This company has called me EVERYDay 10-20 a day stating I owed them money for a payday loan I did on line in 2005. I did no such thing, don't owe any money to any payday company. They informed me the charges include theft by deception, and check fraud. They stated once the charges are made they are going to put me in federal prison. They will have me fired by the end of the month if I don't pay. They also went as far as to say they will have MY CHILD taken away because I was unfit and cant my my debts. They have called me every name in the book and even said 'May god have mercy on me' Ok.

This is such a scam, I don't owe these people anything. They are calling non-stop, and will not provide me with ANYTHING in writing. Everytime they call its a new payday company I owe and and new name calling me. However I have had it out with MR. Roger Smith ( bet that's as fake as he is). someone please help, I cant have them saying that about my child. I know this is against the law, but what can I do as they have told me!

I received three calls today from Morgan Associates, threatening me and wishing me "good luck with the the bad fortune about to rain down" on me. They tried making me believe I owed a pay day loan company over $5000 or else I'm going to prison as soon as Friday! DON'T LET THESE PEOPLE INTIMIDATE YOU, IT IS A BIG SCAM. After hanging up on one of their "American" attorneys named Jeff, I immediately called the FTC [protected] and was insured that Morgan Associates is indeed a scam. Do not supply them with any information, instead threaten them by saying you know they are scam artists and you will be reporting them for fraud and harassment. Good luck everyone, hopefully the more times they are reported the sooner they will be shut down for good!

I received a call from Morgan and Associates Law Firm to explain to ask for my attorney's name. I told them I don't have one on retainer and asked what is this for? She says, OMG you don't know, OMg I can't believe this you did not get your subpoena? I tell her no and ask what this is in reference to. She gets her Sr. Paralegal on the phone, Scott Nicholson, who has very broken English, perhaps Indian or Pakistan or something similar. He says I took a payday loan out for $300 and the case was referred to them and I was due in court this Friday (today was Tuesday) and needed to prepare to defend myself on criminal charges. However, he can stop the case from going through and place a hold on it (he called it a OCC or some type of form he would fill out for me) but that I had to fax him a letter stating my full name and he told me exactly what to write. He even said he needed my state ID and SSN, when I asked why he needed my whole SSN on the letter he corrected himself and said just the last 4 digits. When I asked about the state ID he said it was needed for the legal documentation that had to file with the court.

I knew I had takena payday loan out before once and knew it had been paid back within that week, but I started second guessing myself. So I asked who it was I took it with. They said EZ Cash Advance for $300. I asked the date, he got angry and said he don't have all that information he has not even gotten my full files yet. I asked for the number to EZ Cash Advance so I can call them and verify what happened. He gave me [protected]. I called them and got a same type of broken english with the same accent person named Mike Anderson. He asks for my last 4 of my ssn, he has everything on me; address, DOB etc. I ask him on what date I took the loan and he dodges the question and says they tried to contact me twice via my email account. I tell them I know it has been deducted and he says it is now a legal matter and I referred to Morgan Law Firm and Associates and hangs up on me.

So I call the law firm back and ask for Scott Nicholson, he comes to the phone and says hello this is Mike Anderson (who I just talked to at the EZ Cash Advance). So I ask what is his name Mike or Scott? BHe quickly says this is Scott Nicholson. I tell him I find it curious that I just called EZ Cash Advance and spoke to a Mike Anderson and when I call back to the Law firm I get another Mike Anderson and when asked he changed his name to Scott. He says it does not surprise him becasue two of their Sr. Attorneys are named Mike Anderson and thats why he said Mike Anderson. (It is possible they are not partner attorneys but most of these small attorney offices list themselves all as partners especially if they are senior attorneys, but not always.) So he gives me exactly he wants the letter written to be faxed to him in order to stop my case from going to the courts (which again, if I was supposed to have received a subpoena it would be too late already). So at this point I am freaked out and believing them although I still had doubts, but remember, they had everything on me that I don't give out to people so it all seems legit. After faxing this letter tonight, I was to go to Wal-Mart to purchase a pre-paid debit card and then call them back with the card information. So as I am writing this letter I look them up online and find this site, thank god! Now they are blowing up my personla and work phone non-stop trying to get me to fax this information.

Got a call from "Kenny Rogers" stating that I or my attorney needed to contact him immediately. Didn't say what he was calling about or where he was calling from. And to top it off he even called my work and harassed one of my co-workers after they told him not to call my work anymore. Then when I try to call the number back to give them a piece of my mind it tells me that all lines are busy and I get a busy signal. Very frustrating.

I also received numerous of call form Mark Rymes [protected] stating he needs to talk to my attorney i was baffled because i don't even have an attorney so he said OMG you don't know so i said dont know what? he said that i will be sued for 6000 or i can pay 600.00 now to settle the debt, I told him i don't have no 600.00 and the loan that i did take out was on a payment plan but like everyone else he had all my information. So he said if i can't pay i will be fired with 2 -3 days and police will be at my door tommorrow to pick me up on charges...So im glad i read all the comments that are so similar to mine

I am glad that I was smart like the rest of you and knew that something was rotten in Denmark. Those very same clowns called me with the same song and dance. Thanks to some investigation via google and a quick call to the FTC the are now alerted to yet another SCAM being conducted by Morgan & Associates. Folks please make others aware that they can report it. Be sure they get as much information as possible like names, phone numbers, fax numbers, western union account information, etc. String them along since they were kind enough to pull the SCAM, and provide as much info as you possibly can to the FTC.

