As (Judit Jordan) the passenger’s request to attend the return flight from Milan to Dubai
20th October 2017, without attending the outbound flight from Dubai to
Milan 6th October 2017 deems rightful,
*Etihad is kindly requested to review the passenger’s case*
and engage in a fair procedure where the passenger exercise her rights.
*Reasoning:*
According to the 1969 Vienna Convention on the Law of Treaties under
Article 62 (Fundamental Change of Circumstance) the circumstances existing
at the time of the conclusion of the agreement were indeed objectively
essential to the obligations of treaty (sub-paragraph A) and the instance
wherein the change of circumstances has had a radical effect on the
obligations of the treaty (sub-paragraph B).
The order A3DVBDT for flight DIBSQR Dubai-Milan-Dubai (hereinafter ‘The agreement’)
was placed 25th August 2017, at which time the passenger was not aware of
that the passenger’s employer would send her to a one-time international
assignment 7th September 2017. The assignment period lasts from 3rd October
till 8th October 2017 in Bogota, Columbia. The assignment has a radical
effect on the passenger travel plans, namely, the passenger is not able to
attend the flight from Dubai to Milan 6th October 2017, while the passenger
still can attend the return flight from Milan to Dubai 20th October. The
details of the mentioned circumstances can be credibly proved as required.
In public international law, clausula rebus sic stantibus (Latin for
"things thus standing") is the legal doctrine allowing for agreements to
become inapplicable because of a fundamental change of circumstances. It is
essentially an "escape clause" that makes an exception to the general rule
of pacta sunt servanda (promises must be kept). Agreements can be modified
if the changes in circumstances were unforeseeable by the parties, and
bring about significant changes in the possibility of fulfilling
liabilities. In line with this legal principle Etihad Airlines indeed
allows changes and refunds for flight reservations in its policy, however, when the agency Flysiesta contacted Etihad the request was rejected.
In this case the passenger seems to lose the right to attend the return
flight because of the disability of attending the outbound flight (due to
unforeseeable changes in circumstances which was communicated to the agency, Flysiesta through a help desk ticket ‘[#KXZ-[protected]]: Date change
for flight: A3DVBDT’ in a timely manner). The passenger fulfilled all
liabilities set out in the agreement, amongst others the immediate payment
of the full amount of the flight ticket at the time of the order, however,
the passenger is unable to exercise the rights established in the
agreement. The enforcement of the agreement is clearly one-sided for the
grievance of the passenger.
The Changes and Refunds policy of Etihad Airlines indicates that ‘if you do
not show up for any flight without advising us in advance, we may cancel
your return or onward reservations and charge an administrative fees.
However, if you do advise us in advance we will not cancel your flight
reservations.’ During several mail changes and phone calls with Flysiesta
helpdesk, Flysiesta failed to inform the passenger about that no show
entails administrative fees, also that profound and timely communication of
no show allows the passenger to reserve the right to attend the return
flight.
It is beyond doubt that Etihad operation complies with the law, hence you are requested with due respect to
review the case, provide a fair procedure, and fully inform the passenger about her opportunities and the total amount and the reasoning if any administrative fee. Please consider allowing the
passenger to attend the return flight from Milan to Dubai 20th October
2017, without attending the outbound flight from Dubai to Milan 6th October
2017. Proof of changes in circumstances may be provided upon request.

mismanagement and irresponsibility at its best
I have booked a flight on 18/09/2017 from Melbourne to Hyderabad(India) dated 21/09/2017 and return on 24/09/2017.Scheduled at 3.50 pm from Melbourne. I rescheduled just the return ticket to 25/09/2017. When i came to the melbourne airport i was not allowed to board the flight. I had all the mails of tickets and everything but still i was not allowed to board. It was a very important flight for me to take. I had many things lined up. I am student here and booked a ticket just 2 days back. It was my close relative funeral and some business meetings and many more things lined up.
I choose Eithad airways because of its service and responsibilites. But i was really disappointed with act of yours today. When i called the customer care they told me they will call me in an hour, its been more than 1 hour but still i did not get a call back. Meanwhile i was not allowed to board the flight.
Now who will take care about my lost time and losses? Everything was lined up perfectly for me.. now what should i do?
The customer care team is also so poor at doing something I really don't know what to do..

