I have done my due diligence and fulfilled my obligation to this company, complied with the Terms and Conditions that were posted on the internet site and they continue to bill my credit card company.

In addition to billing me for a product that I have cancelled well within the 14 day period, they have chosen to bill me twice for the amount of $87.13 for merchandise that I am not receiving nor do I care to receive.

"FREE TRIAL OFFERs" FOR ACAI BERRY ARE NOT FREE!
In fact they will cost you more than 4 TIMES AS MUCH as it should cost per bottle. These scammers will charge your credit card at least $80 per bottle each month. That more than twice as much as quality freeze-dried acai berry should cost. And to make it worse, they send you crappy drum dried Acai Berry, which cost about 1/2 as much to produce. So you end up paying at least 4 times more per bottle than you should.

YOU WILL BE SIGNED UP FOR A SUBSCRIPTION
Yes, they say they just charge you for shipping. If that were so, it wouldn't be bad. But in reality, they just want your credit card number and will bill you every month for a subscription you didn't sign up for. They bury the fine print in their terms and conditions.

YOU WILL SPEND HOURS TRYING TO CANCEL THE SUBSCRIPTION
There will either be noone to contact to return the crappy product, or they will say you have to call their customer service number to get return authorization. When you do, you are put on hold and shuffled between different people until you give up. Don't believe me? Before you purchase, call or email them and say you did not sign up for a subscription and please stop sending the product. You will get the runaround

THEY WILL SHIP YOU A CRAPPY, NEARLY WORTHLESS NO NAME BRAND OF ACAI BERRY SUPPLEMENT
They don't expect you to be happy with the product. They don't care, so they make even more money by shipping you crap. Acai Berry supplements must be freeze dried, or else they lose most of the nutrients and antioxidents. These scammers use cheap, heat processed Acai that cost 1/2 as much. THEY OFTEN BUNDLE OTHER PRODUCTS IN THE SUBSCRIPTION TO CHARGE YOU EVEN MORE
It's really obscene what some of these scammers do. We've listed a common offer below, where they bundle additional offers if you do not deselect the checkbox (it's checked by default). Some are hitting people with $150 a month in charges.

The BBB on Monday named Central Coast Nutraceuticals Inc. of Phoenix and FX Supplements of Arlington, Texas, as two companies that engage in misleading sales and marketing practices. At least part of the issue is their use of "negative option marketing" techniques that require customers to cancel recurring orders or membership in ongoing programs they may or may not be aware they've signed up for. BBB said it received numerous complaints from consumers who found it difficult to cancel the orders, and were often charged multiple times.

BBB also criticized the companies for using what appear to be endorsements from Oprah Winfrey, Rachel Ray and other celebrities for their products to lure customers in. "They knew they had a gold mine here by using Oprah's name, " said BBB spokeswoman Alison Preszler-Southwick.

Both Web sites feature photos of and comments made by Winfrey and others regarding the reported health benefits of acai (pronounced AH-sigh-ee), along with identical photo montages of other stars who have purportedly used acai to boost their diets. While neither site specifically claims endorsement of their products, the BBB said the tactic misled consumers who thought the products were getting the nod of approval from their favorite stars

A common mistake among people is that they didn't cancel after the 14 day trial period, and I think you made that mistake too. Aside from calling your card company, call FWM lab customer helpline no. [protected]). Their friendly operators are very eager to help you.

I agree with all the other comments. Only I was billed 4 times for the 87.13 and received only the one trial bottle, because some how they set me up on 2 different accounts. They barely speak english and said I would be directed to the shipping department the two times I called. I should be credited back for at least 3 of these charges...

