Z57 unfair and deceptive business practices

July 1st called Z57 to discuss site development. Spoke with Chad Comfort. Was told that I had to make a decision on the phone with him (1st phone call only qualifies for discount) so that they could lower the start up cost from $499 to $299. Original monthly cost was $99 but they would lower it to $79 for me if I made my decision immediately. We paid a total of $378.00 from our bank card that was taken out on July 3rd. The phone call lasted more than one hour and we looked at several sites with Z57. Both my wife and I were on a conference call with Chad to understand the details. We had narrowed down our search for a web site between Z57 and Real Estate Sites.

Promises:

• All contact lists we provided to them would be uploaded into the back end of the site. We emailed five client lists to Janette Dirks. Only one list was ever uploaded. This is part of a marketing drip campaign we could control to our past client data base.
• Foreclosures.com was part of an agreement with Z57 and both we and clients would have access to this database, included in our monthly fee. This was a BIG selling feature for us. We stressed to Chad Comfort that this feature was a key benefit that would sway our decision. He told us our clients would have full access, that many of his current agents were having great success because of this feature. We were promised to have a backdoor in to determine what searches the prospective buyer viewed and then be able provide them with more information on the properties. Considering the current economy we all agreed (Chad included) that this would be a huge advantage on our site. We only learned during our training call on July 9th, with Hue Huynh, that this was not the case. The prospect buyer would be brought to foreclosure.com website and would need to sign up for a free 7 day trial; after the trial there will be a $10.00 monthly fee paid to foreclosure.com. At this point we were not told about our ability to also purchase a subscription at a discounted rate. We explained to Hue that this is not what we were told by Chad and her response was: “this was a miscommunication and she was sorry”. Chad must have explained it incorrectly. Hue Huynh told us we could add a disclaimer to the site that the fee does not go to us that it is a 3rd party fee, that some of Z57 clients use a disclosure – in addition to asking the client to contact the agent about foreclosure listings. On July 14th, Kevin Grady mailed us (email attached) stating there is no way to add a disclosure to the site re: foreclosure.com fee. We were informed this was a miscommunication and they were sorry.
• IDX search feature. On the initial call with Chad it was clearly explained by us the importance of having a robust IDX search feature for our prospective clients. Our MLS system limits the amount of information published by 3rd party vendors via an IDX feed. We reviewed in detail the IDX solution provided by the contracted Z57 IDX feed provider and it was not acceptable to us. This was a deal killer. We were adamant about the ability to give our prospective buyers as much information, property detail, as possible. No problem we were told, if you don’t like our vendor go out and find an IDX solution you like and Z57 will make it work on the site.
• We searched and found an IDX that provided more information called Ihomefinder. We learned that Z57 used to contract with this company for IDX feeds. We signed an agreement with Ihomefinder filed the appropriate paperwork to have our feed approved by our MLS. Hue, during our training call, said she prefers Ihomefinder and that the technicians will make it work in our new site. We were told by Chad Comfort, Hue Huynh and All others that we would be able to have a Quick Search on the front page of the website and the IDX integrated into the site. On July 12th I spoke to Kevin Grady, customer service, to find out when the technicians could create the quick search function for me on our home page. He said he would put the work order in and it will take a day to hear from them.
• I called back on July 14th and for the first time a supervising customer service rep explained the quick search feature will not be possible, unless we use Z57 provider. On July 15th by Kevin Grady (email attached) also stated that it is not possible to do this unless you have the IDX through their company. I was very angry being given this news so late, the woman I spoke to asked if I want to cancel that I am within my 10 days to do so. I told her I would call back - I had to assess my options.

I was on the phone every day with Z57 trying to iron out all of the “miscommunications” I spoke with Chad Comfort, Truong Nguyen, Gregg Segel, Mike Kulig, Kevin Grady – these are the people I have names; emails are attached with proof of names of people I spoke with. There were others that I did not get follow up emails from. After many calls and finally be given the truth that Z57 made false promises I decided to cancel the site.

I called back Thursday 7/15 to cancel and spoke with a customer service rep (do not have his name) and he said he could see in the notes that I was unhappy and that I could cancel. He said he would put in the request and I would get a call from a manager to review the credit card information to make sure the right account was credited.

