Unsubstantiated claims of late payments.
In Jan 2023, the payment address for monthly condo fees for my community was changed. This also now applies to the annual assessment. Prior to the change, e-checks were accepted and are traceable so there could not be any doubt of the receipt date. Since this change, the management company always claims payments are late and charge a 10% fee + interest. They have been unable to offer any proof to support that the payment was received late despite multiple requests. They expect the homeowner to just accept that checks mailed more than 7 business days are never received in a timely manner. I expect the lockbox is not cleared on a daily basis and checks recorded in a timely manner. It would not be surprising to discover payments sitting on a desk or in a drawer awaiting processing. Where are the accounting controls over the Receivables function and the timely processing of payments?

I'm here in the Heights at Carver Hills Community. I have never paid to receive the poor customer service that we receive from Heritage Property Management! I along with 10 other home owners are preparing to file official complaints! The issues are numerous and the main issue is slow or no responses to concerns and horrible communication! List of concerns:
1. Not addressing concerns in a timely manner
2. Pool closed, no updates
3. Front gate is broken
4. Water at dog park hasn't worked in months, if ever
5. Gutter has been torn from building and just laid beside the building for over 5 months
6. Pine straw is refreshed in areas where they are still trying to sell but not in areas where residents live
7. Grill doesn't work at community bldg
8. Fireplace doesn't work at community bldg
9. Back gate broken at pool area

Horrible Company with Criminal Behavior
Horrible Company with Criminal Behavior. They are not professional They consistently do not answer the phone or take calls. you ask questions about financials they never answer. Jennifer and Rhonda have to be the worse I wouldn't even say behind this company. Gavin is horrible he makes excuses for all the mistakes and makes you feel as if he doesn't understand what it means to take responsibility for something. They have sense without my knowledge or consent opened up a water bill in my name which I didn't approve at all. I am still waiting for answers about my HOA fees and money they have spend for almost a year now. They have to be up to all types of criminal behavior at this point they refuse to answer people that have consistently paid personal salaries. They consistently harass my family and I which is now affecting my health and well being and I have to now go to the doctor to take medication to keep my anxiety down, BP and more. They function off of big company standards by leveraging the home owners to twist and manipulate how they will get what they want. I want them to stop harassing my family we have paid on time and we currently have a credit on our account why would you continue to harass us going forward is my question? I cant sleep at night with this over my head.

On May 1, I received a letter in the mail regarding lawn care. The letter indicated that I must regularly cut my lawn, ensure that my grass does not exceed 6 inches, maintained so that there are no noticeable weeds, have mulch approved by NCC or MC, and that shrubbery be trimmed and maintained in a neat and attractive design. The letter stated that I had 10 days to remedy the aforementioned oversights. I contracted your corporate offices on May 1 to better understand the content of the letter and told that there were no pictures that documented any violations. I was also told that an error may have been made but that I should chemically treat weeds in my yard. I requested and it was confirmed by the representative that my Notice of Non-Compliance be removed.
Please know that I am the original homeowner of my property and am deeply disappointed in the unprofessional and insensitive actions on the part of Heritage Property and Fullers Loch Inspiration Community Association Board of Directors. It saddens me that other neighbors may have received an unwarranted threat of non-compliance in a time when the entire nation is experiencing a pandemic that has caused widespread unemployment that has hinders our countries ability to provide food and shelter to our families. Therefore, there are many families on our neighborhood that may not have the financial resources at this time to afford customary lawn care. When I questioned the representative at Heritage Property regarding their insensitive and unprofessional behavior, I was told that the letter and their threats of fines were the only remedy available and there was no consideration being made for the current pandemic. I believe that this attitude or position taken by Heritage Property and Fullers Loch Inspiration Community Association Board of Directors erodes the sense of community that I have experience in my neighborhood and is wrong.

I bought a house and applied for leasing permit on 11/6. the leasing specialist told me there's one slot available but nothing has been done I bought a house at *** st and applied for a leasing permit on 11/6. Ms Kierra ***, the leasing agent told me there's one slot available for the permit. However, at first she told me computer database needs to be updated and then, she said there's a pending item from the previous owner and it'll be awarded by the end of the week but it didn't happen and then she said it will be awarded monthly so wait until December, so I waited but no words. I called the company and asked what to do and the agent gave me a email address to send the request so I did but no answer. So I called again and Kierra then said she will give it to me by 12/15 but didn't happen. I wonder she is holding off on purpose.

