I have been approached by this company and am unsure as well. They said they will find the discrepancies in my loan (for 1% of original loan amount) and give to their law people who will then assign a lawyer at $1000 per month (for about 9 months). I have researched the lawyers, the Founders and everything I can. All seems OK...but they are a newbie company. Basically not enough data to determine. The Rep I talked to was knowledgeable and explained well and answered my questions. I would go for it for sure except for...I am afraid of the process where I am not supposed to talk to the lender once the TRO (temporary restraining order) is filed, which means I'm not supposed to be sending the lender money, correspondence, nothing. That is the only part of this whole thing I am holding back on because at this time, I have never been late in my payments. Problem is, everything is going to change and soon--so I have to do something. Also, 9 months (10 if you include the audit the first month) is a long time to wait to see if you are a winner...almost like having a baby! I was told things would get worse before they got better--but they cannot guarantee that we will win. So what to do...what to do.

Thank you everyone! I have been holding off becoming a customer of these guys and am glad I listened to my gut. They were too positive I would win my case, they kept lowering the cost of the audit and raising the cost of the legal services. George Pulvino keeps trying, but the next time he calls, I am just going to tell him we went with someone else (and I did... me!). I've figured out how to make it all work without losing my home or even being late on one payment. By the time trouble comes-a-knocking, when all is said and done, I will be paying less for my house than if I went with US Loan Auditors/My Legal Service.

My thoughts and prayers go out to all of you who did get scammed, I hope Karma bites them ALL on the behind!

I must tell you that the employee's of this firm know exactly what is going on. They all know about the complaint board and know why there has been security doors added on extensively around the office. Do you know the turnover of the fraud investigators? Huge. Most of the ones who figure this out don't want any part of it. They are always hiring new fraud investigators. Why would this be if the pay so well? Why would this be if this was such a great thing? You would think people would be knocking down their doors to work for them, but this is not the case. NO CASES HAVE SETTLED. DO NOT PUT YOUR MONEY INTO THIS.

To those who might be interested, after doing some research, I found a company called equityflips.com that Shane Barker and Jeff Pulvino are listed as Principals on. This company makes HUGE profits off the resale of forclosures. It will be interesting to know how many homes they have sold and made profits on that were clients of USLA. For those of you that have lost your home you should looked into who bought and sold it!
I will be doing some more research on this issue and will post as soon as I look at the public records for the foresclosures.
If they are indeed selling forclosed homes from clients of USLA this is a serious problem and I think alot of people will want to know!

Bob, I sure wish I could be there to assist you on Monday. Stay strong and don't let them win! They are heartless, money hungry, leeches and they do hate public attention or should I say negative public attention. I wish we could all work together to get a class action lawsuit against them.

I'm in a similar situation with my mortgage. I'm current on the payments, but am a bit apprehensive about committing to the audit fee (in my case, $4k) & monthly fee ($1, 250). I have to admit that I've learned quite a bit about my loan (albiet after-the-fact) and the predatory practices I fell victim to and am amazed at just how helpless people, including me, can be in these situations. The rep I've spoken with seems very competent with regard to the alleged violations contained in the loan documents and does a good job of explaining it in terms understandable for someone not in their industry. My overall impression thus far with USLA is positive. The rep is attentive, returns phone calls, e-mails in a timely fashion, etc.

I've gone the modification route in the past, which essentially put a temporary "band aid" on the situation, which will come off when my ARM resets. I worked with USLA a couple of months ago until I sort of got "cold feet" with the fees. Had a couple of attorneys say [it] was a "scam" (not USLA, specifically), which I've been unable to confirm. I've since looked into another modification (not with USLA), but that seems to be a waste of time so far and I've actually cancelled that. Either way, my loan is a ticking time bomb and I need to do something.

I've had attorneys tell me to quit making payments and file BK, in which case, I lose my home. Continuing as I am, I can make payments for two more years, when it adjusts and --I lose my home. In all my endless hours of scouring the internet, USLA seems to be the most viable option I've come across.

My main problem is that there seems to be no way to quantify and/or confirm the percentage of success that USLA has had in previous cases. While I have no reason to doubt their claims, I'd certainly like to actually read a case decision (or a few). I'm told that this isn't possible, as all of these cases are settled before they go to trial, with subsequent non-disclosure agreements signed by the plaintiffs; thus making these documents inaccessible to those of us who want verifiable documentation that this has a greater degree of success versus failure before committing to the process...Am I making sense?