Received a call from Mark Ryan this morning demanding call back from me or my attorney. Called back and spoke with Stan Lee;payday loan advance never paid back $200; asked him how and where to send money to; said they filed lawsuit against my SSN; asked why I never repaid loan; asked again how and where to send money; also asked for his State Bar Number which he refused saying that it was protected private information; asked for company address same response; I laughed he didn't said I would be served with legal papers tomorrow and dragged off to prison - then he hung up on me. So I called him back and he said I was harrassing him and told me not to ever call the number again! Question: Who or what agency do I report this to?

11-12-10 message from Mark Ryan Called back spoke to Stan Lee same scam; I tried to obtain info from him but he hung up on me; so I called back told me I was harrassing him and to never call this number again! Reporting to FTC, BBB and CA AG. Thanks to all who post their info

Hello - My name is Dave. On 13 November 2010, at 8:57am, I got a phone call from this telephone number on my cell phone [protected]. I was unable to answer the phone at that time. I got a voicemail several seconds later. *Broken English Male**India* or other foreign accent. The voice-mail said and I quote "This message is intended for, my name, with the last four of 1234. Of course he used my real last four. David the very second your receive this message I need you or your attorney to call the issue at hand is very time sensitive. My name is Kenny Rogers, my contact information is [protected]. Do not discard this message, David if you discard this message and I do not hear from you or your attorney today, then the only this I can do for you is wish you good luck as the situation unfolds on you.

At 9:15am I returned the call. The first time I got a voice mail saying the person at extension 987 was unable to take my call please leave a message. At 9:20am I tried again. This time I got through to a Leo Fernandez, I told him that I just received a call from this number and I was returning the call as it was urgent. He went through some papers and told me to please wait just one moment. After finding my records he said is this David using my last name with the SSN# [protected]? I said yes. What can I help you with? The man named Leo said that he was from Morgan and Associates in San Antonio, TX. I said hello, what can I help you with? He asked me if I lived at an address that I lived at over 10 years ago. I said no, I do not live there and haven’t for 10 years. He tried to get off the phone with me. I said listen here, you said this was urgent; you have my SSN so you got me on the phone what the hell do you want? He said that charges were filed against me in the state of Indiana for fraud and theft. He started reading me this statement which I could not interrupt, which sounded like he was reading me a subpoena, Count one fraud, Count two theft, blah blah blah. When he finished he said do I have any questions. I said yes. Who is the company that is suing me? He said he could not give me that information. How much do I owe this said person? He could not give me that information. After about 5 min on the phone, he told me that US Cash Advance gave me a loan to my bank, knew my bank and the address, by direct deposit and I have failed to make payments. The company was not willing to settle the debt and they will be taking me to court in Indiana. What is the name of your attorney? I verified the information and asked if he was a lawyer. He said yes, for Morgan and Associates. I said that I never heard of US Cash Advance and that I would not use a company for a payday loan. He said that he will have to notify my place of business USAF... NOTE: Everyone in the world sees USAF and the first thing they think of is United States Air Force... but he didn't know that he just said he would have to notify my place of business at USAF what I have done and the legal matters that were against me. I asked him how we can work something out.. He said if I pay the amount that I owe off today, which was $1, 499.00 then this would all go away, but he would have to speak with the company first to see if they would accept my offer without court. He said the court cost would be in the amount of $4, 000.00. I said I can't pay that amount today and he said that he was sorry and that he will proceed with the court. I said that was fine with me. He would not send me anything in the mail or anything.
While I was on the phone with my bank to freeze my accounts, my wife got a phone call from Kenny Rogers. A completely different number than mine, so this told me this guy had my wife’s cell phone number and my number. He was asking for me. The same phone numbers everything, except the law firm was Jesse and Jesse. He asked me the same stuff I asked him who he was.. He told me Kenny Rogers.. I told him Kenny Rogers is a singer not a lawyer. He got really mad and said I know that and it is none of my business what his parents named him and he starting speaking to someone in another language and hung up the phone. I called back. The person answered and said can I help you? I hung up... I contacted my bank, credit bureaus, local, and county authorities. What worries me is that our cell phones are only 3 months old and on Verizon network. Did Verizon have a leak of information? Who are these men calling and what is he going to do with my information? I will also contact Morgan and Associates. I traced the number to an invalid number, and looked up Morgan and Associates on Google.. I didn’t even find the Firms webpage until page 5 all these complaints and scams about this people’s stories. BECARFUL! Leo Fernandez or Kenny Rogers could call you next.

I too have received calls from this so-called law firm. I made a complaint with the FTC. this is a SCAM. I never took out any pay day loan with US CASH ADVANCE. I spoke to a Leo Fernandez ( who had the thickest indian accent) .
I will be filing a complaint with the Florida AG's office as well.

