Keller William - Agent misguided on every step
I am in contract for house at 373 Grove Street, East Rutherford through Keller William City Views Agent named Tatiana Stepanovic (License ID #2183029). I have been misguided on terms of the contract by the agent on which it is not possile for me to move forward and hence want to end the contract. Also request Keller Williams to take action on this agent.
1. Ask price of the house was 724K on zillow. After looking at the house, I wanted to put an offer less than the ask but the agent forced me to put it at ask saying that, "we cannot put offer less than ask and if we do that it wont get accepted". She never gave me any comps about the ongoing rates in that area.
2. When inspection happened, the report said that the house is in very bad shape with electric, plumbing, structural and termite issues. Tatiana said she will get estimates from contractors for me and came back with number 60K but she refused to provide me any paper evidence for that. This was again a misguide in negotiations. Later on, another contractor which I contacted before came back with estimates of 200K for house repairs.
3. I am a first time home buyer and I conveyed upfront to her from the day 1 that I will only go for FHA loan for any house that we will put offer on. I was working with my lender(Chase Bank) for FHA loan approval. When she made an offer to the house, she misguided me and asked to sign up the offer for a Conventional loan type with 20% down. Ofcourse I cannot put 20% down as I do not have that much savings since I landed in USA an year back. She said, "If you do not put conventional then no Seller will accept your offer. You have to sign for conventional now and later when you apply for mortgage then I will ask lender to flip over to FHA. This is how it works here and I have been doing with many other clients. It is nothing abnormal and a common trick I play." Apart from the lender she also alloted me the attorney, whom she knows from long and vouched for.
3. To achieve the above, she then forced me to change lender saying that only the lender whom she knows will do the flip from Conventional to FHA. This new lender, was aware of my application being only for FHA loan. Tatiana then called for appraisal without me even notifying about it with this lender. At this point, she revealed me that my FHA loan will not get approved because the house is in bad condition. I was in shock and told her that I cannot go with Conventional as discussed since starting. She simply denied everything we discussed saying that there is misunderstanding. Though I don't have that much fund to pay 20% down and go for convetional loan, I asked Tatiana to get it sorted, but instead of solving this out, she got panicked and called Attorney/lender/seller side agent and told them that Buyer is intending to cancel the contract. Also Tatiana conveyed everyone(except me) that she is no longer willing to be my realtor. Result of which attorney asked me to pay him $500 upfront(deposit) to work further and threatened me for deposit money. When I informed about this to Tatiana, she also asked me to pay him $500.
4. Since then she never botherred to call me or informed me about she is not working on this anymore until attorney conveyed me after few days.
5. With this misguided terms of contarct, I can not move forward and want to end the contract. Also request Keller Williams to take some strict actions on the agent who forced me to put a false offer and harrassed me throughout during the process.