I also wanted information about the attorney(s) who routinely represent clients through USLA in my geographic area. Here, I was told that was not possible because USLA would lose clients who might then simply go directly to the attorneys. I can understand that to a certain extent, as, with any business model, USLA does need to turn a profit for the service they provide...but I'd certainly like to view the track record of someone who will be representing me on something so terribly important. I really don't like the idea of signing a contract with the jockey before I get a chance to see the horse.

Does anyone besides me understand why some might be apprehensive or even begin to believe that there was some potential for, or actual malfeasance here? Again, I reiterate that I have no basis in fact that there is; conversely, I have no basis in fact that there is not...I'm trying to do my research as best I can, but I keep hitting this barrier when I get down to the "meat & potatoes" issues I'm concerned with.

I'm still "on the fence" with this whole scenario. I realize that there are no "guarantees"--except one. If I commit to the audit fee and monthly fee, I won't be able to stay current on my mortgage and, if, for some reason my case is not sucessfully settled, I "guarantee" I will lose my home sooner than I otherwise would have.

Someone help me out here...

I sympathize with your situation,

I've been researching this company, and those associated with it, and thus far I have concluded they would not be someone I would do business with. But I'm not losing my home.
Personally I do not see an advantage to spending any more money on another service. If the loan is modifiable, I don't understand why you'd need an expensive company in the middle of your attempt to do that. If they hire a lawyer, why not just skip the middleman and hire one yourself? There's plenty of lawyers out there who would similarly accept a retainer, and they are beholden to some scrutiny by an official agency. It appears these loan auditors don't need that. With USLA as you mention, there's no official records, so it's based on faith. I don't particularly care for all the secrecy. And a non-disclosure agreement pretty much won't let you say anything to anybody if things go awry. As noted in two of the case files in court, two of their independent agents/employees were not even allowed to use the labor commissioners office to resolve a complaint. I don't think I'd ever sign my rights away like that based on faith.
Another thing to consider is that the people they hire to work your case appear from the court documents to be promised almost half of the money you give them up front, so it doesn't look like the majority is going to your defense, but rather sales commissions.

Thanks for the information. I've talked to the FBI tel # [protected] to place a report because this is a crime. I have talked to reporters from KGO, KNTV, San Jose Mecury News to Sacramento KOVR & KCRA, which had the con artist himself on Shane Barker. I've met with him and James Donald Sandison - State Bar of California #148812 who basically told me to pound salt. WELL SO MUCH FOR THEIR MONEY BACK GUARANTEE! I was stiffed out of $10, 880.00 and they think that I will just go away...never! I will be in line with Bank of America in the lawsuit they have against Bank of America (Bank of America Corporation v. U.S. Loan Auditors, LLC et al case #2:2010cv01329). I never thought I would be rooting for a bank again. Thanks for all the info!

Well "LA4n6" here are some things to look into.

First, You say that you cant find any cases where they have one or lost... Check Justia.com
Or find an attorney with a pacer account to look up names of clients...
As far as where to find clients, chech there Testimonials..there great... then look up there last name and case... you will see that almost all have been dismissed.

Now... Lets look into Why would you get a "forensic Audit" ?

Well you need to find out if you have any violations... then check the statute of limitations on that cause of action...Respa, Tila, hoepa... and state causes...Like fraud, Breach of feduciary duty...Negligence ...so forth
Most are 3 years...Then find out which can be tolled...please research these terms

Here is the important part of this... You need to make sure that your Loan auditor who is telling you that you have "violations" knows what the hell he is talking about... and 2... if he does advise you to persue Legal action..."which is the only reason you should get an audit" He better be an attorney... or he could get in a lot of trouble.

Ok now to break down these fees !

so lets start with the audit fee... 1% of the loan amount... average loan was(06, 07, 08) about 400, 000 so that 4, 000$ per audit..wow...
But what is this audit..."since i have one in hand" i will break it down...
First they take basic info on what they find... mix in loan paperwork...and the you run a compliance Ease Test...add some old case law that has nothing to do with your actual case...BAM.. AUDIT
but what is Compliance Ease YOU ASK?