I received a call from a “Rachel”, a supervisor Fariday 7/16 in the afternoon. I explained everything to her. She was working in a scripted way and offered to refund $100 and give the next two months free; that the 60 day must go forward - that the refund only applies on 60 unique visitors. She further said yes I could have money back since I canceled in the 10 day period, but since the site was built no refund is due. I explained we purchased the site based on false promises and outright lies, that the company appeared to engage in unfair and deceptive business practices. At this point since I was not conceding to her discount and free months offer and I made it plain that I was lied to, she said she needed to investigate and check with all people at Z57 to see what was promised us. She told me that she would call me on Monday 7/19 in the midmorning since she is on the west coast. I never heard from her. I left a message for her to call me at 3:00 that afternoon. She returned the call on Tuesday. We went over everything again and again she agreed that there had been miscommunication. She told me that they would refund the monies and apologized. That I would be receiving an email with the cancelation from a manager and the money would be returned to my account after I processed the cancelation. Five minutes later she called me again and said that she was wrong and was given the wrong information, Z57 would not be refunding the monies, if we canceled.
My wife and I both went back and forth with Rachel and she kept apologizing and telling us they would refund $100 and waive the next two months fees. If we cancel outright we get nothing. We told her we were not interested in working with the company – the site they provided is not the site we were told we would have or what we paid for. She told us her name was Rachel “Coach” – we asked to speak to a higher up or to speak with the person that told her not to refund the monies and she said she did not have his name.
We have received an email with the link to cancel but we do not agree with the terms for cancellation. Z57 used false and deceptive business practices to get us to pay them and then did not deliver what they promised. Apparently this is a regular practice with them – attached are reports from “[redacted]s”. It seems once someone wants to cancel a “Rachel” calls them.

Lastly when we initially signed up we were about to buy our domain name at GoDaddy.com Chad said he would buy it for us and not charge for it, that I would be the owner of the name. It turns out I am the owner but Z57 is holding the domain name hostage on its server. I received the username, password and authorization code from Z57 to redirect my domain name to another host server; since I cannot change registrars for 60 days. I have requested access to the host site; no response. I have requested Z57 to point the domain to another server no response. Now it is clear to me about the 60 days and why Chad wanted to buy the name on my behalf. We have all our emails tied to this domain so now if we cancel we lose our ability to email or use an alternate web site for our clients. We have branded ourselves as our domain name – this is a big blow to our ability to conduct business. Not only did they rob us of our $378 but they have taken our business identity – you cannot assign a dollar amount to that.

Team Erickson,

We know your issue was already resolved with a refund, but we saw a new posting today that we felt we must address.

First off… we do NOT agree with the opinions of J Howley. We’ve looked through our files and Howley is not an employee (past or current) or a customer (past or current). Howley’s comments are inappropriate, rude and completely uncalled for. Howley - we don’t know who you are, but please stop with the name calling.

The Complaint Board is set up for customers to share their opinions - good and bad. And while it hurts to hear the bad – we needed to hear it. Frankly, we have taken everyone’s feedback very seriously and are rolling out new changes at Z57 that we hope will be the first step towards improving your perception of Z57. While we cannot repair all of the mistakes of the past – we want to improve and are making serious changes here. And we welcome your continued feedback as we strive to improve. Hopefully we can win your business back. But regardless, we want you to know that we heard you and we are changing.
Here’s what we are doing:

Our Cancellation Policy
We want to apologize. Sometimes policies get in the way of offering good client service and it appears we are guilty of that. Z57 prides itself on successful working with thousands of Realtors to grow their Internet marketing for past 12 years. It wasn’t our intention to make it this so challenging to cancel our services and we don’t want to force Realtors to continue with a product if they have changed their mind after hanging up the phone.

Therefore, effective immediately, any new client can cancel their Z57 services within 3 days of purchase – for any reason – and get a full refund. If it’s after 3 days, a client may cancel at any time with 30 days notice. Simply call us at [protected]. Yes, we will still ask you why you want to cancel. But understand that’s only so we can improve our product and services to better suit your needs. We want to offer Realtor’s the best service possible.

