I have done my due diligence and fulfilled my obligation to this company, complied with the Terms and Conditions that were posted on the internet site and they continue to bill my credit card company.

In addition to billing me for a product that I have cancelled well within the 14 day period, they have chosen to bill me twice for the amount of $87.13 for merchandise that I am not receiving nor do I care to receive.

Take your time and look at all the bogus Companies on here:

First off call your bank and cancel your credit card, also immediately file a Chargeback. If they recive enough chargebacks it will screw up their merchant account and get them blacklisted. Don't bother calling the numbers or live chat it is totally useless. Anyways here's some info on these people:

Like all of you, I too have been the unfortunate victim of this company's unscrupulous business practices. Also, like you I too agree that this is most unfortunate for all of us, and yes, I am sure we have all learned our lesson. It does not have to stop there. I fully intend to copy and paste all of these comments made here, and then to include my complaint and send the whole thing to my State Attorney General's Office. When a state sees this sort of crap going on, they are going to want to investigate. I am from Minnesota and have other dealing similar to this sort of thing and when I filed with the Attorney General's office they handled the situation by preventing the company to do any further business in the State of Minnesota. I suggest you all do the same. The other thing I intend to do is to forward all of this information to Oprah Winfrey who has been endorsing this product. I think she needs to know what kind of firestorm she has created here. I don't know what she is likely to do with the information, but one think I would think is for sure; there will be no further endorsement of the product, and therefore, hopefully, the number of individuals financially hurt by this situation will decrease over time. I clearly plan to do what I have stated and will be happy to format a letter that others can use for filing complaints with their State Attorney General's office as well. In the meantime, I did just speak with Wellsfargo, who informs me that they are receiving exponential calls from their banking customers regarding this issue, and their recommendation is to cancel the card you used to make the purchase otherwise these charges can legally continue based on the fine print contractual agreements we all made when we innocently ordered these products. I also ordered the free bottle and cancelled the same day by phone. Didn't think anything about not getting an email confirmation because I had done it the same day. I got the product, opened it but it didn't work so didn't take many of the Acai Berry. When it came there was no information with it so I thought it was cancelled. I get another bottle in the mail and realize they've charged me for both bottles. I called and they have no record of the cancellation but did tell me I could return the second bottle. I hope I get a refund on that.

Sure you can get a refund by calling [protected]. I also ordered Acai Berry products last month but did not continue with my order after a week. I got this contact detail online and my money was returned after a week. This line has very accommodating CSR.

That's a good idea - file a complaint with BBB. I had not thought of that. They have us somewhat over a barrel with the small print. However, I had a family emergency and had to leave town. I sent them verification of death and travel - no refund! Fraudulent way to do business. I'd like to find a way to hurt their business but so far I think it's just an expensive lesson for me.

A SUPERVISOR AT THE CALL CENTER IN GOD ONLY KNOWS WHERE TOLD ME I HAD 14 DAYS FROM THE DAY I PLACED MY ORDER TO CANCEL.? NO PRODUCT AND I'M GOING TO PAY FOR IT. I WILL CONTACT THE ATT'Y GEN. This is the worst scam I've ever seen. They are not only charging your account after you have cancellation, they are changing the name of the product and dollar amount. If you bought this product, the only way out of continuous charge is to cancel the card. I too was told there were no charges when I was looking at the charge on my statement.

My story is the same as everyone else's. The question is what do we do about it? Can't the attorney general in Florida help. What about my attorney general in California. Griping about this isn't helping me. Obviously we were all swindled and I'm going to have to cancel my bank account too. In the meantime, they have roughly $150 of my money. Anyone had any luck getting their money back?

I also am a victim of this scam. Thankfully the credit card I used is almost maxed out so they can't charge me the $87, yet. After receiving the bottle I noticed that it looked nothing like the picture on the website. I immediately looked up FWM laboratories and ran into this website. The pills do not do anything and I'm wondering if they are even safe. I tried to cancel my order yesterday but they said that I am not a customer, after asking for my credit card information again. Thankfully I can cancel my card before anything happens to me.

Everyone who says Oprah promotes this product, that is not true. She just promotes Acai berry, not this scam company. They just used this as an excellent opportunity to make money.

