We signed up for the timeshare agreement with Starpoint Resorts on 7/31/23. On that day we were given a fabulous presentation of timeshare ownership and were offered 2 free trips if we signed a contract. We were led to believe we would be able to use this timeshare anytime, anyplace under our membership.

Issue #1: When we signed up for this program in July of 2022, we were not informed that our 33,000 points would expire on 12/31/22. In fact, we were charged an additional $200 in order to use the points immediately. There was no way we would have signed a contract if our points would expire the same year, especially since we were not planning to travel anymore for the year. With that said, I spoke to Charles in new member services in August 2022 and he said our 33,000 points would be honored. We paid our maintenance fees for the 2022 year, and the points were never applied to our account.

Issue #2: On 7/31/22 when we signed up with the program, we were promised 2 free trips. 1)First trip option: Round trip Airfare for two adults and a 3-night stay in either Honolulu, Los Cabos, or Puerto Vallarta 2) Second trip option: The 2nd option was to Pick a vacation 3/4/or 7-night Cruise or 2 RT Airline tickets or a 7-night stay in 15 destinations or 4 Night Mexico Resort Stay or Airfare and a 2-night stay

3) We mailed our certificates within the timeframes required, and the most upsetting responses we received 1) I am told that the reason we have not received the free trips is that our maintenance fees for 2023 were past due. These terms and conditions were not communicated to us when the salesperson was trying to persuade us to purchase the timeshare.

Keynote: Up until April 2023 our account was up to date with monthly fees. Based on the free trip certificates, we were required to mail in the certificates between October 2022 and January 2023. Nowhere in the terms and conditions of the free trips state that we are required to have our yearly maintenance fees paid to receive these trips. It clearly states on the New Member Certificate provided to us, "This is fulfilled by a third-party vendor and NOT ASSOCIATED with your purchase or membership." So, if this is not associated with our membership, how can we be told our maintenance fees have to be paid to receive something that Starpoint Resorts was obligated to provide for us? How can that be if they are not associated with our contract? Receiving the 2 trips was one of the reasons we decided to purchase the timeshare.

All these stipulations were not exposed during the timeshare presentation. Even more troubling, in January 2023, we mailed our required forms (within the timeframe required) to receive our free trip vouchers per the rules we received. The envelope we mailed was returned to us and stamped "Attempted Not known. (Please view attached copies). At this point, we were devastated. We immediately felt that we were being taken advantage of by Star Point Resorts. How could this company require a certificate and taxes/fees to be mailed to an address that is not valid? We never received any communication stating this trip was no longer valid or that the vendor no longer existed. That means the trips we were promised were never valid, we were provided misleading and false information and tricked into believing we would receive 2 free trips. We signed up for the timeshare on 7/31/22 which we put money down to purchase, we started paying monthly fees in August 2022 and paid the maintenance fees for 2022 even though we had just signed up and it was only 5 months left in the year and now we are not getting what was promised to us?

a. Every time I speak with customer service, I become very upset and feel that we are being taken advantage of and lied to get a sale. No customer service agent would ever address our concerns about not receiving the points and trips that we were promised. Every phone discussion has been nothing short of stressful, degrading, and disappointing and has always left me with the feeling of being taken advantage of because Starpoint Resorts would continuously pressure me to pay the yearly maintenance fee and had no desire to even inquire about why we never received our free trips.

We have paid into this program for a year now and we have not received our 33,000 points from 2022 and we have not received any correspondence informing us about not receiving the free trips. So, based on our contract we are not eligible to get our next set of points until 2025? We are supposed to continue to pay for a timeshare that we can’t use for 3 years and must pay yearly maintenance fees.

At this point, we want to sever ties with Starpoint Resorts. Unlawful deceptive sales tactics, misrepresentation, and omission of facts, exaggerations of the timeshare use. We will eat the loss of what we have paid thus far, however, we cannot afford to continue to pay for a timeshare in which we never received what we were promised. We want out of this contract effective immediately.

Desired outcome: Cancel Contract and release of remaining timeshare fees.