Beyond cancellation policies, there are several other programs and activities that we are working on to improve at Z57. But in fairness to your post, Team Erickson, we don’t want to dominate the conversation or change it like others on this post - who take the opportunity to try and sell you competitive products.

However, we did want you to know we heard you, we are making changes and we are grateful for the feedback.

Lastly - J Howley – we don’t know who you are, but please stop insulting people who simply want share their opinions. If we didn’t get feedback, we couldn’t improve.

You people are not too smart. Z57 is the best internet company out there. When you pick up the phone to speak to one of the reps, they have the patience to deal with how little you know about the internet and how to market. ihouseweb is a joke as is AccessDirect, and all the other companies trying to pretend to know how to handle a real estate agent and create an effective website. My advice to all of you who are complaining-when you talk to Z57 reps, be quiet and listen. They are far smarter then you are and are only trying to help. Those of you who have billing issues...are you sure you know how to read a contract or use a calculator? Just trust Z57. Henry-you are the man! Steve Webber is a genius and is only trying to help the unintelligent real estate agents stay in business

There are many issues to consider before you purchase web services. We all do the research for your home buyers, directing them to the right location, style of home and a whole range of personal must-have features.

As a potential customer you need to do your research regarding a website design/development company. I have received my share of unsolicited phone calls from the Z57 sales side in San Diego, CA. I have taken the time to keep the individual on the phone to find out as much about the company as possible. The art of listening is an important skill to have when working with such an aggressive company. NEVER agree to any business partnership right away. You need to research on your own and see if this is the product/service that will meet your needs. After my second call from the Z57 sales rep (in respect to their privacy I will not name names) I went online to research Z57’s reputation and their website and product.

Coming to the web, I saw the negative responses from so many of you who have had poor customer relations experiences, poor billing experiences, poor traffic when more was promised, complaints regarding numerous aggressive unsolicited sales calls that is highly disruptive to your business and difficulty leaving the Z57’s services. I actually recently connected with a former Z57 employee who also will remain nameless to protect their privacy. I learned a great deal about the internal organization, information about the owner and the company in general.

From my discussions with this former employee, I would highly suggest that you do NOT use Z57. The sales force is taught to close the sale in an aggressive call approach-they do not want to take no as an answer. Most of the team are males in their young 20s with little knowledge of the online real estate industry or internet technology. The young lady who worked there said it was like entering into a fraternity-loud rock music pumping. Z57’s main business effort is on sales conversion and the sales team has to work hard to make their commissions. The turn-over is huge and the sales environment is more-or-less a revolving door. They work from mailing lists that are often outdated and several sales people on the floor will fight to make the call so often one realtor will get multiple calls from Z57 -often in the same day! Once an agent signs up for service, Z57 makes it as difficult as possible for you to leave. This appears to be company policy. Apparently the Z57 customer base continues to drop because Z57 is unable to meet their 60-60 promise therefore the pressure is placed on the sales team to be even more aggressive with an individual on the phone. Z57 scrambles a few days before the 60 days is complete to improve the search engine optimization so the website gets more traffic (not leads) in online search engines like Google, Yahoo or Bing. Nothing illegal; however highly unethical! It seems Z57 is far less concerned about delivering on promises and supporting their customers then they are about making promises during their sales efforts to grow their business.

I also have seen posts from agents complaining about the quality of their website produced from Z57. If you are considering using a web development company to create your site, look at the website of the company that is selling you your site. Visit www.z57.com and see if this is the quality you expect or want to represent your business. Frankly the site looks as though it has not been updated in a long time and does not look very polished or professional.

To be fair to Z57, there are many other real estate website and online marketing companies that have poor reputations; however Z57 seems to be the worst of the lot. Also be careful when you evaluate awards given to the company. They might be #1 on the list of internet developers, but ask yourself what this really means. You will see that Z57 was recognized recently as the “No. 1 web developer and design firm 10 consecutive years; however do your research! You will see that this award is “based on the number of local employees as of August 1, 2010” They have a large tele-sales team (I believe around 100 individuals) and also have their design team. This award does not represent quality of service or product. When having the conversation with the sales person on the other side of the phone, ask a few questions.” How long have you been with the company? How many people work in the development and design team? etc.” Ask for current customer success stories. The testimonials on their website seem quite outdated. If you are local in southern CA, ask to make a visit.