I had offered all the necessary documents well ahead of time, but you'll took more than 2 months to respond on the reply of my email, you can see the trailer mails and see how the entire thing has gone wrong, you'll deactivated my account and i lost all the miles accumulated, please request to transfer them back into my new account, made as mentioned by you'll.

bottle of d & g perfume stolen from check in baggage in zürich
I am utterly disappointed that my New Dolce & Gabbana perfume bottle was stolen from Zürich Checked in Baggage. My flight from Zürich to Abu Dhabhi was on 08.09.2017 when I boarded the flight at 11:20 am with EY 74 flight that same day. The connecting flight to Mumbai EY 7600 was at 23:30 the same day from abu dhabi.
Since by luggage was 12 kilos and was lighter than normal, Etihad employees stole my expensive 80 Euro perfume bottle after I checked my Baggage in Mumbai.
This way I will never trust Etihad ever in my life and will never take this flight again in my life till I get back my expensive perfume bottle.

cancellation of flight and mishandled baggage
Hi i was traveling from Warsaw to Trivandrum. My first transit was at Germany and when i reached there they said my Abudhabi flight is cancelled. And again i had to call etihad and they arranged some alternate flights. There was no support or message from them before my flight was cancelled or about any reschedule. Then i was travelling to Istanbul by Turkish airlines and I reached late, where my next flight left before 20 mins i reach Istanbul. Again from Istanbul help desk they booked flight to Dubai and from dubai to bombay. I was not provided with my destination. I had to book my own tickets from Mumbai to Trivandrum. This was my first huge problem, where i had to roam for no reason. Then after reaching Mumbai when checking for baggage they dont have any info about it. I had to file a complaint fr my baggage and its been two days no information yet. They are still tracing it. I came down for five days and tomorrow night i have my etihad flight again. I haven't got my baggage yet. Full of inconvenience with etihad for the first time. I need some help emergency. I need my baggage before i leave tomorrow. Baggage file num is BOMEK54236. This is totally irritating.

Dear Team,
I had a flight today at 12.55 route Cairo to Abudhabi. Came to airport after 3 hours travel from my town and after 1.30 minutes of airport security queue, I discovered your great staff have changed my ticket to 14.50 flight!
I have to go back to my town now as your staff at Cairo airport couldn't help and put me on my original flight.
Your staff at etihad mall dubai changed the timing of the return ticket with out informing me and with out my approval for this I would like to inform you that I can't fly on 14.55 flight as I can't meet the needed time to attend to airport on time.

My flight was from budapest to sydney trough berlin and abu dhabi. I got to berlin when i wastold my flight is going to be delayed from abu dhabi to sydney...didtn know why, than wegot advised ourflight from berlin is gonna be delayed by 3 hours. It ended up with 5 hours delay, lots of hassle with baggage tickets etc. Worst experience ever. Everyone was rude and not even helpful. In abudhabi wegot a room by 3am . When i arrived to sydney my baggage was not there so now i am expecting the call when it will arrive. Absolutely disappointed, 14hourslonger trip...no baggage...

I was traveling from Dublin to Perth via Abu Dhabi flight no EY486 .Arrived in Dublin airport at 6am was queuing for nearly two hours before being told there would be a delay of three and a half hours plus we would not make our connecting flight so we would have to wait until the following day for next flight out of Abu Dhabi, which means I will be over one day later arriving to my destination, I'm so stressed and annoyed as we where another two hours delayed in Dublin as the flight that was suppose to take off at 9.25 am was also delayed as it was to take off at 1.25pm but in fact did not leave until 3.28. The staff did not keep us updated with arrangements and where not very friendly Then as if this was not enough upset I had to Que to find out which hotel was putting me up for the night and the had to Queu again to check in to hotel it was 3.30 local time again I got to bed exhausted stressed and feeling venerable

My name is Mohammadreza Janghorbani and this email is regarding the problem I faced during my flight and at the transit in Abu Dhabi. I was supposed to travel from Melbourne, Australia to Tehran, Iran, connecting at Abu Dhabi on Etihad airlines (Flight No. EY463). (My ticket is also attached)
My luggage, which was supposed to be checked all the way through to my final destination, has apparently been completely delayed, I spoke to airline in charge and they informed me that they would be in touch within (24) my luggage tracked down and arrived to my destination.

