I signed up with Whiten Pools on May 10, to build a 460 sq.ft. gunite pool at my place. I gave them a downpayment of *** on 5/11 as they said they won't start without it. The first payment was the biggest of all 8 payments for a total of ***. They said they'd start in July and finish in 12 weeks with some delays for rainy days. But they didn't work from August 6, to March 3, 2022. On January 12, 2022, I signed a Change of order to pay an additional *** to Whiten Pools for dirt and retaining walls, which they never talked about before signing the contract. On April 5, 2022, after 11 months of my downpayment, they plastered the pool, but the lights weren't wired, and the pool wasn't ready to pass inspection. The owner, *** Whiten, *** me into paying the last payment of ***. I paid on April 7, 2022, hoping they'd fix the electrical wiring issue quickly. But they didn't. I contacted them several times between April 7 and August 17, 2022, but they didn't respond. The pool hasn't passed the final inspection by *** county, and I'm worried about my family's safety. They breached the contract by stopping work without any excuse.