I ordered a trial offer of Acai Berry on 1/8/09. I called to cancel the product 1/23/09 when I seen a debit from my bank account and did not know what it was for. They cancelled my account the same day and stated I would receive a full refund of $87.13 since no other product was shipped to me. I was told I would receive a refund back into my bank account from the card # that I used to place my trial offer within 7-10 business days. I was told the refund was processed on 2/2/09 and to check with my bank if I did not receive it. I have now been calling them and my bank every week since then and I keep being told that my bank is not giving me the refund and that they have already processed my refund and that they cannot do anything else for me. I still have not received a refund and my bank cannot process a refund to my account when there is no credit showing. I don't know what else to do to get my money back. I called again 3/11/09 and requested a letter be emailed to me with the date of my order, date of cancellation, refund amount and the card # it was credited to be able to take to my bank, but I don't know if that will help. They WILL NOT help me, even if I ask to be transferred to a Supervisor. Is there anything I can do?

I ordered the free sample of "pure acai berry". I got a product that is loaded with Caffeine. This is not what i ordered. Even though they gave it to me for just $3.95 I still took the time to call and complain. They said it was my fault for not doing my research to find out the ingredients of the products even though on the order website www.acaiberrydetox.com they list it as "pure acai". The customer service agent Sam Guzman insisted that my lack of research is the problem and not the fact that the website states "pure acai". When I asked to speak to her manager she hung up on me.

I hate companies that misrepresent their product. Just the caffeine alone would meet all the benefits they list. I could just take caffeine pills if i wanted that trash in my body. Beware!

Like others who have written complaints, I saw an ad online for free acai berry and colon cleanse trial samples. I am pretty careful about looking for the hidden costs/fine print, and not having found any I ordered the trial bottles. As others have stated, I suddenly noticed two charges for 87.13 on my credit card. I immediately called the company and was told that my credit card would be credited back for the 175.66 I had been charged and that my "membership" would be cancelled. They even gave me a "return confirmation #" I returned the 2nd bottle that showed up a few days later. While talking to the rep from the company when I initially called, he mentioned the "terms and conditions" that were listed on the order page. I wondered how I could have missed this since I am so careful about stuff like that, so I went back to the original web page that had linked me to the acai berry site. To my surprise, the same link now connected me to a totally different colon cleanse company than what I had ordered from. The acai berry site was the same so I looked for the "terms and conditions" that were supposedly there. I finally found a link at the very bottom of the web page in about 6 font writing that said "terms". If you didn't scroll down the page (which you don't need to do to place your order) you wouldn't even notice it, as I didn't. The company did credit me 87.13 and I kept waiting for the second credit to come through. I finally called the company and was told that it was in the refund dept and I should receive the credit in a couple days. That has never happened. I have called back twice more since then and talked to 3 very rude girls who could barely speak english. I'm not even sure they understood me...or at least the pretended they didn't. One girl, who said she was the supervisor, just kept saying that I should've read the terms and conditions. She also said that there wasn't anyone higher than her that I could talk to. When I asked her if she owned the company she just said "I work for swm laboratories" and refused to give me a name or number for anyone! When I asked her why 2 other employees had told me that my refund was being processed and there wasn't any problem, she just ignored me. I never could get her, or the other 2, to even respond to my question about why other employees had told me it wouldn't be a problem. So that's where I'm at. I belong to a prepaid legal service and will be calling them to address the issue. I found this site in looking for a contact address for swm laboratories and decided to add my story to the others. These other complaints help validate my concern about "missing" something when I ordered in the first place. Also interesting to note, in trying to find a contact address for swm I again returned to the original web site that had linked me to swm. It no longer links me there. It links to another acaiberry company. Buyer Beware!

I too was scammed on this. They charged my credit card account within the 2 week period. When I called them and told them that I had sent it back to them and called and cancelled the product, I was told that I did not cancell in the allotted time frame, and I told them again that I had sent the package back to them, and they said that if I did not call to get a RMA # that I could not be credited. I am disputing this on my credit card right now. They charged $87.13 without my approval. Beware of these people, they are scam artists!

I just got off the phone with FWM Laboratories and they are 'hopefully' not sending me anymore bottles and not charging me anymore. I told them I got another bottle, but wanted to cancel my subscription because it didn't work. I asked if I only got charged for one bottle and she said yes. I have a full bottle and won't use it - costing me $87.14, but after reading all of your notes, I will just live with it! I am going to check back with the company in a few days to see if the Cancellation Number they gave me works.
Otherwise, I guess I will be prepared to cancel my credit card if they keep charging me...