Do your homework. You would not show a client looking for a rural country home a condo in the city.

I support a large firm and have been a realtor for about 12 years. I will be launching a site that evaluates all internet real estate providers and it will allow interaction by the vendors, past and present employees, former and current customers and professionals. It will truly allow for an open dialogue. I noticed that Z57 pulled their blog site down (http://blog.z57.com). Another bad sign when a company doesthis; however based on the negative responses out there I imagine I know why they did. Technology is confusing to many of us in the real estate field and we need all the ammunition possible to be able to make an educated decision with who we partner with in the technology space. We all need to be able to drive new customers to our services as well as be able to apply new listings. We compete with each other on a local level; however from a national effort we can all work together!

I hope this has been helpful. Please let me know what additional features you might like the site to have or add any comments.
Thanks,
Donald

I (Janette Dirks) request that you revise your post and remove my name from it.
I feel that it could potentially harm my future career ventures (I have resigned from Z57), and should not receive the possible back lash as I was only adhering to current company policies in regards to your contact lists.
I appreciate your time and consideration.
Thank you.

BUYER BEWARE! Be firm when you try to cancel your account. Hard sell, promises, multiple steps to cancel. If you don't follow correctly will be charged another month. I had been a customer for over 3 years spending thousands of dollars and they won't refund a lousy $99 when I made the phone call to cancel. SHAME ON YOU Z57!

I have filed a complaint with the San Diego BBB. Z57 responded. Refuse to refund me the $99 plus $20 for a feature listing. (Had my account been canceled so would have the feature listing.)

SHAME! SHAME! SHAME!

Z57 unfulfilled promises

Realtors beware! Dealing with Z57 Internet Services was one of the worst experiences I've had. They misrepresented their services and costs and when I started implementing "my new website" I could not do what I was told I could do. Called customer service was no help. They were argumentative and wanted to prove they were right, versus helping me solve my problem. When I determined not to continue with them, they refused to admit that they had problems and they kept my money. So basically, I spent $400 to learn that they were scoundrels!

Z57 terrible

Z57 is a complete joke! They offer you at least 60 UNIQUE leads by unique they mean fraudulent, I received maybe 30 emails all of which were fake email addresses. Then when I tried to cancel the first month they told me I had to wait two months to experience the full effect and to qualify for my full refund. I contacted them at the end of this month to cancel again and get my money back and they tell me I received too many unique visitors to qualify for any refund. They are scam artists and you will be wasting your time, energy and money. STAY AWAY FROM Z57

Thank you for letting us know about this situation. Your description of this incident is alarming. We would like to review the call and take appropriate action. If you have any more information on who the agent was that your friend was speaking to on the phone or the date and approximate time of the call, we will do our best to identify the call and review it. Also, we certainly want to address the question you were calling in about. If you can provide more details on your question regarding our neighborhood data, I am more than happy to look into that for you and get back to you with an answer as soon as possible. Please contact us at heretohelp@Z57.com with any additional details you may have.
We look forward to hearing from you.

I am going through a really hard time with z-57. I have not complained but kept asking questions and the agents told me that they are only allowed to go over one topic at a time. everytime I asked the question for the past 4 months I was steered to buy more products. I have a few friends with Z-5. And when my friend was on the phone while he was learning the website the agent did not know I was there and said to my friend oh you know your friend ( me ) They all know her here at Z- 57 and she has her name on the ### list. she is never going get any of her questions resolved the agents hate her here and will always give her a hard time. My question was legitimate about the data and no one wanted to answer it. I am not sure what to do at this point just that it is really uncomfortable and unfortunate that bussiness can be run this way. I wonder if the Owner and Ceo is aware if all this going on. It is sad I have friends all over that are Real Estate agents and I would have referred them but instead they just reallly taught me people don't care even when you pay them for their services. They have the neighborhood date back from the 1800's and not in the year 2012! All I was doing was asking them to fix the problem. Not judge or harm my mind.

