I was promoted firstly in 2012 and not paid salary, and in 2018 promoted again on the same position and same work with different salary compared to appointment letter and ignored my grievances and union engagement until they decided to list me at retrenchment by not consulting me and not agreed with union with the criteria to be used. I was the one told I am sitting without work and I will suffer the consequences of reporting violation of covid19 regulation and safety at workplace. They declined my resignation for constructive by asking me to come to work to solve the problem thereafter they haven't and locked me out of the company premises in 2021 until now I couldn't claim my UIF as their punishment, my case is going up until Labour court and changed by commissioner to unfair dismissal but Nbcci claimed that I reffered case later after dismissal with 532 days past of which is not true. I worked 109 years couldn't receive my UIF due to that. Can I claim or what because its a constructive and unfair dismissal cases? Assist me please.
Desired outcome: I would like to be paid and re-instated according to my agreement on appointment letter dated.