DO NOT order the "free" Natures Acai Berry supplement. Although they state that they will only charge you $4.95 for S&H and indeed you will receive a bottle of "acai berry, " you will also be plagued with having given a random company your credit card information. In addition, Nature's company will happily give your information to 2 other companies, Fit Factory and Cost Smashers, who will then enroll you in a "free 21-day trial" of their products. This is not mentioned on the Nature Acai Berry website, not even in the fine print. Lesson #1: You are better off physically walking into a store and purchasing this supplement rather than giving out your credit card information to random third parties. It may cost a little more initially, but the money you will save on not being involved in this scam is huge! And by the way, the acai berry supplement contains mainly Chromium at 63% of the total capsule, in addition to, Green Tee Extract of 225mg, CAFFIENE of 135mg (very healthy for you...sense the sarcasm?), Acai extract of a mere 50mg, and finally L-theanine of 8mg. I am a physician and I have never heard of L-theanine in my career, so the ingredients are likely a farse.

After more than 45 minutes on the phone with the representative at [protected] to cancel Fit Factory and Cost Smashers, I was given 2 confirmation codes; one for each company. After attempting to get the rep to agree to send a written letter of confirmation to my home address, she insisted that I give her my email address. I asked her, "You sent me two emails already enrolling me in your product line and you are telling me that you do not have my email address in your system already?" She beat around the bush for many minutes and I refused to give out my email address, since they already have my physical address, b/c she made me verify it upon answering the phone. I then asked for a physical address for the companies and she again beat around the bush with me and acted like she was typing something, which sounded like it must have been a novel for all the typing she was doing! Again I asked for a physical address and she answered with, "Ok, I am just sending you a confirmation to your email address." Now all of a sudden she had my email address on file and was sending me a confirmation. Again I went back to the question, "Can you please give me the physical address of these companies, " and this time she said hold please and immediately placed me on hold. I thought this was the end of the call and that I would be dropped shortly. However, she came back on the phone and gave me this address: 2620 South Maryland Parkway Las Vegas NV, and no zip code. Then I asked if she was physically located at this address in a call center or the like and she responded, "No, I am in the Phillipines." Super, I thought.

In the background during my phone call I heard people coughing and sneezing, I heard loud noises like heavy machinery in addition to many other bizarre noises. At American call centers, from having worked for Sprint Telecommunications years ago, the headsets they use filter out that type of background noise and also the cubicles are set up to ensure that other noises do not interfere with the call. Why do I address this issue? Because this clearly indicated to me that this girl, who probably has no idea who she is working for, is in some factory or sitting in her "house" answering calls for $2/hr from some company in the States that doesn't even physically exist!

I was infuriated, to say the least, that some company would distribute my information without a disclaimer regarding it on their website. However, I realize now how ignorant and naive I was to actually have believed that I could safely order a supplement online from a website that I now realize had no credentials. It wasn't like I went to walgreens.com or GNC.com or some other credible American company. Lesson #2: If you haven't head of the company before, and you cannot find any other information about them by Googling the name besides websites about it being a scam, chances are, its a scam!

I hope that my bad experience with these "companies" will at least be a testiment to others so that you do not fall for the same scam that I did. Please, please, for your own good, do not order Nature's Acai Berry unless you have the extra time to call your credit card company to request a new card with a new number, call Nature's and sit on the line for 30 mins before getting anyone to answer, and have the tolerance to put up with ignorant people.

I am also a victim of this scam. I received the charge for shipping and never received the product. I didn't think much of it and thought oh well its only 3.95 but now I have been billed for the $87.13 since I didn't cancell w/in 14 days. I called them and complained that I haven't received the product how can I be billed for it. They only read from a script and cannot think outside of this, I asked for a supervisor and he also reads from script and does nothing. I cancelled my product and am still waiting for the original shipment. They said I would receive an e-mail confirmation and have not received this. I called back 4 days later to tell them this and they said don't worry my "concerns" have been escalated to the shipping dept. I told them I didn't worry before and now I had to pay $87.13 this time I will worry. They won't let you talk to shipping and the supervisor just keeps saying the same thing about how my "concerns" are escalated to shipping. They will not let you talk to the supervisor of the supervisor. I wish I would have read more about this before I did this "free" trial. I am going to call my bank and make sure no charges are accessed.

