Two weeks ago I ordered a trial bottle of the acai berry and a trial bottle of the colon cleanse, 2 lots of 3.95 were debited from my credit card. I have just checked my online bank account to find that not one but two! Payments of £74.53 have been deducted! I have most certainly not agreed to any terms and conditions that let this absolute disgrace of a company take this money, luckily I noticed on the day this went out otherwise I would be incurring charges from my bank. I will be calling viv3 labs first thing monday morning (they are conveniently closed at weekends) and demanding an explanation and a refund of my cash. When ordering the free trial nowhere on the website does it have an option to agree to terms and conditions.

Do not buy this product, it is a scam and they will fleece you for all you have!

I will be contacting watchdog and msn regarding this as people need to know what this company is doing.

They cancelled my account in no time. Just stay on the line as it can take several minutes till they answer, but the call is for free so no problem!

I accepted a free trial of Acai Berry tablets and Ultra Cleanse of this company so say being charged for only the shipping cost but then after 15 days the company took out of my account a further 150.00 i have recieved no more tablets and as far as i was aware did not agree for any more money to be taken out of my account apart from the origianal shipping cost i have now gone in to my over draft as they have now taken out a further 300.00 apart from closing my account down which is going to cause me a lot of problems i dont know hw to stop this or how to get my money back that they have stolen from me.

'Hi all' All these thicko s must be brain dead if they think, they're posting as genuine viv3 hard done by customers' I cancelled and got my money back in no time' WHAT A LOT OF RUBBISH. There is a few of them on this site bleeting away for the love the company. They were all on 6 days ago. Maybe they all post from the em...hospital!

i too was caught in there scam, no where in their terms and conditions does it say how much they will charge you for the product after the "free" sample. i am angry of what they have done but really nothing else we can do. it is best for us to spread the word and put people like this out of bussiness!

hi, be very carefull i cancelled my account with in seconds of my order because i just felt uneasy about it, i was still charge £56 a month later and then 14 days ago i had a call from my bank telling me that someone was trying to use my card details in cyprus, thanks to my bank being on the ball no more money was taken but i still had to cancell my bank card, but the bank said it was all originated from the same company.

I too fell foul of this scam. It is a scam because it is intended to deceive. There is no box to tick - as with any reputable company - to say that you have agreed to terms and conditions. I too have tried to follow Sandra's course but it no longer works. I can't get any information out of the Lothian people, who simply put the phone down on me.

Even though I have now cancelled my order the Barcalys bank tells me that because I paid by debit card the company have 30 days after cancellation to still apply for a second amount.

I tried to report this to the metropolitan police, who were not interested. But I did managed to get through to the Somerset and Avon police who are investigating it.

It is such an evident scam as the pills are pure rubbish and don't even work. What is horrific is that these people are known about and still nothing is being done. I would like to organise a petition to send to WatchDog, to the police and to trading standards (there are 2 crimes, the initial fraud and the second that the goods for the price are not fit for purpose)

Anyone interested?

I have been sent 2 products I did not order. They are supposed to have been ordered in mid-Nov and arrived 19.12.09. A month later they sent another lot of products as no cancellation had been received at the time. It could not be received as I had not got the products or been aware of the order. As I have never visited any of their sites as mentioned above, I believe this is an illegal operation which hacks into other suppliers of health products, bone fide ones, on the internet and accesses the personal and financial data of the shoppers. I am now told that they will cancel the repeat orders and I MIGHT get a refund of the second charge but will be charged £79 x 2 + postage for the first lot.
Where can we complain officially about this illegal operation?

Here is my story. Saw the offer. Understood it. Got the trial. Called the number on my bank statement (+ 44 [protected]) a couple of weeks later and...canceled. I know that probably won't make any headlines but that's it.

It took 30 seconds before an available agent answered the phone. I didn't wait that long to reach them on the phone and it didn`t cost me a cent.

All I can do is recommend that you do the same.

interesting that just viewing certain stories here has within minutes a certain person posting that `its all good- no wuckin furries...'

they get the big thumbs down from me just for that...

