Complaint Description:
Unlawful deceptive sales tactics .and misrepresentation, omission of facts, exaggerations of timeshare use of product anytime etc.. We entered into a timeshare agreement with Starpoint Resorts on 11/05/2017. On that day we were given a glowing presentation by a salesman named Phil he enticed us with a grand picture of what our timeshare ownership with Sapphire/Starpoint Resorts would be if we signed a contract. We were given tickets and dinner at a discount not even free as they had promised. we were told that the time share would be available to our children for their use anytime, and were told this would be the most flexible way for us to vacation inasmuch as we could travel anywhere at any time under our membership. Most importantly, we were led to believe this was a valuable investment. We were assured any time we were not the least bit happy with our ownership, we could sell it back to Starpoint. We found out pretty quickly this timeshare ownership is far from the extremely flexible vacationing that we were promised. Nothing is EVER available when we are free and able to travel. we have tried to use it, only to be told there is no availability. Nor been able to use one time since we bought. we have not been able to use our timeshare not one single time.because of lack of availability at our chosen times. To date, or we would need to pay more money. We have been trying to get a response to our concerns from Starpoint over the course of the last few months. We have called, sent emails and letters to this company, and our legitimate concerns still have NEVER been addressed. Not only are we told that we are unable to sell it back to the company as promised but, our complaints have been completely ignored or responded to with a message that we are in breach of our contract. also the finance company has been illegally Overcharging our account with excessive interest fees and late charges well over the agreed interest rate. for example my payment is $123.54. on 8/14/2018. I made a payment of $155. They applied $1.81 toward my principal and $121.19 toward the interest rate which is 21.14% $7 on impound fee.and $25. late fee. they can never give you a formula to explain why. 3 years of payments and this is a never ending pattern of over charges and fees. which would never be paid off. We were misled into this contract with Sapphire/Starpoint we were told our session would only be 90 minutes we held there almost 6 hours. all terms of contract were never explained to us. we weren't told we had 3 days to cancel . we weren't told or explained to that we would have to go a arbitration instead of lawsuit. if we had a dispute with this nightmare of a company. we didn't get any paper work until 3 weeks later . they pressured and rushed us threw this entire process with lies and misrepresentation and deceptive practices by not explaining 3 day cancellation rights or giving us our paper work to read after leaving jockey club hotel. they also told us we were owners and partners that had legal rights to use the cosmopolitan hotel and that we could book their and stay anytime . and now our stated concerns have been ignored by everyone at this company. We demand to have not only our contract with Sapphire/ Starpoint Resorts not only be rescinded but, to be refunded. the money we have regrettably invested in this scam. if their is a class action lawsuit please sign us up. we are in process of getting attorney.

Your story sounds almost identical to what happened to me and my girlfriend, has there been a solution to your timeshare termination or are you still stuck on this scam business taking all kinds of costumers hard earned money. I would love to hear your status as I signed up by in September 11th of 2021

My name is maria bonadio and my husband james and I have the same story and all these stories are just like mine! unfortunately I signed up 2018 and have been paying for this scam since then and want to terminate my contract asap and it would be great to get reimbursed 😕 for the money invested since for one thing i've never even been able to get to schedule anything to use my timeshare! twice within [protected] i've lost 2 homes... you know that money could've went a long way... was sick for 8 months needing emergency surgery, well guess what, that money could've went a long way too!

Hi My name is Takeiya Dell and My husband and I have the same story. Nothing is never available when they said we would have access to all these luxury resorts and hotels, which are never available. When we signed up in 2020 we were promised an all expense paid trip to Hawaii. And never able to book it. I have been paying them and its like the payments will never end. As I told them why am I paying you and I can never book anything. I always have to book through Booking.com or Priceline. So why should I still be paying you all. Then its a maintenance fee that is over $500 that we have to pay every January or February.why do I need to pay a maintenance fee and I never use any of the properties. I am beyond over the scams. Please sign us up for the class action suit.

Fay Barlowe I was also scammed to make a long story short there isn’t any availability when I want to use it and I would call weeks to months ahead. Then to be told the price is significantly higher to the point where I don’t bother to use it. It’s better to get an Air B&B. Embarrassing to say I have time share and then have to look for a reasonable hotel

This is the EXACT thing that happened to us. We were excited about the free trip to Hawaii (which never happened) and a trip to Mexico (we won on the day - another scam) and purchased. Spending over $10K which we paid off quickly because the interest was so high. We have never been able to book anything and we are still paying for maintenance every year. I cannot afford to pay for something I can't use. Times are so tough now. I need every penny.

Would love to be included as well. My wife and I on our honeymoon was also deceived by the "wonderful opportunity" that Sapphire Resorts had to offer. Lost about $600 total, and then never saw or heard from them since, and this was close to Halloween. If this moves forward, I'd love to be involved as well please.

We are in the exact same situation. We have had this for over 5 years and have never once been able to use it. They send us to their partner and the cost is extremely costly. I have called emailed and asked multiple time about how much lead time do they need for me to get a reservation and no one can answer. I have scheduled use of the time share up to a year in advance and have still never been able to use it.