My wife had ordered this product without letting me know about it. I discovered a charge of $87.13 on her debit card and asked what this was for. She told me about the "free trial" but didn't know why there was a charge. I called FWM Laboratories (866.949.0138) and asked for a refund, this was a "free trial". I was told my wife agreed to their terms, that if the account wasn't canceled within fourteen days her account was going to be charged. I was a little heated and said I don't care about that and want a refund. The CSR became rude and I again asked for a refund and if you can't issue it I will contact our state's Attorney General's office and the BBB. His tone did not change but I was persistent and said what I would do if he didn't refund my money. He kept citing their terms and conditions. Realizing this was going no where I asked for his supervisor. He said my claim would be sent to the refund department and canceled my account. I asked when the refund would appear, he said it would take a few days and I would receive an email confirmation. Not satisfied I continued to press for a supervisor. He finally gave in...hehe...and said it would take a while since the supervisor was busy (imagine that). I said my long distance is free and can wait. It took maybe 3-4 minutes and the supervisor was on the line and after insisting a refund she stated the same thing the CSR said, it would take two days. Ok, I was polite and hung up then immediately called my bank and canceled the debit card so they can't take out anymore money and will dispute this charge if a refund doesn't come through.

THANK YOU KADIE, the number you gave me got me right to the company. I was able to cancil my account and get back half my money.aaaaaaai tried to get all $170.00 back but I ended up paying for the life cleanse. But at least I got some back. I also cancelled my card and have a new one on its way. Here's some NEWs, the gut at the co. told me, they count the 14 cancel days from the day you order, not the day you recieve it. So bewhere out there and red the very tiny fine lines.

Company offered Free Trial. The Free Sample was not delivered. I then saw my bank account was charged for one bottle of Acai XL and one bottle of cologenix. Two days later the product came.
When I called to complain, the customer rep said the matter was handled and I would receive my refund in full, as per their guarenteeShortly thereafter two NEW charges for one bottle of each appeared. Two days later two more bottles came. I refused delivery and the Post Office sent them back.
I'm now being told that I "did it wrong" so they don't have to pay a refund.
How is this Not Fraud?

I have been scammed buy this company. I tried the trial size at the price of $4.00 a bottle, I also purchased life cleanse also $4.oo a bottle. I recieved the products on 3-1-2009. On [protected] my bank account was charged $170.00 for the acai berry and life cleanse. This was not mentioned anywhere on the avertisement. The fine print said cancell within 14 business days.How many of you out there can count from 3-1 2009 to [protected]. I come up with 10 days, anyone else? and 2 of them were weekend days .I called the company and no answer I tried the net no answer. I can't believe Opera stands by this product. Do not try this rip off, please learn from my mistake. If you want to lose weight, train your elbo to not bend to the mouth, then take a walk.

I would like to register a complaint concerning FWM Laboratories and the ACAI Berry Detox. After numerous tries to send the bottle back unopened, seal still on, they refused to give the address and how to contact the return department. I could have possibly overlooked the 14 day trial portion of the description when I ordered this, but not to even allow you to return an unopened bottle is really unbelievable.

I believe this is a very bad company and their practices should be banned.

Very disappointed in this company. I complied with their terms. Cancelled my order and was still charged. When I called the [protected], spent most of the hour on hold then was told to call back in 3 days to see if they would refund my money. Even more frustrating is I can't even talk to anyone who speaks english!

Oprah does not endorse this company. On her web site it states:

"Consumers should be aware that Oprah Winfrey is not associated with nor does she endorse any açaí berry product or online solicitation of such products. Attorneys for Harpo are pursuing any companies that claim such an affiliation."

It's companies like FWM that give free enterprise a bad name. :(

This company has taken $87.13 PLUS out of my bank account for three days straight for their product. The website is deceptive in that the consumer is NOT made aware of any subscription at the time of receiving the "FREE TRIAL". Their call center is obviously in India so there is a language problem when calling in. They promised to process credits to my account but, in fact, processed another daily charge for $87.13. The most recent charge came from Great Britain so they tacked on International Fees.

