen to all these people, and they could not rightfully give us an answer. I want it to be known that we did not take anyone's money and were offering to help for the cost it takes to pay processors, this was not going to be a money maker for us and detracted us for our core business and any modification work would have been performed by our authorized Mortgage Partner here in Utah. With that said let me share with you all some inside information about Loan Modifications. They don't work, never on a permanent basis at least, especially if you are with on of the major lenders. If you are with a smaller bank or CU there is a chance to get a Mod done, sure the banks are giving people temp payment options but nothing is sticking long term from what we can tell. I have been involved in this industry for over 10 years helping people who find themselves in difficult positions and never in history has there been a time of more need and never in history has there been a time of more fraud by the banks. The truth of the matter is the banks have defrauded all of us, they have fraudulently signed out names using ROBO Signing, using MERS (Mortgage Electronic Registry System) they have sold our loans time and time again. Sense the securitization in the 80's of bank notes they have gotten rich to the tune of 250 TRILLION dollars and we are the ones paying for it. This has been the largest transfer of wealth sense 1933 and it is not going to stop anytime soon unless people stand up to the banks. So how do you do that you ask? You have to sue the banks! Right, I know your laughing now, unless you have a couple hundred thousand dollars laying around to pay for attorneys that is not going to happen. That is unless there is a team of TRUE PATRIOTS that are willing to take a stand. American CIB is a consumer advocate that investigates and finds the best solutions for people and we have done this over the years by finding law firms that are willing to do just that, stand up to the powers to be. There is a current pending Mass Joiner law suite taking place against BofA and all the other major lenders to make them prove that they have your notes, which I can tell you 99% of them don't. A Mass Joiner suite is similar to a Class Action, but in a Mass Joiner you have your individual rights and case that must be recognized. You can look up the case called Ronald vs Bank of America out of California or follow this link. http://www.mvipps.com/ronald.pdf We are enrolling our clients in this Mass Joiner suite which currently have 1400 plaintiffs and growing daily. This suite alleges fraud at multiple levels and the outcome of this case will end up making the history books and for individuals it could mean substantially reduced mortgages or cleared all together, that is part of what you get to decide. The banks can't prove that they have your note, they can't because most of them have been destroyed. If you want to stay in your home, you need representation you need to find an attorney that is willing to sue the bank for you. If you are interested in joining this law suite then please call us, its not free, its not cheep. $5000 but what is your home and sanity worth? This is not a pitch nor a call, just a warning that your bank wants to foreclose on you, because they get to cash in on the TARP money that we tax payers put up for them. In closing, I will address a couple issues I saw on this board. We are not accredited with the BBB anymore, which means you pay their fees each year, the BBB is a scam in my opinion and you can Google the recent reports about the BBB on 20/20. Also we are no longer in the Davis county office, we had two offices there and closed them down to move to UT county and conserve on overhead. We still have people in Davis county who work from their homes but our main operation has moved to UT county. We are not a giant of a company, but we are dedicated and passionate about helping people. As for Mr. Moffitt, I am quit confident that he will get his, I have heard that even within the last couple weeks he was drafting peoples money still, shame shame shame on you Mr Moffitt! I know there are mad people, they should be, we have had people come in our new office brandishing hand guns and looking for him, which caused one of my employees to quit and now I have to lock the doors to our new office for fear of someone coming in with an machine gun. I would like to let the CEO of ACIB know that I have personally seen FINAL PERMANENT modification terms for over 60 loans, (that is in a 10 month period of time). Modifications DO happen. The problem is in the way the file is presented to the lender. If the borrower is trying to deceive the lender in any way--they will be caught and their modification will be denied. That is what happened with many files from FF. Those of you who will qualify for a modification, don't be discouraged--lenders are offering terms everyday. Anyone telling you otherwise is trying to sell you on something else.

I got screwed by them. they took our money, didn't do ANYTHING for us and then skipped town. we were waiting for 8 months and about 5 or 6 people that were in charge of our account and still didn't get anything done, even with me calling them because they wouldn't ever do the weekly call they said they would in the beginning. that david moffitt is a thief.

I haven't checked back in for some time but I did get notice that David Moffit didn't make his required bankruptcy court payment and his BK has been yanked back so he no longer has the protection of the court. I'm feeling kind of bad for David as I'm sure many of you are so here is his address to send him a sympathy card.

Dave Moffett was arrested last week and was officially charged today. He is facing 9 felony counts of fraud. I am one of the official victims listed on this case. I have been pushing to arrest this pathetic piece of S____! I know he ripped off some of the employees too, but it's the ones who trusted him and his promise to save our homes that need retribution. His Trial is only for us. First trial I should say.
There has been one death and many lawsuits associated with David.
I don't know when his trial is? Watch the Utah news for more info, but after all is said and done. He will be facing prison for a long time. This is only the first of several financial schemes he was running, and the money he siphoned off to his personal account.
Maybe an investigation into selling our names and private information without permission to another company should be looked into?

Our money and damage to our financial gain have been done. But the satisfaction of going after this dog who has been on the run, is just starting. Dave Moffett, welcome to the party of your life!

Paid Fortified Financial 2500.00 to modify our loan and after 18 months hundreds of phone calls, faxes and 9 different employees we had no results. After taking our money they closed their doors. Now they have changed their business name to something else.
