Midland Credit Management [MCM] Beware

I am in the process of buying a house. I was informed that I had an account with Midland Credit Management on my credit report. I paid off my account with Midland Credit Management. I had to call three weeks in a row to get a letter from them stating it was paid off. Now, I get an e-mail stating my credit report was changed. So I log on. Guess what...Midland Credit Management is reporting that my account is still in collections as of August 30th. It was paid at the beginning of August. Who do I call to sue this mother ***?

I feel that the employees that answer the telephone for MCM are rude and very hard to understand. When I was having issues with Tyrone, which did not speak very clear english, I asked to speak to his superviser. I then was speaking to Gary Johnson, who was supposed to be his superviser and knew no more than Tyrone and was just as rude and also did not speak very good english. Makes me wonder where they were physically located. In the US? Probably not.

I would sure hate to think that at the end of my work day, all I had to show for it was rude behavior and everyone upset with me after each phone call. Sad way to make a living.

Midland Credit Management [MCM] False claims for 20 yr old debt discharged in bankruptcy

This company is trying to collect a deft that was discharged 20 years ago in bankruptcy after my divorce. They claim the account wasn't closed until 1991. Since that time I have purchased three homes, three cars and this debt never showed up on my credit report. If the debt is real, I suspect my ex-husband may have used it so I am requesting that Citibank show the application for the actual credit card.

I am going to contact the Attorney General of both Missouri and Pennsylvania. When calling the above number you are transferred to a someone who asks you to leave a message. However, it is quite obvious that he is reading from a "cue card" and has no idea what the words mean!

If this does show up on my credit report, I will also challenge it and I am contacting the bankruptcy court as well.

You can dispute the debt on all 3 credit reporting agencies. Midland has to prove the debt is legit or take it off your credit report.

Midland Credit Management [MCM] Claims they do not have to validate

I checked my credit reports and seen MCM and Original Creditor SBC-AMeritech $156.72 from Nov 2002. I sent them a "validation letter" as I don't think I even had a phone at that time so this can't be mine.I also disputed with Credit Bureaus. All this done in April 2008. MCM sent me a letter asking me for any documentation that I may have and that they have written "Disputed" on my credit report. May 2008 MCM sends me a bill with options on how to pay. Still no Original bill or validation that this is even MY debt. The Credit Bureaus claim that they have "verified" this debt. How they did this I have NO idea? I have asked for "reinvestigation" and Trans Union took 1 day .not even it was Overnight... . and said it was "verified".
I even tried to call SBC-Ameritech awhich is now ATT and they couldn't help me as they have no information about this so called debt as it is too old.
Yesterday August 19, MCM called me and was very rude and told me that they were the "original creditors" that they don't have to validate as they own this debt and that they are going to pursue this further. I know that the SOL has expired so they cant sue me as it is 6 years in Michigan. I am so frustrated with these people. My wife and I are trying to buy a house and this is one of the things that need to be taken care of before we can. I just don't want to have to pay for something that I believe isn't mine.
All I want is an "original bill" stating that I owe this.. not some bill from MCM.

Addendum to the above. Regarding any debt collector: If the language is polite, and they claim to be understanding and trying to help you get through hard financial times with payment plan options, etc. - They are "Scavenger Debt Collectors" and you should ignore them.

Although it might be difficult, IGNORE their correspondences. They absolutely depend on your ignorance to make money, because by the time MCM gets these "debts", they are considered UNCOLLECTABLE (unless you're foolish enough to pay them). MCM are known as "Scavenger Debt Collectors", and know they can't legally force payment. In my opinion they are disreputable m----- - f-----s, who prey on people's ignorance. And their existence is apparently legal! Before I learned the facts, I responded, demanding proof that I owed money (which I never did) to the alleged creditor. I was told they don't do that. Do what? Prove anything! I simply had to pay! DUH! Needless to say, further correspondence ended forever after that call. By the way, don't depend on any federal laws to protect you. They have no teeth and are basically unenforceable, unless you want to spend a lot of money suing. Note the exception below. You can complain to the BBB, but don't expect it to do any good. That organization is a joke, being made up as it is with BUSINESSES! The statutes of limitations very by state, but range from three years to ten (mostly six), except for the bizarre anomaly of Kentucky (15 years). Another idea would be to ask your lawyer, and he might be able to invoke a certain obscure federal law (if it still exists), and sue them for its violation. My lawyer did it once and it worked, but the collector has to have proceeded in a certain way for you to prevail.