The *** has given us a violation on our property for using a car cover on one of our vehicles to protect it from the elements. The vehicle in question belongs to my wife who is a registered nurse who works 3 days a week and leaves her car covered and parked in our driveway when not working. We have a right to protect our property from damage sustained from the elements and the *** bylways in no way state that a car cover is against the rules.
In March, I received an email stating the *** fees will increase and I will have pay an additional fee of $105 by May 1st. When I submit an request detailing expenses and justification for the increase. Heritage Property Management directed by to the portal and was unable to clearly justify the increase. There balance sheets are very generic and contained questionable expenses. We have made multiple attempts to request a special meeting to discuss. Heritage Property Management has been very dismissive and refuse to meet. .

I have been having an HOA issue for years one of the board members was issuing fines for her benefit that we would go to collections and her husband that worked at a collections agency could get a bonus. this is a violation and abuse of authority. the boar member is no longer in charge and finally got the fees waive and also received a letter stating that all fines and fees were waived. when I went to pay for my HOA the added some charges. according to them the fees were waived but the interest fees were not waived. I should not be charged interest fees when it was an abuse of power. I have reached out more than 3 times and also sent an email to the president. from the first emails sent I have not received any sort of response. I need these fees waived so I can pay my bill due and I am just being ignored while the interest fees keep increasing.

Heritage Property Management claims I am in violation by having a red item on my balcony per in the Declaration, Exhibit F, page 3 it outlines the guidelines for the patio/balcony in your building in our governing docs but It does not exist.Secondly they claim I am in violation of 'UNSIGHTLY OR UNKEMPT CONDITIONS for having my shopping cart in my parking space when other carts are stored in the common area.
I am a home owner and I have been trying to find a resolution to my account since last May.Whenever I call this company, I am always given the run-around. My account has been sent to collections and at this point, I am paying more in fees than I am for the actual HOA.I want to pay off the balance on my account and want fees removed. I have called to get in touch with the accounts receivable department for who knows how many times now, and there is just zero response and zero urgency.
I was notified of a violation on 3/1/22 in which I had 10 days to comply, however on 3/9/22 I was fined $300, even though the issue had been resolved, they were notified of this and had not been 10 days as of yet. They asked me to submit a fee waiver, but I feel as though this is unethical and shady business. It is close to impossible to get anyone on the phone or to return messages. I am also being harassed by the management company as a new owner, while others violations are ignored.

March 31 I again attempted to access the online portal unsuccessfully. I was told to just go to the website. I then asked on April 1 for a detailed accounting of my account and was notified that my account had been assigned to Nowark Howard. I attempted to call them on a few occasions. On April 7 I received another message from Heritage Property Management telling me to contact Nowark Howard with my inquiries. Heritage Management Company has failed to perform its fiduciary duties and responsibilities to the Westminster subdivision as described in the contract they signed when becoming our management company. They have ignored emails for months around rodent, a dangerous leak, what appears to be black mold, and a massive leak and safety hazard in the basement that has caused me to fall and injure myself. I want a regular maintenance on the over grown diseased trees and soil from the Leyland Cypress trees that are diseased and have killed my two crate myrtle trees one in my front yard and the other in my back. I want payment for my trees and shrubs that have been diseased. I want compensation for keeping up the common area that over grows my yard for the past 5 years I want a credit to my account because they refused to clean up these trees and the damage to my property is extensive. Heritage Property Management is fining me on an almost-daily basis on items that they provide no proof on nor any sort of description on what issues need resolving. I have tried to contact them and speak to someone on numerous occasions. I have had my lawyer contact them and the collections firm that represents them and they will not respond back to us. They have continued to charge me fees on a front door awning issue that took me 3 attempts to get an ARC Request approved with them; which was a requirement for me to fullfill before I could even begin working on the issue. The awning is currently being repaired and they are STILL fining me while I am in the process of repairing the structural damage. I want the unsubstantiated charges and lien on my property removed as their actions are highly illegal.