I wish I had seen your website prior to stupidly ordering this product. After ordering product on 2/14/09 they charged my credit card 3/2/09 when I received product approxiatemately 4 or 5 days prior! How does that work! What a scam is right!

Acai Berry SCAMS - Beware Free Trial SCAMS

Got this from doing a search through CNN.News.com

"FREE TRIAL OFFERs" FOR ACAI BERRY ARE NOT FREE!
In fact they will cost you more than 4 TIMES AS MUCH as it should cost per bottle. These scammers will charge your credit card at least $80 per bottle each month. That more than twice as much as quality freeze-dried acai berry should cost. And to make it worse, they send you crappy drum dried Acai Berry, which cost about 1/2 as much to produce. So you end up paying at least 4 times more per bottle than you should.

YOU WILL BE SIGNED UP FOR A SUBSCRIPTION
Yes, they say they just charge you for shipping. If that were so, it wouldn't be bad. But in reality, they just want your credit card number and will bill you every month for a subscription you didn't sign up for. They bury the fine print in their terms and conditions.

YOU WILL SPEND HOURS TRYING TO CANCEL THE SUBSCRIPTION
There will either be noone to contact to return the crappy product, or they will say you have to call their customer service number to get return authorization. When you do, you are put on hold and shuffled between different people until you give up. Don't believe me? Before you purchase, call or email them and say you did not sign up for a subscription and please stop sending the product. You will get the runaround

THEY WILL SHIP YOU A CRAPPY, NEARLY WORTHLESS NO NAME BRAND OF ACAI BERRY SUPPLEMENT
They don't expect you to be happy with the product. They don't care, so they make even more money by shipping you crap. Acai Berry supplements must be freeze dried, or else they lose most of the nutrients and antioxidents. These scammers use cheap, heat processed Acai that cost 1/2 as much. THEY OFTEN BUNDLE OTHER PRODUCTS IN THE SUBSCRIPTION TO CHARGE YOU EVEN MORE
It's really obscene what some of these scammers do. We've listed a common offer below, where they bundle additional offers if you do not deselect the checkbox (it's checked by default). Some are hitting people with $150 a month in charges.

I know it's not funny but you make it sound funny. Keep the bottle and look up the ingredients. Someone posted the ingredients on this website and looked it up in the Dictionary. One of the ingredients said that it was not digestible by humans. On another Website, I read that someone was rushed to the Hospital because of this bogus product. Keep records, I smell another lawsuit at hand...

I writing to make sure that everyone reads this before considering a company to order from on the internet. Back in January I ordered the Acai Berry Detox and received their product on Feb. 2 but after speaking with my doctor he advised that I don't use the product and promptly return it as it is not good to use herbal medicine with seizure medication. I returned their product in its original package, unopened the very next day with a delivery confirmation receipt. I promptly followed up to assure they received my letter and cancelled my order to which I was told they did and that it was cancelled on the 11th of Feb. and received a confirmation on cancellation. On Feb. 17th, my credit card was charged for $40.00 and you better believe I was on the phone in a heart beat only to hear their must be a mistake and that it was being forwarded to the refunds dept. Well that has now been over 2 weeks ago and still no return. I called again yesterday and was told that it was still in the returns dept however could speak with no one from this dept. It has been nothing but a run around and they know it was fraud. You told me it was cancelled and even gave me confirmation that it was on the 11th yet you charged me on the 17th, down right devious and I hope they look into this. I am going to be speaking to an attorney about all of this. This is not right. How can you claim something is cancelled and then charge someone. I know it wasn't a matter of the product because I took pictures of the product in the original packaging and me mailing it so they couldn't say it was opened. I am married to a police officer so I know to cover my bases and how this all works. I am fed up. I hope you investigate this as well. I know I am not alone its just that other people don't know their rights as a consumer and how these companies attempt to cover up.