I am a pensioner and do not know what to do as they could empty my bank account. I have told trading standards and my bank that I do not authrise any more money to be taken but they want copies of emails sent to stop it and they do not have proper email address. I am so very worried.

i clicked on another adverstisment after ordering and found all these complaints from everyone.i contacted my credit card company right after i ordered and told them not to accept anymore charges from these people. they told me if i find anymore charges that i didnt authorize i would not be responsible and they would contact the companys, all i have to do is let them know if it happens. i check my credit card account on line everyday so i will be on top of it.
my credit card company had these phone #'s. these are not the same #'s they put on my order confermation (which i printed off along with their reply for my order) i hope this helps other people

Did not get the product but thought oh well its only £12 or so, having read this above am really concerned especially as the wording of their replies is so careful, and duplicitous.

Thanks for your help, so relieved that your website came up first as I had no idea how to proceed after contacting my card company. I was able with your help to get my account cancelled and have just received an email advising me that I cannot have a refund, desite the fact that I am prepared to return the product unopened. So I took your advise and told them that I would pursue this matter under the Consumer Protection Act. Have given them 48 hours to advise me that the money is being refunded and that when it is back in my card statement I will return the two items by second class post. I think that is fair.

I will let you know how this progresses and if I am not satisfied I will go to Trading Standards and pursue the matter as Fraud. I know I made an error, in that I thought they were sending me a small sample and did not fully read the advert but they should have made the terms crystal clear and they also should have given the full price of the items which again I did not see on the advert page. I would never have bothered a trial on something that costs that much, I couldnt afford to take this product long term.

All of the abcve are lucky. AsI did not check on those "free samples" I was rreeceivng from VIV 3, I was taken for over US$ 2, 000 by the bunch of thieves who operate under those letters and number but are in fact : PHYTOSCIENCES LTD. - 45 Lovell Glen - Linlith Gow -West Lothian - EN. What I would like to know is how does one go about getting these people sactioned by the UK laws. I always had great respesct for UK laws but, apparently, in spite of the fact that it is weell known that these people, under false premises, sell products probably worth a penny or two for over L/79, 00 and repeat that scam until the scammed party calcells his Credit Card or other form or payment. However, no action is taken by any UK Authority against this scam that has been reported for many months on the VIV 3 page of the Internet. To whom can I report this scam in detail and how do I get to know that some action is being taken? Am an 82 year-old citizen from Ecuador of Basque and British ancestry and always very proud of both. Is there any way I may contact an Agency whose action and answer will permit me to keep on being proud of my UK ancestry?

Well done to you Choles Rebancos for your quick and efficient response. Unfortunately some of us tried the same but had great difficulty reaching these people, maybe they have changed their behaviour since all the uproar many months ago. Fortunately I got my money back after much hassle with my building society and thankfully no more money was taken from my account.

THIS HAPPENED TO ME TO, BUT WITH PERSISTANCE I GOT A FULL REFUND BACK!

Luckily I kept my free trial confirmation email from the customer centre Acaiberry and life cleanse goes through. I emailed them and also called them with all my details, name, email, and especially the order reference numbers for the products I had. They tried to get away with it saying that I would not get my money back as I had signed the terms and conditions. BUT I looked on the customer support website through my email and that explained you can get a full refund within 30 days of receiving your product if you are UN satisfied with it. I went on asking for this. They excepted then and there said a refund will appear back in my credit account from 5 to 30 days (due to overseas currency) I then sent them a massive email expressing how unsatisfied I was and how I NEVER authorised any payments to come out. The next day I called them back again because I wanted to get an authorised email sent to me so I had proof they had said they were going to - to cover myself.
The day after that I saw the full amount back in my account. My full refund came to just over $400 NZ I had only lost $3.00. PERSISTANCE AND LOOPE HOLES is how I managed to get the money back. TRY EVERYTHING YOU CAN AND THEN TELL YOUR BANK YOU SUCCEDED. Every day banks get calls from people about this ACAIBERRY product. ITs sick and wrong and I think everyone should know how I did it and try it out for yourself. At the same time I cancelled my 'subscription' and got a new card with a new number on it. These ###ing ### need to be stopped.

Here is the company that I contacted. You have to be firm with them, they obviously get this ALL the time. Even if you didn’t keep your order number they still have your account at their end so you just need to tell them your name and any other details you put down when signing up for the free trial.

It clearly says this is a 14 day trial and if you don't want to continue you should call and cancel your subscription before the 14 days are up or you will be charged the membership fee. You should not believe that some company is going to send you something without some catch behind it. They e-mail was not even that long! This is not the fault of the company but the fault of the consumer not reading what they should have.