POLICE

I am a Detective in New Jersey and am trying to look into this for a victim in our town who received calls from [protected] and [protected]. Both were an Indian male from Morgan and Associates saying our victim has a lawsuit against them for a cash advance payday loan they never payed off. Of course this is not true. I called today and the man who answered just asked "Can I help you?" I told him I got a nessage I was being sued and had to call this number. He told me he cannot help me. I told him if I'm being sued I need to speak to someone. He told me to call back in 30 minutes and speak to Jack Marshall and that he couldn't help because he is an operator only. The only other thing he would say is that they are in California.

I called back two minutes later and asked for Jack Marshall and he said he'll be back in 15 minutes. Called back in 15 minutes and was told by a man who couldn't think of his own name that Jack would be back from break in 15 minutes. Eventually I spoke to "Attorney Jack Marshall" who could not find my information, since I made it up, and told me I wouldn't be bothered again then hung up on me.

Anyway, there's nothing, really, that a local PD ca do for you, it needs to be brought up to higher level where jurisdictional lines don't matter. I'm gonna be looking into which federal agency to contact and will keep this site posted.

i got a call from this place today about oweing so called payday loan money...the guy got mad because i was yelling and cursing him out cos i knew it was all b.s further more CALIFORNIA? seriously how is that possible to sue me there when i live in pa?

I was actually searching for something else and saw this thread - after reading the entire 3 pages its alarmingly clear that someone who works at the site(s) where you have deposited info possibly knows this group. A lot of outsourcing going on with a lot of programming gigs being done at 1/2 the cost. One of the reasons is to gain access to servers like this. But, it appears, IMHO, whomever you signed up with has some noob on the inside releasing your info. I would call the companies you left info with and speak with their IT manager, their IT Security manager, then their counsel and finally ask them who their insurance company is that will represent them at trial.

Read the online website privacy and terms statement again. This isn't the movies and hacking doesn't necessarily happen this easy with companies who have tight control. The argument here is that while although showing a secure "symbol" of security - this online company is possibly guilty of providing a "false sense of security" - let alone carelessness with your information.

Subpoenaed records will show a data download by a logged user with a datestamp.

I got the same type of phone call from this same company - Morgan and Associates Law Firm. The message was like others on this site. The wording on my voice mail was the same as Dave's from November 13th. "Do not discard this message, (my name) if you discard this message and I do not hear from you or your attorney today, then the only this I can do for you is wish you good luck as the situation unfolds on you." The message sounded like it was from Harry Smith but like the others here he had a thick Indian accent. I tried calling back several times because of course this scared me. The first three times I called I got voicemail but could not leave a message because voice mail was full. I finally got through and spoke with a Jack Marshall, also with a thick Indian accent. Since I have taken out payday loans I asked which company and he said United States Cash Advance. I told him I did not have one with that company and I am current on the one I have. He says I have to pay $489. Jack said United States Cash Advance is the parent company and he doesn't know which particular company under them that my loan was through. I asked him for a loan number and he gave me one. I checked my payday loan account and one I have had previously and this is not the number to either account. This guy had me so scared I could not even sleep. He emailed me a "promissary note" document that he wants me to fax back first thing in the morning. This does not have the name of the law firm or anything on it. He did not send me any documentation about my so-called payday loan. The document wants a copy of my id, and my bank information so they can deduct the money from my account. I am not going to send it. He says they will file a lawsuit for fraud and violating bank check fraud laws. I am so scared and am glad I googled this company and found all this information. Thank you everyone for posting messages here. I am still scared but it helps to know this is happening to other people, too. I will report this to the FCC also. I didn't know who to report it to but now I do. I do not have the money to pay this. If I had extra moneylike that I would not have had to take out a payday loan in the first place. I know now that I was stupid to do this. I wonder what would have happened if I never returned the call?

With a student loan killing my credit I decided to try id byrider. Over the 3 days between the time I made the appointment until the day of my appointment the lady called 17 times to confirm. I was told to call if I was going to be late. I got caught in traffic and called to say I may be late. Well I was right on time. I was totally ignored for the first 45 minutes I was there. I only saw 2 half way ok cars on the lot. The grand prix. And the grand am. Also they tried to push the impala

I got a call today from [protected], so blocked my number and called the number back and of course everyone that works there has a thick accent and they just continue to pass the phone back and forth between each other because they dont know what to do. I asked them for an address and the address that I was given was 1320 Michelle St, Fort Worth, TX 32101, I tried pulling up information but I couldn't find anything and to my surprise ( lol ) I wasn't able to pull anything up for that so called company. I have had these calls before and they have told me it is about a payday loan I do not owe anything and when you ask them for information they will not give it to you. I actually called a payday company and they said that these companies are scams and what they do is they are out of the country and are able to get US phone numbers to make it look like they are actually a liget company. They are trying to get these people shut down but they just keep popping up

I just recieved a phone call today. the called my cell phone 4 times. twice while I was on the phone with them from the same number I called back to contact them as they left a voicemail on my phone. they also called my job. The asked my co-worker to leave a message for me. reffered to himself as Officer Harris and said it was urgent and to call him back at [protected]. When I called them back after I recieved the voicemail, the man with a very heavy Indian accent said his name was Denzil Anderson and that he worked for White and Case and that he was calling to inform me of a suit being failed against me for fraud by a company called Casnet. he gave me a case number of CFI-150781, which i see some of you have been given the same case number in a completely different state months ago. He said that they were going to use me as an example. All this for an alleged payday loan that I recieved in July of this year and never paied back and they alleged that I have been ignoring communications from them. they said they have only been sending emails. nothing in writing. What legitimate business only corresponds with a client by email when there is money involved. well non the less, I never agreed to or recieved any loan which my back statements will confirm. The has to be some crazy scam. They say to settle out of court I will have to pay $554. This is just crazy. Filed a complaint with the State of Florida so hopefully this will not continue. I hope I got a jump on this early since this is the first day they have been calling me. Hope this helps someone else.