I am all in for a class action if there is one.

I would like to be involved in the lawsuit as well. We bought ours this past fall. We were highly pressured and pretty much belittled into buying - I told them we were not in the financial position to be making big purchases with me being unemployed and staying home with my kids. Their sales tactic was stating how much of a better life my kids would have being able to travel. I told them no several more times but they would not budge. We eventually just signed so we could leave- the salesman told us our annual dues and when they were due. I said fine. They ended up charging us, then I noticed a month-2 later, I was charged the same annual dues again. I called them wanting an explanation and the person on the phone said the first annual fees that I was charged was for 2021. Would have been nice to know upfront…. We didn’t even get to use it in 2021. If so, no proration? Ended up paying two annual fees in a 2 month period. 800-900 dollars is a lot of money for a family with one income. By the time I went back to review the contract for cancellation, it was already past the cancellation period. I felt if we just tried to book a vacation, we might actually enjoy having this. We also haven’t received one billing statement since the 1st and we never received any of the paperwork for the “ free “ vacations that they promised.

I got suckered too on my birthday trip to Vegas Sept 2021. I went to the Jockey club and got suckered for over 6 hours. I was promised a trip to Hawaii which after repeated calls to Starpoint, I finally receive a little coupon to go but was told that I must book travel out of Atlanta where I live to Vegas and catch the flight from there. Now it says I have to pay 185 per person for some fees, and report fees and booking fees. Well that's the total a trip to Hawaii to get there will cost me. I am so disappointed in myself for allowing this to happen, but when you are in Vegas feeling good and enjoying your birthday and you have someone make you feel so special like they did, it's like shame on me. I have not been able to book a single trip since. They charged me 625.00 for 2020 maintenance fees 3 days after I signed up then again in January they charged me 721.00 for 2022 fees. I was livid. Now I'm trying to book for Spring break, nothing available, but how is that when they tell you owners will always have a place to stay? I need help please someone help me get out of this situation.

We also have never used it, since purchasing it in spring of 2018. Never used it because there’s nothing available. We haven’t been able o take advantage of the 3 vacations, to Hawaii, to Big Bear, and to Vegas again. They gave us these 3 vacation packages for free as part of signing up, but are not accommodating at booking when we call. Please include us if there’s a class action!

Your story sounds almost identical to my story. We purchased our timeshare in Las Vegas November 2016. 1.)We were promised that any transactions with the company would be easy. Absolutely not true. Any time, we've reached out to use the program there was no availability. One time I was told there was a year and half long waiting list to stay at one of the resorts. 2.) We were promised discounts on airline tickets. Not true. In fact, when I checked on the availability of a flight through their services, it charged 30% MORE than buying from the airline directly. 3.)We were promised 2 different cruise tickets for my family. If I had used their program, it would have cost me more than 3 times the cost of just booking the cruise via the standard means of booking a cruise. 4.)They promised us money to use on slot machines while at a participating casino. Well, it was monopoly money that rendered no cash. 5.) They provided tickets to a local show. We still had to pay processing fees to get into the venue that held the event. The processing fee was more than the actual tickets to enter the venue. At least we did enjoy the performance. 6.)We have attempted to use the program many times only to learn that we apparently purchased a low end contract according to the customer service rep. I have filed many complaints with Starpoint with no resolution. I filed complaints through management and was ignored most times. I even went as far as filing a complaint with the BBB and got NOTHING. Last year, I decided I would pay off my loan but refused to pay another dime in maintenance dues for a product that I could never use. I paid off my loan in full with Starpoint hoping to finally be done with them. I am now getting threatening calls regarding the maintenance dues. Yesterday, a rep threatened to report bad marks against my credit report. Isn't it enough that Starpoint received over $11,000 in mortgage payments from me in exchange for NOTHING? How is it legal to obligate a client for life but bear no responsibility to hold up their end of the contract.

Have paid mortgage off, but now their sliding, we owe membership fees, etc... Going to put lien on it. Put a lien on what? Never utilized resort, no availability, just a scam. Absolutely, if there is a class action we want in. We should have known when we went to the Jockey Club and it was a dive. I went to the pool to get some sun and it is one of the shortest hotels in the area so there was NO sun that even gets to the pool. Had to walk to the cosmopolitan to use their pool. What. a hassle. But great pool. In fact if the Jockey would have looked even a 1/4 as good as the Cosmo, I'd have felt better. We (got screwed) bought into the lies in 2019 and used it the one time at the Jokey, I mean Jockey, but it was a joke! Then COVID hits in 2020 and we are unable to make any payments or travel. We asked if we could sell it but they refused to listen. And now it's a collection on my credit. I'm so PO'd that we fell for it. So yes, sign me up for a class action, NOW.

Sounds all too familiar. My husband and I were picked from the street in Las Vegas and bought ours in 2016. Whenever we tried to book something, it wasn’t available. We paid cash and have been paying the dues for six years on something we never used. I hope an attorney reads these posts and helps with a class action lawsuit against them. Kimsnet520@yahoo.com
