Unlawful deceptive sales tactics .and misrepresentation, omission of facts, exaggerations of timeshare use of product anytime etc.. We entered into a timeshare agreement with Starpoint Resorts on 11/05/2017. On that day we were given a glowing presentation by a salesman named Phil he enticed us with a grand picture of what our timeshare ownership with Sapphire/Starpoint Resorts would be if we signed a contract. We were given tickets and dinner at a discount not even free as they had promised. we were told that the time share would be available to our children for their use anytime, and were told this would be the most flexible way for us to vacation inasmuch as we could travel anywhere at any time under our membership. Most importantly, we were led to believe this was a valuable investment. We were assured any time we were not the least bit happy with our ownership, we could sell it back to Starpoint. We found out pretty quickly this timeshare ownership is far from the extremely flexible vacationing that we were promised. Nothing is EVER available when we are free and able to travel. we have tried to use it, only to be told there is no availability. Nor been able to use one time since we bought. we have not been able to use our timeshare not one single time.because of lack of availability at our chosen times. To date, or we would need to pay more money. We have been trying to get a response to our concerns from Starpoint over the course of the last few months. We have called, sent emails and letters to this company, and our legitimate concerns still have NEVER been addressed. Not only are we told that we are unable to sell it back to the company as promised but, our complaints have been completely ignored or responded to with a message that we are in breach of our contract. also the finance company has been illegally Overcharging our account with excessive interest fees and late charges well over the agreed interest rate. for example my payment is $123.54. on 8/14/2018. I made a payment of $155. They applied $1.81 toward my principal and $121.19 toward the interest rate which is 21.14% $7 on impound fee.and $25. late fee. they can never give you a formula to explain why. 3 years of payments and this is a never ending pattern of over charges and fees. which would never be paid off. We were misled into this contract with Sapphire/Starpoint we were told our session would only be 90 minutes we held there almost 6 hours. all terms of contract were never explained to us. we weren't told we had 3 days to cancel . we weren't told or explained to that we would have to go a arbitration instead of lawsuit. if we had a dispute with this nightmare of a company. we didn't get any paper work until 3 weeks later . they pressured and rushed us threw this entire process with lies and misrepresentation and deceptive practices by not explaining 3 day cancellation rights or giving us our paper work to read after leaving jockey club hotel. they also told us we were owners and partners that had legal rights to use the cosmopolitan hotel and that we could book their and stay anytime . and now our stated concerns have been ignored by everyone at this company. We demand to have not only our contract with Sapphire/ Starpoint Resorts not only be rescinded but, to be refunded. the money we have regrettably invested in this scam. if their is a class action lawsuit please sign us up. we are in process of getting attorney.
How has anyone had success in getting your money back? We paid our entire principal in cash when we bought, and we have our yearly maintenance fees we pay now.

I would like to be included in this lawsuit as well. My wife and I were conned into buying this back in 2020. We haven't been able to use it, and they charge the annual management fees and Grey Card fees. No one has been helpful in assisting us to book anything, and it is never useful for the places where I travel for work.

Nothing is available and you only getting 5,000 point each year and you can only carry over one year. But you can not find anything for 5,000 or 10,000 points.

No matter when you call no one answers your phone call. It go straight to voicemail and said they will get back to you but they don't. And there's never any openings to book your stay. And you're correct none of your payments go to the principal it all goes to the interest. So you'll never pay it off.
I also want to be included on the Lawsuit. They lied about how the program works and there is no availability. Their resolution was to pay more for a better package than to resolve the lies told to me.

Same story but I didn't do the full purchase. I kept telling no. Their sales team is very aggressive. They sold me a 3 year trail package which I opt to make payments and not financed. Never received free trip. Was told there was no maintenance fees with this resort during presentation. I paid my 3 years in full and now I'm receiving collections for maintenance fees. I want a refund and to be added to the class action lawsuit.

I felt like it was the only way I could leave. Every time I said no, they would send another person. Very aggressive sales team who will lie to get a sale. I want my money back. Can never use it or get anyone on the phone.

We were basically forced by aggressive fast talking people from sapphire/star point agents and they made me and my boyfriend sign up not telling us all the details we didn’t find out that we would have to pay them for eternity until after they locked us in. They told us so many lies and told us we would get a free trip to Hawaii if we signed up and once we signed up they told us that we couldn’t get the free trip until months later. Once we got the certificate saying we could go, the certificate stated that we would need to pay nearly $500 in order to go. But when we were listening to their presentation they lied to us and told us that the trip was FREE and we had to pay NOTHING. This was a scam & they are taking money out of our accounts saying that we have to pay for a real estate loan that we never knew anything about. No one informed us about these tricks that they were going to pull later and they did not tell us that we had to pay nearly $800 a year even after we paid what they asked us to pay. I don't know it's just including my name and email will get me on any lawsuit for starpoint resort but my email is kellybuzby1@gmail.com. my story sounds a lot like everybody else's. The free trip to Hawaii isn't free, trying to use your points is impossible unless you want to go somewhere unknown in the fall when everybody has to go back to work if you're a teacher. I have screenshots of every single place that we told the star point resort representative we wanted to go that we would use their product for. When they typed in their phone to show us resort openings there was deals to be had in every city. The first time we tried to use the REI company there were no hotels available within 50 miles of Chicago. After that I tried to look for resource for that summer in resource for that summer in resorts for that summer in San Diego and I have screenshots of every single resort full until September.
The scam part is they tell you that you can't use your points or any of your benefits for 60 days after you buy your contract. Then when you find out you can't actually stay anywhere at the times when you want it's too late to cancel.
they got us too ... now every month i'm charged $177 for a loan plus every november or december, right when christmas comes around, i get hit with the maintenance fees. We were told that they were going to give us the first 3 years of vacations (3000 points) immediately only to be told later that 1. the 3000 points might cover one vacation (not the 3 they originally told us) and that we missed the 6 month window to use them so we lost them. They failed to mention that this would also happen. Honestly, at this point, while a refund would be amazing, i'd be willing to just cut ties with them and walk away with a loss and a valuable lesson learned.