For at least the last four years, possibly longer, a group has been calling former payday loan applicants advising them that they have defrauded a bank and are now being sued for non-payment of a loan. The callers will claim to be calling on behalf of an attorney's office (name varies), the Dept. of Law and Investigation, ACS, or other similar combinations below:

United Legal Processing Division
Midline Marketing
Crime Monitoring Services
Monetary Crime Division
U.S. National Bank
Attorney General’s Office (usually in California)
American Legal Services
Affidavit Consolidation Services (ACS)

You will be threatened with arrest, a costly trial and possibly worse. In no shape, way or form can you be arrested for non-payment on a consumer debt. Do not believe these threats, as they are without merit and cannot be carried out in the manner they allege.

Who are they?

In the past when pressed by law enforcement for an address, the callers have provided the following information:

The collector's MO matches a once legit collections agency called Ellis Crosby & Associates. Here are some links on them:

They have been previously fined over $1.3 million for various violations. They have been known to use phone banks in India to make their calls, which more or less coincides with the difficult to understand accent many of us detect when we are contacted.

The last time this group went by any "official" name was back in 2008:

On July 15th, 2010 a Public Awareness Bulletin was sent out by Missouri Information Analysis Center.

"..received reports from individuals in Ohio and Illinois reference suspicious telephone calls they received. In both instances, the callers are reporting that a voicemail is received from a man, with a Middle Eastern accent, identifying himself as an officer working with the Financial Crimes Unit. The message indicates that the reason for the call concerns a loan made by the receiver or someone in the receiver's family. The voicemail requests that a return call be made and a telephone number is provided. When a return call is made, the caller is asked to provide personal identifying information such as their date of birth and social security number.

Reports indicate that the calls are frequent and persistent and that they even threaten arrest or legal action if information or money is not provided. It appears that the individuals making these calls may have access to some records connecting individuals and their relatives. Missouri does not have a Financial Crimes Unit and all indications are that this is a fictitious agency. If you receive a similar phone call, please be advised that it is a scam and please contact your local law enforcement agency or the Missouri Information Analysis Center at [protected]."

Bottom line:

Do not supply the callers with any additional information. Inform them you have reported them to law enforcement and hang up. If you haven't already, go ahead and report the calls to local law enforcement, your state's Attorney General and beyond. Look up the local Secret Service branch's information in your area and get in contact with an agent there.

If you ever applied for a cash advance online, your information is out there.
Possible sources for the breach of your privacy are:

* The scammers obtained your information from Teletrack - a reporting agency used by many cash advance lenders to determine their risk lending to you. The service is able to tell cash advance lenders if you have existing loans with other companies, for example. Many state laws prohibit borrowers from having more than two cash advances out at the same time.

* The scammers created their own fake payday loan application site. People looking for a cash advance went to the site and applied, thus freely providing the scammers with their information for malicious use at a later time.

* The scammers were able to get into the database(s) of cash advance lenders - probable targets being Sonic Payday and Cashnet USA.

How to protect yourself:

* Inform your employer. You are likely getting calls at home and/or at work, so make sure your employer is aware the calls are part of a scam and to not take them seriously. Advise the callers that they are no longer allowed to call you at work. If they continue to call, document the date and time of the calls you received. Save voice mails left if at all possible.

* Change your number(s). For some this may not be an option, for others a one-time number change can be done free of charge.

Be advised - any references you listed on your payday loan application will be contacted. Let those people know that this is a scam, and they can disregard.

* Use Google Voice. Google Voice is a great replacement voice mail system for just about any phone number you use. Messages can be transcribed and voice mail recordings can be saved as mp3 files.

Pro Tip - call the scammers with a Google Voice number before turning off your old phone numbers. Make sure when you call you identify yourself so they can start up their script. At any point after they have your information pulled up just hang up. They will then start religiously calling your Google Voice number. At this point, you are free to change your regular phone number(s) and enjoy not having these people ever call you again. (And laugh at the fact these people are basically talking to a brick wall several times a day)

The scammers change their numbers frequently. Law enforcement used to think it was because the callers ran out of minutes on their prepaid wireless accounts or they were shuttered due to fraud, but now they understand it's simply to evade detection by savvy consumers online. With the proliferation of VoIP, it's even easier for the crooks to stay a couple of steps ahead of law enforcement. Below is just a sampling of the 30+ numbers that have been used in recent memory.

So can they really do anything to you?

It's not a simple yes or no answer. Logic dictates that, if they really wanted to take you for a ride and drain your bank accounts, they already would have.

So, why haven't they?

Authorization.

