September 18, 2020, over 9 months of not getting any help of refund of my shipment from UPS Las Vegas to Barbara Woods Learning Academy, Gramercy, Louisiana, that was damaged and loss, according to UPS.
I filed a demand letter to the Claim's Adjuster, assigned to this claim and their registered agent. Unfortunately, I was made aware that I needed to be suing UPS instead of the Crawford & Company, Claims Department. You will receive a copy of the demand letter that was sent to the Claims instead of UPS and other documents.
I am sending this demand letter in hopes of reaching UPS Complaint Department:
DEMAND LETTER
This is a Demand Letter to United Postal Service, mishandling and losing a new 55" Sony Bravia flatscreen television and the H96 Box that was inside the same shipment box. The Demand Letter is for the reimbursement of the items I shipped that never made it to its destination.
January 14, 2020, I went to UPS located on740 N. MLK, Las Vegas, Nevada 89106 to ship a new-55"-Bravia Sony Flatscreen Television, X-96 and remote to Barbara Woods Learning Academy, 1571 E 2nd St, Gramercy, LA 70052. I paid $247.23 for your shipping services. The tracking number was 12870X800376857215. The expected delivery date for the delivery of the flatscreen and X-96 was January 28, 2020. See attachment 1.
After calling several times to check on the tracking number, with UPS, I was told to call back, they were having problems locating my box. On or about February 15, 2020, I called inquiring to where my merchandise was, again, and I was told that my merchandise was enroute to its destination and to call back.
February26, 2020, I received a letter from Crawford & Company informing me they would be handling my claim. See Letter Attachment 2.
After not hearing anything, I called March 15, 2020 and was told the merchandise was damage. "That the items "inside" the box was broken and discarded in Oklahoma."
I contacted UPS and was told nothing should have been damaged or broken, it was packed correctly. To cover themselves, when I called again inquiring on being reimbursed, I was told by Derick Cross claims, that "my merchandise was in the wrong box. and for me to Fax over information on my loss. See Attachment 3
On top of the runaround, Mr. Cross asked for the serial number. My wife was given the wrong fax number.
It is the middle of September 2020. The delivery was for January 28, 2020. How do you explain, losing or throwing away a so-called damage box that was under the responsibility of UPS? No one has tried to resolve this problem, come up with my merchandise or give a care.
At this point, we deserve a full refund for the items we purchased for Barbara Woods Learning Academy that never made it. You have 10 days in which to pay $3058 which include, insurance, shipping, preparation fee, warranty and the amount of the brand new 55" Sony Bravia and X-96 Box or we will be forced to file a civil complaint in Justice Township Court.