That is a software program that you can use for around 30$ per audit...NICE...look it up.

now lets say that it costs them 1000$ to run the audit... that leaves 3, ooo$ made per file to be split in house 60/40... 40% going to that nice auditor...5 of those deals a month and your making GRREAT MONEY!

Now on to the "LEGAL" fees, Well First thing you should know is that "My US LEGAL" is actually a case management company! so they get you to pay 1, 250$ per month to do WHAT? Manage your case silly!

The way that works is they pay attorneys in your county 250$ per file to put there names on your case...
times that by 50 cases...give it to a sub-par attorney (sharon D. Lapin) and you have...enough money per month to risk your Bar licence...

and that my friends is the dance... Thats why you will never meet an attorney up front... and have to wait for one to call you...because there are no attorneys reviewing that case until it gets to the one that you have to sign up with... what a relief...

I am not saying there bad... Butnow you know the truth

Great advice, Auditjoker.

Here's so more word of advice for LA4n6. Keep this in mind, all because your audit comes back with "violations" does not mean you have a case. Just like Auditjoker, said if the Forensic Investigator tells you, you have a lawsuit, they are in BIG TROUBLE. No one has the authority to tell you, you have a lawsuit except an attorney...period. You have to have a LAW License to give legal advice consumers. If the person that advised you to file a lawsuit doesn't have a license, I would report them to the BAR asap.

Tell USLA & MY US LEGAL the next time you meet with them, you would like to record your conversation/meeting with them, just so you understand everything clearly. If they don't agree to the recording, then RUN FAST.

Anyone that's doing honest work, will not have a problem being recorded.

As far as any of the lawsuits, that's easy access. You will have to do a lot of homework. Hopefully you don't have a day job because it's going to require you go down to Superior Court Records, Federal Court records, etc. pull the files and read.

Search my screen name and you will see we did a lot of research work on the testimonies on the videos, etc.

No lawsuit was ever filed. There is no case number. His case never went to court. USLA did a loan modification. They claim they don't but as you read and listen to the testimony, they claim the lender modified his loan.

So instead of making you pay the legal fees...tell them to call your lender and negotiate a modification because that's what their doing. Furthermore, they cannot legally charge any upfront fees whatsoever for assisting you with a loan modification...until your loan modification is APPROVED. (Notice how they getaway with charging legal fees...even though they are doing a loan modification).

Corrrection.

The man name Marcos Vides DOES own a home but the loan was modified no case was filed. He was not in default. He apparently needed his payments lowered...that's all...Loan Modification.

something to keep in mind if your looking in to this company for the first time...IF YOU HAVE A NOTICE OF TRUSTEE SALES DATE...

you will need a TRO, to stop that sales date, unless you can get it pushed back on your own...

An attorney has to file a a complaint, then the TRO.

At that point that still does not mean you get the sales date posponed... it still has to be granted...

So if you have a sales date in he next month... and you Pay for an audit...Which can take 2 weeks or more..
then you have to wait for them to find you an attorney...

Your better of just going directly to an attorney. Just keep that in mind.

As far as these cases in court and a time line goes...

Things to think about and research... If you do file a complaint. and your house is underwater "up side down in equity" And your behind in payment... then ask your auditor about the judge possibly requesting your ability to "show tender" HUGE

That is the number one reason that these preditory lending cases get dismissed...

Great comment Auditjoker.

Also, keep in mind when you get a TS Notice of Trustee Sale you can call the lender to apply for the HAMP Program, Making Home Affordable program. This can postpone the sale, IF you are eligible for the program.

You MUST read the requirements and see if you qualify first, because if you don't then the Sale will go through.

Talk with a BK attorney, Bankruptcy attorney, they can advise you of your options.

In my experience of talking with several BK attorneys, a Chapter 13 can postpone the sale for a few weeks. If your not approved for HAMP, then you may get approved for an in-house loan modification with your lender.

Chapter 13 will save your home if the Trustee approves it. However, you have to be able to prove you can afford your current mortgage and Trustee payments and any other secured debt.

Yes you are correct in marco vides' case no suit was filed. Once the bank(BofA) became aware of the violations in his case they wanted to do anything in it's power for that case not to go to court. Since when do banks magically knock almost half a million dollars of the principle balance of a loan? Its called leverage. Did Us Loan Auditors try to convince the bank to give a loan modification? No. Marcos Vides notified his bank of the forensic loan audit and BAM they offered him a savings around half a million Dollars through principle reduction, interest forgiveness, and lower interest rate. Would you turn that down to try and fight in court? I would not. These results are not typical however it would not of happened without the services provided by USLA. Just some food for thought.

