Monopoly of abuse of power and unprofessional behavior

Narcissistic frauds! Bullies and thieves… not a waste of time only because I was persistent in proving 35 unfinished substandard abandoned work on exterior paint project…

A farce! Dishonesty and fraud are crimes breaches in contractand omitted facts and evidence is this investigators game! Mjmc

Desired outcome: GET RID OF FRAUDS IN THE SYSTEM FIRE LIARS FINE VIOLATORS.

RE: Beck’s Floor Installations, LLC – ROC #320853

On Friday, August 5, Dave Beck came out and took measurements and wrote up the contract to replace my carpet.

On Friday, August 12, I had new carpeting laid in my great room. I did not see the carpet color before it was laid and was surprised the color was not what I had chosen from the swatches. I ordered something close to what I was replacing and had gotten on my hands and knees with an overhead light to match as close as possible. I called and left a message on their answering machine stating the problem.

Monday, August 15, 2022, Dave called and made arrangements to come out and look at the problem. About 3:30 Dave Beck came by the house and agreed the carpet was not the right color and took pictures of the swatch board that included the left and right sides of the board with carpet. He said he would be in contact after he had a chance to check with the office, to find out where the error occurred.

On Tuesday, August 16, 2022, Dave Beck called mid-morning and said I ordered the lighter color, that was what I said I wanted. I told him I did not want a lighter color. He said he would come by and show me. He arrived about 3:30 and said it was the color I said I wanted. I pointed out that I had gotten on my hands and knees to try to match the color as close as possible to the color I was replacing. What happened was he wrote down the name and number of the swatch above the color I wanted. I told him he had made a mistake his eye had looked at the row above. He told me he had been in the business for 40 years and had not made a mistake. He left leaving me with something that needs to be resolved.

I did sign the work order with the erroneous information, but I trusted the salesman had written the correct information.

I have pets and would not order 3 shades above white. This was a big expense and would expect the company to stand behind their mistake.

I hope you can help resolve this situation.

Arizona Registrar of Contractors (AZROC) Interior pool remodel

I hired Aquashine Pools to replace existing Tile in the pool and on the barbecue. They recommended I have a leak test due to it was easier why the pool was drained. They also recommended that I replaced the interior service of the pool due to the age of it and I can no longer have an acid washed because you’re limited on how many times you can acid wash a pool. I agreed to the new tile and pebble Tec. As agreed with the leak tech and they found two leaks. One in the spa and one at the water filler. They first came and demoed the pool and I was quite surprised of the chunks that were really deep in the pool and tile. Also I saw water leaking out of the shot Crete when they were done with the demo. The person who came and did the tile took forever and did a horrible job. See pics. They also had the plumber come out afterwards to fix the water filler and the leak in the spot. Temple Tech crew came covered up the whole to the water filler. They also came the next day to do the [censored] wash it in the dark with one person in the pouring rain. There was severe stains all throughout the pebble Tec the following day. A crew then came out to look at the hole they covered with water Filler decided to drill a hole halfway because they realize they were drilling in the wrong position. Meanwhile Aquashine never even knew this until I notified them about them coming up the water filler and drilling a hole in the wrong place. When they were done with the town the barbecue they had broke my gas line to the barbecue. They constantly pushed me off on the schedule and if a crew did show up for the tile and wood job in the middle of the day and only work for a couple hours. And the final day to finish the tile on the barbecue he rushed to get it done so he can get on another job site. The barbecue was completely uneven and wavy. See attached pics. They had to send another guy out to redo the tile on the barbecue and I had to once again remind them that they broke my gas line at the barbecue. I had to wait 30 days for the pebble tech take care and they never did a start up on my pool so my pool turned green. I had to drain the pool again for them to come back and acid wash my pool for a second time and for them to patch the hole. They had a plumber come back out to replace the water filler again and he created a new hole through my brand new pebble Tec. The patch is extremely obvious. I had a notify customer that my large diving pool was leaking 4 inches of water a day. And that my pebble Tec was constantly being exposed in the pool and the Jacuzzi. They found that there was a leak in the drain for my sheer descents they patched it up and said they would have to put cement in there as soon as they drain the pool to read patch and acid wash my brand new pebble Tec for a second time. Now my pool is sitting there with water with no pop-ups in it and the Jacuzzi keeps draining to under the waterline. Which kept exposing my brand new pebble Tec. They came to do the start up and they threw tons of salt in my pool and never turned my Salt salon so therefore my pool started turning green again. I notify the customer that the tile had severe cracks and grout all over the place and approve please check all tile and repair and cleaned all the cracks holes and grout that was all over the place. They came three different times and each time they did not do it properly. On the final visit they came to check the tile again and we reminded them that the air raider still do not have a cap on it. They turned on the aerator which should’ve been done at the original start up and now the air raider is leaking underneath all my coping and spraying out all along the side of the pool from under the deck. I have been going through trying to get tire replacement and pebble deck done since beginning of June. I am very concerned that my tile will start popping off and I still have a Jacuzzi that leaks water. An aerator that leaks water. Tile that is extremely shotty work. Also when the kid came and did the tile around the barbecue he was extremely sloppy and got mortar all over my brand new pavers which will now have to be replaced due to the stains will not come out. The owner was sent a video of the water spraying all around the aerator and I am yet to even hear from him. He does not communicate and when he states that they will be here it gets pushed back or they start later in the day to rush to get on another job. I have many more photos and videos along with mini text between Brandon and Nate. I’m having issues uploading all my videos and photos.