Midland Credit Management [MCM] Terrible experience

I have also received a summons from the local sheriff's office stating I am being sued by Midland Funding. Since I have been doing some research, I learned that they have bought my account from someone else. I got a copy of my credit report trying to see if I could figure out the original creditor is. I found two accounts on my report for the same exact amount. One is Midland and the other is presidio/CM, no clue who they are. This looks like a double reporting for the same debt. I will be contacting the credit reporting agencies disputing them both.

I have prepared my answer that will be mailed certified return receipt asking for full disclosure on the original debt, any documentation of the debt etc... on the presidio/CM listing on my credit report is shows my last payment date of 4/2004. Oddly enough Midland Funding did not report a last payment date. In Alabama, correct me if I am wrong, the SOL is 3 years... even if it is 4 years they are out of luck.

My question is can someone point me in the direction where I can find out if Midland Funding LLC is registered to do business in my state? I read on another website where one guy researched and found out they were not registered in New York and the judge threw the case out.

Midland Credit Management [MCM] Credit at the bureaus not reported good

In Feb 2005, I made an arrangement to pay an amount to resolve an issue with them, which I did timely. Impressively it has taken until April 2008 to resolve the issue with them. Because the information was not properly reported to the credit bureaus I have an impressive house mortgage rate over 9.8% and other loans with incredibly higher than average percentage rates. I can only dream of nice things and know that someone else will have grand opportunities. Its funny, I do what I am supposed to do and its others around me who have the strength to make it unfair for me, and their is nothing I can do except for happily have less than those who are more fortunate.

Midland Credit Management [MCM] Repeated calls even when informed they've got the wrong number

Midland Credit Management has been calling day, early in the morning (before 9:00). I've told them four times now that the person they're looking for doesn't live here. And what's their response? An apology? A promise to look into it? Nope, I get an immediate hang up so consistently each time that I'm sure that's company policy. That's real polite. Today I actually got one person to reply before hanging up. He said "I hear the same thing every day. Click." If that's true then maybe they should pay attention to that in some cases it's true.

Midland Credit Management [MCM] I am extremely confused and upset

First of all I had a fraudulent account on my credit report that was through verizon, so I disputed it with transunion. I then received a report saying that it was no longer on file and so I checked my credit report it was also no longer there however a week later I received something from midland credit saying that I need to pay it along with financing options. I don’t understand how it can be no longer on file and taken off of my credit report but I still have to pay for it even though it isn’t mine... I am extremely confused and upset...

Midland Credit Management [MCM] I don't know who they are

These people showed up on my credit report and I have no clue who they are. I was in the middle of purchasing a new home and FHA required me to pay the two accounts before they would finance me. I paid them through their attorneys and received the letter stating the payment. Midland will not accept the letter that I forwarded to them as proof and it's still on my credit as unpaid. When the 3 bureaus contact them as a dispute on my behalf. They have been told I never paid them. What now? I have now paid something that I have no knowledge and can't get them to acknowledge the receipt of my payment.

Midland Credit Management [MCM] Pre-legal notification

I just checked my mail today and received a Pre-legal notification stating I owed 777.94 with 221.75 interest equalling 999.69. Original creditor was Citibank/Goodyear. 1st I never had Citibank for anything other than an old mortgage that they took over years ago and I refinanced that and never Goodyear. My first name is misspelled the letter A & E are swapped and no Middle Initial. All the searching I did on this company seems to be a little bit shady. So I’m wondering if I should just call them and see if they have some wrong information.

Midland Credit Management [MCM] Rip off

I see my search to find others who are having a problem with these people was not in vain - really didn't think it was only me.
Having already filed their suit with a putz law firm. They are leaving me little choice but to file bankruptcy. Really didn't want to do that, any thoughts on how to stop this would be appreciated and yes I have thought of physical violence. Probably not the best course.

I am going through a nightmare! I have been clearing up my credit and disputing the errors on my credit report with the help of Lexington law!( they have been life savers so far!) well on 10-18-2019 they had an old credit card debt removed ( because neither the credit card company and its 2 debt collectors- which here in MN - might add that the "2" debt collectors were one in the same could validate the debt) ok great fantastic right?... Then yesterday [protected]) Bam! At closing time for banks(5:00 p.m) I called my bank and asked WTF ( more poilety) I went to use my card 10 minutes before and it was declined ( keep in mind I had enough money in my account to use my card for what I needed- I had checked my account an hour before hand and all was good)

So I call my bank and was. told to call the main branch in the morning and they could give me more information about the levy from Midland Funding LLC... Seriously these [censored] just took my money without notice! They have not contacted me at all no letters! No phone calls! No court papers! ZIP ZILCH ZERO NADA! How can they do this when just barely a month ago they could not validate the debt? And to make matters even worse my place of employment just did lay offs due to work orders being slow!(hoping it picks up after first of the year!)