The fact that their product was touted on 60 minutes, cnn.com, etc. makes this rip-off even worse. I will alert the networks to this fact.

AND ASIDE FROM THE FRAUDULENT PRACTICES HERE, WHICH LEAVE CONSUMERS FEELING CHEATED AND LIED TO, HERE'S THE KICKER: THIS PRODUCT IS ADVERTISED TO RELIEVE WRINKLES. WRINKLES CAN BE CAUSED BY STRESS. THEIR PRODUCT CAUSES WRINKLES BECAUSE OF THE ANGST THAT THEY PUT THEIR CUSTOMERS THROUGH.

This company is evil. The employees are trained to lie. And I will no longer ingest the "FREE TRIAL" product that I received (which has now cost me over $300) because I have no idea what's in the capsules. In addition, they are charging $40 for shipping. I will be blogging in the future in order to take this company DOWN. ALSO, DERMAPRIL is in cahoots with these criminals. They, too, will be frequent topics for me to write about.

I will alert BBBonline, the Florida Attorney General, the Kentucky Attorney General, and now that they have to brilliantly processed a charge from a company in Great Britain, they are now guilty of FEDERAL AS WELL AS INTERNATIONAL INTERNET FRAUD.

I sent the following email to this company with no response:

I ordered the ACAI Berry and Colon Clens from your company back in the beginning of February. On February 13th I called [protected] to cancel any further shipments. I DID NOT write down a confirmation number.

Now I find that I have been charged again and again on my checking account by your company.
I called to day and cancelled any future shipments and obtained the above confirmation number.

I have contacted the Better Business Bureau who indicated to me that if I do not get satisfaction from your company that I am to call them back and file a complaint.

I have received one bottle of the Acai Berry Detox and one bottle of the Colon Clense.

I understand that I did not read the disclosure well enough but trusted your company. (Although I think this is an atrocious practice... To take advantage of people this way.) So I will not fight the original transaction for the two bottles.

But I expect a full refund of the other charges. From February 23rd through today 3-10-09

In addition for billing me for a product that I have cancelled well within the 14 day period, I was billed twiced on 1/20 for $89.74 each time for merchandise that I am not receiving nor care to. After repeated complaints to company about unauthorized charges, I received credit on 2/17 for $87.13. Several calls later they still prohibit you from talking to a supervisor or the credit department. Obviously this company is in the business of scamming people which is evident by the numerous complaints people have sent it.

Any lawyers out there with the guts to take on a class action lawsuit--I'd be the first plaintif to sign. My e-mail is Mdupont1957@yahoo.com.

They have numerous complaints on file for this company. On 3/6/09 I sent an email to all three addresses I got from the previous post: billing@fwmlabs.com, fwmcancellations4@gmail.com and west@firewatermail.com. In the email I told them that I had filed a report with the BBB and sent them my BBB complaint number along with my billing information (my name and adress). On 3/11/09 I received an email from the billing@fwmlabs.com email address saying that my refund has been processed and then today 03/13/09 my refund has hit my account. Now I'm probably going to cancel my account so they can't charge me again.

i canceled on March 11, 09 and on March 13 they took 87.13 out of my account.Called at lease 4 times wanting my refund they give you the run around they said I will get a email from them I am still waiting.My bank is involved now so we will see .If I dont get my refund I will call the BBB and get attorney

Believe it or not I got my refund of $87.13 today! After reading through pages of complaints below I came across another post that also received her refund. Now I'm probably going to cancel my account so they can't charge me again.