Desired outcome: Have other companies finish repair, everything I hired them to repair has been done in correctly and had to be repaired again and still not repaired correctly. The most recent leak at the aerator nobody has even try to reach out to me

First off the ROC is nearly funded entirely from license fees paid for by the contractors. So no the consumers do not pay for the ROC or govt to protect them. The main goal of the ROC is not to protect the citizens it is to insure contractors are paying their taxes and paying their employees taxes and unemployment insurance. i.e. no under the table employees. By funding through the licensed companies, it is a built in enforcement through the licensed contractors themselves. They feel since they paid then everyone has to pay or its an unfair system. If you cannot tell the customer is not much of a focus at all for the ROC. The ROC is mostly for the contractors and the govt with the consumer falling in last place in order of importance. We have a court system built for the consumer that is to hold accountable those who do not do what they are contracted to do. Unfortunately this leaves some of the work of finding qualified contractors up to the consumer who wishes most of all to find the cheapest price no matter what the qualifications may be for a given job. The saying you get what you pay for is exactly the reality in contracting work. Do not ever expect the govt to protect you the consumer because the govt works to protect its on interests just as every other corporation in America does. Those who work in govt are consumers just like you and they need to make sure they are funded so they get a paycheck and keep the lights on so concerning themselves with others problems comes last.

Repeatedly, I hear our AZ ROC inspectors protect unlawful, unethical substandard work by contractors, and not the home owner/consumer victims. ROC is a Government Agency we pay to protect us from fraud, to determine qualified and responsible licensed contractors and weed out those that don’t qualify.

Home owners almost always try to rectify issues and allow contractors several opportunities to attempt to correct their mistakes before filing a formal complaint with AZ ROC. No home owner takes the process lightly to spend all the time, money, effort to prove and provide documented proof, necessary to complete the ROC Complaint Form. Even attorneys warn victims it’s a serious problem within the government system, making it difficult for victims to rightfully be heard and protected. Attorneys, through their own experiences trying to support victims, often lose when the system is in favor of the contractor and ignore the solid proof provided by victims.

With solid proof through consistent documentation, keeping logs, pictures, voice recordings, it’s still not enough “Valid Justification” for a victim to prove their complaints are vindicated. Even when the victim has expert witnesses, attorneys, insurance companies, professional ethical contractors, have inspected the damages for themselves. If the home owner follows the advise given to them by some or all, to refuse or at least delay, an unqualified contractor to continue work, the ROC abuses ARS11-1154, and claims that the home owner’s complaints are null and void with “no valid justification”.