So not only am I laid off but now these [censored] just took all the money I had in my account to live on until my unemployment kicks in! Are they going to take that too?

I received a call from this "debt collector." First off, never confirm that you owe a debt. Second, by law (FTC) you are entitled to have the company send you information about the said debt. I told the representative that by federal law, the company must send me documentation. When i asked the guy named "Matt" from India, if he could send me documentation, he said he will see what he can do. My best advice to anyone dealing with this company is to 1) NEVER confirm you owe the debt. 2) Ask for documentation to be mailed to you. If they will not send you documentation, file a complaint with the attorney general's office in San Diego along with the attorney general's office in your state. Also contact the FTC (Federal Trade Commission) and open a complaint against the company. 3)NEVER agree to pay anything until you have gotten documentation. After a 25-minute phone call, the gentlemen advised me that the manager on the floor wanted to speak to me, then proceeded to hang up on me. If you need to file a complaint you can call the FTC at [protected]. I hope all this information helped.

I sent the COPIES of proof of pay-off and they still are harassing me saying the account number they have is different even though it is the EXACT amount from the one that was paid. I have been dealing with these people for just over a month now. They someone got my bank to take the money i owe out and put it into a separate account over a month a go. No one bothered to tell me i had to sign anything for them to get the money. So now they are trying to get me to pay them another 100 dollars because I didn't sign. How can I sign something that I didn't know about. I thought that they bank paid them, it wasn't until I called my District Court to find out why my case was still opened was I told anything. Mind you they took the money out on Dec 4th and yesterday was January 30th. So now they are fighting me tooth and nail for 100 more dollars. They are ridiculous. Before last month I haven't heard anything from them in over 2 years. What kind of company wants to get paid, but will make it hard for you to pay them?

monken, affidavit is not a proofs at all. in some state, u might need to file a motion to strike affidavits. i know in NY, all one has to do is let the case goes directly into trial, and tell the judge u weren't shown the actual bill of sales, assignments. they need to be the actually documents, not affidavits or some sort of "computerize", "typed" documents that said "bill of sale" w/o your credit card company's letterhead. u can file a motion to subpean all the witness mentioned in the affidavits. inorder for them to be legally collect from you. they need to provide your credit card agreement with your signature, all the books and record for the credit card (all statements or even charges, payments), assignments, bill of sales, titles of chain.. most of these junk debt buyer would drop the case even before trial starts. they know they don't have anything solid to prove, so they are trying to pressure u to pay up b4 it gets to trial. but you would have a better chance to let it goes thru the trial and let the judge dismiss the case with perjudice, so it can't be reopened (resue u again).

I was at pretrial today. Being sued by Midland Funding. I asked for proof sale, affidavit and he actually showed me a copy of one. He had copies of at least two years credit card statements. He also said people transfer and buy debts all the time and its legal. I told him I wanted to seek counsel so today's trial was stricken. I really don't know where to go from here. I'm thinking on calling chase to validate this copy of the bill of sale I now have.

Who is Midland Funding LLC?

One of the newest trends in the debt collection business is companies that purchase junk debt and pursue collections. This unsavory practice of purchasing old debt for pennies on the dollar and trying to collect the full amount has been a “cash-cow” for many companies, including Midland Funding LLC.
Midland Funding LLC is a division of the San Diego, California based Encore Capital Group. Encore Capital Group was a third-party collection agency for over 30 years prior to beginning its practice of purchasing junk debt. Since the change, Encore has watched its profits triple.

As a junk debt buyer, Midland is one of the largest in the industry. Their size has allowed them to purchase over 5 billion in junk debt in 2010 alone. With that size, however, also comes the ability to break the debt collection laws. In 2010 the company filed a consumer debt lawsuit against 517, 000 different individuals. This perversion of the court system to enforce bad debts is great for their business, but bad for the Defendant. The Defendants in these types of lawsuits may face garnishment or have liens placed against their home and real-property for a debt that is past the statute of limitations, or no longer even reportable on their credit report.

Midland Funding has been involved in many class-action suits during the last few years because of their unethical practices. Failure to comply with collection laws, shady practices for collecting debts, and misuse of the justice system are just a few of the charges placed against the company. Midland and Encore have also been named in robo signing cases where people were unfairly foreclosed upon.