The HOA property management company, Heritage Property Management, has denied our access into the building where our condo units are located. We have bought and paid for a key fob to access the building which has not been sent to us. The key fob was paid for through the HOA manager's portal in the amount of $36.95 transaction number XXXXXXXXX. Their initial excuse as to why we were denied access to our units was that they HOA management company was transfering to a new key fob service provider but this has been going on since July . There was an issue with the key fob system technology but that was resolved in December. A demand notice was sent to Heritage Property Management over a month ago and the key fob has not been provided. This company continues to deny us access to the building.

On April I get a legal charge of $250. I did my due diligence and called heritage. Was told they were atty fees from 2020 for a water bill. I paid it. Fast forward to August and I get another legal charge of $250. No one at Heritage could tell me what the charge was for. I spent 3 weeks investigating and was given the number to the atty that charged the fee. After weeks, they informed me the property manager at Heritage requested the letter and both letters were sent to the wrong address and I never received them. The letter spoke about speeding and entering the community through the exit and short term leasing and parking. Prior to each letter I had no communication regarding any violations. I received a notification in June about parking and I corrected. I got a letter on 09/24 that they will start to fine me 25 a day because of street parking and that was corrected. My account was charged $3,000 and I can't get anyone to call me or speak to me about these fines

I live in a condo community managed by Heritage Property Mgt. In 2020, I submitted a work order to *** James, the community mgr. of our association. Major changes were made to the original plan without my knowledge that negatively impacted my property value. I later learned only 1 board member approved the work (no vote was taken) & that board member only did so b/c *** falsely claimed I approved it. She not only lied, she also violated our policy which requires a majority board vote. I later learned the contractor charged 3-4 times what they should have for the type of work done. No bids from other contractors were sought out. *** refuses to take responsibility for wrongdoing. In fact, she suggested I get involved on the board while simultaneously bad-mouthing me so the board wouldn't contact me. I finally got connected with the board, but there has been no resolution. Heritage needs to fix this. *** had no right to make unapproved modifications to my property.

This property management company adds unnecessary additional charges to the community for bare minimum services. We've also been charged to sell. We've had a history of issues with this management company since they've taken over the HOA. They did not honor our payment arrangement with the previous HOA company. They were asking for $160/month for a community with no pool, no playground, and one tiny general area with a gazebo. In addition to the $160 per month, they wanted us to pay $300+/month to bring our balance up to date. Mind you, we provided the "board" the written agreement of a $5k payoff with previous management which they rejected. We've just recently moved away from the community in large part to this criminal company and they charged us $256 for the required closing letter and added over $2k in "charges" at closing. I know that the existing members of the community are planning to sue. There is also an issue with the mail delivery being stopped and the management company had not put up a centralized mailbox to resolve. I just pray that someone really takes the time to investigate them; I am positive my issue is not the only one.

We were charged $600 for a zoom meeting in 2020 which is unheard of. This community does not have any amenities and all we are paying for is pine straw. We received a letter asking for an increase in the yearly HOA fee due to the lack of homes that did not close in 2021-22 and that is not an issue of the current homeowners, that is a builder issue. We don't have lawn care, flowers in the front of the entry, we don't have holiday decor, no clubhouse, pool nothing but pinestraw and Heritage at this point is nickel and dimming us. We demand answers, phones calls returned and a DECREASE. This is just a summary of it which the amount of characters I have provided, I have pages of complaints even petitions signed.

I sent 4 different emails, and contacted my board member before someone responded. Even then it was very difficult to communicate with them, they never acknowledged any of the information I provided. I also emailed and mailed copies of all checks front and back from my bank showing I had paid all of my monthly fees. This was also eventually waived.March 2022, I receive another notice that I did not pay my monthly HOA ***. I have attached below pictures of February and March's coupons which list the check number on them, and copies of the cancelled checks from my bank showing these have been paid. *** was paid in December, but I can provide a copy of that as well.