On February 9, I order the "Free" sample and was charged $3.95. I received the product on February 20. On Tuesday, February 24, I called and cancelled the account. The operator told me that if I wanted she could lower the price of the product to $47, I told her, "no, cancel the account." The account was cancelled. On Feb. 28, two amounts were charged to my card. One for 70¢ and one for $87.13. I immediately called the company and asked why this was charged. I was told it was because I didn't call back within the 15 days to cancel. I was also told the new shipment was already sent, and that I could return it and a refund would be issued. I needed to call back in 2-3 days. On March 5, I called back. Was told by the operator that the account was cancelled, and that the refund was being escalated. She then transferred me to her supervisor, who told me that the charge was not for a new shipment, but was for the original one because I failed to call back in the 15-day period. I said how can I do that when I didn't receive the product until Feb. 20? He told me that on the piece of paper that came with the product it states that you can call the company and extend your trial period. I don't him, "No, it doesn't." and I proceeded to read him the piece of paper. He apologized for that (as they always say) and told me that he would inform the marketing department that they need to change their wording. He said I should call back in 2-3 days to see if my refund has been processed. I asked him how many more times I'm going to have to call back, and he told me this will be the last time.
What a joke, and shame on us for falling for it. You would think we would all no better.

i have been through pretty much what everyone else has been witnessing. i cancelled my account on jan. 25 and was given a conformation number. Was told i will receive an email regarding the cancellation, never came. Then after 20 phone calls was told my refund would be processed on feb 4th. never received an email from the refund dept either, since they are unable to be reached. I called again for the 100th time and was told my refund was credited to my account and to check with me bank, my bank had no record. I called again and was told it would take 10 to 14 business days from the 4th to process the refund depending on my bank. i have waited longer than that and still have received nothing. Every time I call and ask to speak with a supervisor I am told they are on other calls and will be right with me, an hour later and still no one. I call back and want the supervisors name and they say they have too many supervisors to give out any names, I wanted to know of you have so many then why am I on hold for over an hour and still get no where. I asked for the owner of the company and was told they couldn't give me that information. This place is a fraudulant scam that is taking hard working peoples money. In this economy that is a shame.

This is why Oprah is saying she is not affiliated with this or any other Acai Berry company. I saw it on her page after her show. Still trying to get my two withdrawels of 87.13 and also want my 4.95 for the trial offer I only received half of! Called the bank and they will be involved in the dispute. Has ANYONE got their money back yet? Can we all get together and do something about it?

You have to file charges yourself. With your CC Company, the Federal Trade Commission and the Attorney Generals office in whatever State you got the bogus product.

You can take it to Court in your State and find a Lawyer that would like to put together a Class action lawsuit.

i just realized that I have been scammed by FWM Laboratoreis in Hollywood FL. I noticed on my most recent statement that I was charged twice in January for 87.13. In Dec. i too ordered the free trial for 3.95 and surpringly received the product as well as two more bottles which I never wanted or ordered. I dont uderstand how these people sleep at night knowing that they are robbing people. Since I used my debit card for the 3.95 payment and not a credit card, I feel like they have free access to my account. Most of us work hard for the money we have and its hard to make ends meet without thieves like this. i will be contacting my credit union tomorrow to cancel my card.

I ordered the product on 12/22/08 and canceled the product within the 14 days. I was still charged the $88.00. As of 3/9/2009, I am still waiting on my refund from 1/8/09! Big time scam. Can anyone put them out of business?!

I too am a victim of FWM Labs I ordered a trial sample of the Acai Berry Detox/Colon cleanse product from this company. But before I could even try the sample offer or cancel the order they had charged my credit card $40 for each product which totaled $80. After cancelling the order 2/19/09 and expected a refund to my card, as of today I have called the company a total of 5 times regarding my refund and each time I'm told to call back in 2-3 days and my refund should be processed. What can be done about this company? If there is anything to be done, they should not be allowed to stay in business this is a total ripoff scam. Any suggestions is very much welcomed.

I also ordered the AcaiBerryDetox trial size product for the incredibly low shipping price of $3.95. I submitted all my information and received an order number and an order total of $2.00 (unbelievable, huh?). I just received an overdraft notice on my checking account (since I used my debit card for my order) saying that these people charged my account a FULL $88.00 for a "free" trial-size bottle of the AcaiBerryDetox. I even printed my "confirmation of order" which was completed on 2/13/2009 at 10:21:12 AM. I told you I had this information. Now what do I do to keep them from charging any more to my account? Cancel my checking account and get a whole new one? Let me know.