Consumers have substantial rights against this type of practice. Knowing those rights is imperative to fighting these collection practices. Midland Funding has openly admitted that they win most of their cases in court because of the Defendants failure to show and dispute the claim. This is known as a Default Judgment.

Consumers who do not wish to be subjected to these fear-based tactics and unethical practices should arm themselves with knowledge. The Defense Guide is a practical and informative guide that consumers can use to fight back within the law.

When you visit DefendASummons.com you can purchase a copy of the guide to use. This guide will provide you with all the knowledge and tips that you need to properly defend yourself against a consumer debt lawsuit.

Most cases are lost because the person being sued does not appear in court. They are fearful of the outcome or do not know how to defend themselves. Most are unaware of the rights they have or how to demand those rights. Do not let this happen to you. If you are facing a junk debt collector or court date you need The Defense Guide. What you learn from the guide today can save you from financial disaster tomorrow.

Midland Credit Management [MCM] Ridiculous company

I am so upset with this ridiculous company full of bottom feeders. They have had my debt for over a year now. When I first got word that they had the account, I called them to set up payment arrangements. I paid an agreed upon amount expecting this to be expunged from my record. Months later after receiving no correspondence they told me that I agreed upon amount did not include the 'interest fees' accrued by them. I told them I wasn't paying any additional fees since they bought this account for pennies on the dollar and they were not the original creditor. Over a year later, I have sent them letter after letter after letter with no response. The last conversation I received with one of there very rude reps were interest was continuing to accrue by the day and this was going to collections soon. Can someone please help?

Midland Credit bought out a $640 account I had with Nordstrom. I paid off the entire balance almost a month ago and they still haven't updated the information on my credit report yet they cashed my check right away! I can never seem to get a hold of anyone there. I just get put on hold then hung up on. They promised to update my credit report with the payment made and I even tried disputing it with the credit bureau. The only thing MCM did was add another $1 to my account after I had already paid the entire balance!

LOL i used to work for them. Trust me, they will happily take 100 percent of the debt knowing they would still come out ahead by taking 30 percent of it. MCM adds their own interest charges to some accounts. ask that all those charges be removed. then tell them you will pay only 30 percent of the remaining amount ONLY if they report to the cb that it has been paid in FULL, and make sure you get it in writing. if they pay 5 dollars for a 100 dollar debt, they dont need to mark up the price much further in order to profit, the only reason they do it is because of the original contract binding you legally (they may try to scare you, but they do not take many cases to court because of costs, so if your debt is small you wont have to worry). find out the statue of limitations for your state. for example if its 5 years, that time starts from the charge off date (charged off meaning when it was sent to collections). so if it was charged off 4 and a half years ago, you have 6 months to wait untill they cannot do anything leagally, although they may still imply they can sue. the easist thing to tell them is that the number or numbers they are calling, are all cell phone numbers and its costing you money for them to call you. when asked to remove the numbers, by law they have to. also you can send them a letter telling them to "cease and dessist: all contact. then they cannot call or write.

Midland Credit Management [MCM] Never be a co-signer

My husband co-signed on an Emerge MasterCard for his Mom years ago. Things were good for a long time and then she went into deep debt and maxed out the card. She wouldn't pay the bills, ignored the phone calls from collectors. Eventually it went to collections at Midland Credit Management. THEN it went to an attorney, which at that point is when we FINALLY were even aware of the situation! A settlement was offered - half the balance due - and my husband busted his to pay the $3000.00 due. We later got a letter from the attorney saying the payment was accepted as settled-in-full. We cannot for the life of us get that *** balance off the credit report! I'm just venting.. Pissed off and would never put myself in that position again. I wouldn't co-sign for Jesus after that fiasco!

Midland Credit Management [MCM] Beware

I am constantly and daily being called by MCM for a bill I never owed with a company I never did business with. I sent them the paper work they requested and still they call me and tell me to pay the balance which they have dropped from 900.00 to 585.00. I can not get a word in with the person I am forced to speak with and I can't understand him. Now I am forced to involve an attorney for a bill I never owed. It makes me sick. You do all the steps required to show you don’t owe this money and still they harass you. And I was told it didn’t matter if I wanted them to stop calling. This is now on my credit report.

This is on behalf of my husband's credit. We got a mail stating that he had a credit of 236 some dollars at Citibank from a Children's place in CA. My husband never remember of a children place in CA or having an account in Citibank. Now the MCM is calling us and harassing us to pay. I am talking to someone I couldn't understand the accent. My husband wants me to go ahead and pay it since we need our credit report get back since it affected our credit and we are planning of getting a house and a car. I was researching for this and hoping to get some advice and what other people who got this experience did.