Our condo in *** Landing burned down at the end of November . The *** policy will rebuild the structure to its original builder specifications. Expected completion date is March/April 2023. That is roughly 15 months from original date of loss. None of the residents of the building (building 1) are allowed to return until construction is completed, and we all must rely on our homeowners insurance to find temporary housing. Because these units are condo ownership, the insurance companies will not allow us to sell the land and rebuild elsewhere (as is common in house fire claims). Heritage property management charges all of the units a monthly associate fee of $283, which is now increasing to $295/month. This fee covers water, sewage, roof, trash pickup, regular building maintenance, landscaping, and other association costs like parking enforcement, etc. Shockingly, Heritage has refused to allow a reduction in monthly *** fees to any of the affected homeowners, even though their real costs are almost certainly going down, and the insurance company will rebuild the entire building, including a new roof, exterior for many of the units, plumbing, etc. This should also decrease Heritage's ongoing costs to maintain. If I cannot live there, and cannot use the amenities, trash service, water, and other features of the community, why does my *** fee continue to be assessed at the same level? In my mind, this is taking advantage of many affected homeowners who have lost everything, are trying to find new housing, and are still stuck paying this ridiculous *** fee monthly - all the way until 2023. 15 units affected. $295/month *** 15 months displaced Total paid to heritage: ~$66,000. Total benefits enjoyed by the homeowners: none. I would like to see my *** reduced according to the services that I am no longer receiving!

Heritage Property has stated that our home must be repainted with an approved color from the color list. The color list was not initially in the portal and it took several emails to receive it. We requested that the current color that we chose to be considered and completed an ARC form after the home was painted due to our home being the 1st home under a different builder we were not aware of the required form prior to having any work completed. There had only been 1 meeting prior to Covid and the current board was selected during that time. A request to meet virtually with the remaining 2 board members was held to try and resolve the paint issue based on a financial burden and loss of immediate family members during Covid. We received a letter on 10/22 with an extension- 4/2022 however the ARC form and signed agreement need to be completed and returned by 11/1. There is another house that was painted after our house with a paint color that is not listed on the approved list and when we requested the color for the ARC consideration we have been denied access to the color that the *** president stated during the virtual meeting that is an approved color on the list. How can a house paint after our house be approved to be painted a non-approved color and our house is subject to assessment? We did retroactively complete the ARC form in 10 with the *** color and there was no reason given for the denial. I requested how the colors were selected for the community and why the community was not given an opportunity to assist in the selection, I received no response to my emails. Homes that were built prior to the last builder do not have any of the colors that are on the current sheet so anyone who wants to repaint can not even repaint their home in the original color. There have been at least 3 builders in this community.

Heritage Property Management Services, Inc. (***) has performed invoice fraud and mail fraud with association charges by knowingly and intentionally and knowingly invent $4,000 in association charges 14 years retroactively for an ownership transfer and 5 years before *** was hired to manage *** (***). *** notified me in August of new charges from May (that never existed until the year 2020), I served on the *** board from *** through 2006 and would have been prevented from serving with an outstanding financial balance per the organizations bylaws. I have the official *** financial register for lot #*** (*** Reunion Place which shows the there was never an outstanding balance on the account during that period. In 2020 and 2021, *** has had attorneys contact with a notice of the intention to foreclose. In good faith, I have reached out in numerous ways including from my attorney to engage *** on the inaccurate and misleading register records to move to a successful resolution. The *** provided account register for 2006 has 9 charges totaling $2,912 all on May 20. All communication attempts since 2020 have been ignored by ***. The records provided via the law firm in 2020 and 2021 are inconsistent and inaccurate and are fraudulent. The *** board treasurer at the time of *** taking over property management indicated that *** there was a problem with all of the homeowner financial records prior to 2011 and that *** decided to move forward without any financial history before 2011. So, *** did not have any financial records prior to takeover. The association does not have a fee for transferring your property to your now single member LLC *** has been using a legal firm *** as legal representation and has filed a Notice of Intent to Foreclose based upon these false charges.SEE COMPLAINT NARRATIVE ATTACHMENT FOR DETAILS