Due to extensive damage done by a contractor, Insurance Adjusters can deny future damage coverage, if the home owner, as demanded by ROC, allows the unqualified contractor to continue the substandard work. Insurance companies don’t want to unnecessarily pay for more, almost certain, future damages. ARS 32-1132 states work standards and ethical contractor work guidelines contractors must adhere to in order to be licensed. Yet, ROC claims ARS 32-1154, the home owner must allow the contractor a second chance to victimize home owners even more through this demand. This is a Catch 22 to say the least. S Yet, ROC claims ARS 32-1154, the home owner must allow the contractor a second chance to victimize home owners even more. This also puts the victim in jeopardy of losing their Insurance Coverage because 11-1154 conflicts with qualified coverage claims.

It seems ROC is also committing fraud by ignoring the legal standards set for ROC Inspectors’/Investigators’ responsibilities to protect consumers, not dismiss the ARS Codes indoctrinated by the State of Arizona.

Yes, ROC Investigators/Inspectors are allowed to take gifts. There are good Investigators/Inspectors, but not all. Is this why they, more often than not, side with contractors instead of home owners with valid, legitimate filed complaints? Are they being bribed by contractors in order to keep their license to continue to fraud more consumers out of money, not to mention dealing with damages done by contractors to their home? I don’t know.

So who do we turn to when the ROC won’t fairly protect consumers as they’re held to by law to protect? There are many of us home owners victimized and don’t know who can actually help us in these situations. It’d be helpful to have a nonpartisan website, phone number, contact available without ramifications telling our truths.

Arizona Registrar of Contractors (AZROC) Work not completed as agreed too

I hired WOW Remodeling company from a friends recommendation, Carlos and his wife came and gave me a bid to install pavers in a 9x12 area. I already had the pavers so they just needed to be installed. His bid was really high, but he said he needed to pour mortar because he was afraid the pavers would sink in the mud. I agreed and he said they would do the work the next day. His workers showed up the next day and did the work, but they did not lay mortar down, just sand. I asked Carlos why he didn't lay mortar and he lied and said he did. That is when I told him I had his workers on video. He tried to lie and say we never agreed to having mortar layed down, but again I told him I have him and his wife saying mortar needed to be layed down because the pavers would sink in the mud. With all the information on video he finally admitted the work was not down right and he was going to return part of the money ($300). Since them he will not return my calls and I have not heard from him. Please beware of this contractor, he is a liar and a crook. I hope he loses his license.

Arizona Registrar of Contractors (AZROC) Bathroom remodeling

On june 9, 2021 bath makeover/ axiom sent sean there sales person to give me an estimate on completely gutting my current shower and instaleing a new shower with a rain drop shower head an nickle plated fixtures and installing new tile in shower and double plated shower glass all around along with new counter tops with double sinks and nickle plated fixtures to match the shower, bath makeover took out a loan with greensky under the name on anderson for 12600.00 and took 6500 out of it immediately. I was promised by sean the sales guy it would be completed in 8 to 10 weeks, I informed him I needed it done by christmas... As of today 02/04/2022 nothing has been done... I have tried contacting them over and over again, spoke with 2 managers jenna and dave lopez, still nothin... I asked them to cancel since they breached the contract they said they will keep 33 percent of loan. I am currently paying interest on loan