As I received my luggage 24 hours later by a taxi at my place in Tehran and opened my baggage I found my souvenirs which contains chocolates was completely ruined and would be useless. I did not expect this type of service and damage from your company.
It is supposed your company paid the fee of my damaged and ruined chocolates due to baggage claiming delayed which costs me 600 $. I am also enclosing a photograph of the damaged materials for your reference.

hand carry not allowed by check-in personnel
Hello,
I was returning to Chicago from Hyderabad(India) on 2nd Sept 2017. As per the guidelines on the Etihad website, I was carrying two luggage bags 50lbs each and a carryon bag and a laptop bag.
At Hyderabad Airport, while I was checking in my baggage the etihad representative said that I am allowed to carry only one carry-on bag with me and so I should either take the laptop or the carry-on bag. I tried to show him the guidelines on the websites, but even after reading it, he said he will not allow me to carry them.I told him that I called the customer-care to confirm that I am allowed to carry a hand-carry and a laptop bag but He was in no mood to listen to me. He insisted that I pay for extra baggage if I want to carry the hand-carry(which I am legally allowed by the etihad free of cost).Even the other Etihad agents joined him and as I was getting late, I had to leave my hand carry which contained all the gifts that I had purchased back in india. I am not sure if this is the new way to harass passangers at this airport by Etihad officials.I request you to kindly look into this matter seriously and take action against the authorities.
Also, during the flight I requested the flight attendant for a glass of water and her response was "Everybody is asking for water so wait until we serve the food", which was started after 25-30 minutes.Its like, I made a fool out of myself by selecting this airlines.
Hope some action is taken against such officials who love to harass the customers.

I'm currently on 4 and half hours into flight from adu Dhabi and have paid for WiFi on board todays flight. Flight EY 15 When on take off I asked the stewardess my flight entertainment didn't work and she said there was nothing she could do I replied by saying on other flights with etihad when a customer has had a problem could reset the box or change the head set because my problem was no volume she then replied she would have a look. After 1hour and nothing I asked her again and now 4 and half hours into a 7hr flight still nothing I find this terrible service I have travelled from bangkok so this is my 2nd flight of the day and this is the worst service I have received on a etihad flight I'm a frequent flyer with etihad and will continue to be so I just wanted to highlight staff on today's flight and am writing this complaint now because there's nothing else to do after getting fed up lip reading what Jack sparrow was trying to say on pirates of the Caribbean. I am advised to wait until 4 am for my next flight to abu dahbhe my flights abu dabhi 10: am on the next day this is unfair without offering something for us to rest.

missing guest miles
I ([protected]) have been trying to claim missing miles for 5 or 6 flights with Etihad partner airlines in May this year.
I have submitted my claim with the respective documentation in the beginning of June. I have sent several follow up emails. The only answer (if any) I ever get is that they will correspond with me shortly and that they are looking forward to welcoming me again as their guest in the future. It has been three months now since I started this process. This is ridiculous.

I was stopped from getting into the Etihad Flight No. EY 130 from Washington D.C by one of your managers. I asked for his name but he never gave me his name, so I asked for his name from other people. They said his name was “Raza Hassan”.
My carry-on bag was weighted during the check in time and they said it was ok. After the security check in at the gate area at custom free shops, I purchased some gifts for my family and friends. No one had told me that I could not do shopping in the transit area. I was told that I had exceeded the limit for my carry-on bag and that I had to pay $350 dollars or trash my items. I could not pay $350 dollars neither I could trash my belongings. I explained to him that no one has told me that I could not do shopping in transit aria. Mr. Raza was very root and disrespectful. He never tried to listen to what I had to say. I asked to be able to leave my belongings somewhere else (eg. Front disk) so my family members or friends could come and get them later. He refused to be of any help and at one point he shouted and he told me sit down or he would call police and security on me. He was stubborn enough to unload my bags from the plain and stopped me from getting on my flight.
He has caused me and my family so much serious problems. At the same time, I must reschedule another flight and I am being charged for not showing up, although that wasn’t true, and some other charges that are irrelevant.
I would like to settle this issue before pursuing the complaint further through.