Why do you think you are being called so much? Perhaps it is because they like the sound of your voice? No, they have to have your authorization to take any form of payment from you, period. The callers know their audience, and that audience is typically a bunch of people that have applied for payday loans in the past. Most of those people they call couldn't afford an attorney if they wanted one, and are so used to receiving collections calls that so long as they sound like a real collector, they will likely be perceived as one.

Furthermore, they don't even really want to talk to your attorney - that just sounds official and scary enough. A real attorney would take the callers to task and write them off as two-bit con artists. The callers need you, in writing, to authorize payment against the fictitious debt they claim you owe. Go ahead, ask them for proof you owe the debt - more commonly known as verification of debt. See what they say. A phone authorization carries very little weight, so if they have something signed by you on file, you are done for - and the callers know that. That authorization is the only thing these callers are doing by the book, and for good reason. If they just went all willy nilly and made an ACH debit from your checking account, without your written approval, you could in turn report the transaction as fraudulent to your financial institution. In about 7-10 business days, you would get the funds returned to your account. Then the scammers would be up against a bank and their team of lawyers and investigators.

Bottom line:

If you haven't paid the callers a dime, don't. If you planned on paying them to shut them up, just don't. Remember - you are not being contacted by a legally licensed, ethically owned and operated collector. i just got a call from them stating that first i owed money from a loan i never got and to pay now. then i got a message saying that he was an officer and that i was being charged with bank fraud and internet fraud and that a federal warant was being issued for my arrest what a bunch of [censor]! they called with this number [protected].

I received a call from these people as well about a week ago and just like eveyone else on here they said the same thing. So i called them back and they of course said there was legal actions aginst me. Of course i didn't believed it so i ased what was the SSN they had and to my surprised it was right, but i told them it was wrong. So they said they would "investgate". Then i go on to tell them they are acammers and they laughed at me and then hung up on me. So about a week later they called me again saying they were investageing my SSN and when they said it, it was the wrong one. Agian i told them i did research and found that they are scammers. So they asked how i know, and i told them the intenet. Well then they hung up on me. So i give a bit of time and all the numbers they used i decided to call back. the one that is [protected] i got a voice mail of some other lady that was actually american and i'm sure it was a ligit number but they had nothing to do with it. Then i called [protected] and someone answered that was Indian and i acted like i was a lawyer and said i was representing my well my self, of course using a fake name. And to no surprise they said they didnt know what i was talking about and that they sold some osrt of lotion cream to help improve my skin and actually offered to sell me some..LMAO, then i called [protected] and again someone answered and didn't know what i was talking about. I guess people don't realize that most everyone has more common sence then they do..LMAO!

Same has happened to me. One person called from Morgan Associates and another from American Legal. Different phone numbers both with an Indian accent and was difficult to understand everything he said. I found it amusing when he read me my Miranda rights over the phone.

Same Here. No need to tell you what you all already know. Of course this is a scam. I did verify this is indeed a scam by speaking to an FTC representative. It would not surprise me if some of these so called "payday loan companies' that anyone of us may have applied to on-line, turn out to be the culprits themselves. Those of you who have applied on-line have experienced the same thing. You fill out an application, and within a very few minutes, your E-MAIL is bogged down by HUNDREDS of these compnaies, who, as it tunrs out, are NOT lenders, but "brokers" who BROADCAST all of your personal information to multitudes of companies, who themselves, NEVER turn out to be lenders, but again "BROKERS' who, if you 'complete' your application again, as it appears you are instructed to do in order to COMPLETE the process; in order to FINALLY get your loan, are doing nothing but recycling your application to another list of "Brokers" and so it goes. Occasionally there are actual "lenders', who operate OFFSHORE lending operations, who are therefore EXEMPT from US LENDING LAWS. (see my note at the end of this writing please)

FIRST: (and this is going to take some time ) UNSUBCRIBE to everyone of these e-mails that you get; DO NOT COMPLETE ANOTHER FORM! You will see or should have seen the disclosure on each, and everyone of these applications that you receive in your E-MAIL, that begins with "We Are Not a Lender ect... this disclosure is USUALLY not found UNTIL you reach the SECOND page of your applcation, but sometimes this diclosure is on the FIRST page, at the bottom, and in TINY PRINT. LOOK for this DISCLOSURE. If you see it DO NOT COMPLETE this applcation. YOU WILL BE OPEING yourself UP to SCAMMERS and FRAUD ATTEMPTS if you complete it. (Please see my note at the end of this writing)

These people are, in FACT, NOT LENDERS but are gatherers of information that MOST will turn around and SELL, to such SCAM organizations as those who we have all gotten phone calls from.
Of course the scammers pay these brokers for this information, because they have KNOWN PEOPLE, especially Senior Citizens, or those foks who have STRUGGLED for a long time and are timid because of their credit history, WHO WILL PAY UP. Our own TELEVISION NEWS CHANNELS have reported such scams as having been SUCCESSFUL, thus these scammers keep it up, as they have been told that people fall for these scams.

SECOND- Do report ANY information, no matter how trivial you beleive it to be, to the Federal Trade Commission (FTC). DO NOT report it to your LOCAL Police Department, UNLESS you have been THREATENED with PHYSICAL HARM, or that your checking or savings account HAS BEEN illegally, or fraudulently tapped (stolen from).