Arizona Registrar of Contractors (AZROC) Roofer

I have gone to the BBB to file a complaint against this contractor but was very unhappy with their last email, as it said the complaint had been settled, so they closed the file on me! I got absolutely no help from them, and yet I have two recipes saying the work was guaranteed, and I still am having the same problem I had to begin with!
On the back patio of my home, there is a connection between the roof itself, and the roof of the patio. It seems along the connection, there is nothing there to keep the water from flowing down below and my patio getting flooded each time we have a heavy rain! The roof in my Az. room also has three (3) leaks in it, on the inside!
Both times he has been here, he automatically charges $480.00 which I paid and now he wants to come back & fix it again, since I filed my complaint with the BBB! I certainly don't want him here again, and wish I could climb up there to see for myself, what it is that he said he did!
I have both invoices showing what I paid for, as well as a video I took on the 10th of this month, showing how the water was dripping from the ceiling into a bowl I sat under it. The photo was taken at 8:15 a.m.
He told the BBB that he tried contacting me several times (which he did) but I was told not to speak to him directly and only to the BBB. But it seems he's spoken with them and said the problem was solved! And it's NOT!
Therefore, I am requesting your help, since the roofer refused to take a photo of his work when I asked him to!
Please help me with this matter!
I'm afraid I don't know how to submit my video, sorry.

Arizona Registrar of Contractors (AZROC) The yard guy, brandon nygaard

Frustratingly poor communicator, repeatedly no shows for appointments, undependable and fails to keep his word. May 20: We hired him to fix front irrigation system & paid $300 on $600 estimate. He disappeared. June 8th: Did the work, said everything in good working order & accepted balance owed PLUS an additional $120. June 9: Front irrigation system not working at all. June 18: Last ten days has dodged every effort to finish work he started. We are assuming he has abandoned the job and left us out $720. We are having to start over again, will continue to hand water and begin the Small Claims Court process.

I have an estimate in writing but unable to get your system to accept it.

Review terms is interesting. He "disappeared" but showed up on June8? I think you mean he refuses to warranty the work he completed as you paid the balance so the work was completed at that time. I assume before you paid him the balance you inspected the job done so if it was not finished then you should not have paid him. You act like its the fault of the landscaper you didnt bother to read the poor reviews after you hired him. Responsibility goes along way. Claiming a person ever could be put out of business over a single job where you bear some responsibility for the problem is crazy and lends to the lack of credibility on your own part.

Arizona Registrar of Contractors (AZROC) ROC consumer protection failure

We have attempted on two issues to seek support from the Arizona Registrar of Contractors to address material and financial issues related to 2 separate licensed contractors. The first was a complete waste of time. The ROC inspector arrived with our contractor, both with matching Starbucks in their hands. The ROC representative had a history in some manner and we believe the resolution of the issue was compromised by their relationship. I only bring this issue up because it displays consistency in the lack of support for the homeowner in the ROC process.

The most recent attempt was a complete disregard for the scope of work on our project and the investigators biased position on what is acceptable quality of workmanship. The issues that were addressed in the ROC complaint were ignored and left unresolved but somehow the ROC closed the case without resolution to any of the issues.

We would like to reopen the issues that were not addressed and the issues that were not repaired. It was obvious that the ROC inspector wanted the case closed rather than resolved. As an alternative to repairs, we would gladly sell our home as is to the ROC And maybe when you own the home you will be able to see the discolored grout, missing paint, unfinished plumbing and finally as an owner you will understand how poor the quality of work is.

We sent in a written complaint in follow up but did not receive a reply from the ROC.

Arizona Registrar of Contractors (AZROC) Complaint filed, no reply

I filed a complaint about a bad contractor that charged me for doing a job and didn't do the job right, I filed a complaint and received a letter saying the contractor had to reply which he didn't and it's OK, so If you are going to file a complaint don't get your hopes up that something will be done. I really think they are there to protect the contractor not the consumer.

Arizona Registrar of Contractors (AZROC) Breach of Duty and Misconduct

The Arizona Registrar of Contractors (ROC) is failing the Public with poor performances of: excessive delays, closing wrong complaints, poor follow through, and slow in paying from the Recovery Fund (since is drained by the state lawmakers for the general fund). This was verified by an audit in 2013 by the Arizona Auditor. The ROC looks for ways to decline homeowners from any Recovery Fund monies in order to help fund the Arizona General Fund debt. I was wrongly turned down on by ROC on my Contractor Complaints. I have filed Complaints with Governor Jan Brewer and the Arizona Ombudsman, Dennis Wells.