Hi, my sister and her kids reached thecheck in counter but the counter said as she arrive ld exactly on the closely time they won't be sure if she can make it to the flight after all check ins. So they assured her that eithad airways will issue her tickets for next available flight.
She missed her flight after being assured by the person at counter. Then they informed her about paying 43K INR as rebooking charges for 3 people (1 adult and 2 child) she had money in Swiss Frank and she was unable to pay the amount. She called me for cash and I spoke to the counter guy to ask payment options. He said it's either card or cash. In another 5 minutes I made 43K available for the tickets but there was no one at the counter and now at 1.15 they are asking us to re-issue the ticket. The 3 passenger with 2 being kids have been waiting for the counter person but there's no show? This is completely not fair. They missed the flight due to the counter guy and now they are ticket less. She is staying at one of the airport rooms. Please help us and get tickets in quoted price.

lack of responsibility
My mother went from Detroit to Islamabad on 22 August. Firstly with every passing day you guys are squeezing the seat size and the leaf space. Most importantly when the flight was about to reach Islamabad, it was diverted to Lahore due to bad weather. When the flight reached Lahore the stupid Egyptian pilot refused to fly back to Islamabad for some strange reason. Subsequently my 60 year old mom who had already endured more than 24 hours of journey had to be seated in a low standard bus service which took 8 hours to reach Islamabad. She is highly hypertensive and had to be hospitalized after the tumultuous journey. I mean don't you people have any sense. Why are we traveling on your airline if we had to ride [censor] infested buses. Grow out of your thick heads please. I for one won't ever travel in Etihad anymore.

service from the staff
We traveled from new york to abu dhabi on ey 102 on 20th august -2017, departure 15.00 hrs.
Our family usually prefer to travel through ethihad flights and we had very good experience with it previously.
Unfortunately, during my 13 hrs flight we had experienced differently. Many times we raised the light for a service from the staff and no one turned out. I wanted to have water and to meet my need I went to the pantry and met a lady staff on white jacket. I asked her for water and she gave me glass of water. I asked her gently why no one responding on the light from the guest and immediately she replied can't you hear the announcement from the captain for seat belts so how can we come?
I just kept quiet and back to my seat. After some times I raised the bell repeatedly and no one turned out. During their schedule only they served and the sandwich were served was not even wormed and as if directly took the fridge and served.
I have noticed during my whole flight the staff were busy on going to the duck for sleeping and not caring anything else.
During a 13 hours flight the guests might have different needs and the staff must offer the service as well I believe.
As a frequent traveler of ethihad airways and I had very good experiences previously, I believe to have the same in the future too.
Kindly look into it and as a gust this our right to have good service and response from the staff.

In referance to my e-ticket number ETKT 607 [protected] FOR NEW DELHI TO TANGIER via flight
no. EY8720/EY0613/AT0990 for 19/20 AUG 2017 however baggage checked in for casablanca only from new delhi but immigration
was not done at casablanca and i was not allowed to pick my baggage and while taking boarding pass at casablanca ground
staff told me that we have updated our system and luggage will be transfered to tangier but to my surprize no luggage was
was there in tangier and as i am seaman and joining duties on my ship LPG EPIC BORKUM no compansation was given to me at

etihad airways did not allow me to travel
hi,
I was on my way from Coimbatore to Brussels. My ticket was booked via bangalore, Abu dhabi and to Brussels. On my way to the Coimbatore airport, I tripped and fell, so my leg was swollen a bit. I even reached Bangalore and waiting to board Etihad airways (EY 237) to Abu Dhabi. In Bangalore airport, I visited airport hospital, who put crepe bandage over my feet and suggested to get an X-Ray as a precaution. While boarding the flight, staff didn't allow me to board the plane and asked me to produce fitness certificate then and there!
Since I haven't any, they didn't allow me to board the plane. They simply cancelled my tickets and sent me off.
