I signed up. Then I became ill and could not go. I turned in my keyfob and have not been to DL Anytime Fitness. I had asked to be allowed to stop, and was told I would have to stay a member for 6 more months. Then, additional fees were removed from my checking account, without any notice - that is YOUR contract. I stated since you breached the contract, it was now null and void.
I sent all the information to my bank, who because it was under contract, had to send it to FCA or something like that. It was agreed that Anytime Fitness breached the contract and my money was refunded from the time the additional fees were removed from my account.
I was constantly called and told the person to stop calling me, to put it in writing to my home address. I was called several more times. At that time, you breached the laws in place to protect me. Again, another reason I was able to cancel my contract.
Now, you have sent me to collections. I told them to send it in writing. They tried to say they sent something to my email. Nope, I want it sent to my home address.
I am giving you the opportunity to end this now. I will pursue this legally as well if that is the route you are choosing.
I always give others and corporations a chance to settle this without legal recourse. When they think they have the upper hand and dismiss me, I have always won.
thank you for your time. Please let me know the course you are choosing
Desired outcome: I really do not want to sue, but if you want to pursue the minimal dollars that are left, that is up to you.