I filed complaints with the ROC on January 17, 2014 about a bad and dangerous contractor, Robert Freund - Palmer's Plumbing dba Ben Franklin Plumbing (ROC Complaint No: #2014-250) and Palmer's Kitchen, Bath, & Beyond LLC (ROC Complaint No: 2014-251) for the bad workmanship of repairing an under slab kitchen water leak. The ROC Inspector, Stephen Lawton, said it was the worst contractor complaint the ROC had ever seen for house damages, fraud, and retaliation. I reported 65 issues of contractor problems and took over 70 pictures to document the building code violations, intentional sabotage of the crimping of the waterline, substandard work, and filthy mess left by contractor. The contractor threatened me with harm, demanded another $7, 000 cash after I had already paid $14, 000, and refused to return my house key and alarm fob after he was fired on August 08, 2013. A police report was filed. I experienced property damages of cut electrical lines to the sprinkler system, disabled motion detector night lighting, and slashed and nailed destroyed four car tires. The judge granted Injunctions against Harassment against the contractor, Rob Freund, and his employee, Derrick King.

The ROC inspector, Stephen Lawton, took nearly six months to decline me stating that I broke the law by refusing the contractor to attend the ROC inspection of my house and that I failed to allow the contractor the opportunity to repair the poor workmanship. Those were all lies because Mr. Lawton was the one that blocked the contractor from the ROC's inspection of my house. I had hired a guard to protect me in anticipation of the ROC's inspection. I have documents stating that I wanted to comply with the law and allow the contractor at the ROC inspection. Also, the contractor's building license was Suspended due to not having a Qualified Party (state approved building contractor). Robert Freund should not have bid my house repair job and he was not properly licensed during the clean-up. Mr. Lawton lied on state reports and committed a Breach of Duty and Misconduct.

The ROC failed to properly respond to Public Access laws and did not supply the state inspection documentation of the inspector's inspection and review of my complaint. This is a cover-up by the ROC of the incompetent lawbreaking inspector, Stephen Lawton.

On October 19, 2014 I filed a formal complaint against the ROC with the Arizona Ombudsman. I request a full investigation of the ROC's law breaking activities. I asked the Ombudsman to get the ROC to reopen my complaint, terminate and prosecute Stephen Lawton, and to obtain the justice I deserve.

This bad and dangerous contractor operates in a senior living area of Arizona and preys on the elderly with elder abuse and senior financial exploitation. The local home owner associations, PORA and SCHOA, no longer recommend Robert Freund's contractor companies because too many complaints and unresolved poor workmanship issues.

OUR BAD CONTRACTOR LAWSUIT IS OVER - 17 MONTHS OF HELL

We filed our Reply for the dismissal of the lawsuit today demanding costs and penalties. The contractor's attorney had written the court and said the plaintiff, Robert Freund, did not mind dismissing the $3, 800 lawsuit because it was a waste of the parties' and court's time and money. Frivolous lawsuits are like that!

We had 31 exhibits, 415 pages of evidence, and 22 witnesses while Palmer's Kitchen Bath and Beyond had 6 exhibits, 15 pages of forged evidence, and 6 witnesses. The Plaintiff and his attorney did not show-up at the Pretrial Conference. The lawyer wrote the judge and said his watch had stopped in order to avoid sanctions (fines). I spoke to the judge today and he said that excuse would not work.

We spent over 200 man hours and thousands of dollars fighting this bad contractor's baseless lawsuit. This is Robert Freund's method of doing business by making it so expensive in legal fees that it is cheaper to pay the disputed bill.

NOTE: We received word that the Arizona Attorney General has opened an investigation into the problem that Robert Freund did not obtain required Building Permits. Robert Freund's companies are Palmers Plumbing Services and Palmers Kitchen Bath & Beyond. This has defrauded 100s of homeowners and Maricopa County of tens of thousands of dollars in building permit income. This is grounds for the revocation of Robert Freund's contractor license according to ARS 32-1154.