THIRD- DO access your checking and Savings accounts everyday to see if there are TRANSACTIONS YOU DO NOT RECOGNIZE. IF you see ANY TRANSACTIONS, NO MATTER HOW SMALL (these crooks have been known to run transactions through a persons account, ( a paper draft, similar to a check, however it is a similar item that is processed by your utility company, mortgage company, and other creditors that you may be paying by ON-LINE transaction, or you have established an ACH DEBIT (automatic debit, paid each month, by your authorization, on a specific day each month to a creditor) in order to avoid being lte or even being troubled to remeber to pay it on time each month. I personally ran into BIG PROBLEMS by allowing certain creditors to be paid by ACH (automatic) payment each month and so I WILL NEVER SET UP AN ACCOUNT to be PAID THIS WAY AGAIN. My Mortgage company (another story) paid themselves more than once a month, abusing their privilege so I ENDED it for everyone.
ANYWAY, thee CROOKS WILL run similar looking documents through you bank or credit union, but in small increments such as 16.21 or 29.32, however they will do this on successive days hopng that it does NOT RAISE a RED FLAG.
If you see transactions like these and you DO NOT RECOGNIZE the transaction and NO ONE in yor family, who is an authorized signer on your account has NOT made a purchase in these amounts, IMMEDIATELY, SAME DAY, CONTACT your FINANCIAL INSTITUTION and REPORT these TRANSACTIONS as FRAUDULENT. This process will be time consuming, but necessary. For example, my Credit Union requires hat we complete a STATEMENT of CHECKING ACCOUNT FRAUD, call the police and file a report of Checking Account Fraud with the police, once we have the report from the police, we MUST include the CASE Number on the Statement of checking acount fraud, AND we MUST have our SiGNATURES NOTORIZED, then if you bank or credit union is NOT LOCAL (ours is not) we must FAX the SIGNED, NOTORIZED, form to our CREDIT UNION< that same day, unless it is a weekend or Holiday, then we MUST make a copy for ourselves and MAIL the original to our CREDIT UNION.

What our CREDIT UNION WILL DO. 1. They will RETURN the draft (check looking thing) UNPAID (not debited or subtracted from your account balance). You will be advised that the draft (check) has been returned to who ever was trying to pay themselves from your account. They will also advise you that if the party who was NOT PAID from your checking account DISPUTES that the DEBIT (check) was NOT a FRAUDULENT transaction, then that party MUST SHOW PROOF that the DEBIT or check thay attempted to have paid from your checking account is LEGITIMATE. IF THEY DO SNED SOMETHING SHOWING your Bank or Credit Union that it WAS LEGITIMATE, YOUR Bank or Credit Union will HONOR that transaction and PAY the party. I PROMISE YOU that IF INDEED it was a FRAUDULENT TRANSACTION, these CROOKS WILL NEVER DISPUTE your claim of fraud.

Once you have filed this with your BANK, also file this with the FTC (FEDERAL TRADE COMMISSION (ON-line at ftc.gov) with the FBI(ON LINE at fbi.gov) the FBI websit may refer you to your LOCAL FBI WEB SITE to file a dispute as well.

THEN, File a report with the SECRET SERVICE at secretservice.gov. The Secret Service handles Credit Card and any Financal fraud or Theft.

NEXT, your Financial Institution will advise you to close that account and open a new one with them. A lon as the crooks have your OLD ACCOUNT information, ANY transaction they attempt to process through your OLD account WILL be returned as UNPAID, Account CLOSED.

This is where you may have more work to do, for example, IF your paycheck or Social Security Check is Direct Deposited and you HAVE NOT advised your employer or Social Security or ANY other DIRECT DEPOSIT Situation, that you have OPENED a NEW ACCOUNT, these DIECT DEPOSITS will be REFUSED and SENT BACK t the Sender (payor). Make CERTAIN you contact all DIRECT DEPOSIT SITUATIONS and GIVE THEM YOU NEW ACCOUNT INFORMATION. Do NOT PANIC if for some reason your Direct Deposit was returned. Yes, it will delay your money getting to you on time, however if you Contact the Social Security Office IMMEDIATELY after not having received your funds, they wil do ONE of TWO things at YOUR REQUEST. They will have to wait unitl they receive the payment back from your Financial Institution, (about two to three days later) and then 1. They will MAIL you a REPLACEMENT CHECK or 2) they will re-deposit your check to your NEW ACCOUNT. Option Number TWO TAKES 10-15 DAYS.
NOT: to EXPEDITE your process with the Social Security Office, CONTACT your CONGRESSMAN in your DISTRICT, tell him what has happened and your funds will get to you even faster. AMAZING !
Be certain to contact anyone, ( ie.life isurance premiums, the electric or gas company, mortgage company, ANYONE AND EVERYONE that you have set up Automatic payments with (exept for payday loan companies) OR ANYONE and EVERYONE that you may have SCHEDULED a ONE TIME PAYMENT TO and GET YOUR INFORMATION CHANGED ! PRONTO !. If for some reason your payment may have already processed to your OLD Account, call the PAYEE and tell them what happened. Be prepared to pay them Immediately with your NEW ACCOUNT Information, and ask then to reverse ANY RETURN CHECK FEE, Under the circumsatnces and IF you are polite and courteous during your call, they will forgive any penalties or retunr check fees. Even Credit Card companies become kind in this instance, however be prepared (and NICE), should they ask for PROOF (fax then a copy of the CHECKING ACCOUNT notorized Statement of Fraud tht you had to file to your Financial Institution. BE NICE BE CALM and everyhing will work out IN YOUR FAVOR.

