We purchase the Makalita Maxi Dress - Blush - XS after checking the measurements on the website and paid for express shipping for my daughters ball. The day the dress arrived my daughter tried it on and it didn’t fit. The ‘hips’ of the dress did not fit on her hips, but higher up her torso. The extra fabric hung loose above her hips and looked wrong. The dress is not fit for purpose because it cannot be worn due to the construction of the garment and how the ‘hips’ have been sewn.
We immediately packaged it back up and returned it by DHL courier back to Australia.
Baby boo has said they will not refund us even though this is their smallest dress and there are no other options for size. They have said they do not give refunds (which according to the NSW consumer act is unlawful)
They have offered a credit which we do not want (due to their garment construction we are conscious that no other item will fit) the NSW consumers act says that a credit can only be offered if that was the form of payment we used to by the item or if we have agreed to one which we haven’t.
Baby boo has a section on their website that says ‘refunds /processing times’. It says that “Refunds will be issued to the same method of payment used to create the order” however when I brought this up with them Gabriella said that their policy is that they do not give refunds. This is misleading and needs to be changed.
Desired outcome: We would like a full refund. Our order number is 733002