The seniors will become angry once it is known that homeowner is responsible for obtaining and paying for building permits that the contractor failed to obtain. This could cost several hundreds of dollars otherwise the house cannot be sold or the improvement might have to be removed. Building Permits are very important!

The Arizona Registrar of Contractors (ROC) is doing nothing to protect the public from this bad contractor. Arizonan's have another failed agency of consumer protection...the ROC.

Arizona Registrar of Contractors (AZROC) lack of response to the complaint

Filed a ROC complaint, # [protected] Against Chatters Construction for inferior/defective painting, carpentery breach of contract, I was assigned an investigator from Show-Low, When he did come to my cabin, he never introduced himself to me as who he was or even his name, just started right in stating what the ground rules would be and if they weren't followed he would just leave and come back another time. The only thing he addressed were paint spots all over my lower porch concrete floor and table, which he tried his best to say these were paint drops from the ceiling above that had occurred when it was painted. (not true, this was over spray from a spray gun whose packings had gone bad) He made no comment on the fact that the contractor had painted the one side of my cabin the wrong color had done no prep and the paint was failing off the log siding and had not completely painted the whole side of the cabin as per contract. The inspector then went onto my up-stairs porch and completely ignored the fact that I now had 2 totally different types of railings on the porch, that what this contractor had installed as "new" was only 3 months old and was now splitting in half, was completely "misshapen" and matched nothing that was there previously ! The inspector went through great lengths to say that this is typical of wood at these elevations and weather and that indeed it matched what I had up there, which it did not, photo's to prove just that. I sent him several e-mails pointing out facts that he was quite wrong in several areas of the inspection, it should be noted that in the total 4 plus months that this whole thing went on, including a 2nd. inspection this so called inspector, Tom Sandoval never once acknowledged a single e-mail that I sent him in regards to his flawed inspection, nor did the Director of the ROC Mr. Mundell, fact of the matter when I did place a personal phone call to his office in an attempt to speak to him, his personal sectary answered the phone and when I asked her whom was I speaking to, she replied, "I'm not going to give you my name" ok, that pretty much summed it up for me at that point. be advised, that if you have a complaint with a contractor, don't waste your time contacting the state ROC, cause they won't do squat for you ! Period, there too busy covering their ### to keep their jobs to worry about you or enforcing state codes, which I came to find out this moran Sandoval was making them up to fit his orders to the contractor ! This can also be proven as well, this is not just talk, I can back up every word I've printed here !

On or about July 17, 2013 I filed a complaint with the ROC in regards to poor construction on my summer cabin located in Heber AZ. The complaint ended up in the hands of a local ROC branch office investigator, located in the town of Show-Low, AZ. by the name of Tom Sandoval, and employee of the ROC for 13 years as I've been told. A complaint was then filed, # [protected] which as far as I know has not been closed to my knowledge. My complaint centered around the actions of a general contractor, a Mr. Milt Chatters, of "Chatters Construction". He had done work for us in the past, and this was his 3rd. contract with us. His work turned out to be a complete disaster. Since that time, I have filed numerous complaints to the ROC and to the contractor asking for a response to my complaints. In short, my complaints were never to this day properly addressed but were for the most part, just plain ignored. Also nor were any of the employees of the ROC of any use or help in my complaint. These people will and still do ignore any and all requests you make as far as your complaint is concerned, there is no response from any of these employees that work for the ROC, they are all hiding for some reason. From the Director, Mr. William Mundell, utterly useless I might add, to the lower level employees, such as the investigator in this case, this State Agency is a complete waste and is a joke in as far as what a "State Agency" is suppose to do for the citizens of that state and to serve them not them selves, as is what it would appear to be the case here. I can back up any and ALL comments I have made here today and welcome anyone who wishes to see the photos and the complaint itself as well as the "Corrective Work Order" from the ROC, another joke in it's self.