Z-57 recently got black listed from Yahoo. This caused me to loss contact with all my clients for days. When I called tonight to speak to the rep, she would not give her name, kept talking instead of listening, kept telling me that after I changed my "pass through/pop mail" to gmail account; I would not be getting any mail sent to my domain from yahoo... but I did. Then to after getting very angry asking to speak to someone else, the btich hung up on me. DONE DONE DONE, STICK A FORK IN ME I AM DONE... After six years of this ###!

T0 the Z57 Client development team:

Good job of presenting us with Good Cop-Bad Cop routine. I bet you know full well who J Howley is. Either way it is nothing that any one can prove short of hiring a fleet of lawyers. How convenient.

Z57 ripped me off and I still have the emails from Paul Lamotte suggesting I should give him my log-ins. Only an idiot would give up their MLS LogIns. The MLSs prohibit members from doing that specifically. As if you guys didnt know that - well maybe you dont if you catch my implication.

And I quote Paul Lamotte
"are you able to give me the user and password for that agent long in section so i can look around to pull a link off of that?"

You got plenty of feedback from me and yet you NEVER privided me with any real service. Everything I said in my preivious post on this site still stands. Offering up an apology for past bad conduct does not make up for that conduct. It only shows me how despicable and unethical you people really are. I can walk outside and get clean hot air.

To Wayneloux,

We know your post is a few months old, but saw a new posting today that we felt we must jump in.

Also, we see the posting from Imvu and do not agree with their position either.

If it’s after 3 days, a client may cancel at any time with 30 days notice. Simply call us at [protected]. Yes, we will still ask you why you want to cancel. But understand that’s only so we can improve our product and services to better suit your needs. We want to offer Realtor’s the best service possible.

Our Traffic Guarantee
We received a lot of feedback regarding our Traffic Guarantee. We take pride in the products we deliver and we would never intentionally create an offer that clients felt misled by. We were surprised by the feedback and pulled together our resources to make changes.

So effective immediately, we have removed the Traffic Guarantee and are replacing it with a new program: the Z57 Academy. The Z57 Academy is a comprehensive program that teaches Realtors how to be successful with Internet marketing. Through these five one-on-one courses, Realtors learn how to harness the Internet and Z57 services to maximize their marketing and take advantage of every opportunity to generate traffic, which converts to leads and ultimately– transactions.

We have a lot of experience making Realtors successful online and felt that these courses would offer our clients more value and more back-end support. At the end of the courses, Realtor’s earn a Z-Pro certification for their marketing and will give them access to additional Z57 resources. For a limited time, we are offering these classes free to Z57 clients so if you are interested in enrolling in the academy, simply call us at [protected] to schedule your first course. Also, any existing clients who are currently under the traffic guarantee may immediately switch to the Z57 Academy if they choose to.

I know its a few months too late and we have lost your business. That's our loss. But we did want you to know we heard you, we are making changes and we are grateful for the feedback so we can improve our services.

And J Howley – we don’t know who you are, but please stop insulting people who simply want share their opinions. If we didn’t get feedback, we couldn’t improve.

You real estate agents are not too smart. The next time I call...shut up, give me your credit card # and I will give you the best product/website in the industry. Don't trust these other companies. Steve Weber is a brilliant man and you are lucky to hear one of the sales people when we call. You know you just are not smart enough to understand the way a website works or how to read a contract. Trust the experts. I am so tired of hearing all the complaining. Suck it up, take the call and pay your damn bill. Enough with this nonsense!

Who comes on a complaint board to sing praises for a company that is as fraudulent as Z57! Just google Z57 and you will find page after page of SCAM alerts. If you google Wise Agent, Top Pruducer, Agent Office, Real e Seller you won't find this level of complaints hummmm. So IMVU I think we know what kind of job you have, stealing money from hard working realtors, maybe you need a real job instead of damage control for Z57. It not about us being cheap, it's what we call customer service, and the difference between right and wrong. If you need to come on a complaint board to say good things about Z57 the pressure must be getting to you! Talk about Karma I can't wait to see what comes back around on you. Any one interested the attorney general is investigating Z57 I am sure they would like to hear more stories. IMVU If you have to work this hard to steal my money I know I make alot more dough than you.

