Unlawful deceptive sales tactics .and misrepresentation, omission of facts, exaggerations of timeshare use of product anytime etc.. We entered into a timeshare agreement with Starpoint Resorts on 11/05/2017. On that day we were given a glowing presentation by a salesman named Phil he enticed us with a grand picture of what our timeshare ownership with Sapphire/Starpoint Resorts would be if we signed a contract. We were given tickets and dinner at a discount not even free as they had promised. we were told that the time share would be available to our children for their use anytime, and were told this would be the most flexible way for us to vacation inasmuch as we could travel anywhere at any time under our membership. Most importantly, we were led to believe this was a valuable investment. We were assured any time we were not the least bit happy with our ownership, we could sell it back to Starpoint. We found out pretty quickly this timeshare ownership is far from the extremely flexible vacationing that we were promised. Nothing is EVER available when we are free and able to travel. we have tried to use it, only to be told there is no availability. Nor been able to use one time since we bought. we have not been able to use our timeshare not one single time.because of lack of availability at our chosen times. To date, or we would need to pay more money. We have been trying to get a response to our concerns from Starpoint over the course of the last few months. We have called, sent emails and letters to this company, and our legitimate concerns still have NEVER been addressed. Not only are we told that we are unable to sell it back to the company as promised but, our complaints have been completely ignored or responded to with a message that we are in breach of our contract. also the finance company has been illegally Overcharging our account with excessive interest fees and late charges well over the agreed interest rate. for example my payment is $123.54. on 8/14/2018. I made a payment of $155. They applied $1.81 toward my principal and $121.19 toward the interest rate which is 21.14% $7 on impound fee.and $25. late fee. they can never give you a formula to explain why. 3 years of payments and this is a never ending pattern of over charges and fees. which would never be paid off. We were misled into this contract with Sapphire/Starpoint we were told our session would only be 90 minutes we held there almost 6 hours. all terms of contract were never explained to us. we weren't told we had 3 days to cancel . we weren't told or explained to that we would have to go a arbitration instead of lawsuit. if we had a dispute with this nightmare of a company. we didn't get any paper work until 3 weeks later . they pressured and rushed us threw this entire process with lies and misrepresentation and deceptive practices by not explaining 3 day cancellation rights or giving us our paper work to read after leaving jockey club hotel. they also told us we were owners and partners that had legal rights to use the cosmopolitan hotel and that we could book their and stay anytime . and now our stated concerns have been ignored by everyone at this company. We demand to have not only our contract with Sapphire/ Starpoint Resorts not only be rescinded but, to be refunded. the money we have regrettably invested in this scam. if their is a class action lawsuit please sign us up. we are in process of getting attorney.

The same has happened here. I was told that I had to take 6 trips before this year was out and I just signed the contract in July. I cannot find anything in Texas, I can't book anything, higher prices and when I tried to call the number on the statement today, it's not in service. And the link does not exist. My husband and I have the same story. We joined the Jockey Club because we wanted something on the Strip and everytime we tried to book a reservation they told us they were full and offered us one of their other places off the Strip. The only way we could get into the Jockey Club was to go through RCI and pay an extra fee. We paid off our mortgage hoping that we could return the timeshare and walk away without paying anymore fees, but we were told that isn't possible. If we don't pay the fees they will ruin our credit score and send collection after us. Only way to get out is to declare bankruptcy and show that you have no assets in which to pay them. For lack of sounding like a parrot, same story here. Bought in 2010, have been able to use twice and had to make concessions to do so.
They promised me 2 sets of tickets to Hawaii, got vouchers, would’ve cost me more money and had specific dates I had to travel, went unused. They also told us all interest paid on loan was tax deductible as it was technically a real estate investment, also a lie.
All lies, every time you look or call, nothing available, people on phone are rude and act like they started five minutes ago. Their explanations for every question are bogus and completely contradict what we were told, and what’s in our paperwork.
Paid off the loan, don’t even care to get anything back at this point. We just want out and rid of them.
They sell out spots to other booking companies and websites, then owners, if you even want to call us that, get nothing.
Biggest scam ever. If you’re thinking about buying into this company, go dump your thousands of dollars on lottery tickets, you’ll have a better chance of getting something out of it.

We purchased back in August 2022 too. We we're never told of annual fees, and that it is automatically transferred to our successor if we pass. We had to pay annual fee for this year and will be charged again coming December for next yrs fee. and we only have a few months to plan a vacation for this year so we can use our points but it is impossible as nothing is available on dates that we want unless you pay extra 😒. We just got ours. It's been 6 days. I sent the paper to cancel yesterday.
I booked with Best Vacations Ever who they are affiliated with for 199 for a room at the Strat. After my flight was booked they told me it was Spring Break and I had to pay 600 extr dollars for the Strat. The room looked like a drug trap house. They tried to get more money for an upgrade. I was so mad. And. I still had to go to the Timeshsre presentation. They lied to my husband and I about a free trip to Hawaii will free airfare. After we got home and read the small print it said we would have to catch the flight from Vegas only on a Monday or Tuesday for 3 nights. However, the free flights may have stops and layovers. But you can pay for an upgraded flight, hotel, etc. There were 380 in charges, more for deposits. Get this: You only get 4 days in Hawaii but the flights leave at their discretion between 3 pm and 10 pm. That's one day gone. The flight returns at 6 am on the last day. Ha Ha! 2 days gone. Now you have 2 days in Hawaii. What a joke! Get this: the guy who had us signing papers had us click a few of the things to sign. Same with us BUT we have a solution. We are not giving them authority to withdraw monies from our checking account . What can they do? Sue us? Good luck as we are both retired and living on a fixed income.since they are not a federal entity, they can't do anything .

Please let my me and my wife know how we can get in on a class action suit. We are retired and got duped. This company is a total fraud and have taken thousand of dollars from us and continue to do so. On top of that our kids will continue to pay because of the contract they fooled us into signing.

Please include my husband and myself in this lawsuit. We purchased in Sept. 2022 and cancelled within 5 business days. We didn't heaar anything from Sappire or Starpoint and assumed once they got our certified letter that it was cancelled. In November that took $738.68 and in Dec. they charged $477.04 and $69.00 to my checking account, as well as $134.06 in Nov. and Dec. from my checking account. When I
questioned what this was for I was told it was a one time fee and my yearly maintaince fee along with my monthly payment.
I was also told that the contract had to be cancelled in 5 calendar days not business days. I tried to look at booking a number of different locations without success. I am unable to even log into Sapphire because nowhere in the 40 pages does it give me a member number and you can't log in without it.
We felt pressured into signing this contract after a 4 hour presentation by numerous sales associates. The sales people kept repeating that this is not a timeshare. The contract is given to you in an envelope as you are leaving. It wasn't until I got back to our room and read the contract that I found out it was a timeshare (by their own termenology in the contract).
For these reasons as well as more of the misleadfing sales pitches, we want to be included in this lawsuit.

I agree we were done the same and I read they are supposed to give you the contract packet and go over it and tell you you have 5 days to cancel. They never did and we were also given the contract packet after we signed. That it self is against the law.

My parents signed up for this timeshare. They keep sending my parents letters that they need to make a payment. I told them straight off, your being scammed. I know scammers and if they keep doing this. You pay over and over again. Its same thing with online scammers. They are not listening to me at all.

Check this out...my Wife and I were drinking...[censored] we were on vacation having a good time!
Our 2 scammers knew we were drinking and told us NOT to tell the lady who makes you sign 5000 things.
We were told not to tell her because it is illegal for them to have people sign something while drinking because it is a real estate transaction.