I am appaled at the buisness you are running. The website you display your product on is far from honest. As a person who wished to purchase a product to help my body you have made it worse emotionally. I expected a product that cost 3.95 and in turn I was charged 87.13
I have two items that were billed to my account for Cologenix Bushey GBR and ACAI XL Bushey GRB both for 87.13. I understand that I did not read the portion of your buisness agreement that after 14 days you will be charged a large amount including the shipping, but let me tell you that your website if far from honest to your customers. It is full of all the positive things about your product and the benefits, yet what it fails to show is that you are trying to scam people into your "wonderful" product. If you were decent buisness people you would have your website say that after a 14day period you need to return it if you dont want to be charged 87.13.
I have called your company twice now and I want a refund. I will send the product back to you and I will be expecting my account to be reimbused for the total of 174.26. I will be expecting a reply to this.

I am having trouble stopping my order too. I told my credit card company not to honor the $87.13 charge. In addition, I called the 866 number referenced, and it said "this mailbox is full". A scam if I have ever heard one!

Your mistake falls on the fact that you didn't cancel within the 14 day trial period and so they charged you with the real price of Acai berry products. But there's still hope. Dial [protected] and they have very accommodating operators who can help you fix your refund. Good luck.

I believed acai berry detox FWM labortories inc, was a repitable company but they are a total SCAM."BEWARE"
They were suppose to charge and send me a 14 day trial sample for $3.95.
That never arrived in my mail box.
It's been five weeks since I first inquired about the trial sample. I never recieved the trial or the orginal package. Don't trust them. The FWM labortories reintered my account and withdrew $87.13 without my permission.
They comprised my credit card therefore, I contacted the credit card bank to take care of this unauthorized withdrawl. In addition to that I have spoken four times to this acai bery labortory to cancel my order and explain that I never received either order. I got no where they kept my money and I was left empty handed. I spoke with four separate women. I wish I would have viewed, cnn, do. oz and cbs news...they warned that there were companies that were scams.

fwm labortory acai berry is a scam. cnn, doc. oz & cbs news warned agaginst these fake companies that promise, you products but never deliver. don't order anything from, 3007 greene st in hollywood, fl 33020. they'll take your money and will not deliver anything, except a compromizing debt on your account.
i'll have to go to a supplement store and spend more money. people are mean and crooks.

I am appaled at the buisness you are running. The website you display your product on is far from honest. As a person who wished to purchase a product to help my body you have made it worse emotionally. I expected a product that cost 3.95 and in turn I was charged 87.13
I have two items that were billed to my account for Cologenix Bushey GBR and ACAI XL Bushey GRB both for 87.13. I understand that I did not read the portion of your buisness agreement that after 14 days you will be charged a large amount including the shipping, but let me tell you that your website if far from honest to your customers. It is full of all the positive things about your product and the benefits, yet what it fails to show is that you are trying to scam people into your "wonderful" product. If you were decent buisness people you would have your website say that after a 14day period you need to return it if you dont want to be charged 87.13.
I have called your company twice now and I want a refund. I will send the product back to you and I will be expecting my account to be reimbused for the total of 174.26. I will be expecting a reply to this.

After reading all of these posts I don't feel so bad. I didn't cancel within the 14 days of ordering like a lot of people on here.
When I read 14 day free trial, I didn't realize the trial was so I could see what it's like to order crap on the internet. Silly me, I thought I got to try their stuff for 14 days.
They didn't charge my card for the shipping til several days after I placed the order. I got it on 3/7/09 and they charged me $127.13 on 3/15/09 for the stuff. I ordered the Acai Berry and the Life Cleanse. They got me for the full amount of the Acai Berry $87.13, but I only had $40.00 left for the Life Cleanse. I guess I can take comfort in the fact that they couldn't get the other $20.00, or so, for the Life Cleanse.
I followed the advise of a couple of people on here that actually got refunds. I disputed the charges with my bank (surprise! they had heard of this company), and filed a complaint with the Florida BBB. Then I sent emails to the 3 addresses with my complaint # at FWM Labs. We'll see.

I did not order ACAI Berry Detox or any product from FWM Laboratories. I was shock that they got my card info. I called and finally got the supervisor, Tina Jones, she charged $3.95 to an account I can't find. She informed me no refunds and that the account is closed. But I see the same exact complaints from others that they then charged $87. How in the world did they find a credit card info, it must be a old account that is no longer in uses. AND how do I stop them!