shame on you people for not reading the terms and conditions. have you heard the phrase "if it sounds too good to be true it probably is"... take a lesson from your mother and know that if your going to spend $49-$99 on marketing monthly YOU WILL HAVE TO WORK. who the eff thinks they are going to get quality leads for the price of a good dinner. if you real estate agents honestly believed that then your all [censor]s. with that being said z57 does provide an amazing customer support team that will help you map out a marketing plan and help you get started but they wont do everything for you. i havent worked with one other company that will sit and teach you how to market on craigslist for an hour for free! basically if you people werent so busy pinching pennies and actually invested in GOOD marketing strategies $99 wouldnt seem like the end of the world because you'd actually be making real money.

bottom line real estate agents are lazy, they want the world but dont want to lift a finger for it. this market is karma, go get a real job chumps.

I had the same issue - lousy website. I cancelled back in June but they still kept charging my account. Apparently when I originally called to cancel they said they had given me the option to sell my website to a friend or work mate. Why would I sell something that is worthless to a friend! They never told me this. They say they will not refund my money that they have charged since my original cancellation. I have put in a complaint to the BBB. I also got the stupid fake e-mail leads. This is a scam!

To Realtor1234,

We know your post is dated, but saw a new posting today that we felt we must jump in.

At the end of the courses, Realtor’s earn a ZPro certification for their marketing and will give them access to additional Z57 resources.

But we did want you to know we heard you, we are making changes and we are grateful for the feedback so we can improve our services.

And J Howley – we don’t know who you are, but please stop insulting people who simply want share their opinions. If we didn’t get feedback, we couldn’t improve.

So tired of you idiotic real estate agents. Learn how to read a contract and be thankful Z57 is there to hold your hand and keep you in business. I think they would have to show you how to wipe your own ### as well.

PURE SCAM...liars...everything they will tell you is worded in a way to trick you. SERIOUSLY...do not be stupid (like me). Do your research and not on the web-pages that they send you to. Just Google search with the words [Z57 SCAM}. Start there. There will be pages of the same story. There are 100's of posts from people who have been ripped off by this company. I'm mad at myself for having to learn the lesson (IF IT'S TOO GOOD TO BE TRUE...IT ISN'T). Any Realtor who believes that they are going to close business from leads from Z-57 is dreaming. DO YOUR OWN RESEARCH...DO NOT BELIEVE A WORD THIS COMPANY SAYS.

Z57 rip off

Z57 did not generate one (1) real lead for us and charged us over $300 to develop a website we had to go in and customize. They then charged $99 a month for hosting with many many promises of business leads and marketing.

We contacted the company to reduce the monthly from $99 to $49. They continued to charge our account for the original $99 per month and have yet to provide a refund. We have talked with 5 different people including a supervisor, David Keays, saying our money was to be refunded and would be in 2-3 business days. That was a month ago. Shady business and they do not provide what they promise. DONOT WASTE YOUR MONEY!

I had a Z57 website for a number of months and found their communication to be sub-par. Although I liked the quality of the site overall and did get some leads from working it there definitely were things about it I would have changed if I could. When first working with them to get it set up, communication was dismal. Once it was up and running, I was pretty much doing things on my own anyway so it was okay. I was then solicited by Superlative, LLC websites which offered an initial set up for $99 (as opposed to $299) then a monthly fee of $29.95 (as opposed to $99) for a site that is just as good and in many ways better than Z57. Even though I cancelled my contract with Z57 more than a month ago I was just billed another $60 for having several listings promoted on Trulia because I mistakenly thought I had turned off that feature prior to leaving Z57. Turns out they were on auto-renewal and you had to do a more complicated process to get them to stop. Not happy with them at all and definitely don't recommend them.

Good luck getting anything from them. I had the same charges you did to design then $99 monthly fee. After I discovered how horrible they were I tried to cancel. Numerous e-mails and voicemails, no they make you talke to a live person who switches to another and so on and so on. Took me 3 months to finally get it cancelled, had to change my charge card even. Our last conversation was that the account was cancelled and I would no longer be billed for the 3 months I was trying to cancel. Then today, 7 months later I received a call from a collection agency on behalf of Z57 to collect $296. Stay far, far away from this company. If you are with them and want to cancel, get mean its the only way to get free of them.