Some info for all concerned, US Loan Auditors has filed suit against gambling bob for protesting.

This can be accessed through the web. I have read the documents and find that there are MANY alligations that USLA is claiming and that are in FACT not true. If this goes to court I hope that they understand that they will be commiting purgery, and that is a federal offense.

Well to respond to your comment... yes they do have 50-100 cases against BofA... but The cases are being represented by various attorneys.

But BofA has top dogs working on this case... and since i believe your company hired Pillsbury Winthrop, Shaw, Pittman LLP... on of the biggest and most know law firms in the us. i think its a bit more serious than your playing it off. about 800-1000$ per hour...
I could be wrong on who you retained... but who knows.

As for questions... i will need about an hour... i am going to lunch..Seriously!

And as far as my name goes... anonymity suits me well at this point... not that i would not want to grab a beer with you but... what can ya do!

I will upload the Federal case(s) on PublicDocumentDistributors.com today. There are also two small claims cases I hope to retrieve and upload this week.

In addition, James Sandison and his wife have been the subject of several collections lawsuits over the past 3 years. Mostly they are credit, credit card and other loans that were not serviced, and then the companies sued.
This brings up a subject that should be considered when starting lawsuits. You could win a big or small settlement, but get nothing. Even a company that takes in millions per week or month could be a house of cards financially. They still have expenses daily, weekly, monthly, and operating at a deficit that keeps growing. Sometimes it is circumstances such as those that incubate bad business practices. The principles just don't want to stop the cash flow, because regardless of the debt service, they often still get thier own salaries, benefits, company cars, or just a place to go each day. Not to say that is the case with USLA. but that should be a consideration for anyone whom has already lost a home, and is planning on getting some equitable relief via our judicial system

What do you do for USLA? Auditor, case review?

Just so i can see what areas you would be most versed in, just to keep it fair.

I like that you have decided to defend your company. It mean a lot to those are looking into your company and read this only to see one side of the coin.

Superior court records cannot be accessed on-line. You would have to go down to court records and pull them.

We knew about the lawsuit against Bob. I check records often.

I see your point... but lets do the math... lets say 2000 files...

times that by 1500$ per month...AVG. thats 3, 000, 000 per month just on fees.

Ok now add in that they probably get around 100 cases per month... times 3500$ = 350, 000$ per month in audit fees...

so per year there at about 40, ooo, ooo... now you have to add the increase of 100 clients service payments of 1500$ per month... avg out and there you have it.

If they have even more clients then you get the picture.

Doing great in a recession... NICE

SHANE BARKER and JEFF PULVINO (Equity Flips & Cash-Out Options, 2 companies) have their hands in a lot of things. They obviously know what laws and rules pertain to the Real Estate industry or at least should know, so it seems. I find it hard to believe that they dont think that there is any wrong-doing with the operation and business tactics of USLA! Again, the dam is breaking and it is only a matter of time.

NOW I SUSPECT YET, ANOTHER ROUSE. MY SALES REP ASKED ME IF WE WANTED TO SHORT SELL ANY OF OUR PROPERTIES, ASKED ABOUT THE EQUITY IN EACH OF THEM AND OTHER QUESTIONS PERTAINING TO THE PROPERTIES AND THEIR VALUE. HE STATED THAT THEY ALSO HAD ANOTHER DEPT THAT COULD SHORT SELL FOR US AND OR GIVE US SOME EQUITY OUT OF THE PROPERTY IF WE JUST WANTED TO GET RID OF THEM!

DOESN'T THIS ALL START COMING TOGETHER OR AT LEAST CREATE A VERY STRONG SUSPICION THAT USLA MIGHT ALSO BE UP TO SOMETHING ELSE THAT COMMINGLES WITH THE ENTIRE OPERATION?

Perhaps, convincing a client to short sell or receive some equity and turn the property over to one of barkers or Pulvinos "Other" companies? As Barkers website states, they have agents out there, all over the place, looking for properties in these situations? This is my opinion, but it sure does raise some questions.