One more thing, (well two more including my important note that follows_ Even if the Scammers or Crooks have NOT attempted theft from your checking account, yuo MAY WANT to OPEN A NEW CHECKING ACCOUNT ANYWAY, because you KNOW they already have your information, especially if YOU APPLIED for a PAYDAY LOAN ON-LINE. Do explain to your financail institution why you feel it is important to close and re-open a new account, this will avoid any RED FLAGS that could be posted to a new account.

YES, this is a GREAT DEAL to have to DEAL WITH. NEVER, NEVER, NEVER complete a LOAN APPLICATION of ANY KIND ON-LINE. (UNLESS you KNOW the COMPANY, such as your BANK ) that you are doing business with and ON THEIR SECURED WEB SITE.

NOW HERE IS the important NOTE I ant to share with you.

IF YOU are in a position of needing a short term loan (a/k/a/ PayDay Loan). There are LEGITIMATE COMPANIES with FREE STANDING OFFICES (an ACTUAL BUSINESS LOCATION), that are LICENSED by your STATE and who MUST FOLLOW US LENDING LAWS as well as YOUR STATES LAWS. Face it today MOST of US are LIVING PAYCHECK to PAYCHECK and occasionally we ned a helping hand. It is NOT comfortable for some of us to turn to our families at times like these, we tunr to what ever source we think may help us. PLEASE DON'T tunr tothe internet for help in these situations, even if some of the LICENSED payday loan compaine have registered sites. GO to THEM, conduct our business in person. Yes, I know it who be embarassing to many of us if someone we know sees us doing business at a payday loan company. However, I know that these companies MUST follow laws of confidenciality, AND THEY DO. GO TO AN OFFICE ONE TOWN away. Trust me these legitmate companies UNDERSTAND and willwork with you. These people called me a few months ago and I had my husband listen to the conversation. We told them we knew it was a scam and we were reporting them. They called me again today and I argued with the guy, told him he was a scam and I gave him my attorney's contact information. He said he had proof it was legit and affadavits, etc. I told him to send me the information and he told me he couldn't do that. i to got quiet a few calls two days ago, very thick accents, i called back because they said i had done criminal activity, and was going to get federal charges aginst me.. told them i would wester union the payment and was informed to make it to a diana ngyuen in houston tx, asked why not to the company and was informed in law suits a court appt clerk accepts the money and transfers to companies owed.sounds way fishy, i work where we do western unions., looked up their phone and it is a cell out of north carolina, called back and asked for address asked why told them so i could mail a payment instead gave me 5463 kingkad ave pittsburgh pa 15422, googled it doesnt exist, when i asked who to make it out to they said they already gave me the info. asked to send me my original debt info they said they couldnt becasue it was in the law suit and my attrny should know that, told them makes no sense and im sure they wouldnt mind if we checked with the better bussines bureau and hung up, called them back after reading these post and asked for thomas cook, the guy answereing said hold for attrny cook, i could hear in background him telling someone who i was looking for, david cook got on and i said may i speak with thomas cook, who thomas cook yes mam this is thomas cook. told him who i was and why they want me to western union to tx, calling from north carolina, address in pa doesnt exist, i live in utah and i have contacted the bbb, the atty general etc, and not to call back. funny they called 10 times in 1hr the first day and i have not had a call back since..so glad i did not pay, i have used payday loans in past and thought maybe i owed somehow, they sure di d scare me, i was stressing how to get the money, i really thought they could charge me with fraud and id be in jail. the phone number they used is [protected]..they said they were officers and attorneys with morgan and associates

I got a call from Shawn Woods. Same basic thing as the rest of you. I was threatened with criminal charges for a loan I never took out. They said they had proof of an electronic transfer but could not mail me any information. I was able to get Shawn Woods to give me his California Bar License # and when I looked it up with the California registry it belongs to a different attorney in California. Are they breaking some sort of law by giving false information?

