Dear Patrick Moore and Billy Parish,
I am writing to demand to CANCEL the loans you provided to Viridi Construction, Inc. for a home improvement project that has not been completed as promised at my residence. The loans were obtained under loan numbers (326374, 327144, 326764), dated 04/15/2022, in the amount of $36,000.00.
On 02/24/2022, I entered into an contract with Viridi Construction for a garage conversion and addition (ADU), which was to be partially funded through the loan provided by your company, Mosaic. The terms of the contract specified that Viridi would request money as the project went on and different phases were completed. Instead, they requested and received money in December 2022, 3 weeks after starting demo at my home and already receiving ($34,900.00 cash from me), for work that was not done. Where were the checks and balances from your company?
This is a direct violation of
California Penal Code Section 484b
https://california.public.law/codes/ca_penal_code_section_484b
Viridi Construction, Inc. has failed to fulfill their obligations under the contract. The work performed is incomplete and of substandard quality. Despite repeated attempts to communicate and resolve the issues, they have failed to rectify the situation or provide any updates on the project's status. Along with the company’s contractor's license being suspended on 03/27/23. (CSLB) Mosaic has allowed Viridi Construction to obtain money before work was started AND after their contractors license was suspended.
As a result of their breach of contract and failure to complete the project, I am left with an unfinished and unusable property, significant financial loss, and considerable inconveniences, stress, countless hours of loss sleep and anxiety. I am now seeking a cancelation of the loan amount disbursed to Viridi Construction, Inc., by your company, which is $36,000.00.
Please find enclosed copies of the relevant documentation, including my first complaint to your company and communication records in April 2023, which clearly demonstrate the company's failure to fulfill its obligations an other documents. I kindly request that you investigate this matter promptly and take the necessary steps to cancel the loan amount as soon as possible.
If the refund is not processed within 30 days from the date of this letter, I may have no choice but to explore legal remedies to recover my losses. I hope it does not come to that, as I believe that a swift resolution will be in the best interest of all parties involved.
Please contact me at [protected] or [protected]@yahoo.com to discuss this matter further or to provide updates on the progress of your investigation. I expect a written response to this letter within 15 days from the date of receipt.
Thank you for your prompt attention to this matter, and I look forward to a satisfactory resolution.
PLEASE DO NOT REPLY-RESOLVED. Unless you plan on cancelling my loans!
