I worked for Kmart for 33 years and after a serious accident where I was forced to retire, I applied for my pension. I have received 2 sets of paperwork at 2 separate addresses, showing incomplete information. I sent the final completed copies in mid-September and called again in October to verify that my pension was being processed. I was told that my pension check would be processed 45 days from the date of my last completed documents and the calculated date was for November 19, 2012. The person on the phone verified that everything was completed. I called on November 20, 2012 to ask why my check wasn't deposited and was given a new story. They claim that the final paperwork wasn't received until late October which would be a lie. After being persistent in asking for a date of when I would get my check, she finally said 'probably after January 1st because the last useless representative claims I didn't send the final paperwork until the late October date. I have had to delay payments for a hospital bill because of Kmart's lies to me and of course the hospital put me in the credit bureau because they don't believe me anymore. I asked to speak to someone hire up and was transferred reluctantly. I don't expect to get a call back. I have searched the Kmart/Sears website to see if I can send an email or make a call but there is no contact information. I tried their feedback option but it is only for merchandise or stores. I tried their 'help' but it only provides a blank page. Is there a chance that I am not going to get the pension I worked for? i defended Kmart for many years out of loyalty but not anymore and I will never shop there out of loyalty again either.

The postmark on my return envelope was done on Nov. 13. I called Sears Holdings on Dec. 28 and was told that it was received on Nov. 19 and was not eligible. !?
They are lying and playing games with peoples lives. I'll be calling the MN Attorney Generals office,
once I know that MN is the right state to do this. If anyone knows for sure, please post that information.
I think that a class action suit might be in order.

hilty0917-same boat as you-received letter on Dec 15th stating check would be mailed in Dec. Started calling on Jan. 2nd, every week since-keep telling us that they have no info but if we do not receive by 1/31 to call and they would issue new check.

still no check and i have heard so many excuses from the reps at the [protected] phe # from check was issued, to it being returned ? but my address never changed to too many lump sum requests... This doesn't give Sears a good reputation .. I guess it's time to get a labor lawyer to get answers .. I had to seek a lawyer a few years ago to get them to start sending me statements... maybe we all write in to the AG's office .. they have 30 days from the pay date given or they have to pay interest on whats owed .. I wnder if & when they finally release the funds if it will include interest...

I just called Sears in Hoffman Estates and was told that the remaining checks for January would be mailed out this week. Not received... but mailed. I asked what was "immediate" about that? First, I have a letter dated in December, saying I'd get it in December. Then there's the pre-recorded message saying if your due date was in December, you will receive payment in January. Three things that's not exactly true. It's not immediate, it's wasn't received in December as per their own letter and it wasn't received in January as per their pre-recorded message. Also, I was "originally" told if I didn't get it by the 31st, to call and another one would be reissued. Sears just told me that the "rule" is if it's not received by the 10th, then the first one would be cancelled out and another one sent. NOT the 31st. The 10th is the date to reissue checks. Their number is: [protected]. Hit Option 2, and then... Option 2 again. To make a long story short, the checks will be received the week of Feb. 4th.

Thats good info MsInfo10 ... I just called and was told the week of the 4th of feb.. my original pay date was 12/01/12 not sure if I shld claim this as 2012 income or 2013 income when i do finally get this check.. It has been an experience with sears never encountered this with any other company giving out multiple & misguided info...

And the story continues 2 checks issued 2 checks not received ... but a 1099 saying i received funds? how does that happen, well a call and a letter sent by the attorney now awaiting thethe explanation... this sounds like a s.h.t show...

A letter to Sears from my attorney produced no response, which is why I'll be contacting the Attorney General after I nail down which state AG to talk to.
Please post if your lawyer gets an answer.
This is one slimy company.

I have to add my name to the complain too. I submitted the original paperwork back in October, got my letter saying money would come in December. By the first of January I called said give it a week and call back. I waited til the 21st of January and called and they said they would put in an order to re-issue the check. However, check could not be mailed until the 31st of Januaray because that is when they process checks that are replacements (like they sent the first one! yeah ... right... and I am Santa Clause) was told to wait 5 to 7 days and if did not get check to call back. Called on the 7th of February, they said with processing it takes 7 to 10 days. Guys... today is the 14th of February and all I have gotten from them is a W2 with what they said they paid me in 2012 and how much taxes they were suposed to have sent to the IRS. Every day that goes by I get hotter and hotter. Going to see lawyer today. Anybody still waiting?

There are enough of us here retaining our own lawyers ( to no avail) to join together.
A class action would demand what is rightfully ours AND damages

Mailed my lump sum request 1st week in October but was told it was not received before Nov deadline. I wrote a letter to appeal the decision. Finally spoke to a person and was told my appeal was denied. I was offered the option of monthly pension checks but no lump sum. The monthly amount was even less than what was quoted on the original pension estimate that I had received in Sept. I call and get a recording that my case is no longer on file. I'm fed up. Does anyone have any suggestions?

You have herd the three lies of marriage. Well Sears has there version of the lies and it goes like this. I'll respect you and the check is in the mail. ha ha ha ha ha the joke is on you.

What a crock. I retired a year ago. I was told that No lump sums were available, was directed to 2 different service contractors, and after 23 years service was advised I could receive up to $46 a month. I was also informed that Kmart is not Sears and there is no one pension for everyone. It is one or the other. Since Kmart made no pension contributions since 1995, the pension "awards" appear to be meager, but are in fact generous because after all Kmart contributed half of the Social Security funds credited to that account. Your pension is NOT going to pay your medical bills. Your pension is NOT going to cover your day to day expenses. Your pension is not even gas or beer money. It is nothing more than another we're screwed to add onto over 20 years of Oh Boy were we stupid. Your 401 K was wiped out as well when they cancelled the stock after they used it as matching funds. No one got anything from that. They will tell you they made adjustments but a few hundred to replace 10's of thousands? Good deal for them. Checks? Are you nuts? Wake up. It's over. I worked for Woolworth for 7 years and am receiving $700 a month from them even though they went out of business in 1999 and I quit in1984. If Kmart wanted to they could have. They don't and didn't.