I am in the same boat you are. The free trial offer was only to charge us the shipping and handling. I have been charged a total of $350 for a product that didn't work, that I didn't even get through the free trial and I cancelled within the correct time. I still have not seen the refund. Is there going to be a class action suit or do we call the BBB or what? I'm frustrated for losing so much money on such a scam.

The 14 day refund policy starts the day it is shipped. I received my supplements 7 days after ordering. Tried the product and within 8 days, after the 14 day full refund time frame ended, I experienced an allergic reaction and was no longer able to take the product. I tried to return the remaining product, 52 out 60 pills, and got nowhere with the company. This refund policy is stated in the terms but it is unethical and unfair. Are they in the business to help people lose weight or to scam people? A company that is offering health supplements should offer at least a 30 day money back guarantee. I say FWM Laboratories is in the business to scam people.

Well, for what it is worth, here another sad story! Same here, saw it online thought what the heck a free sample and I did cancel within 14 days because it made me sick. Needless to say they drafted 87.13 from my account and everytime I call I get a foreigner who cannot speak english that tells me my money has already been refunded and it has NOT! I have called faithfully twice a week since January 02 to get a refund only to have them tell me my money was refunded on the 30th which it was not! I will call faithfully until I get it no matter how many dumb foreign people I have to talk to. We will eventually hear about this on the news they will piss the wrong person off eventually!

Credit Card Fraud

I was also a victim of FMW Laboratories. I ordered the "free" trial bottle, and cancelled afterward. I was also charged twice on my credit card after cancelling $87.13. On the phone they continue to give me the runaround. My credit card company has said they will remove the charges from my account. We'll see if that happens. So frustrating!

This company did the same thing to me. Ordered Feb 2 Charged 3.95 S/H. Never recieved anything. Feb 20 Charged 87.13 +S/H. Still revieced nothing. Canceled on March 2. Charged 87.13 +S/H on March 5. Finally got product on March 7th. Not Acai Elite that I ordered, instead it's Acai Berry Detox. Give me ALL my money back! I'm letting VISA take care of them.

I am among all the rest of you, I wanted to try the product, you see the ads all over the place, the ad I clicked on was from my state, I have been billed for two bottles now and have not received them, also I am being charged for foreign transaction fees, I have phoned the credit card company twice and nothing from them since February 5, 2009.
Stupid me, now I have to spend time to write letters, send photo copies of this and that.. you would think that the credit card companies would wise up themselves with so many people being scammed.

FWM Laboratories/ACAI BERRY DETOX

no refund

I ordered the free trial of Acai Berry Detox and received it about 8 days after the initial request. I thought I had 14 days to try the product, but that didn't prove to be true. I tried the product for 3 days and it upset my stomache so I discontinued use. Thinking I still had a few days to call and cancel I didn't worry about it right then. Yesterday I looked at my checking account, only to see that I had been charged $87.13. I contacted the company to try and get a refund but was given the run-around for 20 minutes. I was told they cannot and will not issue refund for the product. I called later and talked to another "supervisor" and got the same song and dance. I researched the BBB site and wish I would have looked there before doing business with FWM Labs. Their rating is an F. They have well over 900 unanswered complaints. I feel like an absolute fool for losing $90 to these ingrates. Hopefully the word will get out and they will lose their business eventually. What a racket!

I received my product in the mail 7 days into my 14day trial period. I became suspicious immediately when the package only had a small piece of paper with the number [protected] and no information about the product. I called and cancelled my subscription immediately through the automated system but then called back to speak with a live individual requesting a confirmation number. Something still didn't feel right even after all that so I started researching online and found this site. After reading repeatedly that most had to cancel their cards I called my bank of which my card was issued. The bank teller told me it was a good thing that I called because they have been receiving complaint after complaint about FWM Laboratories and unauthorized transactions. Thanks to everyone who made their stand and their complaints on here I was able to cancel my card before any money was taken from me other than the shipping and handling fee of $2.00. Apparently this company really just wants access to your account so they can make a living as thieves. Thank you to everyone who cared to make a difference. As a single mother of two children and a very limited income YOU MADE A DIFFERENCE IN OUR LIVES! THANK YOU, THANK YOU, THANK YOU!