Midland Credit Management [MCM] Fraud

I am unsure as to why Midland Credit Reporting Agency continues to report on items that have been paid for years. The original debtor has removed this item from my credit report, yet Midland CONTINUES to attempt to ruin my credit for a paid debt of nearly three years. Does Midland continue to make money from individuals who have paid their debts? It makes me wonder if they somehow reporting agencies also benefit from continuing to list these PAID accounts? Midland also refuses to answer any certified letters, leading me to believe that my only option is to contact the Attorney General's Office in order to have Midland explain why they will not remove a PAID ACCOUNT from a credit report? Spite? Are they making money from this, still?

My wife and I had a credit card with Shell, there was only 300 dollars on it between both of us. Anyway times got bad for a while and of course it went to Midland Credit Management. Well as time went on we got back on our feet again, so the made a deal with us to pay it off. We gave them a total of 3 checks totalling around 350 or 400 dollars and that would then satisfy them. Anyway about 3 months later we got another phone call from the saying we still owed the 350 as if we never paid them at all. So yea you could say I’m pissed.

Midland Credit Management [MCM] Got rid of Midland

Don't fall for the Midland stuff, especially if you don't anybody.

I got rid of them harassing me by complaining first to my state atty. general's office, who then turned the matter over to dept. of consumer affairs.

Midland responded in a letter to dept. of consumer affairs stating-they would case any collection.

This info is from another site and I used it in my letter to Midland, the same letter which I forwarded to my atty. general's office.

“For starters, they should require, in writing, the name and address of the original debt holder, the account number, the date of the last transaction, and the amount of the original debt. Being consumers, they have a right to that information.”

If the statute of limitations has expired on a debt, it cannot be entered on the consumer’s credit report. If the new creditor threatens to report non payment to the credit agencies, it is a violation of the Fair Debt Collections Practices Act.

Hope this helps.

Midland Credit Management [MCM] They're a joke

Midland has filed a small claim against me in court for a credit card account that I have never had. I have been trying to get this cleared up for over three years. I have requested documentation from them and all I have got is harassment from them. I contacted the attorney's office they have hired to represent them and again no proof and no help so what do you do. I guess I will have to fight this one out in court. This place has harassed me for over three years but has produced no proof to back up their claim and I told them that this was a fraud case but since they had my social they said it was my account.

I began receiving calls from an unknown caller before 8 a.m. When I answered, it was a recording saying a representative will be with you shortly. I stayed on the line several times and was disconnected. Finally, after their 5th call I got a person and she asked to speak to Jerrid. I tell her, Jerrid doesn't live here - click. Next day, same thing. I ask who is calling before saying no, Jerrid doesn't live here. She hangs up. Again, they call and this time I say may I ask who is calling and she repeats she wants to talk to Jerrid. I ask what company she is with and what it is regarding. She says she is with MCM and it's none of my business what it is regarding. I told her that Jerrid doesn't live here and she needs to remove my number from her list. She tells me she will not remove my number and she will indeed call back. I completely lost it. Of course my little outburst got me nowhere except a promise that she would indeed call again. I tried using anonymous call rejection so they would at least have to unblock their number when calling so I would have a phone number to report but it did not work and the calls are still coming at all hours. I have complained to my phone company and threatened to disconnect my phone service but there really isn't much else I can do since I can't prove it is really Midland without a phone number to report. These places disgust me. No wonder some people don't pay their bills. If I actually owed them, I'd let them haul me to jail before paying them. Very unprofessional company with SUPER rude employees.

Midland Credit Management [MCM] Upset

I was looking at my annual credit report today and found that midland credit management is on my credit report, for a debt that is old. one that is over 6 years old, which 6 years is the statute of limitations for my state. I am seeing midland credit management as a zombie debt collector. I only found them on 1 credit report, but will find out if they are on the rest. I am disputing, but it still irritates the crap out of me that I have to do this. Its stupid, ridiculous and a waste of my time for someone to start this over again.

Midland Credit Management [MCM] Beware of them

Ruining my credit, trying to collect on an account that they can not verify at this point I am hiring an attorney to sue these *** (www.cceg.biz)

I have sent validation request after validation request with no response. MCM is in:

Violation of the Fair Credit Reporting Act

Violation of the Fair Debt Collection Practices Act

This is the most frustrating process to have to deal with after being a VICTIM of Identity Theft.

I should not be getting the run around from low ### debt collectors! Must not have been smart enough to be real attorney's had to be bully debt collectors... Lowest pieces of dung in the US
