On January 10th, 2024, I purchased a personalized weight loss plan from Yoga-Go for a one-time fee of ZAR 485 using my mobile phone in reaction to a Facebook advertisement. The available product options included a 7-day trial, a one-month plan, and a three-month plan. Opting for the three-month plan, I proceeded with the purchase button directly under the options. Notably, there was no provision or prompt presented for me to consent to an automatic renewal of my three-month plan purchase. Following the selection of products, the button simply stated "GET MY PLAN," without any accompanying disclaimer or reference indicating that pressing the button would enrol me in an automatic renewal subscription. This information is hidden underneath and following the button.
This critical provision was never conveyed to me in the welcome email or any subsequent communication. Expecting to receive the plan via email, I did not utilize the app or the purchased plan, only to discover later that it was exclusively accessible through the app.
On April 7th, 2024, I discovered an unauthorized deduction of ZAR 989 from my bank account for an unsolicited additional subscription labelled as "Three-month intro + Three month + Payment geo_exp." In response to my inquiries, Yoga-Go contends that I accepted and consented to further automatic subscriptions and confirmed my understanding of the subscription terms upon selecting the Get-my-Plan and payment buttons. However, had such information been transparently communicated during the selection of the three-month plan and before the button to Get-my-Plan, I would have refrained from making the purchase, as my understanding and intent were solely aligned with the three-month plan option.
The subsequent disclosure of repeat subscription terms hidden after the Get-my-Plan button constitutes unethical marketing practices. Notably, there was no checkbox provided for me to exercise my choice regarding a recurring subscription. This predetermined condition undermines consumer autonomy and represents an unjust restriction on consumer rights.
Had I genuinely consented to a repeat subscription, the relevant information should have been presented in plain sight before the selection "GET MY PLAN" button and where I completed the banking information for payment authorisation. Regrettably, Yoga-Go refuses to refund the unauthorized and unsolicited bank deduction. I am not the only customer that fell victim to this company. Please see TrustPilot for similar complaints.
Claimed loss: ZAR989 plus associated banking costs
Desired outcome: Please refund and correct your app website to reflect the repeat subscription as a choice selection placed before the option to push any buttons that would effect the purchase and payment.
