7/8/2022 I payed $10,000 to Midtown Fence Company or ***. We never got the fence and haven't got a refund. The company don't answer and can't be reached. I want my money back.

I gave Midtown Fence Company a check for 5,920.00 as a 50% deposit on 7/26/22. The owner, Mr. ***, said he needed the money to order stuff. They promised to build the fence in 4-5 weeks, but it's been 11 weeks now and *** never came and won't give the money back. He takes deposits from people but doesn't do the job. I just want my deposit money back.

A quote was givin by the owner of Midtown - and accepted. A check was written for a 50% deposit by me (homeowner) and cashed by the owner of Midtown. There was no communication for 3 weeks and only after I texted to find out the status did the owner tell me he was behind. In those 3 weeks, our plans changed and we wanted more fences installed and asked for a price on the difference. Nothing was ever sent. The owner of Midtown has since not spoken to me or responded to texts or answered his phone. I would like my deposit back so I may seek other arrangements.

I also wanted to know about the warranty for the vinyl fencing, just in case I needed it later. I let him know on 4/15/2022 and he got back to me in 10 minutes saying it was their fault and he would fix it and get me the paperwork. On 5/22/2022, I messaged him again. Then on 6/1/2022, I messaged him again because he didn't answer my last message and he forgot about everything. He said he would take care of it. That's the last I heard from them as of 10/3/2022. I sent a bunch of texts (he read them because he has read receipts) and called his cell phone a lot. I want money for the posts and I don't have any info about the lifetime warranty, which I would have gone with the other company that gave me a quote.

On 11/25, we contracted Midtown Fence to install 286 linear feet of 5-foot fencing for $7742. However, on 7/8, they informed us the installed fence was only 4 feet high. I contacted the company on 7/9 and emailed them about the issue. The representative acknowledged the error and agreed to a replacement. Between 7/9 and 9/14, I sent multiple emails and voicemails inquiring about the new fence installation. On 9/14, I reached out again and received a text explaining the delay was due to a vacation, but the materials were ordered and I would be updated upon arrival. On 11/19, I followed up with a voicemail and text to the company. The reply was uncertain about the materials' whereabouts but promised an update the next day. On 11/24, after leaving another voicemail, I received no response. To date, there has been no further communication from the company.

On July 22, I paid half of the total cost of the fence I wanted for my house. Mr. said it would take 6-8 weeks to finish everything after I paid. But it's been 10 weeks and I haven't heard anything from him until I emailed about the fence. Every time he replied, he said there's no material 'cause of COVID-19. I get it, but in December , I asked for an update again and he said he'll let me know. Then on January 16, I asked for a refund of the first payment and he said he'll tell his boss. It's been 2 weeks and still no check. On February 2, he said the check was mailed on January 30. It's been a week and still no check. I checked my mail today, February 8. We're in the same state and city, so it should take 2-3 business days to arrive. My bank sent me the statement on February 4th, and I got it on February 6th. I even gave them an option for me.