I had a late fee
I had a late fee. I paid late fee. I was given another late fee with no notice. No confirmation of fees paid or receipt ever sent. I was given a late fee of $5.16 from a late HOA Assoc fee ($600)that was due Jan 1st 2020. I did not receive the late fee ($5.16) notice until June. I Paid the $5.16 as soon as I got a notice of late fee invoice. Notice was sent in June, I paid in full by June 17,2020. Less than 10 days the late fee was paid in full (most company's send another late fee 30 days later) Heritage sent me another late fee July 8th yet not delivered until July 16. New fee showing I owe $25.04. they pushed another late fee on my account .04 cents. ? I called to understand why the .04 cents was even billed, this was a late fee from Jan? Why was that not factored into the first late fee for $5.16? Instead make $5.20? I was told on my follow up via phone call (rep:Brandon) on 7/16 at 9am and nothing can be done. I requested to talk with a manager and was told no. I asked how a homeowner would know they owe any outstanding balance if they do not get written confirmation receipt of the fee's paid. I was told they "expect" me to manage my account via portal online. The billing statement never shows a WWW address or anything about signing up for a portal view to manage the account. How can a homeowner be expected to manage an account online with no www or log in info provided? I have been a great homeowner since 2016 and comply with all the fees and rules per the agreement. I found other homes did not have to pay the original $700 association fee and some got credits back? This company is not easy to deal with and all this over .04 cents that has now become $25.04 is ridiculous. More disturbing is the fact that I do not know if they will try and bill me for more in the next 30 days as I DO Not Get any confirmation. This company needs to have better standards and set proper expectations with good standing homeowners.

Good Evening *** law firm represents Heritage Properties LLC. I am fighting noise violation fines that should be waived (which has been denied). Ive forward over tons of documentation providing my *** about on times and dates of noise violations fines. On March 2 there was a noise fine for ***. On that day my unit had no power. Which I provide through documentation. Still they denied.(Please see all attachments). *** will be the point of contact since shes the property manager. I am being charged attorney fees for Bog-*** fines. Heritage property has allowed these fees to stay on my account. Knowing THERES NO GUESSING WHOS RIGHT! I provided thorough proof! (Documentation). Heritage Property Has shown me they will try to stand on *** from whom they believe *** to be weak. The treatment this property management company has shown. Has allowed other owners to falsely state that I am creating construction noises outside the working time provided by HOA. If I have given proof of my *** about on the date the fine was claimed. Why not be honest a wave fines! Second attachment shows I was out to eat on January 23 2022 at the time *** provided 6:14pm the noise was made. I arrived at restaurant around 5:38pm and didnt leave until 5:30ish giving I had to go to the counter to pick food up 6:23pm. Which attachment shows date time & pick up order at the counter. Heritage property management allows Property *** client Brookwood park to break the bylaws as well. They have allowed the maintenance *** to break my valves to my shower. Demanded to pay $1750 for 3 years of unpaid HOA dues plus late fees which was never communicated to me. No prior knowledge of Heritage. my first ever knowledge or contact with Heritage Property Management (the Rainbow Homeowners Association) was in 2020 after their attorney's attempt to collect delinquent assessment fees from the previous homeowner of the property, three years after my move-in date. In response to the attorney's letter, I provided documentation indicating the Association's error and that I was the current homeowner since 2017, through a cash purchase and I had no information whatsoever regarding the HOA or Heritage Property. I only accepted the letter because I noticed that it was from the Rainbow Homeowner's Association. A few days after corresponding with your attorney, I received a "Welcome Packet", from the association and the delinquent HOA bill with late fees assessed, which was now addressed to me, to be paid immediately. Wow, what a way to welcome me! I am a very responsible person and would never have allowed these fees to pile up to this magnitude. I have never lived in a subdivision and unaware of how they are governed. My stance is that it was the Rainbow Homeowners Association, Inc.'s responsibility to provide me a timely Welcome Packet and/or any administrative documentation when I moved to Rainbow Creek Subdivision in June. It is evident they had no knowledge of a change in ownership due to the fact the demand for payment letter was addressed to the previous owner (after 3 years). It was only after receiving the previous homeowner's past due HOA bill earlier from their attorney that I was made aware that I should have received a Welcome Packet and a fee payment notice from Heritage Property Management Services, Inc. It is unreasonable for me to pay the amount of $1750 after three years of my move-in date and having never received the initial documentation about the HOA and its function, to include payment of dues, the amount of dues, president name(s) and contact information, and the Heritage Property Management Services online portal, etc.