Well, just another post added to the MANY compliants about " Morgan & Assoc ". I received a phone call today from some HEAVY Indian speaking numbnuts. The # is [protected] . I was left a message and told that I have a outstanding payday loan and because I have not contacted the loan company with 21 days of them calling me, I was being sued. The first thing I did, was look up the so called company. I called them back and decided to play along for a little while. I let them give me a "docket #" and yada yada. They then transfered me over to the "payment department" ( HAND OVER PHONE: MUMBLE MUMBLE MUMBLE ) this is the payment department, can I help you? LMAO! I then asked for them to send me paperwork about this matter and that's when I was told that they can not do that and I nust settle this matter NOW! I then informed them that I was looking at the FRAUD reports as we speak and I was told: I DO NOT LIKE YOU DOUBTING ME AND TOMORROW YOU WILL BE VERY SORRY! and that's when they hung up. They called right back and left no message. I then called them back and said I was MARK GOLDSTEIN from Goldstein and assoc and I was retained by "insert my name here" and I needed a mailing address, so I could send them legal documnets for a lawsuit against them for fraud and harrasment. LMAO AGAIN! I was told:I can not give you that info cause I will be fired. I "Mr Goldstein, lol " was then asked for my mailing info so I could be sued by them ;-) then they hung up. They called my husband at work and on his cell phone. They thretened him using the same tactics all the other posters have commented on. The guy told him he had 400 lawyers; that would come after him. My husband said he had 1000 lawyers and hung up. I called the number - it was answered by someone who could barely speak english and said he would transfer me to their law offices.
TheLaw Offices answered the phone with - again in broken english. I identified myself and asked for thelaw firm; name and address as I needed to send them a request for documentation on this loan. He gave me the name Morgan & Assoc, but would not give the address. The firs time I asked, he said my address? I responded that I needed the address of the law firm. He just kept saying dont (actually no you dunt). I told him if he was an atttorney, he evidently didnt know that laws very well because there the Fair Credit Reporting Act has rules creditors must abide by. I then told him that I was going to report him to the Attorney General and asked if this was a good number for them to contact him at. He hung up on me and we have not been bothered since.

I did report it, but all the Attorney General did was put it in their files.

Kenny Rogers called? These people are silly. They ask for your last 4 of your social security # because the 1st 5 are provided by sites such as "Accurint." I really cannot believe these people are in business. The whole bunch of them need to be prosecuted. And the question is, where did they get the information to call to begin with? I believe a payday loan employee gave it to them. But I have no proof.

Just received a phone call and voicemail from "Morgan & Associates Law Firm". The guys name is "Roger Smith". He read my social security number in whole to me, and my address and bank account, I denied any of the information. I told him he must have the wrong person. I am now calling to place fraud alerts on my social security number with Experian, Trans Union and Equifax. These people pray on weak people, they try to scare you by yelling at you, and intimidate you into paying them money that you don't owe. If you get a phone call from a person who is speaking in an indian or arabic accent and is denying information to you and yelling at you, please know it is a major scam! Don't buy into it, but do take appropriate measures to protect your identity.

I checked my daughters cell phone (12 year old) which I do about once a month and heard all these threatening voice mails from "Morgan & Associates. I had taken out a payday loan a few years back but I knew it was paid. I called the number back [protected]) a heavy far eastern accent guy named get this..Stan Wilson answered and gave me the 3rd degree. As I was talking to him my wife was pulling the company up on the computer and that instant I let him have it! I call them back daily and repay the harassment to "Stan Wilson" I call and say hey can I speak to my man Stan they know the voice and instantly hang up. I then called and said hey my name is Jacque Mehoff (sound it out) and stated I have a message that I owe a debt..I said I am trying to buy a house and dont want any trouble. This dummy says yes I have a subpeona right here for you Mr. Mehoff...at that instant I unleashed they caught the voice and hung up after calling me a few black M.F.'s. I dont encourage anyone to do the same but it felt good to me..also I call from numerous lines using *67...I give 'em the blues...

i am tired of them calling me at home and at work. i called the ftc. i have changed my bank account and aslo my home phone number. i have paid them the 150 dollars by prepaid visa( before i knew it is a scam). now they are wanting 189.00 . i am behind in my payday loan but they are claimingg to be one i am behind in and also threatening me with action in court. how are we going to stop them by other people. i didn't know of this and i am sure it is not wery well known. somehow we need to get the word out -possibly by a news station or newspaper.

if you are contacted by a maorgan and associates do not tell them anything contact www.ic3.gov . to file a internet compalint and you local police department. need to somehow spread the word about this scam so no one else is called or threatened

this is the biggest scam ive known. i have called the police and repported them. the harrssment i have faced and ive even lost work time and money, dont compare with the embarressmentive have face with being called every name even cursing at me. saying im worthless piece of... so please dont let first states attorneys office or the so call morgan & associates law firm extort money from u its a crime!

I received threatening calls from them saying that they were going to sue me. They kept calling my work number and demanding to speak to my supervisor. I was given the fake name of Neal Watson. After I wouldn't give them to my supervisor, they told me that there would be an investigation on me and they would get back to me. They called from the number [protected].These people must be stopped

i have read all the postings and it happened to me 2 days ago -i have a loan with a company which i paid in full every time i use them - i did filled out the online loan app (basically they find a company that will give u the loan) where i included all my personal information (ssn, name, dob, employer info and bank account). so this male with and accent (middle eastern) left me a v/m at work, he wanted me to call him back right away with my attorneys information because they were filing charges againts me. i called them back and a female with the same middle accents answer the phone, it was hard to understand her, but she said tha i defaultd on a pay day loan, the loan was for $300 and now its about $1000 plus. i told her that i have not done such a thing and that all my pay loans are paid off. well i guess that did not help the matter, she transfered to another male who said that they were going to send the sheriff to my door and arrest me, that i would not have a job and they will ruin my credit if i did not take care of this. i was on the phone with them for an hour fighting my case, they even call my friend who i listed on the app as a reference!. at the end i told them they were fraud and h/u. i notified my employer of them in case they call. now they call my cell every day but i dont answer. and yes they said they were from Morgan Law firm calling from [protected] (euless, tx). im glad im not the only with this problem that needs to stop.
